IntroductionDublin City Council recognises that street performance is a time honoured art form which enhances the attractiveness and colour of the City. It makes an important contribution to our cultural life and is greatly enjoyed by residents and visitors alike.Dublin is renowned for its artistic and cultural life and Dublin City Council actively encourages performers to showcase their talent in the city. The Council is also committed to providing an accessible, safe and welcoming environment for all who live in, work in or visit Dublin City. While acknowledging the valuable contribution street performance and busking makes to the vitality of the City, the Council also recognises the importance of having in place a structured policy to maintain the amenity and ambiance of the public realm and to minimise complaints and other issues that arise.This Code of Practice will provide a framework to assist street performers, businesses, visitors and residents of the City to become familiar with the Street Performers Bye-Laws 2015 and gain an understanding of how they will be applied in a manner consistent with overall public interest.

PrinciplesStreet Performers make an important contribution to the Arts and the cultural life of Dublin City.

• Street Performance helps create an ambient and vibrant atmosphere which is greatly appreciated by many people, both tourists and members of the public.

• A balance is necessary to ensure that street performances do not cause nuisance, disturb public amenity or adversely affect the ability of commercial premises to conduct business, the right of local residents to peace and quiet and the safe passage of pedestrians.

• Compliance with the Code of Practice and, in particular, responsible use of amplificationwillminimisecomplaints,criticismandotherissuesassociatedwith Street Performance while supporting the rights of the performers to express themselves.

LegislationIn exercise of the powers conferred by Section 199 of the Local Government Act 2001 the Elected Members of Dublin City Council voted on 2nd February 2015 to make the StreetPerformersBye-Laws2015. The Bye-Laws came into effect on 7th April 2015.

What is Street Performance?TheBye-LawsdefineStreetPerformanceasanytypeofperformanceor exhibition where the performer has a reasonable expectation or opportunity of receiving donations from members of the public. Suchaperformanceorexhibitionincludes:

• Playing of musical instruments.

• Singing and/or dancing, musical or theatrical performance.

• Acting, pantomiming, puppeteering, juggling, reciting prose or poetry.

• Magic, balloon modelling, circus based skills, clowning, human statues.

• Pavement art, visual art, 3-dimensional or other art created through shaping solid material such as wood, stone, clay, sand or metal by carving, modelling or similar methods.

• Sculpture, drawing or painting applied to paper, canvas, cardboard or similar medium through use of brush, pastel, crayon, pencil, stylus or other similar object.

• Anyothertypeofperformanceorexhibitionnotspecificallylistedbutwhichissimilar in character.

ThefollowingarenotconsideredtobeStreetPerformance:

• Vending, trading or selling of any kind.

• Political or religious rallying.

• Face painting, caricature painting or other art offered for sale.

• Tarot card or palm reading.

• Advertising or promotional performances.

PermitsA person may not perform in a public place without a Street Performance Permit issued by Dublin City Council.

There are two types of permit:1.Street Performance Permit €30 per annum2.Permittouseamplification€60 per annum

The standard Street Performance Permit will apply to all performers.ThePermittouseAmplificationisanadditionalrequirementfor performersthatuseamplificationofanysortaspartoftheiract.Ifyouuseamplificationaspartofyouractyouwillrequireboth permits.

Applying for a Permit

A person may apply for a Street Performance Permit by submitting a completed application form, the appropriate fee, two recent photographs and evidence of identity to Dublin City Council.

Applying for a Permit (under 18 years of age)

Where the applicant is under 18 years of age the application form must be signed by that person’s parent or guardian.

Duration of Permit

Street Performance Permits will be valid for 1 year from the date of issue.

Display of Permit

Street Performance Permits will contain a photograph of the holder and must be on display and clearly visible at all times during a performance in a public place. Street Performers must allow inspection of the permit by any person authorised by Dublin City Council and members of An Garda Siochána.

Performance Location and TimesFor the moment Dublin City Council has not designated locations or pitches where street performance is permitted. Street Performers may therefore choose any location to perform once it is not a prohibited place and the relevant Bye-Laws are adhered to.

