]n accordance with Department of Land and Natural Resources, Commission on Water Resource Management's Administrative Rules, Section 13-168, entitled "Water Use, Wells, and Stream Diversion Works", this document permits the abandonment/sealing of Puunene TH and Shaft (Well No. 4928-01 & 02) at Mokulele Highway nr old airport, Maui, TMK 3-8-8: I, subject to the Hawaii Well Construction & Pump Installation Standards (HWCPIS - February 2004) which include but are not limited to the following conditions:

I. The Chairperson of the Commission on Water Resource Management P.O. Box 621, Honolulu, Hawaii 96809, shall be notified in writing before any work covered by this permit commences.

2. This permit shall be prominently displayed, or made available, at the site of construction work until work is completed.

3. The well construction permit application is incorporated into this permit by reference and is subject to the HWCPIS. If the HWCPIS are not followed and as a consequence water is wasted or contaminated, a lien on the property may result

4. The Well Abandonment Report form shall be submitted to the Commission on Water Resource Management within sixty (60) days after completion of the work. Please contact staff or visit our website at www.state.hi.us/dlnr/cwrm for the current form.

5. The permittee shall comply with all applicable laws, rules, and ordinances.

6. The sealing shall be completed within two (2) years.

7. Special conditions in the attached cover transmittal letter are incorporated herein by reference.

To validate your permit, please sign both permit originals and return one for our files.

IMPORTANT - The contractor is responsible for all conditions of the permit. This includes ensuring that the submission of a completed Well Abandonment Report form (enclosed) within sixty (60) days after the well construction work is completed. Be advised that you may be subject to fines of up to $5000 per day for any violations of your permit conditions.

Our original route slip indicated we should get some loose ends tied before proceeding. You were notified by fax on March 14, 2007, and that effort is underway; we have confidence that those matters will be resolved shortly. Meanwhile, we understand that road construction is proceeding, with the two wells in the way. Because it is a sealing rather a producing water water permit, we are waiving the loose-end requirement for these permits. We will get them finalized today if possible, and faxed to you this afternoon or early tomorrow morning if necessary. You should proceed with that understanding to prevent any further delay.

Subject Puunene well sealings 4928-01,02

Per our conversation, I understand from you that the Mokulele Hwy project will be reaching the area of these well sealings this week and that these wells are essentially located in the middle of the road construction. I am not sure why these applications are being held up as they are sealing work, hence reducing threats to the resource by eliminating direct communication between the ground surface and aquifer which we encourage. We also have an understanding with DOH such that sealing work does not require their normal well review to similarly help achieve this protection to the aquifer. Charley is on vacation, so I will have to go through his things to find the paperwork to shed some light on what is the hold up, if any. You also said there are some engineering documents specifying how to seal the wells and that if was not part of the original well application then you'd forward them to us.

Therefore, given the time constraints and the above issues I'm saying go ahead seal the wells and we will try to issue the permit asap before you start. The worst that may result from this is that this will become an after-the-fact activity but this email should suffice in removing any recommended fines from Commission staff should it come to an after-the-fact situation.

As per the conversation today with Chad Goodfellow, please find attached the Application for Well Permit for two wells that are to be abandoned as part of our contract with the DOT.

Goodfellows Bros., Inc is the contractor performing the work on the DOT contract for the Mokulele Highway Widening Project as referenced above. The contract specifications and plan sheet are also attached.

We would like to perform the abandonment work as soon as we receive approval of this permit.

Please let us know where to send the original application and permit fee.

(8) Neat cement grout shall be mixed with one 94-pound sack of cement and not more than six gallons of clean and potable water.

Construction Requirements.

(A) Licensed Contractor. The Contractor performing the well abandonment and sealing shall be a Hawaii licensed contractor holding a C-57 type license.

(8) Approval of Well Abandonment/Sealing Permit. No work at the site shall be performed prior to approval of the permit by the Water Resources Commission.

(C) Sounding of Wells. Prior to sealing, both wells shall be sounded to determine that they are free of obstructions which may interfere with sealing, and to verify their physical dimensions and conditions. Findings of the sounding shall be reported to the Engineer.

