Sectio 2. If the part" concerned is absent fro the Philippines, he a" a&e the stateent hereinauthorized before an" officer of the %o#ernent of the 'nited tates authorized to adinister oaths,and he shall forward such stateent to!ether with his oath of alle!iance, to the Ci#il *e!istr" of+anila$

AN ACT PROVIDING FOR THE WAYS IN WHICH PHILIPPINE CITIZENSHIP MAY BE LOST ORREAC$%IRED

Be it enacted by the National Assembly of the Philippines:

Sectio !. How citizenship may be lost $ / A 0ilipino citizen a" lose his citizenship in an" of thefollowin! wa"s andor e#ents2

(1) 3" naturalization in a forei!n countr"

() 3" express renunciation of citizenship

(5) 3" subscribin! to an oath of alle!iance to support the constitution or laws of a forei!ncountr" upon attainin! twent"6one "ears of a!e or ore2 Provided, however, That a 0ilipinoa" not di#est hiself of Philippine citizenship in an" anner while the *epublic of thePhilippines is at war with an" countr"

(4) 3" rendering services to, or acceptin! coission in, the armed forces of a forei!ncountr"2 Provided,That the renderin! of ser#ice to, or the acceptance of such coission in,the ared forces of a forei!n countr", and the ta&in! of an oath of alle!iance incidentthereto, with the consent of the *epublic of the Philippines, shall not di#est a 0ilipino of hisPhilippine citizenship if either of the followin! circustances is present2

(a) The *epublic of the Philippines has a defensi#e andor offensi#e pact of alliancewith the said forei!n countr" or 

(b) The said forei!n countr" aintains ared forces on Philippine territor" with theconsent of the *epublic of the Philippines2 Provided, That the 0ilipino citizenconcerned, at the tie of renderin! said ser#ice, or acceptance of said coission,and ta&in! the oath of alle!iance incident thereto, states that he does so onl" inconnection with his ser#ice to said forei!n countr"2 And provided, finally, That an"0ilipino citizen who is renderin! ser#ice to, or is coissioned in, the ared forcesof a forei!n countr" under an" of the circustances entioned in para!raph (a) or(b), shall not be peritted to participate nor #ote in an" election of the *epublic of thePhilippines durin! the period of his ser#ice to, or coission in, the ared forces ofsaid forei!n countr"$ 'pon his dischar!e fro the ser#ice of the said forei!n countr",he shall be autoaticall" entitled to the full en7o"ent of his ci#il and political ri!htsas a 0ilipino citizen

(8) 3" cancellation of the of the certificates of naturalization

(9) 3" ha#in! been declared b" copetent authorit", a deserter of the Philippine &'(e)*o'ce+ in tie of war, unless subse:uentl", a plenar" pardon or anest" has been !rantedand

(-) In the case of a woan, upon her arria!e to a forei!ner if, b" #irtue of the laws in forcein her husband;s countr", she ac:uires his nationalit"$1

The pro#isions of this section notwithstandin!, the ac:uisition of citizenship b" a natural born 0ilipinocitizen fro one of the Iberian and an" friendl" deocratic Ibero6Aerican countries o' *'o( t,e%ite) -i)o( shall not produce loss or forfeiture of his Philippine citizenship if the law of thatcountr" !rants the sae pri#ile!e to its citizens and such had been a!reed upon b" treat" betweenthe Philippines and the forei!n countr" fro which citizenship is ac:uired$

Sectio. 2. How citizenship may be reacquired / Citizenship a" be reac:uired2

(1) 3" naturalization2 Provided, That the applicant possess none of the dis:ualification;sprescribed in section two of Act <ubered Twent"6nine hundred and twent"6se#en,5

() 3" repatriation of deserters of the Ar", <a#" or Air Corp2 Provided, That a woan wholost her citizenship b" reason of her arria!e to an alien a" be repatriated in accordancewith the pro#isions of this Act after the terination of the arital status4 and

