AGREEMENT 1

Agreement entered , 20 between Oregon Nurses Association, hereinafter 2

referred to as the “Association,” and Columbia Memorial Hospital, hereinafter referred to 3

as the “Hospital.” 4

PREAMBLE 6

Whereas the parties hereto desire to cooperate in establishing conditions which 7

will tend to secure to the registered professional licensed nurses a living wage and fair 8

and reasonable conditions of employment, and to provide methods for fair and peaceful 9

adjustment of all disputes which may arise between them so as to secure uninterrupted 10

operation and continued high standards of nursing practice and patient care. 11

Now, therefore, be it mutually agreed to as follows: 13

14

ARTICLE 1. RECOGNITION AND MEMBERSHIP (TA 5/9/19) 15

Section 1. The Hospital recognizes the Association as the collective bargaining 16

representative with respect to wage rates, hours of work, and other conditions of 17

employment for a bargaining unit composed of all categories of registered nurses 18

including Patient Care Coordinators and Charge Nurses employed by the Hospital. The 19

Hospital shall not challenge the status of bargaining unit nurses or assert that 20

bargaining unit nurses are supervisors. 21

Section 2. The Hospital agrees to issue each new nurse a copy of this 23

Agreement, as provided by the Association. During the orientation process for new 24

nurses, a designated Association member will be given a chance to give a 15-minute 25

presentation on paid time about the Association and joining the Association at the 26

orientation. 27

Section 3. The Hospital encourages nurses to be actively involved in the 29

professional activities of their professional organizations. 30

Section 4. Nurses will have access to the use of a conference room for 31

bargaining unit meetings, as scheduled in advance and as available. 32

Section 5. On a monthly basis the Hospital will supply the Association 34

electronically with a list of all bargaining unit nurses which includes their names, 1

addresses, telephone numbers, employee identification numbers, shift (day, night, 2

evening or variable), units or assignments, and employment status, as that information 3

exists in the Hospital’s records. It also will include initial job assignments of nurses 4

hired into the bargaining unit since the last report. 5

ARTICLE 2. NON-DISCRIMINATION (TA 5/9/19) 7

In the application of this Agreement, there shall be no discrimination in violation 8

of applicable federal and state laws against nurses because of race, color, religion, 9

national origin, sex, sexual orientation, age, physical or mental disability, veterans 10

status, gender, gender identity, gender expression, Association membership, or any 11

other status or characteristic protected by any applicable law. Where the masculine or 12

feminine gender has been used in any job classification or provision of this Agreement, 13

it shall be deemed to refer to all sexes and is not intended and shall not be deemed to 14

limit job eligibility or the application of any provision of this Agreement to members of 15

any sex. 16

ARTICLE 3. DUES/FAIR SHARE 18

The Hospital will deduct Association membership dues, or payments in lieu of 19

dues, from the wages of each nurse who voluntarily agrees to such payroll deductions 20

and who submits an appropriate written authorization to the Hospital setting forth 21

standard amounts and times of deductions. Deductions shall be made and remitted 22

monthly. 23

All nurses hired on or after June 1, 1993 shall be required to select one of the 25

following options: 26

27

1. Within thirty (30) days of completion of their first ninety (90) calendar days 28

of employment, join the Association and maintain dues payments as established by the 29

Association, or 30

31

2. Within thirty (30) days of completion of their first ninety (90) calendar days 32

of employment, begin making payments in lieu of membership, at a fair share rate 33

equivalent to, or less than, Association dues, as established by the Association, to 34

either Lower Columbia Hospice, Columbia Memorial Hospital Foundation, or the 35

Nurses required to maintain membership or in-lieu-of payments who fail to do so 3

shall be provided written notice by the Association that they must furnish evidence that 4

they have complied with the obligation of this Article. A copy of such written notice shall 5

be provided to the Director of Human Resources. 6

7

Nurses who receive such written notice shall be given fourteen (14) calendar 8

days in which to demonstrate compliance with this Article. If the nurse has not 9

demonstrated such compliance within the fourteen (14)-calendar-day period, the 10

Association may request termination of the nurse. The request must be made in writing 11

to the Director of Human Resources. The Hospital will then have seven (7) calendar 12

days to investigate the situation, and if the Hospital’s investigation establishes that the 13

nurse failed to comply with the requirements of this Article, the employment of the nurse 14

will be terminated within fourteen (14) calendar days’ notice, pursuant to the 15

Association’s request. 16

ARTICLE 4. PERSONNEL CATEGORIES 2

Section 1. During or at the completion of a nurse’s probationary period, the 3

manager will determine whether any step advancement is appropriate. The parties 4

recognize that the probationary review will not result in an automatic increase and that 5

the decision regarding any adjustment is in management’s sole discretion. 6

7

Section 2. Definitions 8

A. “Nurse” is defined as a registered nurse licensed by the State of Oregon. 9

10

B. “Full-time nurse” is defined as a nurse scheduled a minimum of seventy-11

two (72) hours per pay period. 12

13

C. “Part-time nurse” is defined as a nurse scheduled a minimum of at least 14

forty (40) hours but less than seventy-two (72) hours per pay period. If a part-time 15

nurse averages seventy-two (72) hours or more per pay period for more than six 16

months, the position will be reassessed to determine if the need has changed. If, as a 17

result of this reassessment, the Hospital determines that the need has changed, the 18

part-time nurse who has been working the additional hours shall be offered the 19

opportunity to reclassify to full-time status prior to posting a full-time or part-time 20

position. If a part-time nurse’s average scheduled hours (measured on a rolling six-21

month basis) drop by 30% or more for a period of three months, the nurse may appeal 22

such drop in hours. Any such appeal is to be raised, in writing, with human resources. 23

Human resources and the Vice President of Patient Care will review the hours reduction 24

and determine if there was an internal adjustment that has caused the reduction in 25

hours. If it is determined that an internal adjustment caused the reduction in hours, then 26

human resources and the Vice President of Patient Care will conduct a further review to 27

determine 1) if there is a means by which some scheduled hours can be reinstated to 28

the nurse, or 2) some other adjustment needs to be made, consistent with this 29

Agreement. 30

E. “Relief nurse” is defined as a nurse scheduled at least one (1) regular shift 32

per month, but less than forty (40) hours per pay period. Relief nurses shall provide 33

availability of fifteen (15) shifts per month, including at least one weekend shift and one 34

open call shift per month if working in a department with required call shifts. Holiday 35

requirements are the same as intermittent nurses (see Section 5(F), below). 1

Management may waive some or all of these requirements for periods of time, 2

depending on the circumstances. 3

F. “Intermittent nurse” is defined as a nurse not scheduled on a regular basis 5

and has no guarantee of hours. An intermittent nurse must submit work availability for 6

at least three (3) open shifts in a rolling three (3) month calendar period, one of which 7

must be on a weekend. For intermittent nurses working in departments with scheduled 8

call, an intermittent nurse also must submit call availability for at least one (1) call shift in 9

a rolling three (3) month calendar period. In addition, an intermittent nurse also must 10

submit availability for work and/or call for at least two (2) holidays per year, which must 11

include Thanksgiving, Christmas Eve, Christmas Day, New Year’s Eve, or New Year’s 12

Day as one of the holidays, in order to maintain employment. Management may waive 13

some or all of these requirements for periods of time depending on the circumstances. 14

15

Note: On a voluntary basis, relief and intermittent nurses may at times be 16

scheduled forty (40) or more hours per pay period due to vacations, etc., but not 17

consistently. If a relief or intermittent nurse averages forty (40) or more hours per pay 18

period for more than six (6) months, the position will be reassessed to determine if the 19

need has changed and the position will be posted. 20

Relief and intermittent nurses must provide availability by the first day of the 22

month prior to the schedule being posted. If the nurse does not meet the requirements 23

of this Section E or F, the nurse may be removed from employment upon written notice 24

from the Hospital. The nurse will have fifteen calendar days to provide availability, prior 25

to termination. 26

G. “Probationary nurse” is defined as a newly hired nurse (not transferred 28

from a different unit) who has not completed a probationary period of ninety (90) 29

calendar days from date of employment for full-time and part-time nurses and between 30

ninety (90) and one hundred fifty (150) calendar days from date of employment for relief 31

and intermittent nurses, as determined by management. The probationary period may 32

be extended up to sixty (60) days by written mutual agreement of the manager and 33

nurse. 34

H. “Temporary nurse” is a nurse filling a temporary position not exceeding 1

one hundred and fifty (150) calendar days or hired as a replacement for an employee 2

with reinstatement rights provided by applicable federal or state law or hired for a 3

position on a temporary assignment. A temporary position is not posted under Article 9 4

unless it is expected to last more than one hundred and fifty (150) calendar days. In a 5

situation presenting an unexpected staffing need, the Hospital may assign a nurse on 6

an interim basis while following the posting requirements of Article 9. 7

ARTICLE 5. NURSE ORIENTATION (TA 5/31/19) 2

The Hospital agrees to provide a new-employee orientation to all newly-hired 3

bargaining unit nurses. The objectives of the orientation process shall include, but not 4

limited to, the following: 5

1. To familiarize new nurses with the objectives and philosophy of the 6

Hospital. 7

2. To familiarize new nurses with nursing services provided by the Hospital. 9

10

3. To orient new nurses to the nurse’s job description and responsibilities at 11

the Hospital. 12

13

4. To orient new nurses to Hospital policies and procedures. 14

15

The orientation shall be based upon the experience, qualifications and expressed 16

needs of the nurse and shall be concluded before the nurse is counted in the staffing 17

complement of the unit. The nurse will meet with the preceptor and nurse manager on a 18

weekly basis during orientation. The decision to take a nurse off of orientation will be 19

made by consensus of the nurse, preceptor and nurse manager. In the event that there 20

are unresolved issues during the orientation period or a consensus cannot be reached 21

to end orientation, the issue(s) and/or case will be reviewed by the Chief Nurse 22

