April 9, 2016

I. Call to Order

- President Brian Owens called the regular monthly meeting of the Columbine

Lake Country Club Board of Directors to order at 9:00am. Other Board members present were Mark Woltkamp, Kirstin Reimann, Neal Cross and Stephanie Kroepfl. Staff member Chris Atencio was present, as well as ARC member Robb Shamo. Brian Owens was elected President during a CLCC Board Executive Session held via conference call on 4/4/16 from 7:08 through 7:44 pm.

II. Approval of Minutes The minutes of the March 12, 2016 Board of Directors Meeting were reviewed and a motion was made by Stephanie Kroepfl, seconded by Kirstin Reimann, and passed unanimously to accept the minutes as amended.

III. Members Forum

Dennis Hathaway: submitted letter to the board regarding snowmobile use and he read the letter out loud. See Appendix B for details of that letter.

Rob Shamo: Can the board share the survey results to the membership? Why don’t we allow motor boats on the lake? He thinks this is because of gas and noise. Why is this different in the winter? Read passages from a Colorado and national state survey about the damage snowmobiles can cause on public use land and relate it to snowmobiles on our lake.

Steve Tarr: He uses snowmobiles on the lake to assist with ice fishing. This is different than racing across the lake. Need to understand the different uses of snowmobiles on the lake.

Jean Cross: I feel a change in the atmosphere when I walk into the clubhouse & see the new exercise equipment. The town is investing in the Grand Lake Center which will have an exercise facility, so we may want to support the town instead of investing in exercise equipment at CLCC.

Piet Knight: presented three different versions of CLCC shirts he put together. Piet is doing it on his own as a hobby and thinking about selling the shirts at cost. Would like to sell at CLCC events.

Marilyn Binkley sent a note to Chris asking about Kinnikinnick road issues. Three Lakes will come back in the spring and make the necessary repairs.

IV. Financial Reports

Noteworthy expenses for March were $2000 for ½ of the flooring for the men’s and women’s bathrooms. Noteworthy expenses for April will include the second half of the flooring ($2083).

Reserves: Received a refund for past tax liens. Reimbursed the miscellaneous operating fund; then deposited the difference ($3741) into the reserve account. The reserve total for the end of March was $192,339

Highlights: Received a second new home start fee ($7000) in March which is found under Building Permit Fees, and then two additional home start fees ($14,000) on 4/6/16.

A motion was made by Kirstin Reimann, and seconded by Neal Cross, and passed unanimously to accept the Financial Report as presented.

V. Manager’s Report

Attached are Whitmer Law Firm’s response to our questions asking clarification about election rules. (His associate Andrew Moore completed the response.) Explained the new voting process. Big difference is that the ballots will not be numbered, per our attorney’s recommendation. Also, if we had an uncontested election, then the HOA should not hold an election. This year, we will have five people on the ballot for three positions so the election for officers will take place.

Information from the Recreation Board Meeting that is of interest to Columbine Lake include:

o Clearing of 111 acres on the other side of golf course - The property is owned by the Rec District, Baptist Camp, Jimmy Reed and the Warner Family. The reason that this is important for us is that it creates a large fire break west of Columbine Lake.

o Grand Lake Nordic Center closed for the season on Sunday, April 3rd. o Golf greens will be cleared beginning Monday, April 11th

Upcoming Events:

o April 8th- Game Night (last of the season)

o April 22nd – Pot Luck (last of the season)

o Late May – Kids Fishing Derby (shortly after fish are delivered)

o July 2nd - 4th of July Celebration

o July 30/31 – Slash and Trash

Preview day for all unclaimed boats is May 29th. Sealed bids will be taken for them until May 30th

Multiple plowing days, but spring came early. We will begin filling potholes this month. Road grading will begin in May and dust control in June.

ARC:

o New Build 816 Columbine Drive (Block 8, Lot 37) Met with Owners in Denver on March 26th. They are

downsizing plans a bit. No major changes to house.

Last game nights and potlucks for the season are this month. Consensus is that next year the game nights should occur on Fridays.

VI. Administrator’s Report

The Columbine property of which CLCC purchased past years of tax liens was redeemed in full by the homeowner in late March. Interest paid to Columbine Lake was approximately $1,000.

Our 2nd quarter newsletter has been sent to all homeowners. Some of the topics mentioned included our upcoming Annual Meeting on May 29th, wildlife, rental reminders, trash/dumpster issues and the use of our homeowner & fishing pass.

Administrator Negri has been working with our general manager Chris Atencio to clean up the 2015 ARC permit files. Ms. Negri has made all new files for the open permits going forward, as well as all completed permits. All closed-out permits have been boxed to make room for the new ones.