(0) Removal of Obstructions. Any obstructions, equipment, machinery, foreign materials or loose casing remaining in the wells shall be removed if possible. Well casing or conductor pipe remaining in the ground shall be cut off eleven feet below existing ground at the top of the well.

(E) Well 4924-01 Sealing. Well 4924-01 shall be sealed as soon as practicable after preparations are completed, in accordance with this specification.

On Friday I check out Shaft 34 (4928-02) near the old Puu Nene Airport. The shaft is in a house and most of the 6'x9' vertical shaft is covered. There is a small 2'x3' opening. I dropped a rock down and it hit water. The proposal Noda Engineering to fill the shaft with gravel until it reaches inside the 6'x9' shaft and then fill to the surface with concrete is reasonable.

I also checked well 4928-01 which is about 500' north of the shaft. That well should also be sealed. It appears to be abandoned. I'll have my photos developed today and will put them in the well file.

The standard well abandonment procedure would have us fill with sand cement grout, but this would take a large quantity of material (estimate at 100 cubic yards for the vertical shaft, and perhaps 80 cubic yards or more for the tunnels).

Could this well be sealed by filling some large portion of the shaft with rock, then sealing the remainder with sand cement grout? It would seem that grout would seal the shaft pretty well considering that the shaft penetrates 30 feet of dense basalt.

Our field crew will observe this shaft next week but probably not enter the shaft. If there's further detail revealed I will relay it to you.

I have a well abandonment specification ready, which is largely a repeat of the standard requirements, but it seems a little excessive to grout the entire volume. I think we can seal the well and protect the aquifer without making the grout suppliers get rich. I'll keep the standard procedure in place for the other well, which is only 8 inches diameter.

A sketch of well 4928~02, also known as Shaft 34, owned by HC&S, follows. It waS drawn during a field conducted May 22, 2000. The shaft was not entered. Anyone considering to enter the shaft should be aware of confined space procedures and should verify the atmosphere prior to entry. By dangling a weighted tape from the surface, the depth to top of horizontal gallery is approximately 43 feet, to water approximately 47 feet; to bottom approximately 53.5 feet. The steel ladder into the shaft appears to be in good condition near the surface.

The wellhouse is locked but bring a large straight screwdriver to get in ...

Also provided with this fax is a copy of the preliminary highway widening plan. I realize it doesn't locate the site too well; the best description I can provide is that the well is between the MurrayAir and Maui Drag Strip driveways. By the plan, it is about 200 feet from the edge of pavement and is the only wooden building in the area.

Subject: Water Quality Analyses of the Puunene Airport Well

Enclosed is a copy of the results of physical and chemical analyses of the water sample taken from the Puunene Airport Well. As indicated in the results, the concentrations of chloride and total dissolve solids, 305 mg/l and 1010 mg/l respectively, exceed the limits of the U.S.P.H.S. Drinking Water Standards for such parameters. Also, based on the total hardness result of 300, the subject well water would be classified as livery hard. II

The proposed blending of waters from the Puunene Airport Well and MOkuhau Well to result in water quality which would meet the U.S.P.H.S. Drinking Water Standards would not violate the State's antidegradation policy pursuant of Chapter 37, "Water Pollution Control, II of the State Public Health Regt1lations. The blending of water from various sources to produce potable water is considered an acceptable practice by the Department of Health.

We have no objections to the blending of waters from the aforementioned wells. However, we recommend that the following measures be implemented:

1. The blending of waters incorporate the highest ratio of Mokuhau Well to Puunene Airport Well waters possible, but in no case should such ratio be less than the 2.2 ratio recommended by the Department of Land and Natural Resources.

2. The appurtenances required to achieve the above objective be constructed so as to prevent contamination of the water supply system.

3. A program to monitor water quality of the Puunene Airport Well and the blend water be implemented.

4. Your efforts to investigate other potential sources of drinking water should be continued.

Enclosed are results of analyses on water sample submitted recently to our laboratory from Puunene Airport Shaft. Chloride and dissolved-solid contents exceeded the recom­mended limits for drinking water standards set by PHS. The sample is classified as medium alkali hazard using U. S. Salinity Laboratory Staff's classification of irrigation wa~ers, and is also considered very hard water by the U. ~. Geological Survey hardness classification:
