BACKGROUND INFORMATION: At the regular Elk Grove City Council Meeting held on October 8, 2014, the City Council conducted a review of the performance of Jason Lindgren, City Clerk, during a duly noticed Closed Session. As a result of that review, the City Council directed staff to bring back the City Clerk’s Employment Agreement for the City Council’s consideration of an amendment to provide for a five percent salary increase, which is broken down as a two percent salary increase for meritorious performance, as well as a three percent CPI increase based on the Consumer Price Index - All Urban Consumers for the San Francisco-Oakland-San Jose, California region, as published by the U.S. Department of Labor, Bureau of Labor Statistics. The City’s employee salary schedule includes five percent step increments. City employees who achieve satisfactory performance, who are not already paid at the top step of the salary range, are awarded a step increase on 1

Therefore, a five percent increase is consistent with how other City employees are compensated. Pursuant to the City’s Personnel Rules and Regulations, the salary increase would be effective as of the first day of the pay period following the City Clerk’s hire anniversary date. The City Clerk’s anniversary date is October 14. Mr. Lindgren’s employment agreement states in part:

SECTION 3. SALARY

B. Employee may receive annual compensation cost of living increases at a rate not less than the Consumer Price Index - All Urban Consumers for the San Francisco-Oakland-San Jose, California region as published by the U.S. Department of Labor, Bureau of Labor Statistics, based on the amount of the City Clerk's salary as may be adjusted from time to time. The City Clerk's salary shall not be adjusted downward as a result of a decrease in the above-referenced Consumer Price Index.

C. Subject to the limitations and qualifications set forth in subsection 3.B. above, the City Council, in its sole discretion, may grant salary increases to Employee.

FISCAL IMPACT: With this amendment, the City Clerk’s annual salary will increase from $110,087 to $115,592. Pursuant to a prior contract amendment with the City Clerk, which will remain in place, the City Clerk would continue to pay 100% of the cost of the Employee’s share of the PERS contributions, consistent with other City employees. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELK GROVE AUTHORIZING THE MAYOR TO EXECUTE AMENDMENT NUMBER 4 TO THE

EMPLOYMENT AGREEMENT WITH JASON LINDGREN FOR THE POSITION OF CITY CLERK

WHEREAS, on October 13, 2010, the City Council of the City of Elk Grove adopted Resolution No. 2010-204, appointing Jason Lindgren as the City Clerk and authorizing the Mayor to execute an Employment Agreement with Mr. Lindgren; and WHEREAS, on or about July 11, 2012, the City and Mr. Lindgren executed an Amendment Number 1 to the Employment Agreement to address certain PERS issues; and WHEREAS, the Employment Agreement with Mr. Lindgren states that the City Council shall conduct evaluations of Mr. Lindgren’s performance for the purposes of determining whether to grant a salary increase; and WHEREAS, at the Elk Grove City Council Meeting on October 8, 2014, the City Council conducted an evaluation of Mr. Lindgren’s performance. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Elk Grove hereby authorizes the Mayor to execute Amendment No. 4 to the Employment Agreement with Jason Lindgren in substantially the form presented to the City Council with the accompanying staff report to provide for a 5% salary increase, and City staff is authorized to execute all documents and take all action reasonably necessary to implement Amendment Number 4 to the Employment Agreement once fully executed. BE IT FURTHER RESOLVED that the new salary set forth in Amendment Number 4 shall take effect as of October 19, 2014, which is the first day of the pay period following the City Clerk’s anniversary date.
