Council Workshop Letter No. 18-276 October 17, 2018 TO: The Honorable Mayor and Members of the City Council FROM: Clinton P. Gridley, City Administrator SUBJECT: Position Classification and Compensation Plan Analysis

SUMMARY The City of Woodbury last accomplished a comprehensive review of its position classification and compensation plan in 2005. Over the years, there have been changes to jobs / classifications creating concern that Woodbury’s plan had become outdated. Therefore, the City hired consultant GovHR USA in 2018 to review the classification and compensation plan to ensure an equitable plan is in place to compensate employees properly for the services being provided compared to market, to create consistent titling and to recognize differences in classifications. City staff and consultant Joellen Cademartori will present an overview of the process and study results at the October 17 and November 14, 2018 City Council Workshop meetings, with employee presentations to follow. RECOMMENDATION Staff recommends Council review the position classification and compensation plan analysis at the October 17 workshop meeting and recommendations at the November 14, 2018 workshop meeting and provide direction to staff. BUDGET IMPACT This process has coincided with the 2019 budgetary planning process and any changes will be supportable in the 2019 budget. PUBLIC PROCESS This will be the first public process for this item.

Council Workshop Letter No. 18-276 October 17, 2018 Page 2 BACKGROUND The City of Woodbury employs approximately 244 regular full-time employees. These employees are organized into 92 position titles / classifications / job descriptions and are separated into three compensation plans. In recent years, there was growing concern that the City’s current classification and compensation plan had become outdated. Therefore, a third-party independent analysis was planned and budgeted for in 2018. A formal request for proposals was accomplished, and the firm GovHR USA was selected to perform this work for the City. The 2018 classification and compensation plan analysis focused on the non-represented compensation plan (excluding police officers, public service workers and mechanics) which has fifteen salary levels, or bands, with the position classifications split amongst the fifteen salary bands. This plan is a performance-based pay plan and has consistently achieved compliance with the Minnesota Pay Equity requirements. The 2018 analysis included the following elements: (1) Updating of position descriptions and a written evaluation of each classification/job.

(2) Evaluation of each classification/ job on the following factors to establish a numerical job

score used for internal ranking: Education – Required Preparation and Training Work Experience – Year of Experience Needed to Perform Job Decision Making and Independent Judgment Responsibility for Policy Development Planning of Work Contact with Others Work of Others (Supervision Exercised) Working Conditions Technology Used

Office of City Administrator Council Workshop Letter No. 18-277 October 17, 2018 TO: The Honorable Mayor and Members of the City Council FROM: Clinton P. Gridley, City Administrator SUBJECT: METRO Gold Line Bus Rapid Transit Update

SUMMARY The METRO Gold Line Bus Rapid Transit project (Gold Line) will connect people across the region to job centers, housing options, transit stations and key destinations in the I-94 corridor. The planned nine-mile dedicated Bus Rapid Transit (BRT) line will connect St. Paul, Maplewood, Landfall, Oakdale and Woodbury generally along Interstate 94. On January 19, 2018, the Federal Transit Administration (FTA) granted the Gold Line entry into the project development phase of the federal New Starts program, which is the first step to securing federal funding, and allows the project to advance conceptual design, environmental work, and community outreach over a not-to-exceed two year timeline. During project eevelopment, the project design will progress from 3 percent engineering to 15 percent engineering by the end of 2018, and 30 percent engineering by the end of the project development phase (early 2020). Another major milestone for the Gold Line is the assignment of Metro Transit as the lead agency responsible for developing and eventually operating the Gold Line. The purpose of this council letter is to provide the Council with an update on the various aspects of the Gold Line project. BACKGROUND In November 2016, the City of Woodbury approved Resolution 16-198, supporting a revised locally preferred alternative (LPA) for the Gold Line. The LPA, enters Woodbury at a proposed new bridge over I-94 at Helmo Avenue/Bielenberg Drive, continues along south on Bielenberg Drive, then turns west onto Guider Drive. The Gold Line terminates near the Woodbury Theatre park and ride behind the Woodbury Village Target store. The LPA also showed two stations in Woodbury, one at the end of the line near the Woodbury Theatre and one generally north of Tamarack Road along Bielenberg Drive. (See the yellow-colored segment of Gold Line route in the LPA illustration on page 2.) As we approach the mid-point of the project development phase, it is appropriate to update the Council on several components of the Gold Line project including the guideway design, alignment, station locations, and stakeholder engagement. In addition, staff will update Council

