A special exception is a use that would not be appropriate or without restriction throughout a zoning division or district but which, if cc>ntrolled as to number, area, location, or relation to the neighborhood, would promote the public health, safety, welfare, morals, order, comfort, convenience, appearance, prosperity, or the general welfare. The meeting opened at 7:00 P .M.

PUBLI HEARING:

SE 0515

Rick Rewiski: There is an existing tower located in the southwest portion of the county near

Ichetucknee State Park. Original design was for microwave relay coverage. Issues have developed. The Fish and Wildlife Commission is not getting the coverage they need. A grant has been received to increase the height of the tower, which will provide the coverage and penetration into the thicker woods in the area. Currently it is strictly for law enforcement, however the tower but has the capability to hold commercial uses if one was to come along and want to do so.

Jordan: Once this was approved they could let anyone place their equipment on this tower?

Brian Kepner: Correct, as part of the original application for a special exception they had to show the

ability to allow or co-location on the tower.

Jordan: Are you going to add onto the top of the tower or tear it down and build a new one?

Rewiski: We will be adding on to the top, some guide wires will have to be replaced.

Jordan: Do you have any additional information you would like to present at this time.

Rewiski: I believe we have been provided the information required for this application.

Kepner: Mr. Chainnan, I would like the record to reflect that we have received the missing information that would make this application complete. When the packets were sent out to you there were a few items missing. The last few items were received today.

Jordan: Open the public hearing for comment. Anyone wish to speak for or against?

Lt. Scott Kihei: I am with the Fish and Wildlife Commission and there are some gaps in coverage

especially along the rivers and many times we have to use our personal phones in order to communicate. The increase in height of this tower wi.11 help communications in Columbia, Gilchrist and Suwannee Counties along with Alachua as well.

Lt. Mark Boatright: The increase in height for this tower for coverage can only help the 13 different

agencies that will use it.

Jordan: Anyone wish to speak against the request? Seeing none, close the public hearing.

Vann: Motion to approve SE 0515.

Ruffo: 2nd the motion.

LDR 11-1 - Board of County Commissioners, requesting to amend the Land Development Regulations Section 5.7 entitled Maintenance, to require that any road, street, utilities, public parking or other public area or drainage facility accepted for maintenance by the County be designed and built in accordance with the Board of County Commissioners requirements and amending Section 5.20 entitled Maintenance and Repair of Required Improvements, to require subdividers to maintain and repair the improvements they are required to construct until it has achieved no less than 50 percent build out with certificates of occupancy within the recorded subdivision; to increase the maintenance surety from IO to 15 percent for required subdivision improvements; to provide the procedures for the Board of County Commissioners to accept the maintenance of subdivision improvements.

LDR 11-2 - Board of County Commissioners, requesting to amend the Land Development Regulations Section 4.2.3.2 entitled Width of Curb Break, to change the maximum width of curb breaks within residential areas from 24 feet to 40 feet, to change the minimum width of curb breaks within planned shopping centers, industrial developments multi-family developments with parking for 300 or more vehicles from 24 feet to 40 feet, and to revise the resolution number referenced in said section.

SCHEDULE "A"

SECTION 5.7 MAINTENANCE. Nothing in these land development regulations shall be construed as meaning that the Board of County Commissioners shall take over for maintenance any road, street, utilities, public parking or other public area, or drainage facility related thereto,: Any road, street, utilities, public parking or other public area, or drainage facility accepted for maintenance by the County shall be e'l'eept these designed and built in accordance with the Board of County Commissioner's requirements and accepted for maintenance by specific action by the Board ofCounty Commissioners (See Section 5.20).

SECTION 5.20 MAINTENANCE AND REPAIR OF REQUIRED IMPROVEMENTS. The subdivider shall maintain and repair all improvements which these land development regulations require the subdivider to construct in the subdivision until it has achieved no less than fifty (50) uercent build out with certificates of occupancy within the recorded subdivision f&F-it peried ef oee (1) year aftel' the eempletiaa ef the same. A final plat shall neither be approved by the Board ofCounty Commissioners nor accepted for filing until the subdivider posts a maintenance bond, letter of credit or other security acceptable to the County to cover at least ten (l@) fifteen (15) percent of the estimated costs ofall required improvements for the above specified maintenance oeriod a period ef one (1) year (See Appendix A). All defects which occur within oae (1) year after completion ofall required improvements and within the above specified maintenance period shall be remedied and corrected at the subdivider's expense. After the above specified maintenance period has terminated, the following procedures shall appy;

1. The subdivider shall petition the County to accept maintenance of the subdivision improvements.

2. The Public Works Director or his designee shall inspect the improvements. If discrepancies are found, a letter shall be sent to the subdivider noting said discrepancies. The subdivider shall notify the Public Works Director when all discrepancies have been rectified. Upon re-inspection of all the discrepancies have been corrected and found to be in compliance with the Columbia County LDR's as reflected by the final approval by the County, the Suwannee River Water Management District {SRWMD) includin2 as built permit certification and all other applicable local and state rules and regulations, recommendation for final acceptance for maintenance by the County will be submitted to the Board of County Commissioners for their final approval.

The subdivider's responsibility for maintenance of the improvements shall continue until the Board of County Commissioners has approved final acceptance.