Executive, who will have the final decision-making authority. 23

Managers may obtain input on the orientation process for their unit from the 24

UBNPC. 25

ARTICLE 6. WORK SCHEDULE 2

Section 1. A normal workday shall consist of eight (8) hours excluding lunch. 3

Meal and Rest Periods: 4

For eight (8) and ten (10) hour shifts, one fifteen (15)-minute paid rest period will 6

be taken every four (4) hours worked, or major portion thereof. One thirty (30)-minute 7

unpaid meal period will be taken every eight (8) hours worked, or major portion thereof. 8

For twelve (12) hour shifts, one fifteen (15)-minute paid rest break shall be taken 9

during the first four (4) hours worked, one thirty (30)-minute unpaid meal period shall be 10

taken approximately halfway in the schedule, and one thirty (30)-minute paid rest break 11

shall be taken in the second half of the schedule. 12

It is understood by the Hospital and the Association that every reasonable 14

attempt will be made to provide nurses with required breaks, and that it is the 15

expectation that nurses will take required breaks. 16

17

If a nurse is unable to take his/her break as scheduled, or is interrupted, s/he 18

shall contact the unit’s charge nurse/PCC, manager/supervisor or house supervisor, 19

who shall make every reasonable attempt to have the nurse relieved as soon as 20

possible. 21

22

Managers or supervisors, or their designee, shall schedule nurses’ meal periods. 23

The unit manager will consider input from nurses in the unit to attempt to develop 24

creative and flexible approaches to scheduling meal periods. The scheduling process 25

may not violate the unit’s staffing plan. Nurses will be responsible for taking meal 26

periods when scheduled, unless urgent/emergent patient care needs require otherwise. 27

If a nurse is unable to take his or her meal period as scheduled, or is interrupted, the 28

nurse shall contact a manager or supervisor immediately (or as soon as possible if 29

engaged in an urgent/emergent patient care need). The manager/supervisor or house 30

supervisor shall make arrangements to have the nurse relieved as soon as possible. A 31

nurse who does not receive a thirty (30)-minute uninterrupted meal period during a shift 32

of eight (8) or more hours shall be paid for the time worked by entering a “missed meal” 33

in Kronos. 34

Mandatory Missed Meals: If a nurse has not had a meal period within four-and-1

a-half (4.5) hours after the start of the shift (for eight (8) and ten (10) hour shifts; six-2

and-a-half (6.5) hours for twelve (12) hour shifts) and informs his or her nurse manager 3

or the house supervisor about that fact immediately (or as soon as possible if engaged 4

in an urgent/emergent patient care need), and is then told by the nurse manager or the 5

house supervisor that the nurse will not be able to begin the meal break prior to six and 6

one-half (6.5) hours after the start of the shift (for eight (8) and ten (10) hour shifts; nine-7

and-a-half (9.5) hours for twelve (12) hour shifts), the nurse will be paid a premium of 8

ten dollars ($10) for that day. The nurse manager or house supervisor must note the 9

requirement for the nurse to work through meal period on an exception sheet (or initial 10

the employee’s notation) for the premium payment to be made. Payment will be 11

included in the next regular paycheck. 12

Nursing mothers: Nursing mothers will receive an additional fifteen (15) 14

minutes of unpaid time per rest break in order to express milk, and will be provided a 15

private location in which to do so. 16

17

Hospital-laundered clothing: Nurses who are required to wear Hospital-18

laundered uniforms in order to perform their assigned work will be given a maximum of 19

seven (7) minutes after the beginning of their regular shift and seven (7) minutes prior to 20

the end of their regular shift to clean up and change clothes. 21

22

Section 2. The basic work period (pay period) shall be eighty (80) hours every 23

two-week period, beginning at 2245 hours every other Saturday. 24

25

For alternative work schedules other than eight (8) hours per day, the Hospital 26

may designate a workweek of forty (40) hours in seven (7) days beginning at 2245 27

hours every Saturday. 28

29

Section 3. Nurses will not be scheduled to work three (3) consecutive weekends 30

without their written approval. Nurses shall be scheduled to receive every other 31

weekend off whenever possible. 32

33

Section 4. Working above the weekend and/or holiday requirements, or 34

alternative schedules, requested in writing by the nurse, may be arranged by mutual 35

Section 5. Work schedules shall be posted by the 15th of the prior month. If the 3

15th falls on a weekend when the department is not open, the schedule shall be posted 4

prior to the department closing for the weekend. 5

Section 6. Nurses who are scheduled to report for work, and who are permitted 7

to come to work without receiving a minimum of two (2) hours’ prior notice that no work 8

is available in their regular assignment, shall perform any nursing work to which they 9

may be assigned and for which the Hospital has determined they are qualified on the 10

basis of relevant skill, education and nursing experience. When the Hospital is unable to 11

utilize such nurse and the reason for lack of work is within the control of the Hospital, 12

the nurse shall be paid an amount equivalent to four (4) hours at step wage plus 13

applicable differential. A nurse who was scheduled to work less than four (4) hours on 14

such day shall be paid for regularly-scheduled number of hours of work for reporting 15

and not working. The provisions of this Section shall not apply if the lack of work is not 16

within the control of the Hospital or if the Hospital makes a reasonable effort to notify the 17

nurse by telephone as stated above in this Section. 18

19

Section 7. It shall be the responsibility of the nurse to notify the Hospital of the 20

nurse’s current address and telephone number. Failure to do so shall excuse the 21

Hospital from notification requirements and the payment of the above minimum 22

guarantee. 23

24

Section 8. Shift Rotation. Shift rotation is defined as a schedule deviation 25

outside of a full-or part-time nurse’s primary shift. For example, a nurse’s primary shift is 26

day shift but is scheduled a night shift. In the event that a manager must consider shift 27

rotation, the manager shall first assign rotation on a voluntary basis. If there are not 28

enough volunteers, the rotation will be assigned in reverse seniority order, starting with 29

the least senior nurse, unless a less senior nurse does not possess the necessary skill 30

set or experience. The Hospital will maintain a list to document the rotation. 31

Section 9. Changes in Shift Length to Alternative Shift. 32

In a department where a simple majority of all full- and part-time nurses vote in favor of 33

an alternative (i.e., 10, 12 hour) shift, a change may be implemented. Where mutually 34

agreeable to the Employer and the individual nurse, a standard shift may be for a length 35

ARTICLE 7. FLOATING 2

Floating will be utilized when patient needs require additional staff. Floating shall 3

be used prior to dock or dock standby, in accordance with patient care needs. Nurses 4

who are working the day as an extra shift at the request of the hospital may request to 5

be docked in lieu of floating. 6

There are three levels of floating: 7

1. Floating as a sitter/performing CNA duties. No additional compensation. 8

2. Floating to work in partnership with a nurse from the unit, utilizing “Basic 9

Nursing Competencies.” Nurses will be paid an additional $1.00 per hour. 10

3. Floating to assume a full patient assignment. Nurses will be paid an additional 11

$2.00 per hour. 12

Nurses who have completed cross-training may be given a full patient 13

assignment, in accordance with patient care needs (Level 3). Nurses who have not 14

completed cross-training may be assigned based on the “Basic Nursing Competency” 15

list that all nursing staff complete on hire (Level 2). This competency list will be 16

reviewed annually by PNCC for content and completeness. Updates will be made as 17

needed. 18

Unit specific orientation will be completed when there is adequate staff available 19

to train. This needs to be approved by the department manager where the employee is 20

being oriented. 21

ARTICLE 8. REQUESTS OFF 25

Section 1. The Hospital attempts to grant requests for planned days off. 26

Scheduling of such requests is determined by the needs of the Hospital as determined 27

by the appropriate manager. Such requests shall not be unreasonably denied. 28

29

Section 2. All requests off must be made to the manager and/or designee a 30

minimum of four (4) weeks but no more than twelve (12) months prior to posting the 31

work schedule. Employees must note on the request whether they will have enough 32

Earned Leave for the duration of the requested time off. All requests off for periods 33

longer than six (6) calendar days will be posted in the department and held open for a 34

minimum of fourteen (14) calendar days. The manager and/or designee shall respond in 35

writing within three (3) calendar days after the posting period with either an approval or 1

denial of the request with explanation. All requests for time off that are for six (6) 2

calendar days or less shall be approved on a first come, first served basis and should 3

be approved or denied, in writing, within fourteen (14) calendar days of the request. 4

Denied requests shall be held open and shall be first in line for approval if operational 5

needs permit approval of the request. Nurses denied an Earned Leave request also 6

may seek a shift trade with another nurse, with manager approval. (Note: The UBNPC 7

(or consensus of unit nurses where a UBNPC does not exist) may recommend a 8

different scheduling process for its specific unit, which may be adopted by the unit 9

manager. In the event the manager does not adopt the recommended process, s/he 10

will explain the reason to and discuss with the UBNPC. The process may be revisited 11

and adjusted in the event of a significant staffing increase or decrease. If a different 12

process is adopted through this procedure, it will override this Section, and the Hospital 13

will provide a copy of the process to the Association.) 14

15

Section 3. Approvals of requests off are subject to the nurse having enough 16

Earned Leave to cover the requested time off at the time it is taken. 17

18

Section 4. Nurses may request to use seniority to bump a vacation request 19

during the fourteen (14) day posting period referenced in Section 2, above. A nurse 20

cannot exercise this right of seniority more than once per year. Once an employee’s 21

request for time off has been granted, that request will not later be rescinded unless the 22

nurse does not have enough Earned Leave to cover the time off as provided in Article 23

19. 24

Section 5. Nurses who are unable to report to work as scheduled shall advise 26

the nurse supervisor/manager, as appropriate, at the earliest possible time, but no later 27

than two (2) hours prior to the start of the shift, of their inability to report to work. 28

