Commonwealth Health Research Board [CHRB]

The CHRB was created by Virginia Code § 23-278 to provide financial support – in the form of grants, donations, or other assistance – for research efforts having the potential of maximizing human health benefits for the citizens of the Commonwealth.Research efforts eligible for support by the Board may include traditional medical and biomedical research relating to the causes and cures of diseases, as well as research related to health services and the delivery of health care.The CHRB encourages collaborative research efforts among two or more institutions or organizations, gives priority to those research efforts where Board support can be leveraged to foster contributions from federal agencies or other entities, and supports both new research efforts and the expansion or continuation of existing research efforts.

Fund [CHRF]

The authority to invest and manage the assets of the CHRF and maintain a separate accounting for the CHRF assets are provided to the Virginia Retirement System [VRS] in Virginia Code § 51.1-124.36.

The estimated value of the CHRF as of March 31, 2014 was $34 million.

Grant funding is calculated by an amount not to exceed six percent of the moving average of the market value of the CHRF calculated over the previous fives years or since inception, whichever is shorter, on a one-year delayed basis, net of any administrative fee assessed pursuant to subsection E of § 51.1-124.36.

Assets of the CHRF are pooled with the $63.9 billion Virginia VRS investment fund [as of March 31, 2014] .

The current asset allocation for the VRS investment fund reflects 44% public equity, 19% fixed income, 18% credit, 10% real assets, 8% private equity and 1% strategic opportunities.

Collaborators and Consultants

Principal Investigator [PI]

Individual located at and employed by the Applicant Institution or Organization having overall responsibility for the research project, including the conduct of the research and its oversight, management, and evaluation. The PI must devote sufficient effort to the project to ensure the project can be carried out as described in the application. The CHRB will not consider PI effort of less than 10% effort for each year as sufficient to carry out the project. Can be paid for services from CHRB or matching funds and can be cited in publications.

Co-Investigator [Co-I]

An individual located at and employed by the Applicant Institution assisting with the research project or an individual at a CHRB-eligible institution partnering with the Applicant Institution on the research project. Percent effort must be greater than 0%. Can be paid for services from CHRB or matching funds and can be cited in publications

Collaborator Provides limited advisory services and/or serves a mentor to the PI. Percent effort must be greater than 0%. Cannot be paid for services from CHRB or matching funds but can be cited in publications.

Consultant Provides a service for a fee e.g. tissue samples, running tests, etc. An in-state or out-of-state consultant can be paid through a subcontract. Can be paid for services from CHRB or matching funds and can be cited in publications.

•Can participate in a grant project during off-semester or summer time, or as part of a research course.•Salaries and fringe benefits must be paid as allowed by the IRS Student exception to the FICA tax.•CHRB or Matching funds can be used to pay salaries and benefits.•Cannot receive tuition assistance or a stipend for their participation in the project.•The research participation may be permitted as part of an undergraduate student’s required research activity.•Can be cited in research publications.

Calendar of Key DatesRequests for Reconsideration During Grant Process

Requests for reconsideration of decisions made by the CHRB at any state of the grant application review process, or during the term of an awarded grant, must be made by the Principal Investigator [PI] and the Applicant Institution or Organization, within seven business days of the date that the PI or Applicant Institution is notified of the Board’s decision.

Requests for reconsideration by the PI and the Applicant Institution or Organization can only be made where there are documented factual errors in the review of the Concept Paper or Full Proposal.

Decisions regarding reconsideration requests, for any of the reasons provided below, may be made by the CHRB Chair after consultation with the CHRB Administrator, at least one of the scientific reviewers and individual polling of the members of the CHRB.

The CHRB Chair’s decision shall be final and will be communicated to the PI and Applicant Institution or Organization in writing within 14 business days of the CHRB Administrator’s receipt of the written request for reconsideration.

