In the matter of the application of the Missouri, Kansas & Texas Railway Company for appointment of referees to determine and appraise all compensation and damages to be paid for land, property and im-provements to "be appropriated and condemned for right-of-way for branch lines to mines near Coalgate, Choctaw Nation, Indian Territory.

To the Choctaw Nation or tribe of Indians, Green McCurtain, Principal Chief of the Choctaw Nation or tribe of Indians, the Chickasaw Nation or Tribe of Indians, D. H. Johnston, Governor of the Chickasaw Nation or tribe of Indians, Carrie M. Perry, the Coalgate Coal Co., Ed Morgan and to all other persons, corporations, tribes or nations..of Indians interested.

You, and each of you, are hereby notified, that

the undersigned referees, appointed by the Honorable Thomas Humphry, Judge of the United States court for the Central Judicial District of the Indian Territory, to determine and appraise all compensation and damages to be paid by reason of the condemnation and appropriation of the following described land, to be used by the Missouri, Kansas & Texas Railway company for right-of-way for branch lines to mines near Goalgate, Choctaw Nation, Indian Territory, to-wit:

"A strip of ground 100 feet wide, being 50 feet on each side of the center line of each of the branch lines as shown on the map filed with the Department of the Interior October 8, 1904. Said branch lines being described as follows:

1. A spur track to mine number 10 of the South-western Development Co., leading from a connection with the spur to said company*s mine No. 9 in the southeast quarter of section 13, T. 1 N., R 10 E., at a point about 1490 feet north and 2840 feet east of the southwest corner of said section southerly a distance of 50-100 mile to a point in the northeast quarter of section 24, township and range aforesaid, about 780 feet south and 3250 feet east of the northwest corner thereof, said right-of-way containing 5 51-100 acres, more or less.

McDougall shaft lying outside of the townsite of Goalgate, extending from a point in the north line of said townsite about 1150 feet north and 668.8 feet east of the center of section 23. T. IN., R 10' E westerly 99-100 of a mile to a point in the northeast quarter of section 22, town-ship and range aforesaid, about 1160 feet south and 1440 feet west of the northeast corner thereof, said right-of-way containing 12 9-100 acres, more or less.

The right-of-way 100 feet wide, for both of said branches, outside of the townsite of Qoalgate, containing in the aggregate 17 60-100 acres, more or less".

Will meet at Atoka, Choctew Nation, Indian Territory, on the 22nd day of July, 1905, in the office of J. O. Ralls, at 9 o'clock a. m., and at said time and place proceed with the assessment of damages and the compensation for the appropriation of said land for the purposes above stated, and will adjourn from time to time at said time and place provided their labors are not determined, and until their labors in this behalf are completed, at which time and place, and such other times and places to which the undersigned referees may adjourn, you, and each of you, and all persons and parties, cor-poration or corporations, nations or tribes of Indians, owning or having any interest in or title to the above described land, or any part thereof, may appear and be

heard.

And you, and each of you, are hereby further notified that we, the undersigned referees, will ascertain and set forth in our report the names of the person or persons, corporation or corporations, tribe or tribes or nation or nations of Indians to whom such damages are payable, and the interest of each person, corporation, tribe or nation in the award of said damages.

the Central Judicial District of the Indian Territory, to determine an appraise all compensation and damages to be paid by reason of the condemnation and appropaiation of the following described land, within the townsite of Coalgate, to used by the said Missouri, Kansas & Texas Railway Company for right-of-way for branch lines to mines near Coalgate, Choctaw Nation, Indian Territory, to-wit:

" A strip of ground 100 feet wide, being 50 feet on each side of the center line of the extension to McDougall*s shaft, as shown on the map filed with the Department of the Interior, October 8, 1904; the portion of said extension lying within the limits of the townsite of Coalgate being described as follows: starting from the point on the branch to McDougall's slope in the Northeast quarter of section 23, T. 1, N., R# 10 E., about 1530 feet South and 1340 feet West of the Northeast corner thereof, westerly 12-100 of a mile to a point in the North line of said townsite of Coalgate about 1150 North 668.8 feet East of the center of said section 23, said right-of-way containing 1 10-100 acres, more or less."

Having been presented to the undersigned Judge will meet at Atoka, Choctaw Nation, Indian Territory, on the 22 day of July, 1905, in the office of J. G. Ralls, at 9 o'clock a. m., and at said time and placed with the assess-ment of damages and the compensation for the appropriation