ARTICLE 9. JOB POSTINGS 2

Section 1. When a bargaining unit position becomes available the Hospital shall 3

post the position online for seven (7) days before filling the position. Nurses must apply 4

online to be considered for the position. The Hospital will also provide a copy of the 5

postings to the designated Association nurse representative. The Hospital will 6

acknowledge each nurse’s application by email within seven (7) days. Job postings 7

shall include shift length, shift (day, night, evening or variable), and unit. 8

9

Section 2. The Hospital shall award the position to nurse applicants who meet 10

the minimum qualifications for the position, as stated in the job posting. Written 11

discipline beyond a documented verbal warning within the last eighteen (18) months 12

may be considered at the Hospital’s discretion when awarding a position. Subject to the 13

foregoing, position shall be awarded to applicants who meet the minimum qualifications 14

for the position, as stated in the job posting, in the following order: 15

A. The most senior nurse who has completed their probationary period and 16

works (home department) on the unit where the position is posted. 17

B. A nurse who has floated to the unit where the position is posted, and 18

taken a patient assignment, at least 144 hours in the previous twelve 19

months. 20

21

C. If there is no such nurse applicant on the unit or who has floated to the 22

unit in accordance with paragraph B, above, then the most senior nurse in the 23

bargaining unit. 24

25

D. If there is no such nurse applicant in the bargaining unit, then the nurse 26

outside the bargaining unit. 27

28

The name of the applicant who is awarded the job will be provided to the designated 29

Association nurse representative. 30

31

Section 3. Temporary positions expected to last more than ninety (90) calendar 32

days shall be posted for seven (7) calendar days before they are filled, although the 33

Hospital may assign any nurse to the position during the posting period. 34

Section 4. Posting requirements do not apply to interim fills or temporary 1

positions not expected to last more than one hundred and fifty (150) calendar days. In 2

appropriate circumstances, bargaining unit nurses may be given the opportunity to fill 3

any unscheduled shifts prior to contracting hours to agency or traveler nurses. 4

5

A. An interim fill results from an unexpected opening or an opening which 6

exists as a result of the temporary absence of a nurse who has the right to return to the 7

same position (such as an opening which exists during a nurse’s family or medical leave 8

of absence or vacation). 9

10

B. A temporary position is a vacancy which is not expected to last more than 11

ninety (90) calendar days and for which there is no incumbent. 12

13

C. At the point that the nurse who has the right to return to the position gives 14

notice of their intent not to return or a temporary position is found to be necessary to be 15

regular, the Hospital shall post the position in accordance with this Article. 16

17

Section 5. The Hospital will also post notices of any vacancies in nursing 18

positions outside the bargaining unit. It is recognized, however, that non-bargaining unit 19

positions are filled without regard to this Agreement. The Hospital also will provide a 20

copy to the designated Association representative of job postings for non-management 21

positions outside of the bargaining unit that require an RN license. 22

23

Section 6. When a nurse accepts a position in another department, they will 24

receive a performance review within ninety (90) days of the transfer. For relief and/or 25

intermittent nurses, the Hospital, in its discretion, may extend the period in which to 26

provide a performance review by up to six (6) months if the Hospital determines that the 27

nurse has not worked enough hours to be properly evaluated. 28

ARTICLE 10. SENIORITY 2

Section 1. Seniority shall continue to be calculated on length of continuous 3

employment with the Hospital based on cumulative hours of service. Hours of service 4

include: regular, over-time, earned leave, education, dock, dock standby, 5

compassionate leave, jury duty, and call-back. 6

7

Section 2. A nurse shall lose all seniority rights for any one or more of the 8

following reasons: 9

A. Voluntary resignation. 10

11

B. Termination for just cause. 12

13

C. Voluntary break in service of twelve (12) months or more. 14

15

D. Voluntary break in service due to illness of eighteen (18) months. 16

17

E. Layoff for a continued period of more than one (1) year. 18

19

F. Failure to return to work within five (5) calendar days after being recalled 20

by registered mail, return receipt requested, unless due to illness or accident. 21

22

G. Failure to return when scheduled from approved leave of absence. 23

24

ARTICLE 11. NURSE SAFETY 25

Section 1. Data from the surveillance cameras, locator devices, and/or tracking 26

devices will not be the sole determining factor for employee evaluation or disciplinary 27

action. 28

29

Section 2. The Hospital agrees to make reasonable and proper provisions for 30

the maintenance of appropriate standards of health and safety in the workplace 31

including a Written Staffing Plan for Nursing Services, to promptly review unsafe 32

conditions brought to its attention, and to correct them as necessary. The nurses 33

acknowledge their responsibility to observe safety policies and procedures established 34

by the Hospital or mandated by state or federal laws or regulations related to 35

employees’ job or work areas. The Hospital acknowledges its responsibility to 1

appropriately train all nurses regarding the Hospital’s safety policies, procedures, and 2

state/federal laws and regulations. The Hospital and the Association agree that nurses 3

have the right to give input into the safety program of the Hospital. 4

ARTICLE 12. LAYOFFS/RECALL 6

Section 1. Layoffs shall occur as follows: 7

A. Short-term layoffs: Staffing adjustment to low census or other temporary 8

adjustments of less than fifteen (15) consecutive calendar days shall occur in the order 9

listed in Article 35. 10

Staffing adjustments which are expected to exceed fifteen (15) consecutive 12

calendar days shall occur as follows: 13

1. Agency Nurses. 14

15

2. Volunteers from the shift and work unit. 16

17

3. Intermittent nurses from shift and work unit who shall be laid off in 18

the following order: 19

a. Temporary. 20

b. Probationary. 21

4. Relief nurses from shift and work unit who shall be laid off in the 23

following order: 24

a. Temporary. 25

b. Probationary. 26

27

5. Part-time and full-time nurses in following order: 28

a. Temporary. 29

b. Probationary. 30

c. Regular by shift and work unit on seniority basis. 31

d. A more senior nurse may be laid off out of seniority if the 32

Hospital determines the nurse is not qualified to perform the work on the 33

unit during the layoff or does not possess special skills related to the unit 34

which are possessed by a less senior nurse, provided the Hospital’s 35

determination shall not be arbitrary or capricious. 1

e. A nurse who is laid off may exercise seniority over the least 2

senior nurse in another patient care unit or on another shift so long as the 3

nurse meets the standard set forth in the prior paragraph. The bumped 4

nurse may exercise seniority, if any. The nurse so displaced shall be 5

placed on layoff status. 6

f. The nurse shall have seven (7) calendar days from the time 7

of notification of layoff to exercise seniority in the above manner by 8

delivery of written notice to the Director of Human Resources. If seniority 9

is not exercised in this manner, the nurse shall be placed on layoff. 10

11

C. Recall: 12

1. Nurses laid off shall be recalled to work in their shift and work unit 13

in the reverse order of layoffs. 14

15

2. A nurse laid off shall, if recalled within one (1) year, be restored to 16

their former step and shall not lose seniority. 17

18

ARTICLE 13. LEAVE OF ABSENCE (TA 5/9/19) 19

Section 1. Personal Leave of Absence. A leave of absence without pay, not to 20

exceed ninety (90) calendar days, may be granted at the discretion of the Hospital, in 21

accordance with Hospital policy. The nurse shall not forfeit any accrued rights during an 22

authorized leave of absence, without pay, but likewise the nurse shall not accrue any 23

rights during such leave. 24

25

A request for a leave, extension of the leave and approval shall be in writing. The 26

request will include reasons for the leave. The nurse will give the Hospital as much 27

notice as possible when requesting leave. 28

Section 2. Military Leave. Military leaves will be provided in accordance with 29

applicable law and Hospital policy. 30

31

Section 3. Compassionate Leave. Full-time, part-time and relief nurses will be 32

granted three (3) paid scheduled days off in the event of a death in the nurse’s 33

immediate family, i.e., father, mother, brother, sister, wife, husband, same sex domestic 34

partner (must cohabitate at the same address and not be married to another person), 35

children, (including current in-laws and step), grandparents, and grandchildren. This 1

Section applies if request is made within fourteen (14) calendar days of death. In the 2

case of a family death out of town, reasonable unpaid leave of absence will also be 3

given when required. Compassionate leave will be paid at step wage plus shift 4

differential. Compassionate Leave taken under this provision will run concurrently with 5

any bereavement leave to which a nurse may be entitled under the Oregon Family 6

Leave Act. 7

Section 4. Family and Medical Leaves. Nurses may be eligible for leaves of 9

absence under the Oregon Family Leave Act and/or the federal Family and Medical 10

Leave Act and the Hospital’s Leaves of Absence Policy (Family and Medical Leaves 11

section). The purpose of the Family and Medical Leave section of the Leaves of 12

Absence Policy is to enable nurses to take reasonable leaves of absence for medical 13

reasons, for the birth or adoption of a child, for the placement of a foster child, and for 14

the care of a child, spouse, (grandparent, grandchild, same sex domestic partner – 15

Oregon Leave only), parent, or parent-in-law who has a serious health condition, and for 16

any other reason covered by state or federal law. Family and medical leaves will be 17

provided in accordance with applicable law and the Hospital’s Leaves of Absence Policy 18

(Family and Medical Leave section), which is intended to comply with federal and state 19

laws regulating such leaves of absence. The Hospital’s Leaves of Absence Policy is 20

available from CMH TV, PolicyTech, Policy No. 8650-770. 21

22

A nurse must take a minimum of forty (40) hours per pay period until their EL 23

bank is one hundred sixty (160) hours or less. At that time the nurse can choose 24

whether or not to use EL. 25

26

ARTICLE 14. EMPLOYMENT STATUS; DISCHARGE AND DISCIPLINE 27

Section 1. Voluntary Resignation. A nurse who wishes to resign from 28

employment must submit a written notice of resignation to his/her manager with a copy 29

to Human Resources at least fourteen (14) calendar days in advance of the resignation 30

date. 31

32

Section 2. Involuntary Termination with Notice (Permanent Layoff). The Hospital 33

will provide fourteen (14) calendar days’ advance notice of termination of employment 34

when such termination is due to a permanent layoff. In the event of such permanent 35

layoff, nurses will be terminated in the order provided in Article 12, Section B for long-1

term layoffs, and shall have all rights granted under that section. If less than fourteen 2

