City Clerk recommended tha t the printed pamphlets of Council proceedings of February 1, 1926, be corrected by striking out the word 'Contingent' in the next to last line of resolution rela+ive to transfer of moneys on page 346 and inserting therefor the word "Street,' said line when corrected to read; From Fuller St. Bridge to Street Fund $577.68.
Moved by Aid. Maulbetsch, tha t recommendation of City Clerk be concurred in.
Adopted by following vote: Yeas, Ala. Slauson, Graf. Maulbetsch, Lucas, Sweet, Dwyer, Ware, Moore. Freeman. Bursley, Young, Lutz, Pres. Woodbury. 13. Nays, none.

Conimunicittions Frciiii Board of Public Works City Engineer recommended
that one new Ford runabout with steel box be purchased at a cost of $395.00 for Engineering Oe-partment.
Moved by Mr. Rentschler, tha t Board asks Council for i)ermission to purchase one new i^ord runabout as recommended, and for permission to trade in old Fordson tractor, for a new Fordson at a price of $462.50.

on motion of Aid. Lutz. From Board of Appeals.
Moved by Mr. Gram, that the Board of Appeals respectfully returns the petition of Helen M. Woodliff for change in the use of property located at 545 E. University ave. with recommendation that it be denied; but tha t permission be granted contra.-y to the provisions of the zoning ordinance to erect a business property 28x30 ft. of fireproof construction, plans subject to approval of the City Engineer.

sale by the City Treasurer of $1,500 of Water Rights Bonds.

Resolved, that the City Treasurer be authorized to sell Water Works bonds issued May 15, 1920, to the amount of $1,500 to net not over 4 1-4 per cent interest.

Aid. Slauson made oral report that the Allen Cre3k drain tax on property acquired by City from Dana Hiscock, et. al., amounted to $1.452.00, that the 192 5 tax amounting to $96.80 had been paid by Mr. Hiscock, leaving balance of $1,355.20 which can be paid in 3 4 annual installments W3th 6 per cent interest, or paid in full at this time without interest.
On motion of Aid. Slauson. matter was referred to Budget Committee.
Aid. Slauson presented bill of Cavanaugh & Burke for $1,575.00 for services in re. Carrie Davidson, et. al., vs. City of Ann Ai'bor, which said bill was approved by Board of Water Commissioners Feb. 9, 1926.
Moved by Aid. Slauson, tha t bill be allowed and City Clerk instructed to draw warran t in payment of same.

Whereas, the State Highway Department has submitted to the City of Ann Arbor for approval general plans for that part of a proposed belt line highway cut off and a Grade Separation project known as Federal Aid No. 74, crossing the t;jutheastern portion of the said City and the said portion of this highway lying within the city limits and more accurately described as extending in an approximate straight line from the center-line of Stimpson Avenue a short distance west of East University Avenue to the centerline of Stats Street a short distance north of Rose Avenue, as shown on the plan H-l l -A-3 sui'omitted to the City for approval; and
Y hereas the State Highway Department has through its Bridge Engineer at a public meeting of 1he City Council 'of the c t y of Ann Arbor held on February 1, 1'926. reouested the City to par-tic.pate in the cost of the afore-5-aid Grade Sf i>aration pro ect.
Now therefore be it resolved: A. That the Ptate Highway De
partment shall build a Grade Sep-pration over State Stre'"t. including therein conduit fVr lighting and li"-hting fixtures and also including the reconstruction of pipe, conduit and sewers made necessary by the construction of this structure with the understanding that the City of Ann Arbor shall connect wire and provide fixtures for lighting the structure, the City of Ann Arbor to pay 12 1-2 per cent of the cost of the sfcid structure which is estimated at a total of $18,546.00. C.ty's share not to eyceed $2..'il8.2u.
B. The State will grade and remove the east walk on State Street in accordance with the profile shown 'on plan H-l l-A-o, utilizing the excavatod material in the fills for the Grade Separation and on this understanding the City to bear no part of this cost
C. The State will provide facilities in State Street extending from Granger Avenue south to the south city limits as follows:
1. Cur") and gutter with 18-inch gutter pan 'on each side of t\}e
Street with a distance of ^4 feet from face to face of curbs.
2. Rebuild sidewalk on east side of the street where made necessary in order to maintain the grade not higher than 1 foot above the proposed top of curb elevation.
3. Place one course Class A gravel of 4 inch compacted thickness in State Street for the full width of 31 feet inside the gutter pans.
4. Restore interrupted or dis-r»laced pipe, conduit or sewers in State Street if found necessary.
5. State to save the City of Ann Arbor harmless from any and all damages arising from the project, including change of grade on State Street, and at its expen'ic to defend any and all actions and pay all damages assessed in connection therewith.
6. The City of Ann Arbor shall bear 25 per cent of the cost of the wbrk done undt r items 1 to 4 inclusive above except as otherwise noted, the ei^timated total cost of these items 'b-^lng $.^,776.00, City's share not to e^ceed $994.00.
D. 1. The State will provide the right of way for openng up Rose Avenue from White Street to State Street with a right "of way width of 40 feet, measured from foot of the north slope of Federal Aid 74, and will absorb the abuttal damages and property purchase neces-pavy to open this street, the city of Ann Arbor to pay n'o part of the cost of this Item No, 1.
2. The State will grade Rose Avenue for a width of 40 feet inside the above limits the City to bear no part of this cost.
3. The State will provide one course Class A. gravel of 4 inch compacted thiskness on R o s e Avenue within the above limits with a width of 16 feet.
4. The State will reconstruct water pipe, conduit and sewers in Rose Avenue where interrupted within the above limits.
5. The City of Ann Arbor shall ibear 2 5 per cent of the cost of the work under items 1, o and 4 abbve except as otherwise noted, the total estimated cost of these items being $676.00. City's share not to exceed $169.00.
E. 1. The State will provide right of way for extending Henry Street tt> the west from White Street to intersect with State Street with right of way wii th the same

as for the present street the City to bear no part of this expense.
2. The S t i te will provide one course Class A. gravel of 4 inch compacted tliickness on Henry Street insitle the above limits with a width of 16 feet.
'^. The City of Ann Arbor shall bear 25 pei cent of the cost of item 2 except as otherwise noted at a total estimated cost of $n77.00. City's share not to exceed $94.25.
F. The City of Ann Arbor does hereby approve the plans and otherwise insofar as its authori ty may extend, the c'onstruction of this belt line highway through the said city limits as hereinbefore described subject to the condition that it shall not participate in the cost of said work except as hereinbefore noted.
1. City and property owners and puulic utility companies shall at all t imes have the right to InstaM and maintain all public utiliti*^s and make necessary municipal improvements as shall be deemed necessary
G. In the event that the City of Ann Arbor should wish to pave State Street from Granger Avenue south to the south city limits, it is agreed tha t the State and City shall share equally in the excess of the cost of paving over and above the cost of gravel surfacing of State Street, the latter cost being shown on the estimate for this work hereto at tached and forming a part of this resolution agreement, and est:mated at $2,522.00. In this event it is herewith estimated that the city pavement will cost $8,730.00 for a width of 31 feet. The net portion 'of the work to be divided equally then between the State and the City would amount to $6 208.00 leaving the City's share of the paving $3,104.00 and the State's share $3,104.00. this latter item to be considered as chargeable to University improvements. Also in the event the City decides to pave State Street, the State will credit to the city the value 'of the gravel surfacing estimated at $2,-522.00.
In view of the fact that the total estimated City's share of items. A, B, C and D hereinbefore noted aggregates $3,525.00, it is herewith agreed tha t the lump sum of $1 -000.00 payable on completion of the work hereinbefore noted shall be paid by the City of Ann Arbor
to the State Highway Depar tment in full sett lement of all of the bb-ligations of the City as hereinbefore noted in case the City shall elect to pave State Street; and in the event that the City should not so elect the State will gravel this surface and the City shall at such similar t ime as before noted pay to the State Highway Department the lump sum of $ri,500.00 in full payment of all items hereinbefore noted.
H. It is further agreed that the State shall maintain the slopes of embankments , paving and shoulders on Federal Aid 74 and also the State Street Separation structure and tha t the City of Ann Arbor shall maintain the walks, curbs and gutter, lighting and light service, paving or other surfacing, and also drainage in State Street and in all such portions of this improvement as herein noted in which the City of Ann Arbor is participating.
I t is further understood and agreed tha t the State shall require maintenance bends on all paving work for benefit of City in cases where pavement is to be maintained by the City.

City Attorney made oral report of attending hearing before Dept. of Conservation and Dept. of Health at Lansing, Feb. 9, 1926, relative to disposal of sew^age and that the city within six months must file a statem,ent covering the proposed method of disposal.
Mayor Campbell informed Council that two reliable bus companies were anxious to provide bus transportation in this city and suggested, if the Peoples Motor Coach Company do not provide better service, that another company be authorized to replace them.
Moved by Aid. Lutz, that the matter be referred to Railway Committee to require better service from Peoples Motor Coach Company or negotiate with another company to provide bus transportation.