Council Workshop Letter 18-277 October 17, 2018 Page 2 on some governance and committee structure changes that occurred as part of the transition to project development and assignment of Metro Transit as the lead agency. Finally, staff will provide an update on cost participation from both a capital and operations/maintenance perspective.

Locally Preferred Alternative, 2016 Guideway Design: The Gold Line will be Minnesota's first BRT line that operates primarily within a dedicated guideway or exclusive bus-only lane. These separate lanes ensure buses are not delayed due to traffic congestion. A dedicated guideway can be either side-running or center-running. Diagrams of these guideway designs will be provided at the meeting. While approximately 80 percent of the Gold Line will have exclusive lanes dedicated only to buses, it is important to note that portions of the line will operate within mixed traffic lanes. In Woodbury, the Gold Line is proposed to have a dedicated, center-running guideway from the new Helmo-Bielenberg bridge until just south of the Nature Path intersection. The existing full accesses to the businesses along Bielenberg Drive will remain and become signalized as part of the Gold Line project. A new signal is also proposed at the intersection of Hudson Road and Bielenberg Drive. City staff felt that it was important to preserve the full access points for existing businesses. Having full access to both sides of Bielenberg Drive will also help to maximize the potential future development and redevelopment opportunities along this corridor. The Gold Line busses will run in mixed traffic from just south of Nature Path to Guider Drive. New traffic signals are proposed on Bielenberg Drive at both of these intersections. The mixed traffic guideway design option was selected in order to avoid/minimize impacts to the environmentally sensitive Tamarack Nature Preserve wetland area on either side of Bielenberg Drive. The Gold Line will continue to run in mixed traffic along Guider Drive to the terminus of the route near the Woodbury Theatre. The maps on the following page show the Gold Line route from the City of Woodbury’s northern border at I-94 to the route’s terminus on Guider Drive. The solid pink color depicts the dedicated guideway and the hash-marked pink depicts the segment of the route in mixed traffic.