Our 2016-2017 budget process has begun. Each line item has been reviewed by our general manager and administrator. The next step is to meet

with our Columbine Lake Treasurer, Stephanie Kroepfl. The last meeting of the budget committee will occur before final presentation to the Board in April.

The process for our upcoming CLCC Board Elections & Budget approval has begun. Questions have been sent to our new attorney regarding these elections. Estimates have been received from our printer for numbering & printing the return envelopes as well.

There were no home transfers for the month of March.

VII. Unfinished Business

Snowmobile Research:

Over the winter, the office/board members have received complaints about noise and high speeds of snowmobiles on the lake. The survey was completed to gain an understanding if these complaints reflected the feelings of the overall membership.

The survey results were not intended as a membership "vote"; instead, the board planned to use the information as one element of their decision process.

The results for question #1, which asks if snowmobiles should be banned (excluding those used for ice fishing), highlights how split the membership is on this issue. Strongly Agree=36%, Agree=21%, No Opinion=13%, Disagree=14% and Strongly Disagree=16%. (For full results of the survey, see Appendix A)

The idea to put a 15 mph speed limit was originated from member forum comments and unsolicited member comments on the survey.

There are numerous places within the CLCC Bylaws which mention snowmobiles on the lake; therefore, it was the intent of decades past boards that snowmobiles are allowed on the lake.

The Board noted that snowmobiling on the lake only occurs during a limited time frame (Jan-Mar) and high use is typically only seen on holiday weekends. The vast majority of snowmobilers within CLCC this winter were responsible drivers; therefore, we are discussing this issue because of the actions of the few. Staff confirmed that some of issues were from renters not owners.

Staff will add adequate speed limit signage and make the membership aware of the new speed limits through their available channels next winter, monitor the impact and inform the Board.

A motion was made by Mark Woltkamp, seconded by Neal Cross, and passed unanimously to not ban snowmobiles on the lake, but add a 15 mph speed limit with signs and change the bylaws to reflect this.

Chris Atencio spoke with the Grand County sheriff. The roads are county roads, therefore, speed limits must be followed. Regarding snowmobiles, they follow under the same rules and regulations. The sheriff agreed to send officers to Columbine on Saturdays if we ask to monitor snowmobile, ATV or car speeds.

Camera at the Dumpster

Total cost for Grainger is $2100 – includes 6 cameras

General manager Chris Atencio has verified with the sheriff that it is against the law to dump illegally at the dumpster, so CLCC would go to the sheriff to press charges.

Waste Management is also looking into ways to secure their equipment.

Chris plans to get a recycling bin; will cost an extra $100/month. It will be monitored on certain Saturday’s for a few hours so non-recyclables will not be added. It will not be open when it is not monitored. The board is interested in this option.

Chris suggests that we wait to approve the expenditure until next month after we hear from the sheriff, Waste Management, and to project cost savings

Clubhouse Flooring

Scheduled to put floor in men’s and women’s bathroom on 4/12/16 and the clubhouse will be closed until 4/15/16 to allow the floor to cure properly.

Block 10, Lot 46 – 847 Columbine Drive:

It has come to the boards’ attention that there are extenuating circumstances surrounding this property. The board has tabled further discussion until a later time.

VIII. New Business

Conflict of Interest Policy – All board members present signed this policy. We will need to get signed documents from John Amerman, Rick Bishop and the new board members

2016/2017 Budget

The CLCC Budget Committee presented their proposed 2016/2017 CLCC Operating Budget and Reserves to the CLCC Board. After minor adjustments, the Board is proposing no increase to HOA dues for the 2016/2017 fiscal year (dues are currently $726/year). The Projected Revenue is $416,694. Since CLCC is a non-profit and thus zero-balance budgets, the Projected Expenses are also $416,694.

Due to the four new home starts YTD (three more than in the 2015/2016 Budget), there are no funds allocated in the 2016/2017 Operating Budget to feed the 2016/2017 Reserves. The Board and staff will manage April-June 2016 expenses to ensure necessary funds will be available in excess of the budget to be able to fund the Reserves at a 75% level for the next fiscal year.

For 2016/2017 Reserves, CLCC had originally budgeted $15,000 for new road base for Columbine Drive. Our general manager received one bid for a minimum cost of $65,000 for 3” of base. Therefore, this item was removed from Reserves and replaced with $2500 to study the best course of action for Columbine Drive. Also added $4000 for a Security Card Swipe system. Therefore, the budgeted expenses from the Reserve Account for 2016/2017 is $30,700.

A motion was made by Neal Cross, and seconded by Kirstin Reimann, and passed unanimously to accept the 2016/2017 Proposed Budget.

There being no further business to discuss, a motion was made and passed to adjourn the meeting at 12:10pm.