Prohibited Places The Bye-Laws prohibit street performance at two locations in the city.

1.StreetPerformersmaynotperforminfrontoftheGeneralPostOffice(GPO)on O’Connell Street or anywhere in the vicinity on Henry Street and Prince’s Street North as shown on the map below (left).

2.In Temple Bar, Street Performers may not perform anywhere on East Essex Street and Temple Bar Street from the junction at Eustace Street to the junction at Fownes Street/Fownes Street Lower as shown on the map below (right).

Performance Times

The earliest time a street performance can commence is 9.00am. However, on pedestrian streets such as Henry and Grafton streets where vehicles have access for deliveries etc., in the interest of Health and Safety, street performance is not permitted before 11.00am.

All street performances must end by 11.00pm.

Reservation of Performance Locations and Mobility

A Street Performer cannot “reserve” a location by arriving early and waiting to perform.Monopolising or “hogging” a performance location is not permitted and Street Performers must not perform in the same location for more than twohours in any day. A Street Performer shall not perform within 50metres of another performer.When a Street Performer relocates it must be to a different street and at least 50metres from his/her previous location.

Behaviour and ConductStreet Performers must conduct themselves in a safe, professional manner and fully co-operate with other street performers, persons authorised by Dublin City Council and members of An Garda Siochána.A Street Performer should not use lewd or offensive language or conduct as part of their act. Street Performers must at all times ensure that no aspect of their performances endangers public safety.Street Performers must not charge members of the public a fee but may receive donations for their performance. Persistent or aggressive solicitation of donations is not permitted.Street Performers should note that in accordance with the Casual Trading Act 1995 the sale of CDs or other merchandise is not permitted.

Obstructions

Street Performers must show consideration for the public, businesses and residents on streets where they perform. A Street Performer must not block the entrance to any premises or residence. Performance within 3metres of the entrance to a business premises is not permitted during the opening hours of the business. Street Performance within 3metres of residential premises is not permitted at any time.Street Performers must ensure that no aspect of their performance blocks obstructs or interferes with the free and safe movement of pedestrians.Street Performers are solely responsible for their equipment, props and instruments. These must not be left unattended and Street Performers must ensure that they are not placed in such a way as to cause an obstruction in a public place.

Street Performers must keep the location they use clean while they are performing and ensure that it is left in the condition that it was found. Pavement artists and performers using props must ensure that the location is not stained with any chemical, material or residue.Street Performers should consult and co-operate with shopkeepers and other businesses outside whose premises they wish to perform.

Circle Acts

Street Performers who have a structured performance based on elements of street theatre, acrobatics, dance etc. and which may incorporate the use of dangerous props are commonly referred to as Circle Acts.Circle Act Performers should ensure that their location is appropriateandsufficientlylargeastoensurethattheactorthewatching crowd do not block or disrupt a street.Street Performers or Circle Act Performers using potentially dangerous props must hold public liability insurance and indemnify Dublin City Council. A copy of the insurance certificatemustbesubmittedwiththeapplicationform.Ifthe insurance expires before the permit expires, the Permit holder mustsubmitacopyofthenewinsurancecertificate.Due to the nature of their performances Circle Acts must ensure there is a clear separation between the performers and the audience.

Amplification and Sound LevelsFor those living or working in the city centre street performance can be intrusive

and annoying and the majority of complaints made about Street Performers relate to noiselevelsandexcessiveamplification.In order to achieve a balance between the sound generated by a street performance and the potential nuisance it can cause

certain additional measures and restrictions are necessary.Street Performers who wish to use amplificationaspartoftheiractmustapplyfor an additional permit for the use of such equipment. A standard Street Performance Permitdoesnotcoveranamplifiedperformance.

Onlybatterypoweredamplificationis permitted and Street Performers must not connect any equipment to any building or mains power source using a cord or wire cable.The noise levels from a street performance must not unreasonably intrude into nearbyshops or residences and must not interrupt trade of local businesses or cause a loss of amenity. The maximum sound level permitted is 80decibels in the immediate vicinity of a Street Performance. The only exception to this is in the entire Temple Bar area where the sound level must not exceed 75decibels. Periodic monitoring of sound levels with a decibel meter will be carried out to ensure that the levels are not being exceeded.Street Performers must comply with a request from a person authorised by Dublin City Council or a member of An Garda Siochána to reduce their volume.