Council Workshop Letter 18-277 October 17, 2018 Page 4 Alignment/Route: The LPA showed the Gold Line terminating at the Woodbury Theatre park-and-ride lot. As part of the project development phase, each city along the corridor has an Issue Resolution Team (IRT) made up of staff that assist in identifying and resolving technical issues regarding the alignment, guideway, station locations, etc. As part of this IRT process, the Woodbury staff worked with the Gold Line project office to evaluate an option which would extend the Gold Line route approximately one quarter mile and move the terminus of the line westward to the intersection of Guider Drive and Woodlane Drive. This revised terminus, which would be adjacent to I-494, would more effectively allow for the future consolidation of the Gold Line and Express Bus park-and-ride lots, which staff believes is the highest and best use for this site. It would also maximize the transit oriented redevelopment potential of the Woodbury Theatre site. Metro Transit staff is exploring whether MnDOT will allow a ‘slip-ramp’ bus access to northbound I-494 for the express busses, which would add efficiency for Express Bus users. Two downtown routing alternatives are being considered. The approved LPA includes routing through downtown St. Paul and includes a stop at Union Depot (“Downtown Routing” option). A second option has been presented in which the Gold Line would end at Union Depot, without the downtown routing service (“Union Depot Bus Deck” option). These options will have different ridership projections. For Woodbury riders bound for Union Depot or destinations east of Union Depot, a transfer would be required under the “Union Depot Bus Deck” option, which would result in longer travel times when compared to the “Downtown Routing” alternative. Station Locations: The maps above show three proposed station locations. As part of the IRT process, city staff worked with the Gold Line project team to evaluate and further refine the station locations. The LPA showed general locations for two stations; one located on Bielenberg Drive north Tamarack Road and another at the Woodbury Theatre park-and-ride. A third station location is proposed at the west end of Guider Drive. The northern station (Tamarack Station) is proposed to be located at the northern access point to the Tamarack Hills development. This station will be a walk-up station (no park-and-ride facilities). The quarter-mile walk-shed for this station location, which equates to an approximate five minute walk, will generally serve the development east and west of Bielenberg Drive from I-94 to Tamarack Road. This includes the former Hartford building and businesses in the Tamarack Hills developments. There is also future “Places to Work” development potential in this immediate area, which provides opportunities for transit oriented development. The second station is located on Guider Drive just north of the Woodbury Theatre (Woodbury Theatre Station). This will primarily be a walk-up station, but some spaces at the Woodbury Theatre that are currently used by Express Bus customers could be freed up for Gold Line use because of the construction of the new planned Express Bus park-and-ride lot at I-94 and Manning Avenue in Lake Elmo. This station would serve the near-by high density residential properties as well as the “Places to Shop” areas of Woodbury Village. The third station is located at the end of the Gold Line near I-494 (Woodbury 494 Station), and improvements would be implemented in a phased approach. Under Phase 1, on day of opening of the Gold Line BRT, this station would include a surface park-and-ride lot which is anticipated to accommodate 250 cars. Under Phase 2, a parking ramp would be constructed at the Woodbury

Parking for existing Express Bus users at Woodbury Theatre, Woodbury Lutheran Church and Christ Episcopal Church would be consolidated at the new parking ramp with the Gold Line users. As noted in the “Alignment” section above, Metro Transit staff is working with MnDOT to explore the possibility of adding a ‘slip-ramp’ onto northbound I-494 for the Express Busses, which would cut travel time and increase efficiency for those routes. It should be noted that Phase 2 is currently unfunded. Stakeholder Engagement: As the Gold Line has progressed through the project development phase, there have been several opportunities for stakeholder input and engagement. City staff has worked with Gold Line staff to coordinate meetings with the major business owners along the corridor. Owners of the former Hartford building and Iron Gate Solutions on Bielenberg Drive expressed concerns about property impacts/takings, traffic congestion, especially with the additional traffic signals, as well as concerns about data and electric reliability during the construction phase of the Gold Line project. City staff also attended the open house events sponsored by the Gold Line project office, and had an opportunity to interact with residents along the corridor and those generally interested in the project. Staff will continue to seek opportunities to reach out to affected property owners and the public at large as the Gold Line continues to progress toward 30 percent engineering by the end of the project development phase. Governance: As the Gold Line project moved into project development, there were several changes to the committee structure and governance. The chart below depicts how the teams, committees and government agencies relate to each other, with the recommendations ultimately landing at the Metropolitan Council for final decisions. A brief description of each committee follows the chart.

Issue Resolution Teams (IRT): As noted above, each city has an IRT. Woodbury’s IRT consists of staff from both Engineering (Tony Kutzke) and Community Development (Dwight Picha, Janelle Schmitz, Eric Searles and Gina Gore), to provide technical and local policy perspective in regard to corridor design elements and the eventual operation and maintenance of the guideway. There are also several IRT’s related to specific issues (i.e. stormwater, etc.). Sharon Doucette is Woodbury’s representative on the stormwater IRT. Technical Advisory Committee (TAC): Each city along the corridor is allowed two TAC members to work through technical planning and engineering issues. Tony Kutzke and Janelle Schmitz represent Woodbury on the TAC. Community and Business Advisory Committee (CBAC): The Metropolitan Council appointed the members of the CBAC, which include representatives from each city along the corridor. As the name implies, the CBAC is composed of both residents and business representatives, with the goal of having all of the stations along the corridor represented as well as some at-large membership. Members of the CBAC that represent Woodbury include:

Corridor Management Committee (CMC): The CMC is made up of elected and appointed officials from each of the cities along the corridor, as well as the various agencies that are involved in the project (Metropolitan Council, MnDOT, etc.) Currently Mayor Stephens is serving on the CMC, with Councilmember Scoggins as the alternate. With Mayor Stephens’ term coming to an end in 2018, the Council will want to consider who will represent the City of Woodbury on the CMC going forward. Counties: Washington County and Ramsey County, and their Railroad Authorities, are the two counties involved in the Gold Line project. Metropolitan Council: As noted above, the lead agency for the Gold Line project is Metro Transit, which is a part of the Metropolitan Council. The input and recommendations from the committees and counties above ultimately flow to the Metropolitan Council for final decision making authority.

Cost Participation: City staff has been working closely with the Gold Line project office to understand the City’s potential cost participation in the Gold Line, both from an initial capital perspective (upgrades to station areas, landscaping, etc.) and any ongoing maintenance and operations costs the City may be responsible for. One of the more complex issues related to cost participation is the proposed new Helmo/Bielenberg bridge, which has been in both the City of

Council Workshop Letter 18-277 October 17, 2018 Page 7 Woodbury’s as well as the City of Oakdale’s Comprehensive Plans for decades. Since the bridge will not only accommodate the Gold Line, but will have general traffic lanes and a pedestrian/ bike path, the County and City staff are exploring options for the initial capital funding for the non-BRT components of the bridge. Other issues being discussed include ownership of the bridge and ongoing operation and maintenance responsibilities associated with the bridge. These discussions are ongoing and more detail will be provided prior to any approvals by the City. Continued Municipal Collaboration: In early 2019, the Gold Line project will provide MnDOT, both counties, and each city with the Gold Line’s 15 percent concept design and provide a 30-day review and comment period followed by time for GBRT staff to respond to comments. The concept design will include the location of planned construction and the size and features of project components. Following staff review, the Metropolitan Council and the project counties will encourage each city to pass a resolution supporting the project’s concept design. This support helps affirm the project scope before the Metropolitan Council advances into the next project phase. Each city, both counties, MnDOT, and all other interested parties may also submit formal comments on the Environmental Assessment (EA) in the summer of 2019. This timing is designed so the Metropolitan Council and Counties will have feedback on both the EA and the 15 percent design from each city before entering the Engineering Phase, which is anticipated to begin in 2020. Following is the anticipated timing of actions during project development:

15 percent staff level design review 1st quarter, 2019 Resolution of Support 2nd quarter, 2019 Comments on Environmental Assessment 3rd quarter, 2019

While the project development phase defines the project scope and completes environmental review, project collaboration will continue through engineering and construction. This will include ongoing advisory committees and coordination through final design. Some project scope items may also require Trunk Highway and County State Aid Highway Municipal Consent approvals, and review of these components will follow the 30 percent design. Design reviews by project partners will also continue during the Engineering Phase at key milestones (i.e. 60 percent, 90 percent). SUMMARY

Staff is recommending revising the Lawn Watering Policy which aligns with the City Council Strategic Initiative- Sustainable Water Future for Woodbury and updates the policy with current language and practices since its original adoption. The significant revisions include:

1. Expanding the focus of the policy to include protecting quantity of groundwater; 2. Changing the policy’s reach to include the entire City rather than within the Municipal

Urban Service Area (MUSA); 3. Updating language to include current technologies, such as water reuse; 4. Revising firm capacity percentages referenced under Levels 2 and 3.

A majority of Woodbury residents will not be impacted by the proposed changes. There are approximately 500 additional homes that will need to follow the policy starting in 2019, these homes are outside of the MUSA and will be notified directly of this change.

RECOMMENDATION

Provide staff with direction on proposed changes and adopt revisions to the policy through the consent agenda at the November 7, 2018 Council meeting. Staff recommends policy go into effect January 1, 2019.

