DISCUSSION

The LADOT Crossing Guard Program plays an important part in enhancing the safecrossing of elementary school children at intersections city-wide when school is insession. As of this date there are 388 crossing guards employed by the City. There arecurrently 307 schools and 492 locations on and around the schools where crossingguard services are deployed.

Crossing guards are covered by MOU 34 Crossing Guards, and represented by theCalifornia Teamsters Local 911. Their work schedules are based on the Los AngelesUnified School District (LAUSD) bell schedule",~ndassignments are staffed by priority:

Attrition over the past few years within the Crossing Guard program has resulted instaffing shortages that has caused approximately 140 corners to be uncovered on aweekly basis. Unfortunately, the Department has not been able to hire since 2009 dueto the economic crisis and the prioritization of services provided to residents as directedby City administrators. Due to the mature age of the Crossing Guard staff, the programstaffing level continues to decline. The attrition rate for crossing guards is approx. 1.1per month.

The program's safety record is the responsibility of the Risk Management Division.However, Human Resources (HR) currently tracks Workers' Compensation claims forall employees. All accident related paperwork is forwarded to HR and a copy ismaintained in the employee's folder. All classroom, field training and observationsrelated to child safety are provided by the Crossing Guard Program supervisors.

A review of the crossing guard traffic accident history revealed that over the past three(3) years there has been six (6) traffic accidents involving crossing guards (vehicle vs.pedestrian) averaging two 2 accidents a year. Each accident was non-preventableand the police report noted that the crossing guard was not at fault. The report notedin each incident the motorist failed to yield hitting the crossing guard, child or both.Note: LADOT Parking Enforcement Division has an established Accident Review Boardthat reviews and responds to all parking enforcement personnel involved in a trafficaccident. In the past, crossing guard accidents were not reviewed by this board.However, at the recommendation of risk management, all future accidents involvingcrossing guards will be reviewed by the Parking Enforcement Division Accident ReviewBoard.

LADOT currently provides crossing guard services for 180,418 students at 307 schoolsthroughout the City of Los Angeles. Each day, the average crossing guard makes over20 safe escorts of children across busy intersections. With a typical school year of 36weeks, this invaluable service results in an estimated 1.4 million crossings of studentsby the Crossing Guard Program each year. Given this fact, it is remarkable that theprogram averages only two (2) pedestrian vs. vehicle incidents each year. Withoutmaintaining appropriate staffing and oversight of this vital program, the safety of ourchildren will continue to be at risk.

The screening process for hiring crossing guards is a joint effort between HR and theCrossing Guard Program managers. Recruitment is handled by the posting anddistribution of the Job Opportunity Notice. This process was centralized within HR onJune 01,2007. Interviews are conducted based on the responses from the JobOpportunity Notice. Applicants passing the interview are scheduled for a medicalevaluation and background check (fingerprints). Only applicants who clear medical andbackground are given a job offer.

The medical history and physical examination requirements for new and existingemployees, is a joint effort between Medical Services Division (MSD), Crossing GuardProgram and HR. Prior to offering a job to an applicant, he/she must pass theemployment medical, conducted by MSD. During the employee's career, if theCrossing Guard supervisors notice any concerns regarding the employee's ability toperform their job, a memo is prepared with supporting documentation and forwarded toHR for handling. HR reviews the memo to determine if a Work Fitness Evaluationshould be scheduled. If so, HR coordinates this with MSD.

Additionally, if an employee is off work due to a medical reason the employee isrequired to provide authorization from his/her treating physician releasing them to returnto work fu II duty.

The process that individuals must undergo before returning to duty after absences is ajoint effort between MSD, Crossing Guard Program and HR. The employee is requiredto provide his/her crossing guard supervisor (sergeant) a return authorization fromhis/her treating physician. If the supervisor questions the employee's ability to performtheir job, HR is contacted to schedule a return to duty medical. MSD would thenevaluate the employee based on the class specifications to determine if the employeecan return to work. For example, an employee returning to duty with a cane, brace orany assisting device that may restrict their mobility would be considered a reason torefer the employee to MSD.

The type and frequency of crossing guard training is the responsibility of the CrossingGuard Program managers. New employees receive at least one day of classroomtraining and up to two weeks offield training. The training consists of instruction anddemonstrations regarding the proper procedures and policies of the Crossing GuardProgram. This training includes but is not limited to; the proper crossing guard positionbetween the children and roadway, public interaction and cooperation, identification ofpotential hazards, and determining intersection priority. A crossing guard may receiveadditional training or instruction at the time of hire and during their course ofemployment due to observations made by a Crossing Guard supervisor.

Crossing Guards are subject to rules and regulations of LADOT. Crossing Guardsrepresent the City to those whom they come in contact with. Their attitude anddemeanor greatly influences how children and parents perceive the City and othermembers of the city work force. They are instructed to be diplomatic and tactful in all oftheir interactions with the public, children and adults. They should demonstrate pride inthe job they perform because it is vitally important to our community. Also, they shouldadhere to all policies and procedures, be fair and impartial to everyone, and alwaysremember that traffic safety is their responsibility. The fundamental mission is alwaysthe same, "to escort children safely across the street at the intersection to which you areassigned."

Lead Guards provide periodic training. Training is usually scheduled on a quarterlybasis or upon implementation of a new policy and/or procedure. Lead guards aretrained on how to observe crossing guards in the performance of their duties, todocument and report any safety concerns observed around the school such as potholes, malfunctioning signals, down signs, damaged curbs, sidewalks and crosswalks orany suspicious activity around the school.

A mandatory Annual Meeting is held after Summer Break each year. A memo isdistributed to all employees prior to the end of the school year with the dates, times andlocations. During the mandatory meeting refresher training on the policies andprocedures that govern crossing guard services are covered. All Crossing Guardpersonnel must attend one of the scheduled four meetings. Employees arecompensated 2 hours for their attendance. Crossing Guards that fail to attend will notbe allowed to work the upcoming school year until they have received instruction on thetopics covered during the mandatory meeting.

Determining the appropriate level of supervision is the responsibility of the CrossingGuard Program managers. The overall responsibility for the supervision of a CrossingGuard is a Sergeant. There are lead guards assigned to each geographic area,however, lead guards are not supervisors and can not discipline crossing guards. Theleads guards provide support to the Sergeants by conducting field checks(observations) of crossing guards during the morning and afternoon locations, provideadditional training as needed, and perform minor administrative crossing guard duties.

The Bi-Weekly Field Check Observation (Special Order No.2) was implemented onNovember 03, 2009. The observation of a Crossing Guard should be a minimum of 3 to5 minutes during the course of a Lead Guard's daily field location check. Observationsmust occur during actual crossing of children. The evaluation form is not to be given tothe crossing guard. It is used to document the Lead Guard's observation of theemployee on that date and for the Sergeant's follow-up and appropriate action. Note:due to staffing shortages and concern for the safety of children, Lead Crossing Guardsare often assigned to a school location daily and have been unable to perform fieldcheck observations on a regular basis as required.

The nature of employee performance evaluations is not applicable to the CrossingGuard program. Although crossing guards are "as needed" employees and exemptfrom employee performance evaluations, the crossing guard program does use theobservation forms to determine the employee's performance. If deficiencies areobserved, additional training is provided.

The Department's process for reporting and investigating accidents is a jointresponsibility between Risk Management Division and the Crossing Guard Program.

However, HR receives a copy of the Workers' Compensation documents. All accidentrelated paperwork is forwarded to HR and a copy is maintained in the employee'sfolder.

Crossing Guards are required to immediately report all work-related injuries to theirsupervisor. The supervisor's first responsibility is to determine whether immediatemedical care is required. The Form DWC1, Form 5020, employee's report of injury formand supervisor's investigation form are required. All documentation for work relatedinjuries are forwarded by the supervisor to workers' compensation, HR and riskmanagement staff.

How external and internal complaints are reported and resolved is the joint responsibilityof the Crossing Guard Program and HR. Complaints are received in various formats,such as; correspondence, telephone calls, or a citizen visit to their local ParkingEnforcement Office. If HR receives a complaint, the information is obtained andforwarded to the Crossing Guard Program for further investigation and resolution.Based on the nature of the complaint, findings and recommendation of the crossingguard command staff and HR, crossing guards are subject to discipline, which mayinclude discharge.

BACKGROUND

The attached council motion (C.F. 14-0033) by Councilmembers Mitchell Englander,Bob Blumenfield, Mike Bonin and Paul Krekorian was adopted on January 08,2014:

FISCAL IMPACT

Due to ongoing staffing shortages, there are approximately 140 qualified corners orintersections that go uncovered on a weekly basis. Because of the mature average agefor the crossing guard staff, attrition is greater and continues to result in a diminution ofavailable staff. Further, due to the Department's inability to hire additional crossingguards, current staffing needs and the desirable level oversight for the program are notbeing met. Lead guards are currently being deployed to provide crossing guard servicesat various locations to help ensure the safety of the children at priority locations.

The purposeof this Special Order is to establish the procedurepertaining to the Department's Crossing Guard Program, GuardRotation during a 'major school break (i.e. Winter, Spring &Summer Breaks).

As a result of an increased shortage in the Crossing Guard Program and theCity's inability to" hire, it has become necessary to remind all crossing guards ofthe reassignment policy.

In accordance with the Teamsters Union Local 911, Memorandum ofUnderstanding (MOU) for the City of Los Angeles Crossing Guards, Appendix Bin part states, management reserves the right to reassign Crossing Guards toany site or area for administrative, training purposes or to meet any need. .

As you are aware, high priority corners must be covered, The corners are definedas, (a) uncontrolled, (b) stop sign, (c) signals and (d) tunnels. Rotation ofassignments will be utilized and crossing guards will be compensated for two (2)days at the regular rate if the reassigned corner is less than the corner previouslyassigned. Note: If an employee declines to take an assignment, it shall beconsidered refusal of assignment and the crossing guard may be subjectto disciplinary action up to and including discharge.

SUBJECT: ABSENc:E REPORTING REQUIREMENTS

This memorandum is to remind crossing guard employees. that It is theirresponsibility to report all absences on a dally basis to the crossing guardsergeant or designee (lead guard) at least one hour prior to their start of shift. Ifthe employee provides a doctors note that he/she will be off work for severaldays, the crossing guard sergeant or designee (lead guard) may waive therequirement to call in each day to report the absence. However, it Is theresponsibility of the employee to keep their sergeant informed of their status andexpected date of return to duty.

All crossing guards are required to report to their assignment on time and remainat the location for the duration of their shift. Tardiness must be reported prior tothe beginning of the crossing guard shift. Failure to notify the crossing guardsergeant or designee (lead guard) of all absences'and/or leaving an assignmentwithout authorization will subject the employee to loss of pay and/or disciplinaryaction up to and including discharge.
