Ryland Apartments Alleyway Abandonment

This request for abandonment of a portion of the alleyways between Ryland and Willow (south-north)

and High and Park (west-east) is made solely for portions of alleyway that lies between properties

owned by Desiderio Family Trust, Desiderio Properties or 3D Properties, LLC. The surface condition of

the existing driving surface of the portions of alleyways proposed for abandonment is generally poor.

Following is a map generally showing the portions of alleyway that are requested for abandonment with

this application.

Zoning

All properties adjacent to the proposed alley abandonment area are zoned MU/DRRC/CAL (mixed use-

Downtown Reno Regional Center-California District) as shown in the following map from the City of

Reno GIS Mapserver.

Existing Conditions

This alleyway within this block does not show any sign of recent maintenance, paving nor repair. It

exists in a graded, sparcely gravelled condition. Photos of the existing conditions of the alleyway

sections proposed for abandonment are provided, below.

Ryland Apartments Alley Abandonment

Legal Finding Review

This request for abandonment is the final portion of the Ryland Apartments Development project that

was approved on August 14, 2019 by the Reno City Council. The requested abandonment only affects

portions of the alleyway system between Ryland and Willow Street, High and Park Streets where the

Desiderio Family is involved in ownership of both sides of the alley.

The legal finding for abandonment applications consist of a single requirement per RMC 18.06.603(c), In

approving any abandonment, the City Council shall find the following:

1) The public will not be materially injured by the proposed vacation.

The public will not be materially injured as the alleyway in question has fallen into a state of neglect and

disrepair. See Existing Condition site photos provided in narrative for this application that shows the

minimal improvement level of the existing alleyway area proposed for abandonment. A portion of the

original existing north-south alleyway between parcel 02-137-18 & 19 was previously abandoned by the

City of Reno. The final configuration of the Ryland Apartment development will establish a publicly

accessible travel-way between Ryland and Willow Streets, incorporating a 20’ to 24’ driveway access

that will not have any building coverage for future residents in the Ryland Apartments and existing

residents within this city block.

Below is a building elevation view from Ryland Street and preliminary site plan from the Ryland

Apartments that was approved special use permit that shows the location of the open throughway.

Driveway

In short, a better more drivable surface will exist after the abandonment and development of the

project than currently exists within this block. The format of a north/south connection between Ryland

and Willow Street takes the form that was originally platted with the Haydon & Shoemaker’s Southeast

Addition Tract Map (Tract Map 36 as recorded in the Washoe County Recorder’s Office). A copy of the

tract map is provided in this application package.