PURPOSE

It is the purpose of this policy to regulate lawn watering, to encourage water conservation, and

protect groundwater resources, prevent excessive demands on the City's water system. water

demand, and encourage water efficiency and conservation by regulating lawn and landscape

watering. This policy is authorized under Woodbury City Code 23-20, Emergency Water

Conservation. This policy covers all water services, including those served in Maplewood, that

are connected to the City's water system. This policy also covers all private wells within the

MUSA boundary used for lawn City that do not hold a water appropriations permit from the

ways to maintain their lawns.

The City will promote water conservation and the use of water saving devices.

As of April 11, 2001 all new commercial property lawn sprinkler systems shall have

rain sensors.

SportsAthletic fields, golf courses, commercial nurseries, and agricultural, and horticultural

businesses that operate under a State of Minnesota appropriation permit will be exempt from

this policy. These users are encouraged to employ water conservation practices to the extent

possible.

Athletic fields connected to the municipal system are exempt from Level 1 and 2 of this

The City Council annually reviews the proposed Woodbury legislative program items for communication benefit to our legislative delegation. The purpose of this workshop agenda item is to get an early start on this since the state legislature convenes starting January 8, 2019. Each year, the Municipal Legislative Commission (MLC) also puts together a legislative program to provide their legislative delegation guidance on key initiatives and the MLC lobbyists advocate for the advancement of those key initiatives at the Capitol. This will be developed and made available at a later time when completed. RECOMMENDATION Staff is requesting Council to review the Woodbury legislative program for feedback ahead of adoption consideration. DRAFT 2019 Legislative Agenda

1. LOCAL CONTROL

Local governmental entities are closest to their constituents, are most knowledgeable about its jurisdiction, and are most invested in the welfare and success of its community. Therefore, elected local governmental officials are best suited to making important decisions about its operations, regulations and activities. The following are specific areas of home-rule authority pre-emption that the City of Woodbury opposes. need to be resisted or relaxed.

a. The City of Woodbury supports the principle of representative democracy that allows city councils

to formulate local budgets and therefore oppose state-imposed levy limits.

b. State imposition of artificial limitations such as the “taxpayer’s bill of rights”, valuation freezes, reverse referenda, fund balance restrictions, limits on use of G.O. bonding authority, super majority requirements or other limitations to the local government budgeting and taxing process are not supported by the City of Woodbury.

c. The City of Woodbury supports exempting cities from local government compensation limits per Minnesota State Statute 43A.17 which limits the salary and the value of other forms of compensation of a person employed by a political subdivision of this state, excluding school districts and university personnel. The local government compensation limit was originally established in 1983 and as enacted, permanently set the limit at 95 percent of the governor’s salary. In 2005, the law was modified to annually adjust the compensation cap based on CPI-U increase over the prior year. This cap is an impingement on city home rule authority and their ability to recruit and retain the best talent it needs to operate cities. Moreover, Woodbury is not an LGA recipient, which should allow for exemption under this act.

d. The City of Woodbury supports amending State Statutes 469.190 Local Lodging Tax that would

allow cities more flexibility to utilize the lodging tax proceeds to finance economic development, marketing and tourism-related expenses without requirement to form a convention and visitors bureau / destination marketing organization.

e. The City of Woodbury opposes legislation that reduces or eliminates the City’s authority in the

areas of local land use controls - local zoning, land use, comprehensive planning, utility and transportation planning, etc. These types of regulations have significant impacts to local neighborhoods. Cities are best positioned to govern these matters and have effective processes for hearing and addressing concerns of affected citizens. The City has an adopted Comprehensive Plan based on broad community input that articulates the community’s goals. Interference with these effective local processes impedes the City’s ability to effectively implement the Comprehensive Plan.

f. The City of Woodbury opposes the Federal Communications Commission (FCC) Sept. 26, 2018

Declaratory Ruling and Third Report and Order on small cell wireless deployment which limits local control of processing wireless permits on city structures and structures in a city’s right of way by creating unreasonable time frames to process applications and by limiting a city’s ability to recoup the costs incurred in processing an application.