(14) calendar days’ notice is given, the Hospital will pay the nurse through the 14th 3

calendar day after notice at the nurse’s step wage for normally-scheduled hours, up to a 4

maximum of eighty (80) hours’ pay. There is no credit for earned leave on such pay. 5

The Hospital’s compliance with this provision does not excuse its compliance with any 6

applicable federal, state or local law. 7

8

Section 3. Termination for Just Cause. A nurse may be disciplined or 9

discharged only for just cause, provided, however, that a nurse may be terminated 10

during his/her probationary period at the sole discretion of the Hospital and without 11

recourse to the grievance procedure by the nurse or the Association. A nurse who is 12

terminated for just cause is not entitled to prior notice of termination or to pay in lieu of 13

notice. 14

15

Section 4. Discipline – Verbal Warnings – Reprimands – Association 16

Representation. Nurses may be disciplined only for just cause. If the Hospital has 17

reason to verbally reprimand, or discipline a nurse in writing, the nurse shall have the 18

right to the presence of an Association representative. The determination of just cause 19

is the responsibility of the manager and/or Hospital Administration. 20

21

ARTICLE 15. DRUG & ALCOHOL POLICY 22

Section 1. Philosophy. In keeping with the Hospital’s mission to create an 23

environment of caring, the Hospital recognizes alcohol/drug abuse as a treatable 24

disease with serious consequences for its nurses, their co-workers, and the patients 25

who trust the Hospital for their care. Therefore, all attempts will be made, within the 26

scope of the affecting laws, to provide a safe and healthy work environment free from 27

the effects of alcohol and drugs. 28

29

Nurses are encouraged to seek evaluation and treatment for substance abuse 30

problems. Nurses may obtain confidential evaluation and counseling through the 31

Employee Assistance Program (EAP) and may be eligible for treatment through the 32

Hospital’s medical insurance policy. 33

34

Section 2. Objective. To inform nurses that involvement with alcohol and drugs 35

on the job, and in some circumstances off the job, where job performance is diminished 1

is prohibited and that submission to alcohol/drug testing may be required as a condition 2

of continued employment. 3

Section 3. Purpose. Nurses will follow the Hospital’s Drug & Alcohol Policy (No. 5

8650.759). The Hospital will provide the Association at least thirty (30) calendar days 6

prior written notice that changes are contemplated and an opportunity to meet to 7

negotiate any proposed revisions. The Association agrees not to unreasonably withhold 8

agreement to such revisions. The absence of the Association’s agreement shall not 9

prevent the Hospital from implementing revisions in the Drug & Alcohol Policy for other 10

employees. 11

ARTICLE 16. GRIEVANCE PROCEDURE (TA 5/9/19) 13

Both parties are encouraged to meet and resolve differences prior to initiating the 14

following grievance process. The nurse may be represented by the Association at any 15

step in the grievance procedure at the request of the nurse. Probationary nurses may 16

not grieve terminations. 17

Any grievance or dispute which may arise between the parties regarding the loss 19

of any employment rights or benefits, or the application, meaning or interpretation of this 20

Agreement shall be settled as described below: 21

22

Step 1: The nurse shall take up the grievance or dispute with the nurse’s manager 23

by written notice within twenty-one (21) calendar days of its occurrence or 24

twenty-one (21) calendar days of when the nurse could reasonably be 25

expected to know of the occurrence, or the dispute shall be waived. The 26

manager shall meet with the nurse within fourteen (14) calendar days of 27

receipt of the grievance in an attempt to settle the matter. The manager 28

shall respond to the nurse within seven (7) calendar days after the 29

meeting. 30

Step 2: If the grievance has not been settled at Step 1, or involves the involuntary 32

termination of a non-probationary nurse, it may be presented in writing to 33

the Chief Nurse Executive within fourteen (14) calendar days of the 34

response from the manager. The Chief Nurse Executive shall schedule to 35

meet with the grievant and the grievant’s representative within fourteen 1

(14) calendar days after the receipt of the grievance. Following this 2

meeting, the Chief Nurse Executive will respond within seven (7) calendar 3

days in writing to the grievant with a copy to the Association 4

representative. Any Association grievances shall be introduced at this 5

step. An Association grievance must affect a class of nurses (i.e., 6

department, shift, classification) rather than an individual nurse. 7

8

Step 3: If the grievance has not been settled at Step 2, it may be presented in 9

writing to the Chief Operating Officer within fourteen (14) calendar days of 10

the response from the Chief Nurse Executive. The Chief Operating Officer 11

shall schedule to meet with the grievant and the Bargaining Unit 12

Grievance Committee and/or the Association representative within 13

fourteen (14) calendar days after receipt of the grievance. Following this 14

meeting, the Chief Operating Officer will respond within fourteen (14) 15

calendar days in writing to the Grievant with a copy to the chairperson of 16

the Grievance Committee. 17

Step 4: If the grievance is still unsettled, the Association may request arbitration 19

by written notice to the Hospital within thirty (30) calendar days of the 20

response from the Chief Executive Officer. 21

22

The Director of Human Resources may attend any scheduled grievance meeting 23

and generally will be involved in the grievance procedure as a resource to the Hospital 24

These time limits may be extended by mutual agreement of the parties. 27

The arbitration proceeding shall be conducted by an arbitrator to be selected by 29

the Hospital and the Association within seven (7) calendar days after notice has been 30

given. If the parties fail to select an arbitrator, the Federal Mediation and Conciliation 31

Service shall be requested by either or both parties to provide a list of five (5) 32

arbitrators. Both the Hospital and the Association shall alternately strike names from the 33

list until one name is remaining. The remaining person shall be the arbitrator. 34

The decision of the arbitrator shall be final and binding on the parties, and the 1

arbitrator shall be requested to issue his or her decision within thirty (30) days after the 2

conclusion of testimony and arguments. 3

The arbitrator shall have no authority to add to, delete from, or otherwise modify 5

this Agreement or any portion thereof. 6

7

Expenses for the arbitrator’s services shall be borne by the losing party as 8

determined by the arbitrator. Each party shall be individually responsible for any 9

compensation to its own representatives and witnesses and any other expenses it 10

incurs, unless the parties mutually agree to share such other expenses. If either party 11

desires a reported record of the proceedings, it shall pay the cost of the copy. The other 12

party shall receive a copy of the transcript upon paying one-half the court reporter’s fee 13

for providing a transcript to each party and to the arbitrator. 14

ARTICLE 17. PROVIDER CONCERNS 16

The Hospital will respond to nurse(s) who believe they have been subjected to 17

inappropriate behavior by healthcare providers on staff. The nurse will discuss the 18

concern with his/her nurse manager and the Director of Nursing and/or Chief Nurse 19

Executive. A written response will be provided within fourteen (14) days. 20

ARTICLE 18. SHARED GOVERNANCE 2

The Association and the Hospital recognize that safe, quality patient care is built 3

upon collaborative relationships between direct patient care nurses and nursing 4

leadership. It is recognized that structures supporting nursing autonomy, involvement 5

and participation in decision making create a highly engaged and productive practice 6

environment. In addition, both parties agree that shared governance is a successful, 7

evidence based approach for fostering collaborative relationships between direct patient 8

care nurses and nursing leadership, provides a venue in which to recognize the value 9

and responsibility of professional nurses in the development of care delivery systems 10

within which quality cost efficient care is provided, and recognizes the legal and 11

regulatory accountability of the registered nurse. It is recognized that resolution of 12

issues at the point of care and in a timely manner are in the best interests of both 13

parties and patients. 14

Section 1. Professional Nurse Care Committee. The purpose of the Professional 16

Nurse Care Committee (PNCC) is to achieve excellence in nursing care by promoting 17

advancement of professional nursing practice throughout CMH that is both patient and 18

family centric. PNCC works in cooperation with the General Safety (EOC) Committee 19

and reports through the Quality Practice & Patient Safety Council. The PNCC will meet 20

quarterly and as needed and will function in an advisory capacity to nursing leadership, 21

the Hospital, the Nurse Staffing Committee, and Unit Based Nurse Practice Councils 22

(UBNPC) on matters of professional nursing practice, nurse staffing as it relates to care 23

delivery systems, and patient safety. In no event will the committee engage in any 24

grievances, negotiations or reinterpretation of the contract. Responsibility for developing 25

staffing plans, reviewing staffing systems, and complying with applicable laws and 26

regulations, such as SB 469 and all applicable Division 501 OARs, rests with the Nurse 27

Staffing Committee. 28

The objectives of the Committee shall be: 30

A. To lead the development, integration, promotion, and modeling of the 32

The Hospital will consider PNCC recommendations and will advise the 17

Committee of any action taken within thirty (30) days of receiving the 18

recommendation(s). 19

Structure: 21

PNCC Direct Care Nurse members will consist of up to ten (10) nurses selected 23

by the bargaining unit from diverse areas of the Hospital, to include one (1) Chair from 24

each UBNPC, and one (1) clinic nurse. (If a department does not have a UBNPC, the 25

nurses in the department shall select the PNCC member from their department.) These 26

nurses shall also be accountable as the conduit for communication between PNCC and 27

direct care nurses, and UBPCs. 28

Nursing Leadership members will consist of the Chief Nurse Executive and up to 30

five (5) nurse leaders selected by the Chief Nurse Executive. 31

The direct care nurse members will be paid two (2) hours each quarter at regular 33

rate of pay (unless federal overtime rules apply) to attend PNCC meetings and up to 34

three (3) hours each quarter to perform the work of the committee. Additional hours for 35

committee work at the request of the committee must be approved by the nurses’ 1

manager. 2

Other nurses may attend meetings of the PNCC on their own time, subject to 4

meeting space. 5

A charter will be developed and updated as needed. The charter will contain 7

specific elements that govern the structure and functions of the committee, to include 8

member and leadership selection processes, roles and responsibilities, decision making 9

processes, and meeting logistics. A Direct Care Nurse shall serve as council chair. 10