OffencesOffences under the Bye-Laws include:

• Contravention by any person of a Bye-Law.• Refusal to comply with a request of a person authorised by Dublin City

Council or a member of An Garda Siochána.• Refusal to provide name and address or providing a false name and address

to a person authorised by Dublin City Council or a member of An Garda Siochána.

Fixed Payment Notices

An authorised person or a member of An Garda Siochána may serve a Fixed Payment Notice on a person who has contravened a Bye-Law. Thefixedpaymentis€75.A Fixed Payment Notice will specify the name and address of the alleged offender together with details of the alleged contravention and the date and place where it occurred.Ifthefixedpaymentispaidwithin28daysfromthedateofthenoticenolegalproceedings will be instituted.

Revocation of Permit

Dublin City Council will revoke or not renew a Street Performer Permit where the permit holder persistently contravenes or fails to observe the Bye-Laws.When the Council decides to revoke a Street Performer Permit written notificationofthedecisionwillbedeliveredbyhandtotheStreetPerformer.Where a Street Performance Permit is revoked the holder of the Permit must surrender the Permit to a person authorised by Dublin City Council or a member of An Garda Siochána.Failure to surrender a Street Performance Permit when requested to do so is an offence under the Bye-Laws.

Appeals

A Street Performer whose Street Performance Permit has been revoked or has an application to renew a permit refused by Dublin City Council may appeal the decisiontotheAdministrativeOfficerwithresponsibilityfortheStreet Performance Bye-Laws. AStreetPerformerwhohasmadeanappealtotheAdministrativeOfficerandwhoisdissatisfiedwiththeresultofthatappealmaymakeafurtherappealtoaSeniorExecutiveOfficerintheCulture,Recreation,AmenityandCommunityDepartment

Complaints

Any person who considers that a Street Performer is causing them nuisance shouldinthefirstinstanceadvisetheStreetPerformeroftheproblemand request that he/she desists.If a person considers that a Street Performer has not complied with a reasonable request and/or is contravening the Bye-Laws, he/she should contact Dublin City Council (details below) or a member of An Garda Siochána.Where possible the Street Performer’s Permit number should be noted and passed on.

Miscellaneous

Review of the Bye-Laws

TheCouncilhastherighttotemporarilyprohibitperformancesinaspecified location to allow construction, repair or other works on or near the location.Activities or events in a public place which are organised by Dublin City Council or have received consent from the Council are exempt from the Street Performers Bye-Laws.A Street Performer who is hired by a private organisation as part of an approved event does not require a Street Performance Permit.

The Street Performers Bye-Laws 2015 will be reviewed after an operational period of six months.

Dublin City Council Street Performers Bye-Laws 2015

Long Title:

The Lord Mayor and Members of Dublin City Council (hereinafter referred to as “The Council”) in exercise of the powers conferred on them by Section 199 of the Local Government Act 2001, hereby make the following Bye-Laws in relation to the Control of Street Performers in the administrative area of Dublin City Council.

Preliminary:

Short Title: These Bye-Laws may be cited as the Street Performers Bye- Laws 2015

Area of Application: These Bye-Laws apply to the administrative area of Dublin City Council.

Commencement Date: These Bye-Laws shall come into effect on the 7th April 2015.

Definitions: In these Bye-Laws the following words or phrases shall have the meanings hereby expressly given to them that is to say:-

The Act: Means the Local Government Act, 2001

Amplification: Means using an electronic device to increase the volume of a musical instrument.

Authorised Person: Means a person authorised in writing by the Council pursuant to and for the purposes of Section 204 of the Local Government Act 2001 or a member of An Garda Siochána.