2. FINANCIAL

a. 2018 bonding request – 50% state and local cost share for land acquisition, site preparation and development of Health and Emergency Response Occupations (HERO) Center at 12600 Ravine Parkway in Cottage Grove for the cities of Woodbury and Cottage Grove.

b. The City of Woodbury supports expanding the state sales tax exemption to include general vehicle purchases (marked squad cars and emergency vehicles are exempt), fuel purchases, lodging and prepared foods, and municipal golf course purchases. (MS297a.70 see subd 2 subparagraph b regarding exemptions). The City of Woodbury also supports simplifying the process to secure the sales tax exemption for construction materials when a contractor purchases materials on behalf of the city.

c. The City of Woodbury opposes the use of fiscal disparities to fund housing, social or physical

metropolitan programs (e.g. Bloomington Mall of America). Fiscal disparities should be solely used for tax base redistribution.

d. The City of Woodbury supports property tax relief via the Circuit Breaker (Regular Homeowner's

Homestead Credit Refund) as opposed to Local Government Aid (LGA).

3. TRANSPORTATION

a. Support for a comprehensive transportation funding package

b. Support for I-94, I-494, I-694 interchange improvements

c. Support for the Gateway Corridor Gold Line project

d. The Legislature should authorize local units of government to impose infrastructure fees so new development pays its fair share of the off-site, as well as the on-site, costs of public infrastructure and other public facilities needed to adequately serve new development.

4. ADMINISTRATIVE

a. The City of Woodbury does not support expanding the current Data Practice statutes, and encourage reforming the open records law to address some of the abuses that are occurring as follows:

i. Inspection, copies and copy costs - Currently the MGDPA states that when a person requests access to documents for the purpose of inspection, the responsible authority may not impose a

charge or otherwise require the payment of a fee to inspect data. This requirement is a hindrance, as the same amount of work is done to research documents for inspection is done as when the individual wishes copies of the documents.

ii. Responding to data requests - Currently the MGDPA states the responsible authority or designee generally may not require requestors to identify themselves, state a reason for a request, or otherwise justify a request for public data. (Statute does allow the responsible authority to request information to confirm that an individual requesting private data is in fact the subject of the data (or the authorized representative). These requirements are a hindrance as there are many times when a requester seeks voluminous, wide-ranging information and the responsible authority should have the ability to be able to ask questions about the information request. This will, in essence, provide a more positive avenue of communication and improve ability to more efficiently provide the requested information.

b. The City of Woodbury supports statewide professional licensure and regulation for practice of

massage therapy so long as new state statutes meets or exceeds current city ordinance standards.

c. The City of Woodbury opposes the January 23, 2016 new Minnesota State Plumbing Code that went to effect requiring annual backflow prevention testing per section 603.4.2 of the plumbing code. Homeowners with new lawn irrigation systems as of January 23, 2016 must have the backflow valve tested every year; homeowners with existing pressure vacuum breakers are exempt from the requirement until the valve is replaced. The reason for requirement is to prevent water from the household irrigation system from backing up into the drinking water system if there is a significant loss of pressure in the city’s water supply system. This level of pressure loss is an exceedingly rare event. The cost for annual testing for residential property is estimated at $100-$150.

5. WATER RESOURCE MANAGEMENT:

a. The City of Woodbury supports legislative action resulting in more flexible approaches to water reuse regulations that meet economic and environmental goals including addressing overlapping, duplicative, and conflicting requirements from the MDH, MDNR, and other state agencies in the current system.

b. The City of Woodbury opposes funding of any implementation cost involved with the DNR North & East Metro study (e.g. connection of northeastern metro cities to surface water) if it does not directly result in supplying water to Woodbury residents.

6. METROPOLITAN COUNCIL:

a. The City of Woodbury favors a modification to the present governance model for the Metropolitan Council as follows:

i. A structure that is more responsive to the needs and challenges of local government. ii. Appointment of Metropolitan Council members by the Governor with four-year, staggered

terms. The appointment of the Metropolitan Council Chair should coincide with the term of the Governor.

iii. Nominating committee process that maximizes participation and input by local officials.

iv. Bipartisan Legislative Commission on Metropolitan Government, or another entity, to monitor and review the Metropolitan Council’s activities and to provide transparency and accountability of the Metropolitan Council operations and functions.

i. The City of Woodbury favors a modification to the present governance model for the Metropolitan

Council in the form of a “council of governments” type model utilizing elected city and county officials to serve as the metropolitan governing board with appointments being made by the local governments themselves.

ii. Nominating committee process that maximizes participation and input by local officials.

iii. Bipartisan or bicameral legislative commission on Metropolitan Government, or another

entity, to monitor and review the Metropolitan Council’s activities and to provide transparency and accountability of the Metropolitan Council operations and functions.

b. The City of Woodbury opposes:

i. Any expansion of Metropolitan Council powers such as the conversion of either housing or

potable waters to a “metropolitan systems” classification as defined in the Metropolitan Land Use Planning Act.

ii. Mandatory targets for affordable housing or mandatory inclusionary housing provisions in the regional comprehensive planning process or through other regulatory processes.

DRAFT 2019 Legislative Agenda

1. LOCAL CONTROL

Local governmental entities are closest to their constituents, are most knowledgeable about its jurisdiction, and are most invested in the welfare and success of its community. Therefore, elected local governmental officials are best suited to making important decisions about its operations, regulations and activities. The following are specific areas of home-rule authority pre-emption that need to be resisted or relaxed.

a. The City of Woodbury supports the principle of representative democracy that allows city councils

to formulate local budgets and therefore oppose state-imposed levy limits.

b. State imposition of artificial limitations such as the “taxpayer’s bill of rights”, valuation freezes, reverse referenda, fund balance restrictions, limits on use of G.O. bonding authority, super majority requirements or other limitations to the local government budgeting and taxing process are not supported by the City of Woodbury.

c. The City of Woodbury supports exempting cities from local government compensation limits per Minnesota State Statute 43A.17 which limits the salary and the value of other forms of compensation of a person employed by a political subdivision of this state, excluding school districts and university personnel. The local government compensation limit was originally established in 1983 and as enacted, permanently set the limit at 95 percent of the governor’s salary. In 2005, the law was modified to annually adjust the compensation cap based on CPI-U increase over the prior year. This cap is an impingement on city home rule authority and their ability to recruit and retain the best talent it needs to operate cities. Moreover, Woodbury is not an LGA recipient, which should allow for exemption under this act.

d. The City of Woodbury supports amending State Statutes 469.190 Local Lodging Tax that would

allow cities more flexibility to utilize the lodging tax proceeds to finance economic development, marketing and tourism-related expenses without requirement to form a convention and visitors bureau / destination marketing organization.

e. The City of Woodbury opposes legislation that reduces or eliminates the City’s authority in the

areas of local land use controls - local zoning, land use, comprehensive planning, utility and transportation planning, etc. These types of regulations have significant impacts to local neighborhoods. Cities are best positioned to govern these matters and have effective processes for hearing and addressing concerns of affected citizens. The City has an adopted Comprehensive Plan based on broad community input that articulates the community’s goals. Interference with these effective local processes impedes the City’s ability to effectively implement the Comprehensive Plan.

f. The City of Woodbury opposes the Federal Communications Commission (FCC) Sept. 26, 2018

Declaratory Ruling and Third Report and Order on small cell wireless deployment which limits local control of processing wireless permits on city structures and structures in a city’s right of way by creating unreasonable time frames to process applications and by limiting a city’s ability to recoup the costs incurred in processing an application.