Agenda and minutes will be kept. The Hospital shall provide administrative support to 11

schedule meetings, distribute agendas, and record and distribute minutes. Appropriate 12

agenda items may be submitted for consideration to the council chair from members of 13

the nursing staff, nursing administration, and CMH administration. 14

15

Section 2: Unit Based Nurse Practice Councils (UBNPC) UBNPC are 16

foundational for shared governance at the unit level and provide a formal structure for 17

collaborative process improvement activities and shared decision making. Each 18

department of nursing services is encouraged to implement a UBNPC. 19

20

UBNPCs shall consist of no fewer than two (2) members of the unit’s direct care 21

nurses and the unit’s manager and/or supervisor. The total number of members shall be 22

determined in the department UBNPC charter. A direct care nurse shall serve as 23

UBNPC Chair. 24

25

UBNPCs shall develop and maintain a charter, which includes a purpose 26

statement, a process for membership selection and rotation, roles and responsibilities, 27

goals and objectives, decision-making processes, and meeting logistics. UBNPC 28

members shall, by consensus, select a staff nurse to serve as chair of such committee. 29

Each UBNPC chairperson will also automatically become a member of the PNCC, 30

pursuant to Section 18(1), above. 31

UBNPC members shall be paid two (2) hours a month for meetings and for 33

relevant work done outside of meeting time that is preapproved by the member’s 34

manager. At the manager’s discretion, UBNPC members may be relieved from regular 35

duty to attend UBNPC meetings on work time. Other nursing staff may attend meetings 1

on their own time, space permitting. 2

UBNPC members are accountable to gather relevant input, ideas, and 4

information from nursing care staff and others to bring forward to the council for 5

discussion. 6

It is the intention of both parties that direct care nurses and nurse managers work 8

together on decisions affecting nursing and nursing care and that issues be resolved at 9

the unit level. Issues which cannot be satisfactorily resolved at the UBNPC level may be 10

forwarded to the PNCC for further discussion and evaluation. Final decisions remain the 11

province of Hospital management. 12

13 Section 3. Labor Management Committee (LMC). 14 15 The Labor Management Committee (LMC) is formed of delegates of the CMH ONA 16 executive team and CMH leadership. The committee will meet to help to address 17 issues that may arise between contract negotiations, provided however that the LMC 18 will not be empowered to modify this Agreement. Time spent at LMC meetings shall be 19 compensated at regular rates of pay or overtime where applicable. LMC will meet 20 quarterly on designated days that have been agreed upon by both parties. LMC may 21 meet more often, upon mutual agreement. The Hospital shall provide administrative 22 support to schedule meetings and distribute agendas. Each party shall be responsible 23 for their own notes. 24 25 Section 4. Staffing 26 27 A. Concerns. Nurses are encouraged to raise any staffing concerns, without fear of 28 retaliation. For specific staffing concerns, the Hospital will make available a form that is 29 mutually agreeable to the Hospital and the Association. Nurses will leave completed 30 forms in a designated place, and the Hospital will not discourage the reporting, 31 documentation and submission of such forms. A copy of such reports received by the 32 Hospital will be provided to the Association, the house wide staffing committee, and the 33 appropriate unit manager. The co-chairs of the house wide staffing committee will meet 34 at least monthly, or as requested by either, to discuss any such staffing concerns, and 35 will work collaboratively to attempt to address them. This meeting may be cancelled by 36 mutual agreement if there are no staffing concerns to address, or if either co-chair is 37 unavailable. Any staffing concerns that are unable to be resolved, and are of the type to 38 be referred to the house wide staffing committee pursuant to Oregon’s nurse staffing 39 law, will be addressed at the next house wide staffing committee meeting. 40 41 B. Oregon Nurse Staffing Law Information. The Hospital will provide a link to 42 Oregon’s nurse staffing law and related OARs, as well as interpretive documents 43 supplied by the State of Oregon, on the Hospital’s intranet in a manner that affords easy 44 access by managers and bargaining unit members. 45 46

ARTICLE 19. EARNED LEAVE 2

Section 1. Earned leave (EL) is time earned for paid time off which shall be used 3

to replace scheduled hours. Such earned leave is in lieu of vacation, sick leave and 4

holidays. Because the use of earned leave is meant to offset a nurse’s scheduled hours, 5

the use of earned leave (other than cash-out) cannot cause the nurse to exceed their 6

scheduled hours, or eighty (80) hours per pay period (seventy-one (71) hours for part-7

time employees), whichever is less. 8

9

A nurse may not drop below minimum hours required for the nurse’s current full-10

time or part-time employment status. Therefore, a nurse must use earned leave each 11

pay period to cover absences from scheduled shifts (shifts that appear on the monthly 12

schedule, including traded shifts, but not including call shifts). 13

14

Earned leave may be used only if the nurse (1) has accrued sufficient leave 15

according to the accrual rates described below, and (2) (a) has advance permission 16

from his/her manager to use the earned leave on the requested day(s), or (b) is forced 17

to miss work due to an illness or injury or protected leave of absence. 18

19

Section 2. Full-time and part-time nurses accrue earned leave at the following 20

rates (relief and intermittent and temporary nurses do not accrue earned leave). 21

assigned to day shift (as designated by personnel file) shall receive evening shift 17

differential on one-third (1/3) of their earned leave.) 18

Section 5. Nurses shall accrue but cannot use earned leave during their first 20

ninety (90) calendar days of employment. 21

Section 6. Earned leave will be paid at step wage plus applicable shift differential 23

(based on the nurse’s regular shift schedule as designated by personnel file); except as 24

stated in Section 7. (Nurses on 12-hour shifts shall receive applicable shift differential 25

on earned leave as follows: 12-hour nurses regularly assigned to night shift (as 26

designated by personnel file) shall receive evening shift differential on one-third (1/3) of 27

their earned leave and night shift differential on two-thirds (2/3) of their earned leave; 28

12-hour nurses regularly assigned to day shift (as designated by personnel file) shall 29

receive evening shift differential on one-third (1/3) of their earned leave.) 30

Section 7. Upon resignation or termination, a nurse shall be paid at step wage 32

for all accrued earned leave in a separate check if requested by the nurse. Nurses who 33

resign or are terminated during probation will not be paid accrued earned leave. 34

Section 8. When a nurse changes status from full- or part-time to relief or 1

intermittent, earned leave will be cashed out at that time at step wage plus applicable 2

shift differential. 3

Section 9. Nurses may elect to participate in the Hospital’s Donated Leave 5

program to donate and/or utilize donated earned leave in accordance with Hospital 6

policy. 7

Section 10. Oregon Paid Sick Leave. Use of earned leave used for reasons 8

which qualify under the Oregon Paid Sick Leave law shall be counted against the 9

nurse’s Oregon Paid Sick Leave entitlement. Use of earned leave for reasons other 10

than those that qualify under the Oregon Paid Sick Leave law shall not be counted 11

against the nurse’s Oregon Paid Sick Leave entitlement. Notwithstanding the foregoing 12

sentence, the Hospital shall not be required to provide additional sick leave to 13

employees who utilize all of their yearly accrual of earned leave for reasons other than 14

those that qualify under the Oregon Paid Sick Leave law. 15

ARTICLE 20. HOLIDAYS 17

Nurses will receive time and one-half pay for all hours worked on the following 18

Holiday shifts will be scheduled equitably among the nurses in each department, 32

using a procedure determined by the UBNPC. 33

Nurses who are required to serve on a jury or as witness for the Hospital will be 1

given time off for the period covered by the initial subpoena or court order. Full-time and 2

part-time nurses whose jury duty or witness obligations for the Hospital force them to 3

miss scheduled work will be paid for hours missed. Nurses working night or evening 4

shift will be paid for the shift that is scheduled the same day they are required to attend 5

court for jury duty. Note that night shift is considered the first shift of the day. The nurse 6

will receive full base rate of pay for scheduled time missed, but must reimburse the 7

Hospital for the amount of pay received from jury duty service for scheduled time 8

missed. 9

A nurse who is released from jury duty or witness duty for the Hospital during 10

regular working hours will normally be expected to return to work in a timely manner. A 11

nurse may be requested to report to work prior to jury duty. Such a request will be made 12

only on rare occasions caused by scheduling difficulties. 13

14

It is the Hospital’s intent to accommodate full- and part-time nurses to be able to 15

meet their jury duty obligations without loss of base pay. The manager will work with the 16

nurse to try to accommodate individual circumstances. 17

ARTICLE 22. EDUCATION 2

Section 1. Continuing Education. 3

A. The Hospital agrees to maintain a continuing education program for all 4

nurses covered by this Agreement. All nurses covered by this Agreement are required 5

to maintain unit-specific competencies and required annual and continuing education. 6

B. The Hospital shall make reasonable efforts to offer required continuing 8

education during nurses’ regularly assigned shifts. In the event that a nurse attends 9

hospital provided continuing education functions in which attendance is mandatory 10

outside the nurses’ normal shift, the nurse will be compensated for such time at their 11

step wage. 12

C. The Hospital shall make reasonable efforts to offer more than one 14

opportunity or modality for nurses to satisfactorily complete mandatory continuing 15

education, including but not limited to in-services, classes, on-line modules, and peer to 16

peer training. 17

18

D. The Hospital shall provide nurses with timely information regarding 19

mandatory education requirements, choices for completion, and deadlines. Nurses are 20

accountable to be informed of mandatory continuing education requirements, choices 21

for completion, and completion of mandatory education within defined timeframes. 22

23

E. Any reimbursement for education and training opportunities described in 24

this Article shall be in accordance with the procedures outlined in the Hospital 25

