The attached email with comments and questions on SP #2019-0034 from Judith Molinelli was sent to the Planning Commission prior to the meeting. OTHER BUSINESS SP #2019-0034 Jefferson Square Subdivision Staff: Gregory Bokan, AICP, Zoning Administrator, Land Development Manager Mr. Bokan discussed the subdivision plat for Jefferson Square, which was rezoned and approved in 2019 for 85 townhouses and 20 single family homes. Mr. Bokan provided an update on the status of the project and let the Commission know that the site plan and subdivision review were approaching final approval. After those approvals, building permits will be submitted and issued and then construction will begin. Mr. Bokan reviewed the plat and required elements for subdivision approval including required street dedication. Mr. Bokan noted that an existing 16-foot trail easement is being vacated and the plat includes an easement for a plaza area at the entrance to Jefferson Street and Prince William Street with a historical marker. Chairman Clark addressed each commissioner individually asking for questions or comment. Commissioner Harrison asked if the layout of the plat is the same that was presented to commission in 2019. Mr. Bokan answered yes. Commissioner Harrison asked regarding the easement is only for utility access, there is no trail being built correct? Mr. Bokan confirmed that is correct. Commissioner Johnson had no questions or comments. Commissioner Schilpp had no questions or comments. Commissioner Thompson asked if the new residents decide that they are interested in extending Winters Branch Trail, that the access easement would not preclude a trail to be built. Mr. Bokan confirmed that is correct.

Commissioner Trautwein had no questions or comments. Commissioner Wilson requested a response to the questions that were sent in by Judi Molinelli. Below are the questions and Mr. Bokan’s response: Q1. Do you have a presentation prepared for the PC meeting for the Jefferson development? If so may I have a copy? I couldn't tell from the documents in the Agenda package what the development will look like. Mr. Bokan: There is no presentation. Staff is presenting what was provided in the agenda packet. Q2. Do you have any drawings?

Mr. Bokan: There are no drawings, we are currently at site plan review, which is the physical land development. Building plans will eventually need to be submitted which will be reviewed by zoning to confirm that they conform with the design guidelines and elevations that were approved with the rezoning.

Q3. How high is the building in total including mechanical enclosures?

Q4. Was the developer granted a parking waiver/exception? How many spaces are required under the zoning ordinance? How many are actually being provided per unit by the developer, and where are they?

Mr. Bokan: No waiver was granted. 253 spaces required per zoning ordinance and a total of 332 were provided. Single family homes require 2 spaces and town homes require 2.5 spaces according to the zoning ordinance.

Q5. What is the greenspace requirement under the ordinance? How much greenspace is provided? Was the developer given a waiver permitting a reduction in greenspace? Was the developer given a waiver permitting a reduction in greenspace?

Mr. Bokan: The zoning ordinance requires 7% which is .69 acres. Applicant provided 28.4% open space which is 2.8 acres. Requirements have been exceeded.

Chairman Clark had no questions or comments. Commissioner Schilpp motioned to recommend approval of Jefferson Square Subdivision. Commissioner Harrison seconded the motion. MONTHLY UPDATE Staff: Matthew Arcieri, AICP, Director Planning & Development Pending Land Use Cases - July 2020 Mr. Arcieri shared Pending Land Use Cases for July 2020. Mr. Arcieri introduced Christian Samples, the City’s new Senior Planner. Mr. Arcieri discussed and previewed the new online interactive version of the 2040 Comprehensive Plan and discussed the upcoming schedule. ADJOURNMENT Commissioner Johnson motioned to adjourn the meeting. The B-3 zoning district, as revised through the comprehensive zoning update, is an appropriate zoning district for the existing building. The existing proffers are no longer required to mitigate land use impacts. Staff recommends approval of REZ #2020-06, as conditioned.

ANALYSIS

Background and History:

9001 Center Street also known as the Historic Meredith House was built in 1890. Elisha Edward Meredith, whom the house is named after, was a member of the VA Senate from 1883-1887, and served in the U.S. House of Representatives from 1891-1897. He along with his family lived in the house. In the early 1900’s, the structure operated as a boarding house as well as a residence. In 1979, the building was converted to commercial use, and has been used for the Center of the Arts, and as a training center. The structure is a copy of Tudor Hall, a demolished late 19th century mansion located nearby. The building is in the Classical Revival style, with the two-story portico and modillion pediment.

The building is subject to proffers approved as part of REZ #1991-04 that restricts the use of the building to only offices for business or professional use and antique, gift shops, and similar retail activities. The proposed rezoning would eliminate this restriction and allow the property to fully utilize the list of by-right uses in the B-3 zoning district as revised through the Comprehensive Zoning Ordinance Update. The building will remain in the Historic Overlay District and is designated as a contributing structure. No physical changes to the building or site are proposed.

Comprehensive Plan Analysis:

Manassas will be a vibrant, mixed-use community that reinforces the positive qualities of existing neighborhoods, promotes compatible infill and redevelopment, and emphasizes improved design

principles that reflect its historic character and charm.

The subject property is zoned B-3, City Center Commercial, and is designated Downtown in the Comprehensive Plan The existing proffers are no longer required to mitigate land use impacts.