2. FINANCIAL

a. 2018 bonding request – 50% state and local cost share for land acquisition, site preparation and

development of Health and Emergency Response Occupations (HERO) Center at 12600 Ravine Parkway in Cottage Grove for the cities of Woodbury and Cottage Grove.

b. The City of Woodbury supports expanding the state sales tax exemption to include general vehicle purchases (marked squad cars and emergency vehicles are exempt), fuel purchases, lodging and prepared foods, and municipal golf course purchases. (MS297a.70 see subd 2 subparagraph b regarding exemptions).

c. The City of Woodbury opposes the use of fiscal disparities to fund housing, social or physical

metropolitan programs (e.g. Bloomington Mall of America). Fiscal disparities should be solely used for tax base redistribution.

d. The City of Woodbury supports property tax relief via the Circuit Breaker (Regular Homeowner's

Homestead Credit Refund) as opposed to Local Government Aid (LGA).

3. TRANSPORTATION

a. Support for a comprehensive transportation funding package

b. Support for I-94, I-494, I-694 interchange improvements

c. Support for the Gateway Corridor Gold Line project

4. ADMINISTRATIVE

a. The City of Woodbury does not support expanding the current Data Practice statutes, and encourage reforming the open records law to address some of the abuses that are occurring as follows:

i. Inspection, copies and copy costs - Currently the MGDPA states that when a person requests access to documents for the purpose of inspection, the responsible authority may not impose a charge or otherwise require the payment of a fee to inspect data. This requirement is a hindrance, as the same amount of work is done to research documents for inspection is done as when the individual wishes copies of the documents.

ii. Responding to data requests - Currently the MGDPA states the responsible authority or designee generally may not require requestors to identify themselves, state a reason for a request, or otherwise justify a request for public data. (Statute does allow the responsible authority to request information to confirm that an individual requesting private data is in fact the subject of the data (or the authorized representative). These requirements are a hindrance as there are many times when a requester seeks voluminous, wide-ranging information and the responsible authority should have the ability to be able to ask questions about the information request. This will, in essence, provide a more positive avenue of communication and improve ability to more efficiently provide the requested information.

b. The City of Woodbury supports statewide professional licensure and regulation for practice of

massage therapy so long as new state statutes meets or exceeds current city ordinance standards.

c. The City of Woodbury opposes the January 23, 2016 new Minnesota State Plumbing Code that went

to effect requiring annual backflow prevention testing per section 603.4.2 of the plumbing code. Homeowners with new lawn irrigation systems as of January 23, 2016 must have the backflow valve tested every year; homeowners with existing pressure vacuum breakers are exempt from the requirement until the valve is replaced. The reason for requirement is to prevent water from the household irrigation system from backing up into the drinking water system if there is a significant loss of pressure in the city’s water supply system. This level of pressure loss is an exceedingly rare event. The cost for annual testing for residential property is estimated at $100-$150.

5. WATER RESOURCE MANAGEMENT:

a. The City of Woodbury supports legislative action resulting in more flexible approaches to water reuse regulations that meet economic and environmental goals including addressing overlapping, duplicative, and conflicting requirements from the MDH, MDNR, and other state agencies in the current system.

b. The City of Woodbury opposes funding of any implementation cost involved with the DNR North & East Metro study (e.g. connection of northeastern metro cities to surface water) if it does not directly result in supplying water to Woodbury residents.

6. METROPOLITAN COUNCIL:

a. The City of Woodbury favors a modification to the present governance model for the Metropolitan Council as follows:

i. A structure that is more responsive to the needs and challenges of local government. ii. Appointment of Metropolitan Council members by the Governor with four-year, staggered

terms. The appointment of the Metropolitan Council Chair should coincide with the term of the Governor.

iii. Nominating committee process that maximizes participation and input by local officials. iv. Bipartisan Legislative Commission on Metropolitan Government, or another entity, to

monitor and review the Metropolitan Council’s activities and to provide transparency and accountability of the Metropolitan Council operations and functions.

b. The City of Woodbury opposes: i. Any expansion of Metropolitan Council powers such as the conversion of either housing or