Administrative Policy: Education Travel Expenses/Procedures. 26

Section 2. Paid Education Leave. 27

A. Nurses after probation shall be granted the following hours each calendar 28

year with pay at step wage to attend professional education meetings or to obtain, 29

maintain or renew nationally-recognized certifications as listed in Section 6 below. Each 30

request for such leave must be pre-approved by the nurse’s manager. 31

Full-time and part-time: 24 hours. 32

Relief/Intermittent: 8 hours. 33

Section 3. Paid Conference. Full-time, part-time and relief nurses after 6

probation shall be granted payment of tuition to one (1) education conference per 7

calendar year. 8

Section 4. Specific Training. When Hospital needs require a nurse to complete 10

a specific training course the Hospital agrees that the period of such training will be paid 11

at step wage and that the nurse will be reimbursed for tuition cost and expenses in 12

accordance with Administrative Policy, and these hours shall not count as paid 13

education hours under section 2. 14

Section 5. Credentials. Nurses will receive a one hundred dollar ($100) bonus 16

upon documented completion and renewal of the following credentials through a 17

Hospital-approved program: 18

• Advanced Cardiac Life Support (ACLS) 19

• Neonatal Resuscitation Program (NRP) 20

• Pediatric Advanced Life Support (PALS) 21

• Emergency Nurse Pediatric Course (ENPC) 22

• Trauma Nurse Core Curriculum (TNCC) or Trauma Emergency Assessment 23

Management (TEAM) 24

• S.T.A.B.L.E Program 25

• Advanced Fetal Heart Monitoring 26

• Instructor credentialing for any of the credentials eligible for the one hundred 27

dollar ($100) bonus, and for Basic Life Support (BLS) 28

Unless approved by the nurses’ manager, nurses must attend credential courses offered 29

by the Hospital. For credentials required for a nurse’s position, nurses will be allowed to 30

take either full initial classes or renewal classes. A nurse who is not required to maintain 31

any of the above credentials for his/her position may elect to obtain or renew one of the 32

above-listed credentials on paid time at a Hospital-sponsored course, with manager 33

approval. For nurses renewing elective credentials under the foregoing sentence, only 34

If a nurse is interested in pursuing a nationally-recognized nursing specialty certification 2

that is not included in the above list, she may apply to the Chief Nurse Executive to 3

have that certification recognized for the above one thousand dollar ($1,000) bonus. 4

Section 7. Certification Reimbursement. The Hospital will reimburse full-time 6

and part-time nurses for tuition and/or materials and testing reimbursement up to five 7

hundred dollars ($500) a year (annually) to obtain, maintain or renew nationally-8

recognized certifications as provided in Section 6 above. Reimbursement is contingent 9

upon successful completion of the certification exam Nurses must obtain prior 10

authorization from their manager or supervisor prior to purchasing materials. Material 11

approved for purchase remains the property of the Hospital to be retained by the 12

nurses’ unit or Hospital for the use and benefit of nurses. 13

Section 8. Tuition Reimbursement; RN to BSN. The Hospital will reimburse full-14

time and part-time nurses for tuition and/or materials up to two thousand dollars 15

($2,000) a year (annually) for enrollment in a regionally or nationally accredited nursing 16

program to obtain a BSN. This benefit will be paid for a maximum of two (2) years. The 17

nurse in turn for receiving this benefit will agree to work for the Hospital for 2 years after 18

the completion of the BSN degree. The nurse will agree at the time of application to 19

repay the Employer for tuition covered under this benefit if the nurse does not complete 20

the course, does not receive a passing grade for the course or voluntarily terminates 21

employment before completion of the two year commitment (pro-rated amount). Nurses 22

who apply for this benefit must have been employed for a minimum of six (6) months, 23

must have successfully completed their probationary period, and may not be on a 24

Performance Improvement Plan for anything greater than a verbal warning. 25

ARTICLE 23. GROUP HEALTH 2

Section 1. Definitions. 3

Family Members: If the nurse is married, the legal spouse is eligible for coverage. 4

Unmarried children are eligible if they are under age 26, and are eligible pursuant to the 5

plan’s Summary Plan Description 6

Eligibility: Full-time and part-time nurses. A nurse is eligible for coverage at the 8

first of the month following completion of thirty (30) calendar days of full- or part-time 9

continued employment. At time of hire, the nurse is informed that it is the responsibility 10

of the nurse to complete the enrollment process no later than thirty (30) days after 11

eligibility. Relief/intermittent and temporary nurses are not eligible for group benefits. 12

If a relief/intermittent nurse has worked at least forty (40) hours per pay period in 14

the previous thirty (30) days before officially filling a full- or part-time position, that time 15

will count toward the completion of the thirty (30) calendar days of work as outlined 16

above. 17

Section 2. Premiums. Group health insurance shall be made available on a 19

payroll deduction basis. 20

Employee-Only Premiums 22

Full-Time Employees: 24

Effective January 1, 2014, coverage under the base plan of up to $1080 monthly will be 25

provided at no cost to full-time employees. Full-time employees and the Hospital will 26

split 50/50 any premium increases above $1080 monthly. Notwithstanding the 27

foregoing, the maximum employee contribution for full-time employees for Employee 28

Only coverage will be 10% of the total Employee Only premium in effect at that time. 29

The Hospital will pay the entire Employee Only premium for the Tier 2 plan. 30

Part-Time Employees: 31

Part-time employees will pay 20% of employee only premiums for the base plan. The 32

Hospital will pay the entire Employee Only premium for the Tier 2 plan. 33

previous six months and the Hospital may reclassify an employee to full-time or part-2

time status based on that average. For employees with less than six months of 3

consecutive employment, full-time or part-time status will be based on the status 4

assigned upon hire) 5

Dependent Premiums: 7

Full- or part-time employees may obtain dependent coverage under either plan by 8

paying the following percentages of the insurance premium.: 9

For employees with less than 20,800 hours of service, dependent coverage may be 11

obtained by paying thirty percent (30%) of the insurance premium. Employees with 12

more than 20,800 hours (but less than 31,200 hours) of service may obtain dependent 13

coverage by paying twenty-five percent (25%) of the insurance premium. Employees 14

with more than 31,200 hours (but less than 41,600 hours) of service may obtain 15

dependent coverage by paying twenty percent (20%) of the insurance premium. 16

Employees with more than 41,600 hours of service may obtain dependent coverage by 17

paying fifteen percent (15%) of the insurance premium. Premium costs will be adjusted 18

based on seniority hours in January and July of each year. 19

Changes in Premiums. The Hospital agrees that if it makes changes to the 21

percentage-split of insurance premiums for employees represented by Service 22

Employees International Union Local 49, and/or for management employees, it will offer 23

the same changes to nurses covered by this Agreement, using the process identified in 24

Section 3, below. 25

Section 3. Coverage Revisions. It is recognized that the Hospital will continue to 27

seek opportunities to revise health insurance coverage consistent with the interest of 28

the nurse and the Hospital. Any proposed revisions in the Hospital’s health insurance 29

program shall include the current vision and dental plan as well as a comprehensive 30

health insurance which provides major medical benefits. 31

The Hospital will provide the Association at least sixty (60) days’ prior written 33

notice that such changes are contemplated and an opportunity to meet to negotiate any 34

proposed revisions. The Association agrees not to unreasonably withhold agreement to 35

such provisions. The absence of the Association’s agreement shall not prevent the 1

Hospital from implementing revisions in the health insurance program. 2

Section 4. Opt-Out Provision. Nurses receiving “employee only” health 4

insurance coverage may exercise their option to “opt-out” of such health insurance 5

coverage if they have alternative coverage through another source. In such a case, the 6

nurse will receive two hundred dollars ($200) per month. Nurses must opt out prior to 7

the 15th of the month preceding the month on which the opt-out will be effective. 8

9

Section 5. Health Insurance Advisory Committee. The Hospital will establish a 10

Health Insurance Advisory Committee to include two (2) representatives of the 11

bargaining unit. The purpose of the committee will be to review claims experience, 12

utilization and trends in the insurance industry. The committee will be a forum to ask 13

questions, to address concerns and to make recommendations regarding the insurance 14

plan. The committee will meet quarterly. 15

ARTICLE 24. GROUP LIFE 17

Eligibility: Full- and part-time nurses are eligible to receive Hospital-paid life 18

insurance in the amount of $20,000. Coverage is effective on the first of the month 19

following ninety (90) calendar days of full- or part-time employment. For an additional 20

employee-paid premium, nurses may opt to include coverage for their spouse and/or 21

dependent children. 22

ARTICLE 25. LONG-TERM DISABILITY INSURANCE 24

Effective, June 1, 2008, full- and part-time nurses are eligible to participate in a 25

Hospital-paid long-term disability policy, effective on the first of the month following 26

ninety (90) calendar days of full- or part-time employment. The policy will provide 27

benefits after ninety (90) days of missed work and provide coverage for a nurse’s 28

missed wages of fifty percent (50%) up to a maximum of one thousand dollars ($1,000) 29

per month. 30

ARTICLE 26. RETIREMENT PLAN (TA 5/31/19) 32

Eligibility: Nurses become participants in the Retirement Plan on the first day of 33

the month on or after they are at least age 21 and have one thousand (1,000) hours 34

during the twelve (12) months after employment or during any Plan Year. Hours include 35

regular, overtime, call, dock standby, earned leave, education, paid meetings, and jury 1

duty. If the nurse meets the eligibility requirements, participation is automatic and there 2

are no enrollment forms. The Hospital shall guarantee to maintain or improve the 3

current level of benefits offered in the Retirement Plan. 4

Only those nurses who have been hired prior to the ratification date of July 27, 6

2007 are eligible to participate in the Defined Benefit Retirement Plan described above. 7

Nurses hired after that date are eligible to participate in a Defined Contribution Plan 8

established by the Hospital. 9

After one (1) year of employment by those participating nurses, the Hospital shall 11

make a one hundred percent (100%) matching contribution up to two and one-half 12

percent (2.5%) of the nurse’s earnings to the Defined Contribution Plan (Tax Sheltered 13

Annuity). After two (2) years of employment, the Hospital shall make a contribution 14

based on five percent (5%) of the nurse’s earnings for each month following the two (2)-15

year anniversary of employment (and without regard to whether the nurse is contributing 16

to the Defined Contribution Plan). After five (5) years of employment, the Hospital shall 17

make a one hundred percent (100%) matching contribution up to three percent (3%) of 18

the nurse’s earnings to the Defined Contribution Plan. Nurses must be twenty-one (21) 19

years or older and have worked a minimum of one thousand (1000) hours during the 20

twelve months after employment or during any Plan year to be eligible to receive a 21

contribution. Nurses become one hundred percent (100%) vested in the Plan following 22

one year of service. All contributions shall be deposited into the nurse’s Defined 23