(5) 3" direct act of the <ational Assebl"$

Sectio ". Procedure incident to reacquisition of Philippine citizenship$ / The procedure prescribedfor naturalization under Act <ubered Twent"6nine hundred and twent"6se#en,8 as aended, shallappl" to the reac:uisition of Philippine citizenship b" naturalization pro#ided for in the next precedin!section2 Provided , That the :ualifications and special :ualifications prescribed in section three andfour of said Act shall not be re:uired2 And provided, further,

(1) That the applicant be at least twent"6one "ears of a!e and shall ha#e resided in thePhilippines at least six onths before he applies for naturalization

() That he shall ha#e conducted hiself in a proper and irreproachable anner durin! theentire period of his residence in the Philippines, in his relations with the constituted!o#ernent as well as with the counit" in which he is li#in! and

(5) That he subscribes to an oath declarin! his intention to renounce absolutel" andperpetuall" all faith and alle!iance to the forei!n authorit", state or so#erei!nt" of which hewas a citizen or sub7ect$

Sectio #. *epatriation shall be effected b" erel" ta&in! the necessar" oath of alle!iance to theCoonwealth9of the Philippines and re!istration in the proper ci#il re!istr"$

Sectio 5. The ecretar" of ustice shall issue the necessar" re!ulations for the properenforceent of this Act$ <aturalization blan&s and other blan&s re:uired for carr"in! out thepro#isions of this Act shall be prepared and furnished b" the olicitor %eneral, sub7ect to appro#al ofthe ecretar" of ustice$

Sectio 6. This Act shall ta&e effect upon its appro#al$

Sectio ". $pecial qualifications The ten "ears of continuous residence re:uired under the secondcondition of the last precedin! section shall be understood as reduced to fi#e "ears for an" petitioner ha#in! an" of the followin! :ualifications2

Sectio /. Petition for citizenship / An" person desirin! to ac:uire Philippine citizenship shall filewith the copetent court, a petition in triplicate, accopanied b" two photo!raphs of the petitioner,settin! forth his nae and surnae his present and forer places of residence his occupation theplace and date of his birth whether sin!le or arried and the father of children, the nae, a!e,birthplace and residence of the wife and of each of the children the approxiate date of his or herarri#al in the Philippines, the nae of the port of debar&ation, and, if he reebers it, the nae of

the ship on which he cae a declaration that he has the :ualifications re:uired b" this Act,specif"in! the sae, and that he is not dis:ualified for naturalization under the pro#isions of this Actthat he has coplied with the re:uireents of section fi#e of this Act and that he will residecontinuousl" in the Philippines fro the date of the filin! of the petition up to the tie of hisadission to Philippine citizenship$ The petition ust be si!ned b" the applicant in his ownhandwritin! and be supported b" the affida#it of at least two credible persons, statin! that the" arecitizens of the Philippines and personall" &now the petitioner to be a resident of the Philippines forthe period of tie re:uired b" this Act and a person of !ood repute and orall" irreproachable, andthat said petitioner has in their opinion all the :ualifications necessar" to becoe a citizen of thePhilippines and is not in an" wa" dis:ualified under the pro#isions of this Act$ The petition shall alsoset forth the naes and post6office addresses of such witnesses as the petitioner a" desire tointroduce at the hearin! of the case$ The certificate of arri#al, and the declaration of intention ust

Sectio ;. *ompetent court+The Court of 0irst Instance of the pro#ince in which the petitioner hasresided at least one "ear iediatel" precedin! the filin! of the petition shall ha#e exclusi#e ori!inal 7urisdiction to hear the petition$

Sectio <. Notification and appearance+Iediatel" upon the filin! of a petition, it shall be thedut" of the cler& of the court to publish the sae at petitioner;s expense, once a wee& for threeconsecuti#e wee&s, in the =fficial %azette, and in one of the newspapers of !eneral circulation in thepro#ince where the petitioner resides, and to ha#e copies of said petition and a !eneral notice of thehearin! posted in a public and conspicuous place in his office or in the buildin! where said office islocated, settin! forth in such notice the nae, birthplace and residence of the petitioner, the dateand place of his arri#al in the Philippines, the naes of the witnesses who the petitioner proposesto introduce in support of his petition, and the date of the hearin! of the petition, which hearin! shallnot be held within ninet" da"s fro the date of the last publication of the notice$ The cler& shall, as

Sectio !=. Hearing of the petition+<o petition shall be heard within the thirt" da"s precedin! an"election$ The hearin! shall be public, and the olicitor6%eneral, either hiself or throu!h hisdele!ate or the pro#incial fiscal concerned, shall appear on behalf of the Coonwealth11 of the

Philippines at all the proceedin!s and at the hearin!$ If, after the hearin!, the court belie#es, in #iewof the e#idence ta&en, that the petitioner has all the :ualifications re:uired b", and none of thedis:ualifications specified in this Act and has coplied with all re:uisites herein established, it shallorder the proper naturalization certificate to be issued and the re!istration of the said naturalizationcertificate in the proper ci#il re!istr" as re:uired in section ten of Act <ubered Three thousandse#en hundred and fift"6three$1

Sectio !!.  Appeal+The final sentence a", at the instance of either of the parties, be appealed tothe upree Court$15

Sectio !2. ssuance of the *ertificate of NaturalizationEIf, after the lapse of thirt" da"s fro andafter the date on which the parties were notified of the Court, no appeal has been filed, or if, upon

appeal, the decision of the court has been confired b" the upree Court,14 and the said decisionhas becoe final, the cler& of the court which heard the petition shall issue to the petitioner anaturalization certificate which shall, aon! other thin!s, state the followin!2 The file nuber of thepetition, the nuber of the naturalization certificate, the si!nature of the person naturalized affixed inthe presence of the cler& of the court, the personal circustances of the person naturalized, thedates on which his declaration of intention and petition were filed, the date of the decision !rantin!the petition, and the nae of the 7ud!e who rendered the decision$ A photo!raph of the petitionerwith the dr" seal affixed thereto of the court which !ranted the petition, ust be affixed to thecertificate$

Sectio !#. #ees+The cler& of the Court of 0irst Instance shall char!e as fees for recordin! apetition for naturalization and for the proceedin!s in connection therewith, includin! the issuance ofthe certificate, the su of thirt" pesos$

Sectio !5. .ffect of the naturalization on wife and children+ An" woan who is now or a"hereafter be arried to a citizen of the Philippines, and who i!ht herself be lawfull" naturalizedshall be deeed a citizen of the Philippines$

+inor children of persons naturalized under this law who ha#e been born in the Philippines shall beconsidered citizens thereof$

 A forei!n6born inor child, if dwellin! in the Philippines at the tie of the naturalization of the parent,shall autoaticall" becoe a Philippine citizen, and a forei!n6born inor child, who is not in the

Philippines at the tie the parent is naturalized, shall be deeed a Philippine citizen onl" durin! hisinorit", unless he be!ins to reside peranentl" in the Philippines when still a inor, in which case,he will continue to be a Philippine citizen e#en after becoin! of a!e$

(e) If it is shown that the naturalized citizen has allowed hiself to be used as adu" in #iolation of the Constitutional or le!al pro#ision re:uirin! Philippinecitizenship as a re:uisite for the exercise, use or en7o"ent of a ri!ht, franchise orpri#ile!e$

 