The proposed proffer amendment would only impact the uses permitted on the property. No physical changes to the building or site are proposed. The property will continue to be located in the Historic Overlay District with exterior alterations subject to review and approval by the Architectural Review Board.

Economic Development

Manassas is an economically thriving City where the combination of an entrepreneurial spirit, an involved business community, and a supportive City economic development presence results in growing businesses, a thriving active community, and a strong sense of place and opportunity.

The Department of Economic Development supports this proffer amendment. This proposal ensures the zoning of the property supports current and intended uses, thereby increasing the opportunity for the types of businesses that want to be in these spaces and maximizing the economic potential of each property. The City initiated rezoning process is a strong incentive to help property owners undertake the process.

Thank you for the reply. I would like to have a copy of the 1991 ‐ 04 proffer as soon as possible so that I have reviewed it before the May 6th meeting. Please send a copy or provide a link so that I may retrieve it. 

  

It appears that the present zoning is B 3.0 for which the uses are limited by a proffer.  The owner asks that limits on the use be removed, correct?  Our main question is simple, does removing the proffer [which appears to be a

rezoning] have any effect on the maximum allowable height of the landmark building?  In other words does the proffer somehow limit how high the building can be?  And does removing the proffer mean that the greenspace which is now very large could be reduced for the purpose of expanding the existing landmark building or building new structures? 

  

If we have misunderstood the request for rezoning,  please tell me now. If there's no possible way that removing the proffer will affect the allowable building height or greenspace, there would appear not to be a problem.

I hope you are well and are not too stressed by the pandemic. 

  

RE: rezoning proposal for 9001 Center Street. 

  

I am relieved that the requested change is for 

B3.0 and NOT B3.5. The building is a historic landmark which means it should be subject to heightened scrutiny and minimal changes. However, I have a few questions for the zoning office. 

 

The zoning office described the proposal for rezoning as one that would expand the "uses" of the the property to those commensurate with B 3.0. What the building is used for is less of a concern to Preserve Historic Manassas than changes to either the footprint of the building, new construction on top of the building or a loss of greenspace, a discussion or even mention of which was conspicuously omitted. 

 

I am concerned that the owners REAL motivation for changing the zoning to B 3.0 is not just that they can add a different use, as the town implies. Rather, I am concerned that they plan to raise the height of the existing landmark to 60 feet and develop the greenspace. Unfortunately, I have learned not to take the explanations given by the town at face value.  

  

Therefore I want to ask specific questions. 

 

1. If B3.0 is granted, could new construction be permitted that could raise the height of the landmark building up to 60 feet [including mechanical enclosures] as long as the new construction is stepped back 15 feet? 

 

2. Presently there is landscaped greenspace surrounding the landmark building that is natural [grass, trees, etc.], which adds to the beauty, historic significance and grandeur of the building.

Is there ANY WAY that rezoning to B3.0 could permit development of this greenspace, i.e. ANY REDUCTION in the square footage of this surrounding greenspace to make way for new construction? Specifically, could the land/greenspace at the sides, front OR back of the landmark building be turned into hardscape or new construction?  

 

Preserve Historic Manassas is particularly concerned with obstruction of light AND loss of greenspace in the historic core downtown area where this landmark has stood since 1860. We are also concerned that new construction can diminish the beauty and historic presence of the landmark.  

 

In many historic towns landmark buildings such as this are converted into dwellings WITHOUT a loss of greenspace or new construction that is visible from the street. This has been accomplished to maintain the integrity of the landmark and to preserve the site/greenspace on which it sits are preserved.  

 

3. Could this building or a portion of it be converted into dwellings/apartments/condos by rezoning to residential status instead of B3.0?  

  

4. Exactly HOW could this landmark property and greenspace be changed if B 3.0 zoning is granted?  

 

Please provide detailed answers since these are questions that we will raise at any eventual public hearings. We also plan to invite Matt Arcieri and someone from the Planning board to a question and answer meeting at some point, even if it is on line.

Zoning Ordinance Annual Update

As a follow-up to the completion of the City’s comprehensive zoning ordinance update, staff recommends that the City annually review the ordinance to make technical corrections and updates, and to ensure the code remains in compliance with current requirements of state and federal laws and regulations. This year’s list of updates also will include recommended code changes address policy challenges created by the Covid-19 pandemic. The attached resolution will initiate the review of proposed changes to the ordinance as follows:

• To consider updates to the definitions (Sec. 130-44) of Character Areas, Through Lot; Motor Vehicle Repair Major, and Motor Vehicle Repair Minor;

• To consider new terms and definitions (Sec. 130-44) for Apiary, Colony, Contractor, Data Center, Domestic Fowl, Hive, Local Emergency, and Outdoor Dining;

• To consider the addition of new sub-sections for accessory structures to provide standards for the keeping of domestic chickens, fowl, and bees (Sec. 130-89);

• To consider the addition of a new sub-section for temporary uses to enable the extension of a temporary use or structure in the event of a local emergency (Sec. 130-104(f));

• To consider modifications to the single-family detached dwelling parking and driveway location standards and parking lot landscaping in the I-A Airport district (Sec. 130-205, Table 1 and Sec. 130-205(c));

• To add Data Center to the use tables (Sec. 130-241 Table 1 and Sec. 130-241 Table 2);