Contribution account each pay period. 24

Eligibility: Full- and part-time nurses. A nurse is eligible for coverage on the first 29

of the month following completion of up to ninety (90) consecutive calendar days of 30

continued employment (the period may be shorter depending on the specific benefit). 31

premiums, as well as other eligible voluntary insurance premiums, deducted on a pre-34

Eligibility: All nurses upon completion of ninety (90) consecutive calendar days 7

Effective August 1, 2010, nurses and dependents will receive a seventy percent 10

(70%) discount on any remaining balance after insurance payment. Effective August 1, 11

2010, nurses and dependents not covered by any health plan will receive a twenty-five 12

percent (25%) discount on total charges. 13

Discounts are applicable only if the account is settled within thirty (30) days from 15

receipt of post-insurance balance due or other suitable arrangements have been made 16

with Patient Financial Services. 17

It is the nurse’s responsibility to inform Patient Financial Services of their and/or 19

their dependent’s eligibility for this discount. This can be done by phone or email to 20

Patient Financial Services. 21

The parties agree that the foregoing discount does not apply to elective procedures not 23

Pharmaceutical items are available for purchase by nurses and family members 33

at a discounted rate of cost plus four dollars ($4.00). Certain over-the-counter items are 34

D. A refrigerator will be available for the nurses’ use. 22

Section 8. Physicals. The Hospital will pay for an annual physical exam for each 24

nurse to the extent that said exam is not covered by the nurse’s medical insurance. The 25

Hospital also agrees to pay for CBC, Chem. 12 and U.A. that are done at the Hospital 26

and ordered by the nurse’s physician as part of the physical exam. 27

Section 9. Access to Kronos. The Hospital agrees to make Kronos available to 28

nurses to access off-site. The parties acknowledge that this off-site access is being 29

provided to allow nurses to review, and approve their time cards without having to come 30

into the Hospital, and that it is being provided at the nurses’ request. Nurses who wish 31

to have off-site Kronos access to allow them to review, and approve their time card 32

remotely may request such access through Payroll. The parties acknowledge that since 33

this access is being offered for certain nurses’ convenience and benefit, rather than the 34

Hospital’s, that any time spent accessing Kronos from off-site will not be considered 35

ARTICLE 30. STEP WAGE SCHEDULE 3

Within sixty (60) days of a nurse’s anniversary date, an annual evaluation shall 4

be conducted by the nurse’s manager, a copy which will be given to the nurse. 5

Full-time and part-time nurses will advance steps annually. Relief or intermittent 7

nurses will advance steps every two (2) years, unless they work eight hundred thirty-two 8

(832) hours in an anniversary year, in which case they will advance at the end of that 9

anniversary year. If a relief or intermittent nurse advances after one (1) year in 10

accordance with the foregoing sentence, he/she will be eligible to advance again either 11

on the second anniversary following such advancement or in the next anniversary year 12

in which the nurse works at least eight hundred thirty-two (832) hours, whichever comes 13

first. 14

Relief and Intermittent wages will be ten percent (10%) more than full-time and 16

part-time nurses. 17

Effective upon ratification, there will be a five percent (5%) increase applied to all 19

of the steps in the scale.. 20

Section 3. Nurses required to work in excess of six (6) days in a row (four (4) for 6

nurses on 12-hour shifts) shall be paid a premium pay of step wage and applicable 7

differential(s) times one and one-half (1.5) for all days in excess of six (6) days in a row. 8

For purposes of this Article, nurses must work a minimum of four (4) hours to be 9

considered a consecutive day and twenty-four (24) hours will be considered a break of a 10

day. At the nurse’s option, this provision may be waived. 11

Section 4. All work performed at the request of the Hospital on any shift where at 13

least twelve (12) hours has not elapsed since the end of the nurse’s previous shift (ten 14

(10) hours for nurses on twelve (12) hour shifts) shall be paid a premium pay of step 15

wage plus applicable differential(s) times one and one half (1.5). At the nurse’s option, 16

this provision may be waived. For purposes of this Section, nurses must work a 17

minimum of four (4) hours to be considered a shift. 18

Section 5. Any hours or shifts worked as an extra shift or on an unscheduled 19

basis after the schedule is posted shall be paid a premium pay of step wage plus 20

applicable differential(s) times one and one half. At the nurse’s option, this provision 21

may be waived. 22

Relief nurses must be scheduled a minimum of eight (8) days in a month to be 24

eligible for premium pay under this Section for that month. 25

26

Intermittent nurses are not eligible for premium pay under this Section. 27

Nurses returning from a leave of absence and placed on the schedule after it is 28

posted will not be eligible for premium pay under this Section, provided that they may 29

only be placed in available openings on the schedule. 30

31

Section 6. Unless federal overtime rules apply, hours worked in call-in status will 32

Section 7. In-services, education, Hospital orientation, and attendance at 1

meetings are exempt from Sections 3, 4, and 5 premium pay provisions of this Article. 2

Section 9. The overtime and premium provisions of this contract will not be 6

pyramided for any purpose in determining appropriate pay for time worked. Hours in a 7

pay period for which a nurse has already received a rate of time and one-half (1.5) or 8

greater under the terms of this Agreement (for example, call-back, unscheduled, 9

consecutive days, rest between shifts, daily overtime, workweek overtime pay, pay 10

period overtime pay), will not be counted again for purposes of determining daily, 11

workweek, or pay period overtime pay. 12

ARTICLE 32. SHIFT/WEEKEND DIFFERENTIAL 14

Changes to shift differential times and amounts shall be implemented in the first 15

pay period following ratification of the 2016-2019 collective bargaining agreement. 16

Section 1. Evening Shift Differential. Evening shift differential is two dollars and 18

fifty cents ($2.50) per hour. Evening shift differential shall be paid for all hours worked 19

between 1500 and 2300. 20

Section 2. Night Shift Differential. Night shift differential is four dollars and 21

seventy-five cents ($4.75) per hour. Effective the first pay period following ratification of 22

this Agreement, night shift differential shall be increased to five dollars ($5.00) per hour. 23

Night shift differential shall be paid for all hours worked between 2300 and 0700. 24

Section 3. Weekend Differential. Weekend differential is two dollars and 26

seventy-five cents ($2.75) per hour. 27

ARTICLE 33. CHARGE/PCC/DIFFERENTIAL 29

Section 1. The Hospital recognizes the appropriateness of assigning charge 30

when appropriate as determined by the nurse manager. 31

Section 2. Charge Differential. The Hospital recognizes the appropriateness of 33

paying a premium of one dollar and seventy-five cents ($1.75) per hour for nurses 34

performing the responsibilities of Charge Nurse. 35

Section 3. Patient Care Coordinator. The Hospital may assign nurses to the 2

position of Patient Care Coordinator. Any nurse assigned by the Hospital to the position 3

of Patient Care Coordinator will be paid a premium of two dollars and twenty-five cents 4

($2.25) per hour. 5

ARTICLE 34. PRECEPTOR DIFFERENTIAL 7

A nurse working as a preceptor will be paid a differential of one dollar and fifty 8

cents ($1.50) per hour. The nurse who registers a willingness to act as a preceptor will 9

assess the learning needs of the nurse for a specified period of time to plan and 10

implement the program and to provide direct guidance. 11

For Hospital employees, the nurse manager, the preceptor, and the preceptee, 12

will meet regularly to evaluate the nurse preceptee’s progress during the program 13

(orientation). 14

15

This differential will not be paid for any hours when the nurse is not working as a 16

preceptor. Nurses working as preceptors shall have these additional preceptor 17

responsibilities considered in their regular patient care assignment. 18

19

ARTICLE 35. DOCK TIME 20

Section 1. Nurses scheduled but subsequently asked not to work because of low 21

patient census or acuity, shall be floated to another unit in accordance with Article 7, if 22

needed, and if not needed to float shall be placed in dock or dock standby status. 23

Nurses placed on dock are not expected to remain available to the Hospital. There is no 24

compensation for time on dock status. A nurse’s status will not be negatively affected by 25

dock or dock standby time. All time spent on dock or dock standby status shall count as 26

time worked for purposes of group benefits, including earned leave and seniority, 27

provided however that all time counted towards earned leave is capped at eighty (80) 28

hours per pay period. 29

The use of dock time is meant to offset a nurse’s regularly-scheduled hours. 31

Therefore, the use of dock time cannot cause the employee to exceed their regularly-32

scheduled hours and any additional unscheduled time worked. 33

Section 2. Nurses who are placed on dock or dock standby after they have 35

already reported for work will be responsible for entering their own dock hours or earned 1

leave into the payroll system. The Hospital will enter dock hours for nurses who are 2

placed on dock or dock standby prior to reporting to work. The nurse will be responsible 3

for entering earned leave if he/she wishes to utilize earned leave for the time. Nurses 4

will have thirty (30) days following the end of the pay period to correct errors related to 5

entering dock hours in that pay period. 6

Section 3. Nurses will be placed on dock time in the following order: 8

1. Nurses working at the federal overtime rate. 9

2. Volunteers among the nurses who are working at a premium rate of 10

pay. 11

3. Nurses working at a premium rate of pay. 12

4. Remaining volunteers from shift and work unit. 13

5. Agency Nurse. 14

6. Intermittent. 15

8. Rotation among full-time and part-time nurses from shift and work 21

their contract with the Hospital. 25

10. Surgical Services Nurses who are on call immediately following their 26

regularly-scheduled shift have the option to rotate dock last on their regularly-27

scheduled shift. 28

A nurse may be docked out of rotation if the Hospital determines the nurse is not 30

qualified to perform the work of the unit during the layoff or does not possess special 31

skills related to the unit which are possessed by another nurse, provided the Hospital’s 32

determination shall not be arbitrary or capricious. 33

Section 4. Dock Cap. Full-time and part-time nurses shall not be involuntarily 34

docked for more than 20% of their scheduled hours in each quarter (6 pay periods). It is 35

the nurse’s responsibility to notify his/her supervisor when the dock cap is reached. The 1