This winter, the Board received complaints regarding the noise and speed of snowmobiles

driving on the lake. The topic was discussed at the February 13 Board meeting but no decision

was taken. To provide the Board with more information from the homeowners on this issue prior

to taking any action, it was decided that a survey should be conducted.

Our current database of information on the CLCC indicates there are 605 lots of which 100 are

vacant. Of approximately 505 homes, we have e-mail addresses for 334 and no e-mail for 155.

As a result, we sent an electronic survey via Survey Monkey to those with an e-mail address and

a paper survey to those who don’t.

Keep lake a tranquil area.

My concern is the people walking around the lake in the middle of the road acting like they own it.

My guess is the complainers are people who live on the lake and those who don’t own snowmobiles.

When CLCC was first developed, the promise was “so quiet you can hear it.”

Didn’t the original covenants prohibit “motorized vehicles from the lake? Board just didn’t enforce it.

Original founders of CLCC never dreamed of snowmobiles on the lake.

The Nanny State continues!

Make sure renters know they can not take snowmobiles on the lake.

The use of snowmobiles and ATVs in CLCC has been abused by people having an entitled mentality.

Don’t punish the majority for the acts of the minority.

This is the snowmobile capital of the USA. I bought in CLCC to be close to the trails and lake. I built my

garage around snowmobiling with two doors and a powerful heater. You banned renters, now

snowmobiling, what’s next?

I have no interest in snowmobiling in CLCC, but I oppose in general principle any attempt to turn CLCC

into a geriatric retirement community. Some residents consider CLCC their private fiefdom. Most

snowmobiles don’t leak oil.

I am OK limiting access hours but no ban.

If this is a change to owners regulations. A careful definition of "those used for hauling fishing equipment

for ice fishing" will have to be carefully defined.

Would allow if they kept to 15mph but they race

I think all snowmobiles should be allowed on the lake but the 15mph speed limit should be enforced on the

lake as well

There are many places to take the snowmobiles. The lake is a more relaxed area where people are fishing,

walking, XC skiing...enjoying the beauty. There is no need for a snowmobile person to play around on the

lake when there are already so many options.

We have had our dock destroyed by them jumping off them. We do not appreciate the noise and destruction

done. We think that all people should be off the lake by dark.

If it is a ban it should be all snowmobiles on lake….cannot do half deal.

One of the best things about CL is the rule that allows snowmobiles and ATVs to travel from one place to

another

The time should be limited and the speed! Personally I wish ice fishing wasn't allowed in winter.

But how would this be enforced if some snowmobiles are still allowed on the lake?

I would feel differently if i lived on the lake

There are already too many rules.

If you ban some, you should ban all.

What's the difference between snowmobiles and power boats on the lake. Power boats are not permitted.

There are enough other places to ride fast and they are close by and freely accessible.

Limit the amount of time they can ride and the speed

But my guess would be that it is not good to make problems on lake.

If Banned, I think it will be hard to enforce, and I think will cause hard feeling in the community between

the snowmobiler and non-snowmobilers

I had the belief that this was already prohibited.

Allow snowmobiles on the lake for whatever purpose, but enforce the 15 mph speed limit as we have on

the roads.

I would prefer no snowmobiles be allowed on the lake. The lake is too small and the conditions shouldn't

require a hut. Go old school.

Have small children that enjoy riding around the lake, snowmobiles on the lake is not a big issue

Strongly Disagree. Current rules prevent continuous riding. This is adequate.

Snow mobile speed limits and regulations, signs, etc. have been posted since we have built our home in

Columbine Lake and it appears folks don't adhere to them; therefore, I would vote for the number one

choice.

You could have a speed limit or curfew or other rules instead of a ban.

In my view the desires of the few who oppose them are no more or less significant ten those who don't

The snowmobiles who access the lake should adhere to the 15 mph rules.

I believe that oil and other by products end up in the lake. Over time, these could easily damage the fragile

ecosystem of the lake.

Q#4 Do you live directly on the Lake?

I live on the golf course, and bought my cabin specifically to be as far away from snowmobile noise as

possible. I value my quiet location, and the ability to go out my back door to the Nordic center to cross

country ski.

But we can hear the snowmobiles when they are on the lake

But we can relate that the noise would be nerve racking for those wanting some solitude.

This shouldn't matter. Noise carries. There are 110 miles of trails just outside CLCC. Go there and be loud

and stay as long as you wish.

Q#6 Do you use the lake in the winter for activities other than snowmobiling?

Walk my dogs.

Ice Fishing

I enjoy the serenity of the mountains, and I love walking around the lake. It's obnoxious to hear

snowmobiles, smell their fumes etc.

It's a great safe place for our grand kids to ride their Kitty cat Snowmobile, we pull the kids in a tube

behind a snowmobile on the lake, we walk across the lake.

We have walked across it with grandchildren.