Circle Act: Means street performers that have a structured performance or routine that requires the audience to stop, watch and/ or participate. Performances may incorporate elementsofstreettheatre,puppetry,dance,comedy,fire manipulation, juggling and acrobatics and may involve the use of dangerous properties as part of the act.

Dangerous Properties Meanssubstancesthatareflammable,toxicor hazardous and items including but not limited to sharp implements or those that pose a risk /capable of causing bodily harm such as swords, knives and axes.

Public Place: Means any street, road, footpath, open space, beach, public park, green space and amenity areas, including the Liffey Boardwalk, and such like places in the charge or ownership of Dublin City Council.

Perform: Means to engage in any type of performance or exhibition with the reasonable expectation or opportunity of receiving donations and without prejudice to the generality such performance or exhibition shall include playing musical instruments, singing, dancing, acting, pantomiming,puppeteering, juggling, reciting, engaging in magic, circus based skills, human statues, balloon modelling, street theatre, poetry or acts of a similar nature, clowning, pavement art, musical or theatrical performance skills, creating visual art, three dimensional work of art which is created through shaping solid material such as wood, stone, clay, sand or metal by carving, modelling or similar methods, in its entirety, or similar artistic endeavours, sculptures or draw ings and paintings, applied to paper, cardboard, canvas, or other similar or technologically equivalent medium through the use of brush, pastel, crayon, pencil, stylus, or other similar object or do ing other acts of a similar nature in a public space and any other type of performance or exhibition not specificallylistedbutwhichwouldbesimilarin character; and the words Performance and to Perform shall be construed accordingly.

Permit Holder: Means a person who holds a Street Performance Permitand/oraPermittouseAmplification.

Street Performer: Means a person who performs in a public place.

Street Performance Permit: Means a Permit to perform in a public place issued under these Bye Laws

Permit to use Amplification: Means a Permit issued to a Street Performer under these Bye-Laws to use amplification.

Prohibited Place: Means any place outside the GPO as shown highlighted on map index SM-2015-0085, any place on the street known as Temple Bar between the junction at Fownes Street/Fownes Street Lower and the junction at Temple Lane South and any place on East Essex Street between the junction at Temple Lane South and the junction at Eustace Street. The prohibited places in Temple Bar are as shown highlighted on map index SM-2015-0040.Permits: 1. A person may not perform in a public place without a Street Performance Permit issued by the Council.

1. (a) A person may not perform in a prohibited place with or without a Street Performance Permit issued by the Council.

2. A person may apply for and be granted a Street Performance Permit by the Council upon completion of the requisite application form for a permit, payment of the fee and on the production of evidence of identity together with two recent photographs of the applicant.

2. (a) The permit granted will be valid for 1 year from the date of issue.

2. (b) ThecostoftheStreetPerformancePermit(withoutamplification)will be €30 per annum.

3. A Street Performer will require an additional permit if they wish to use amplification.

3. (a) ThecostofaStreetPerformancePermitfortheuseofamplification will be €60 per annum.

4. All permits granted will contain a photograph of the permit holder and must be on display and clearly visible at all times during a performance in a public place.

4. (a) The permit holder must be present at all times during a performance.

Performance Times:

5. A Street Performer shall not perform in a public place after 11pm and before 9am on any day SAVE AND EXCEPT on pedestrianised streets where a person shall not perform before 11am.

6. AStreetPerformerisonlypermittedtoperforminaspecificlocationfora maximum period of two hours in any day. After this two hour period he/she must re-locate to a different street not within 50 metres of his/her previous location.

7. A Street Performer shall not “reserve” a location/area i.e. arrive prior to performance and wait.

Instruments/Equipment/Properties:

8. A Street Performer who performs in a public place shall be solely responsible for his/her instruments, equipment and props and shall not leave them unattended in a public place and shall remove them from the public place at the end of his/her performance.

9. The sound produced in the immediate vicinity of a Street Performer or Street Performers during a performance shall not exceed 80 decibels, SAVE AND EXCEPT in Temple Bar, as shown highlighted on map index SM-2015-0084, where the sound produced in the immediate vicinity of a Street Performer or Street Performers during a performance shall not exceed 75 decibels.