Hospital will develop a system to track data of mandatory vs voluntary dock time for 2

each nurse, which will be available to each nurse for review. Dock time for which the 3

nurse volunteered does not count towards the dock cap. Dock time during an extra shift 4

also does not count towards the dock cap. 5

Nurses who would otherwise be docked if not for the dock cap may be floated to 6

another unit in accordance with Article 7, or may be assigned other work duties as 7

determined by the manager. 8

ARTICLE 36. DOCK STANDBY/ON-CALL 9

Section 1. Dock Standby. Nurses scheduled but subsequently asked not to 10

work because of low patient census or acuity, may be placed in dock standby. 11

A. Nurses on dock standby must be available to respond within thirty (30) 12

minutes (forty-five (45) minutes for FBC and PACU; twenty (20) minutes for Surgery) of 13

being contacted. 14

15

B. Nurses on dock standby must abstain from alcohol and drugs as defined 16

in the Hospital’s Drug & Alcohol Policy. 17

18

C. Nurses on dock standby shall, on request, be provided a pager which shall 19

be returned or passed on to the following shift. 20

21

D. Nurses on dock standby will receive four dollars and fifteen cents ($4.15) 22

per hour for the time spent on dock standby. Nurses on dock standby on a holiday will 23

receive four dollars and seventy cents ($4.70) per hour for the time spent on dock 24

standby. Dock standby shall be assigned for the nurse’s entire shift (or the remainder of 25

the shift, if the nurse is placed on dock standby after reporting for work), unless the 26

nurse agrees to be released from dock standby prior to the end of his/her shift. 27

E. All time spent on dock standby shall count as time worked for purposes of 28

group benefits, including earned leave and seniority. There will be no pyramiding of 29

benefit accrual. Provided however, that all time counted towards earned leave is 30

capped as provided in Article 19. 31

F. Call-in: Nurses on dock standby who are “called in” to work shall be paid 33

time and a half plus appropriate differentials for all hours worked at a minimum of three 34

hours. In-services and meetings are exempt from this provision. A nurse may not 35

receive dock standby pay and call-in pay for the same hours. 1

G. When dock or dock standby assignments are necessary, nurses who are 3

working extra shifts or on an unscheduled basis under Article 31, Section 5, of this 4

agreement shall be selected first to be placed on dock or dock standby status. 5

6

Section 2. On-Call. Nurses may be placed in on-call status beyond the 7

regularly-scheduled shifts for a department. Unless mutually agreed between the nurse 8

and the Hospital, on call hours are limited to a maximum of 168 hours per month. On-9

call status is utilized beyond the scheduled requirements for a department. Call does 10

not begin until the nurse has finished their workday and clocked out. 11

A. Nurses on call must be available to respond within thirty (30) minutes of 12

being contacted. Surgery nurses on call must be available to respond within twenty (20) 13

minutes of being contacted. FBC and PACU nurses on call must be available to 14

respond within forty-five (45) minutes of being contacted. 15

16

B. Nurses on call must abstain from alcohol and drugs as defined in the 17

Hospital’s Drug & Alcohol Policy. 18

C. Nurses on call shall, on request, be provided a pager which shall be 20

be paid a premium pay of time and one-half (1.5) step wage plus applicable 29

differential(s) for all time actually worked, with a minimum of two (2) hour, plus the on-30

call payment. 31

G. Nurses working on dock standby or on call are responsible for logging all 33

phone calls in which they give nursing advice. Nurses shall be paid for all such time at 34

premium pay of time and one-half step wage plus applicable differentials for actual time 35

Section 3. Additional Provisions for Hospice Nurses. 3

A. A nurse working on either dock standby or on call who is called to work at 4

a patient’s home shall receive pay as per the above provisions beginning from the time 5

the nurse leaves home and continuing until the nurse returns home. Mileage shall be 6

paid at the established IRS rate for all miles traveled to and from the patient’s home. 7

ARTICLE 37. BULLETIN BOARD 2

Designated space for posting of matters pertaining to legitimate Association 3

business will be provided in each nurse lounge. Arrangements and space will be 4

decided between the Association and Human Resources. 5

Mail slots for the bargaining unit may be used for dissemination of such 7

information as is the current practice. Materials may be posted or disseminated only in 8

such designated areas. 9

All distribution of Association information within the Hospital must be in 11

compliance with this Article. 12

ARTICLE 38. MANAGEMENT RIGHTS 2

The Hospital retains all customary, usual and exclusive rights, decision-making, 3

prerogatives, functions and authority connected with or in any way incident to its 4

responsibility to manage the affairs of the business. The right of nurses in the 5

bargaining unit and the Association are limited to those specifically set forth in this 6

Agreement, and the Hospital retains all prerogatives, functions and rights not 7

specifically limited by the terms of this Agreement. 8

The Hospital shall have the right to hire, suspend, discharge, promote, 9

transfer, and discipline nurses for proper cause, subject to the Grievance Procedure. 10

11

ARTICLE 39. SEPARABILITY 12

In the event that any provision of this Agreement shall at any time be declared 13

invalid by any court of competent jurisdiction or through government regulations or 14

decree, such decision shall not invalidate the entire Agreement, it being the express 15

intention of the parties hereto that all other provisions not declared invalid shall remain 16

in full force and effect. Affected provision shall be renegotiated by the parties. 17

ARTICLE 40. NO STRIKE/NO LOCKOUT 19

The Hospital and the Association realize that a hospital is different in its 20

operation from industries because of its services rendered to the community and for 21

humanitarian reasons, and agree that there shall be no lockouts on the part of the 22

Hospital or suspensions of work on the part of the nurses during the term of this 23

Agreement. One of the purposes of this Agreement is to guarantee that there will be no 24

strikes, sympathy strikes, lockouts, informational picketing, or work stoppages, 25

individually or collectively, during the term of this Agreement. 26

27

The above provision shall apply to the Hospital and the Association, its agents 28

and members, without regard to whether or not the controversy or dispute arises under 29

this Agreement, at this or at any other facility of the Hospital. 30

31

The Hospital retains the right to discharge or otherwise discipline nurses in the 32

bargaining unit who have engaged in acts prohibited by the provisions of this Article. 33

If the Hospital is sold, merged or otherwise transferred to a successor, this 1

Agreement shall remain binding on the successor regarding the present Hospital 2

bargaining unit. The Hospital shall have an affirmative duty to call this provision of the 3

Agreement to the attention of any firm or individual with which it seeks to make such an 4

agreement as aforementioned, and if such notice is so given, the Hospital shall have no 5

further obligations hereunder from the date of takeover. 6

NEW ARTICLE 42 – MUTUAL RESPECT (TA 7/31/19) 2

42.1 The Hospital and the Association agree that mutual respect between and 4

among managers, employees, co-workers and supervisors is integral to a healthy 5

work environment, a culture of safety and to the excellent provision of patient care. 6

Behaviors that undermine such mutual respect, including abusive or “bullying” 7

language or behavior, are unacceptable and will not be tolerated. 8

(a) Any nurse who witnesses or believes they are subject to such behavior 9

should raise their concerns with their manager as soon as possible. If the manager 10

is unavailable, or if the nurse believes it would be inappropriate to contact that 11

person, the nurse should raise their concerns with Human Resources and/or the 12

Chief Nurse Executive. 13

(b) Any nurse who in good faith reports such behavior, or who takes part in an 14

investigation of such behavior, will not be subject to retaliation by the Hospital, the 15

Association or by co-workers. Any nurse who believes they are being retaliated 16

against for reporting such behaviors should raise their concerns with an appropriate 17

manager, supervisor or human resources representative as soon as possible. 18

(c) The Hospital will promptly investigate any reports of such behavior and, 19

based on such investigation and, applying appropriate discretion, take appropriate 20

action to prevent the reoccurrence of such behavior. Any Hospital employee who 21

has been found to have engaged in such inappropriate behavior will be subject to 22

the appropriate step in a progressive disciplinary action in accordance with Article 23

14. 24

(d) The Hospital will communicate to the nurse who was subject to such 25

alleged bullying behavior whether the investigation supported the allegation, did not 26

support the allegation, or was inconclusive. The Hospital may choose to keep 27

confidential, consistent with Hospital policy, the level of discipline given to an 28

employee who has been found to have engaged in such behavior.29

MEMORANDUM OF AGREEMENT 1

BETWEEN OREGON NURSES ASSOCIATION 2

AND COLUMBIA MEMORIAL HOSPITAL 3

RE DURATION OF THE DEFINED BENEFIT RETIREMENT PLAN 4

The Hospital agrees to continue its present Defined Benefit Retirement Plan (the 6

Columbia Memorial Hospital Retirement Plan established effective April 1, 1976, last 7

amended and restated effective January 1, 2000, and last amended effective January 1, 8

2002) in full force and effect for eligible employees hired prior to July 27, 2007, and will 9

not reduce or diminish in any way the benefits, eligibility requirement and the rights of 10

employees thereunder. 11

The Hospital agrees to maintain the Defined Benefit Retirement Plan as long as 13

there are eligible employees covered by the Plan and will not seek in any way to 14

eliminate or modify the plan in any future contract negotiations. The Hospital agrees to 15

execute any documents necessary to effectuate this commitment. The Defined Benefit 16

Retirement Plan will be maintained as long as there are eligible employees covered by 17

the Plan and consistent with regulations of the Internal Revenue Service and the United 18

States Department of Labor. This provision shall remain in effect until there are no 19

longer eligible employees covered by the Defined Benefit Retirement Plan. After many 20

years, if the number of remaining Plan participants makes it unfeasible to continue the 21

Plan, the Hospital will guarantee that their monthly pensions will not be eliminated or 22

reduced. 23