3. Once the Board of County Commissioners has accepted the improvements, the County shall release the subdivision performance security, cash or surety bond.

Subdivisions which have received final approval by the Board of County Commissioners upon adoption of this amendment shall not have to comply with the fifty (50) percent build out requirement but, shall comply with the other requirements for acceptance of maintenance by the County.

As a follow-up to our meeting this date, I submit the following:

I request that the Board of County Commissioners approve the amending of Article 5, Section 5.7 of Columbia County's Land Development Regulations to read as follows:

Nothing in these land development regulations shalJ be construed as meaning that the Board of County Commissioners shall take over for maintenance any road, street, utilities. public parking or other public area, or drainage facility related thereto unless:

I. The subject subdivision has a minimum of 50o/o lot build out. 2. A letter from the devdoper is submitted to the Board of County Commissioners

requesting the County accept maintenance. 3. Upon receipt of such letter the Director of Public Works will perfonn an

inspection of the project. 4. A letter noting any/all discrepancies will be sent to the developer. 5. Developer will notify the Director of Public Works when all discrepancies have

been rectified. 6. Director of Public Works will perform re-inspection. lf all discrepancies have

been corrected, recommendation for final acceptance of maintenance by the County will be submitted to the Board of County Commissioners for their final approval.

7. For subdivisions completed prior to 2011, #1 does not apply.

I understand that the 50% build-out rule will not apply prior to this date therefore. I included the verbiage listed as #7.

Dear Brian:

We have previously requested the Board of County Commissioners to amend Section 5. 7 of the Columbia County Land Development Regulations regarding maintenance of roads, streets and other public areas for subdivisions dedicated to the County. r believe you are currently working on the language to amend Section 5.7 of the LDRs and 1enclose a copy of the Memorandum provided me from the County Manager's office which lists the seven (7) points to be included in the amendment. As to the seventh paragraph regarding subdivisions completed prior to 2011, I believe the Board's intent as stated at the meeting was that subdivisions where the preliminary plat had been approved prior to 2011, the changes will not apply. Thus, if a preliminary plat was approved prior to 2011, but the final plat is approved after January 1, 2011, the 50% lot build out requirement will not apply.

Obviously, we will need to discuss this in more detail after you complete a draft which you believe will properly incorporate these changes.

Amending Section 4.2.3.2 of the LDR' s concerning access control and the width of curb break. See attached Schedule "A" . The reason for this amendment is two-fold. 1). It would make the culverts wide enough for all purposes and have standardization. 2). Prior width was not wide enough for all purposes and the ends are being damaged, therefore causing additional expense for Public Works Department to repair.

SCHEDULE "A"

Section 4.2.3 ACCESS CONTROL

In order to provide ease and convenience in ingress and egress to private property, but more importantly to provide the maximum safety with the least interference to the traffic flow on public streets, the number and location ofcurb breaks shall be regulated relative to the intensity or size of the property served and the amount of frontage which that property has on a given street.

Further, for roadways which are part of the State ofFlorida highway system the number and location ofcurb breaks shall be in conformance with Chapter 14-96 and 14-97, rules of the Florida Department of Transportation and the Departments Access Management Manual.

4.2.3. l Number and location ofcurb breaks. A curb break is a driveway or any other point of access or opening for vehicles onto a public street. The number and location of curb breaks shall be regulated as follows:

1. One ( 1) curb break shall be permitted for ingress and egress purposes to a single property or development.

2. Two (2) curb breaks entering on a particular street from a single property or development may be permitted if all other requirements of this Section are met and if the minimum distance between the two curb breaks equals or exceeds twenty (20) feet.

3. Three (3) curb breaks entering on a particular street from a single property or development may be permitted if all other requirements of this Section are met and if the minimum distance between adjacent curb breaks equals or exceeds one hundred (100) feet.

4. More than three (3) curb breaks entering on a particular street will be permitted from a single property or development where the minimum distance between adjacent curb breaks equals or exceeds one thousand (1,000) feet.

4.2.3.2 Width ofcurb break.

1. The width of a curb break shall be within the minimum and maximum limits as specified below:

Note:A culvert shall be required to be installed as part ofany newly constructed private driveway or road, or public road, which connects to a county road in Columbia County. Such culverts shall require a permit from the County Building Inspector and shall be installed in accordance with the provisions of County Resolution 8eR 4S 2000R-9, as amended.

2. All curb break widths shall be measured at the street right-of-way line.

3. In no case shall a curb break width be less than twelve (12) feet.

4.2.3.3 Areas of limited street improvements.

1. No curb break shall be constructed in the radius return ( curved arc between intersecting street pavements) of an intersection.

2. No curb break shall be constructed nearer than ten (IO) feet from the intersection of street right-of-way lines.

3. No curb break shall be constructed nearer than five (5) feet from any interior property line.

4. To prevent vehicle overhang on private property in the vicinity of curb breaks, off-street parking areas, and off-street loading areas, a six ( 6) inch raised curb and/or parking stops shall be constructed a minimum

5. No curb break shall be permitted to include any public facility such as traffic signal standards, catch basins, fire hydrants, utility poles, fire alarm supports, or other similar type structures.

4.2.3.4 Curb break permit. No curb break shall be established or altered without a permit issued by the Land Development Regulation Administrator.
