n Must be in the Express Business Eligible Class table, or be an Express Business classified in PennPlus quoting application.

n Must have been in business for at least three years or have at least three years management experience in this type of business.

n Must have three or fewer losses during the prior three years, with the total less than $5,000.

n Risks must not have been cancelled or non-renewed for underwriting reasons or nonpayment of premium.

n Any applicant with any bankruptcies, tax or credit liens in the past five years are not eligible.

n Multiple named insureds require prior approval.

AutomobileGeneral Authority

n Ten vehicles or fewer.

n Auto liability limit authority = $1 million; medical = $5,000.

n Auto physical damage minimum deductibles are $250 comprehensive and $500 collision.

n Acceptable vehicle types: private passenger types*, pick-up trucks, delivery vans, light trucks*, medium trucks (GVW 20,000 lbs. or less) and utility trailers.

n Radius must not exceed 100 miles.

n Uninsured motorists and underinsured motorists stacked limits are not eligible (PA & NC).

n Drivers must be licensed a minimum of 5 years.

n Appropriate driver screening program.

n Any driver with one or more of these violations in the past three years may not be written: DWI/DUI, vehicular homicide, reckless driving, driving with a suspended or revoked license, driving without a license, using a vehicle in the commission of a crime, and leaving the scene of an accident.

n Drivers 70 years of age or older.

n Monoline policies.

n Trucking-for-hire exposures.

n Pollution buy-back.

n Motor carrier endorsements, including MCS–90.

n Garagekeepers legal liability.

n Individually owned autos registered to anyone other than a sole proprietor.

n Any hired auto or nonowned auto coverage, if there are delivery exposures and employees using their own vehicles.

n Maximum of 50,000 sq. ft. of eligible occupancy.

n If combined wholesale and retail, retail cannot exceed 25 percent of total receipts.

n Direct importing is not eligible.

n Sale of any second-hand products is not eligible.

n Discount retail stores or factory outlets are not eligible.

n Rental operations are not eligible.

Lessor’s Risk

n Buildings or premises not occupied by the insured must meet the eligibility criteria for the risk occupancy.

n Eligible BOP classes listed in the Express Business Eligible Class table must occupy at least 85 percent of the building. All office occupancies will be considered BOP eligible.

Mercantile – Retail

n Maximum of 50,000 sq. ft. of eligible occupancy.

n Maximum of 50 percent of total receipts from off-premises installation or repair.

n If combined retail and wholesale, retail sales must exceed 25 percent of total receipts.

Office

n Building coverage – maximum of 10 stories or 100,000 sq. ft. in total area, with no more than 15,000 sq. ft. of other eligible occupancies.

n Business Personal Property – maximum 50,000 sq. ft. in any one building.

Mini-Warehouses

n Establishments renting storage space to individuals or businesses. Facilities should consist of many individual storage units, each subject to access by the lessee.

n Unlimited numbers of storage units, buildings or square footage.

n Movement of stored items is the sole responsibility of the lessee.

n Ownership or operation by a moving, storage or trucking company is not eligible.

n Lessees must sign a contractual lease with a hold-harmless agreement in favor of the insured, and there must be written restrictions on hazardous and/or flammable items stored.

n Processing, manufacturing or repair operations on premises are not eligible.

n Truck rental or leasing operations are not eligible.

For a very affordable cost, you can close the gap in coverage against claims against contracting work.

A value-added, affordable endorsement that extends coverage not commonly provided by your Commercial General Liability. Coverage protects contractors from a claim made for damages they are legally obligated to pay as a result of a negligent act, error or omission, or defect in materials or in a product sold or installed.

A wallpaper contractor is contracted to re-wallpaper all of the rooms in a hotel during a renovation project. Due to the use of an inadequate adhesive, the wallpaper begins to peel throughout the hotel after completion of the project. The Contractor’s Errors and Omissions endorsement would pay the cost to re-wallpaper the entire hotel up to the Contractor’s Errors and Omissions limit.

An electrical contractor installs a new electrical panel in a factory. Faulty installation causes the panel to catch fire and the factory is destroyed two weeks after completion of the work. The electrical contractor’s general liability policy would pay for the factory damage, with the exception of the electrical panel, which would be excluded. With the purchase of the Contractor’s Errors and Omissions endorsement, the cost to reinstall the panel would also be covered.

If the factory had not caught on fire, but the electrical service was disrupted due to the faulty installation of the electrical panel, the Contractor’s Errors and Omissions endorsement would still pay for the cost to repair or replace the panel.

An HVAC contractor converts a residential property from electrical baseboard heat to a new duct-based system. After installation, the new system fails to satisfactorily heat the residence. If it is concluded that the ducts are improperly installed, the Contractor’s Errors and Omissions endorsement would pay for the cost of remedying the defective duct installation.

A plumber is hired to install lines running to a new sink in an addition to a residential property. After installation, it is determined that the improper soldering of pipe permitted a leak which damaged the flooring. The general liability policy would pay for the resultant damage to the flooring, but would exclude damage to the faulty plumbing work. The Contractor’s Errors and Omissions endorsement would also pay for the cost of the corrections to the plumbing system.

Our Crisis Response Coverage is affordable, extra protection that addresses additional expenses and business interruption generated by a crisis incident. The coverage can be added to any Penn National Insurance BOP policy or property policy that includes time element coverage.

Violent Act

• Child abduction or kidnapping

• Stalking of employees or customers

Contaminated Food

The necessary announcement or closure of your covered location ordered by a board of health or any other governmental authority as a result of the discovery or belief that contaminated food or drink has been served to patrons there.

Premises Contamination

Necessary closure of your covered location due to any sudden, accidental and unintentional contamination or impairment, which results in clear, identifiable symptoms of bodily injury, illness or death. This includes locations contaminated by communicable disease or Legionnaires’ disease, but does not include contamination by other pollutants or fungi.

Crisis Incident Communication Expense

• Reasonable and necessary expenses for the services of a public relations firm or other crisis communication firm to guide, advise or assist you in internal and external crisis communications

• Reasonable and necessary expenses incurred by your own communications department beyond those of its normal communications activities for you to guide, advise or assist you in internal and external crisis communications

Many business owners believe they will never face employee lawsuits. A business would not think of failing to buy fire insurance. But a company is roughly three times more likely to have an employment practice claim than a fire.

Myths about EPLI coverage

Employment laws only apply to large employers. Many states have employment statues that lower the employee threshold to as low as one employee for some laws.

We treat our employees like family. Even the happiest families have disputes from time to time, and even end up in court. In a partial database of EPLI verdicts and settlements, nearly 1,000 claims involved businesses with fewer than 15 employees.

I’m covered under business liability and umbrella coverage. Most General Liability and Umbrella forms specifically exclude employment practices. EPLI policies handle the unique employment practice exposure.

We’ve never had an employment problem. One in six American workers feel victimized by job discrimination. Would you consider a fire so unlikely as to go without coverage? Yet, the number of employment claims exceeds that of commercial fires by a margin of three to one.

I can’t afford it. A typical company with five or fewer employees will find $100,000 in protection costs about $400 and $1 million in protection costs about $1,000.