10. A Street Performer or Circle Act using potentially dangerous properties in a performance in a public place must hold public liability insurance of at least €6.4 million and indemnify Dublin City Council.

11. A Street Performer shall not connect to or maintain an electrical connection by way of a cord or wire to an adjacent building or to any mains power source.

Charges:

12. A Street Performer shall not charge Members of the Public a fee for a performance in a public place. Members of the public may however leave or give money to Street Performer.

13. A Street Performer shall not use any measures to solicit donations from the public other than a receptacle for receipt of donations.

Without prejudice to the generality of this bye-law such measures shall include: blocking or impeding the passage, going behind, ahead or alongside a person with the intent to solicit a donation or to intimidate, coerce or threaten, by word or gesture, a person into making a donation.

Obstructions:

14. A Street Performer shall not obstruct the public’s access to and egress from any premises.

15. A Street Performer shall immediately cease performing if the crowd they have attracted is blocking a street.

16. A Street Performer shall not perform within 50 metres of another performer.

17. A Street Performer shall not perform in a public place within 3 metres of the outer edge of the entrance to any business or premises including, but not limited to: doors, vestibules, driveways, outdoor dining areas, entries, and emergency exits, during the hours that the business on the premises is open to the public or to persons having or conducting business in those premises.

17. (a) A Street Performer shall not perform in a public place within 3 metres of the outer edge of any residence at any time.

18. A Street Performer with instruments, equipment or props shall not block, obstruct or interfere with the free and safe movement of pedestrians.

Health and Safety:

19. A Street Performer shall at all times ensure that no aspect of his/her performance endangers the public safety in his/her use of the public place.

Miscellaneous:

20. TheCouncilmayprohibitperformancesinaspecificpublicplaceona temporary basis by Executive Order in order to facilitate the construction, development, maintenance or repair of a public place or part thereof or for other infrastructural work thereon or such work on adjoining private property or for other operational reasons.

Exemptions:

21. These Bye-Laws shall not apply to activities taking place in a public place that are organised by the Council or are activities that have received consent from the Council by way of event approval or have received a Public Event Licence under Part XVI of the Planning and Development Act 2000.

Offences:22. Any person who contravenes any bye-law shall be guilty of an offence and shallbeliableonsummaryconvictiontoafinenotexceeding€1500.

23. A person who obstructs or impedes or refuses to comply with a request of an authorised person acting in the exercise of the functions conferred on an authorised person by the Act or a member of An Garda Siochána shall be guilty ofanoffenceandshallbeliableonsummaryconvictiontoafinenotexceeding €1500.

24. Where an authorised person or a member of An Garda Siochána is of the opinion that a person is committing or has committed an offence under either of the two preceding bye-laws the authorised person or member of An Garda Siochána may demand the name and address of such a person and if that demand is refused or the person gives a name and address which is false or misleading, that person shall be guilty of an offence and shall be liable on summaryconvictiontoafinenotexceeding€1500.

25. Pursuant to Section 204 (3) (d) of the Act where a member of An Garda Siochána is of the opinion that a person is committing or has committed an offence under the preceding three bye-laws, that member may arrest the person without warrant.

Fixed Payment Notice:

26. Where a Bye Law is contravened an authorised person or a member of the Garda Siochána may serve a Fixed Payment Notice in respect of the contravention. The Notice shall specify the name and address of the alleged offender and in general terms the nature of the contravention alleged to have been committed; and the date and place of the alleged contravention. The Noticeshallstatethatifthefixedpaymentof€75ispaidtotheCouncilwithin a period of 28 days that no legal proceedings will be instituted against the person in respect of the alleged offence. The Notice shall contain a statement to the affect that the alleged offender is entitled to disregard the Notice and defend a prosecution of the alleged contravention in Court.

27. Any permit issued by the Council may be revoked or not renewed in circumstances where the holder of the permit persistently contravenes or fails to observe these Bye-Laws, whether prosecuted or not for such repeated contraventions; provided however written notice is given to the holder by the Council of each such alleged breach and the applicant is given an opportunity to reply.

Appeals

28.