Sectio !<. Penalties for violation of this ActEAn" person who shall fraudulentl" a&e, falsif",for!e, chan!e, alter, or cause or aid an" person to do the sae, or who shall purposel" aid andassist in falsel" a&in!, for!in!, falsif"in!, chan!in! or alterin! a naturalization certificate for thepurpose of a&in! use thereof, or in order that the sae a" be used b" another person orpersons, and an" person who shall purposel" aid and assist another in obtainin! a naturalizationcertificate in #iolation of the pro#isions of this Act, shall be punished b" a fine of not ore than fi#ethousand pesos or b" iprisonent for not ore than fi#e "ears, or both, and in the case that theperson con#icted is a naturalized citizen his certificate of naturalization and the re!istration of thesae in the proper ci#il re!istr" shall be ordered cancelled$

Sectio 2=. Prescription$E<o person shall be prosecuted, char!ed, or punished for an offenseipl"in! a #iolation of the pro#isions of this Act, unless the inforation or coplaint is filed within fi#e

"ears fro the detection or disco#er" of the coission of said offense$

Sectio 2!. -egulation and blan(sEThe ecretar" of ustice shall issue the necessar" re!ulationsfor the proper enforceent of this Act$ <aturalization certificate blan&s and other blan&s re:uired forcarr"in! out the pro#isions of this Act shall be prepared and furnished b" the olicitor6%eneral,sub7ect to the appro#al of the ecretar" of ustice$

REPUBLIC ACT NO. 530 - AN ACT MAKING ADDITIONAL PROVISIONS FOR 

NATURALIZATION

Section 1. The provisions of existing laws notwithstanding, no petition for Philippine

citizenship shall be heard by the courts until after six months from the publication of theapplication required by law, nor shall any decision granting the application become executoryuntil after two years from its promulgation and after the court, on proper hearing, with theattendance of the Solicitor eneral or his representative, is satisfied, and so finds, thatduring the intervening time the applicant has !1" not left the Philippines, !#" has dedicatedhimself continuously to a lawful calling or profession, !$" has not been convicted of anyoffense or violation of overnment promulgated rules, !%" or committed any act pre&udicialto the interest of the nation or contrary to any overnment announced policies.

Sec. #. 'fter the finding mentioned in section one, the order of the court grantingcitizenship shall be registered and the oath provided by existing laws shall be ta(en by theapplicant, whereupon, and not before, he will be entitled to all the privileges of a )ilipino

citizen.

Sec. $. Such parts of 'ct *umbered )our hundred seventy+three as are inconsistent withthe provisions of the present 'ct are hereby repealed.

Sec. %. This 'ct shall ta(e effect upon its approval, and shall apply to cases pending incourt and to those where the applicant has not yet ta(en the oath of citizenship Provided,however, That in pending cases where the requisite of publication under the old law andalready been complied with, the publication herein required shall not apply.

AN ACT PROVIDING FOR THE REPATRIATION OF FILIPINO WOMEN WHO HAVE LOST

THEIR PHILIPPINE CITIZENSHIP BY MARRIAGE TO ALIENS AND OF NATURAL-BORN

FILIPINOS.

Section . Filipino women who have lost their Philippine citizenship by marriage to aliens

and natural-born Filipinos who have lost their Philippine citizenship, including their minor

children, on account of political or economic necessity, may reacquire Philippine citizenship

through repatriation in the manner provided in Section 4 of Commonwealth ct !o" #$, as

  '() Person opposed to organized government or a*liated with any association or group of

persons who uphold and teach doctrines opposing organized government+

  ') Person defending or teaching the necessity or propriety of violence, personal assault,

or associaton for the predominance of their ideas+

  '$) Person convictad of crimes involving moral turpitude+ or

  '4) Person su.ering from mental alienation or incurablecontagious diseases"

Sec. !. /epatriation shall be e.ected by ta0ing the necessary oath of allegiance to the

/epublic of the Philippines and registration in the proper civil registry and in the 1ureau or

2mmigration" &he 1ureau of 2mmigration shall thereupon cancel the pertinent alien

certi3cate of registration and issue the certi3cate of identi3cation as Filipino citizen to the

repatriated citizen"

this ct are hereby repealed or amended accordingly"