Awarded Grant or Regarding Termination or Revocation of Grant Award or Portion Thereof

[1] If, during the term of a Grant Agreement,

the CHRB terminates or revokes a grant, or any

portion thereof, for failure to comply with any CHRB policy or procedures, or

any requirement set forth in the Grant Agreement, the Principal Investigator [PI] and/or the Grantee

Institution or Organization, may submit a written

request to the CHRB for a reconsideration of the

CHRB’s decision to terminate or to revoke the

grant award, or any portion thereof.

[2] Requests for

reconsideration of decisions made by the CHRB must be

made by the Principal Investigator [PI] and the Applicant Institution or

Organization, within seven business days of the date that the PI or Applicant Institution

is notified of the Board’s decision. The request for reconsideration must be

submitted in writing to the CHRB Administrator for forwarding to the CHRB Chair. Request can be

submitted via email in PDF format with original

signatures.

may be made by the CHRB Chair after

Concept Paper or Full Proposal

Substantive Changes: Unallowable substantive changes

between the Concept Paper and Full Proposal submission are as follows:

Nonsubstantive Changes: Allowable Changes between the Concept

Paper and Full Proposal which may be permitted, provided an explanation and

justification are provided to the satisfaction of the CHRB

•Scope of the proposed project•Objectives•Anticipated outcomes identified in the Concept Paper that were considered in the favorable review of that Concept Paper; •Proposing a new Principal Investigator or proposed percentage of effort; •Salary requests for research participants [change of less than 5% in percentage of effort allowable only for research participants]; •Major equipment purchases; and,•Requests for two years of funding in the Full Proposal if the Concept Paper only requested one year of funding.

•Changes in procedures or methods should be explained and justified.•Citation of new publications in the literature concerning methodology since the submission of the Concept Paper. •Minor budgetary changes, such as the cost of animals, equipment and supplies if no programmatic changes will result and additional funds for increased effort by the PI are not requested. •Percentage of effort for specific project participants [change of less than 5% of effort allowable]. •Substitution of comparably-qualified persons [not including the Principal Investigator] at comparable percent of effort and duties; however, adding additional individuals who are not substitutes would not be allowed.

CHRB Grant Award

Proposed changes in the protocol. Provide copies of IRB and/or IACUC approval letters for changes.

Proposed changes regarding the Principal Investigator, or other identified professional members of the approved research team, including individual changes to the salaries and percentage of professional effort.

Proposed changes in the approved budget to include personnel and nonpersonnel [supplies and equipment] from those described in the Full Proposal and approved as part of the CHRB Grant Award.

After a CHRB Grant Award has been made, the Principal Investigator must notify the CHRB Administrator in writing of:

Proposed changes must be approved in advance prior to expending any portion of the grant related to the proposed change.

Extended absence from the project, including a sabbatical or leave of absence, by any of the professional staff members of the approved research team will not be approved without compelling justification provided, in advance of the absence, by the Principal Investigator to the CHRB.

The Principal Investigator [PI] and the Grantee Institution or Organization, by and through the Institutional Official, or his or her successor, must agree and acknowledge that the Budget which has been approved for the Grant Award by the CHRB is the operating budget for the grant period. It is also the Budget upon which any post-award budget reallocation requests must be based.

1. Requests for budget reallocations must be submitted in writing by the PI, and co-signed by the appropriate Institutional Official or Organization’s authorized representative, and sent to the CHRB Administrator at least 30 days before the budget change is needed.

2. A revised budget form must be submitted along with the budget reallocation request so that the CHRB Chair can determine the substance of the proposed changes between the initial budget and the revised budget.

3. An explanation must be provided as to the overall impact on the project.

Decisions regarding requests for budget reallocation will be communicated in writing by the CHRB Chair to the PI with 14 business days of the CHRB Administrator’s receipt of the written request. Decisions regarding budget reallocation requests are solely within the CHRB Chair’s discretion and are final.

Change in Academic Affiliation during the Grant Process

Change in Academic Affiliation after the CHRB has Awarded a Grant

If a grant applicant’s academic affiliation changes to another CHRB-eligible institution at any time during the grant review process, between the time a Concept Paper is submitted, a Full Proposal is requested, and/or a presentation of the Full Proposal is made to the CHRB, the PI must provide the following information to the CHRB in order for the grant application to be considered throughout the grant review process:

[1] A letter must be received by the CHRB Administrator that this change at both the original Grantee Institution and the new Grantee Institution is agreeable. [2] The written agreement of both institutions to this change must be provided to the CHRB Administrator and is required for further consideration of the grant application in the competition.

If a Principal Investigator [PI] changes his or her academic affiliation after the CHRB has awarded a grant, the Grantee Institution may request that the grant be transferred to the PI’s new institution, provided that the new institution agrees to the transfer and is an eligible Virginia institution.

A written statement that the original Grantee Institution relinquishes its rights to the research and the grant funding must be sent by the original Grantee Institution to the CHRB before the grant can be transferred.

If during a grant period a change in the Grantee Institution’s or Grantee Organization’s Institutional Official or authorized representative, is anticipated, or if a Grantee Institution or Grantee Organization withdraws his authority to act on its behalf, or to make legally binding agreements on its behalf, the Grantee Institution or Grantee Organization will so advise the CHRB in writing at least five business days before the anticipated change.

A Grantee Institution or Organization may request a substitute Principal Investigator [PI] if the original PI retires, resigns or can no longer serve as the PI for the project. In such case, the Grantee Institution or Organization may request a substitute PI be named.

[1] If the CHRB Chair agrees that the individual is qualified, the individual may become the PI for the remaining period of the grant award with the remaining budget after receiving the CHRB Chair’s written decision to that effect.[2] If the proposed substitute PI is not acceptable to the CHRB Chair, the CHRB, in its sole discretion, may revocate the grant upon a majority vote of a quorum of its members. Any remaining funds must be returned to the CHRB.

One-Year Grant Awards Two-Year Grant Awards

Each Grantee Institution or Organization is required to submit:•An interim scientific and fiscal progress report by January 31 [6-month report]•A final scientific and fiscal progress report by August 31 [final 12-month report]

Each Grantee Institution or Organization is required to submit:•An interim scientific and fiscal progress report by March 31 [9-month report]•An interim scientific and fiscal progress report by January 31 [18-month report]•A final scientific and fiscal progress report by August 31 [final 24-month report]Funding of the second year of a two-year award is not automatic, but is contingent upon demonstration of satisfactory progress and compliance with reporting requirements and the term and conditions of the Grant Agreement during the first year.

For both One-Year and Two-Year Grant Awards: Failure to submit the scientific and fiscal reports by the deadlines set forth in the Grant Agreement may result in revocation of the grant and forfeiture of all or a portion of the grant funding.

Termination/Revocation of Grant Award or Portion Thereof

If the Principal Investigator [PI] is unable to initiate or complete the project under the terms awarded, the Grantee Institution or Organization is required to immediately notify the CHRB in writing and to return all unexpended grant funds to the CHRB within 60 days of the CHRB’s receipt of notification.

The CHRB may cancel or terminate a grant and revoke any portion of, or all, grant funding for the project whenever the terms of the Grant Agreement, the Grant Guidelines, and/or the CHRB policies and Procedures are violated or are not met.

• Any human subjects or animal welfare concerns involving or affecting the CHRB grant must receive immediate review by the Grantee Institution’s or Organization’s relevant review board, i.e., the Institution Review Board [IRB] or the Animal Care and Use Committee [IACUC] in addition to other reporting as may be required by law.

• Proven violations of applicable federal, state, or local regulations, requirements or standards, including any conditions of institutional IRB or IACUC approval, will result in the grant being revoked and all awarded funds must be returned to the CHRB.

• The PI must advise the CHRB in writing of the manner in which the conflict or potential conflict of interest was resolved.

Three-Month No-Cost Extension

•Pursuant to compelling justification, an extension, for up to three months to complete the project may be permitted without providing additional funds.

•Only under extraordinary circumstances may a no-cost extension exceeding three months, but not to exceed six months, be requested. •An example of an “extraordinary circumstance” may be an incident in which a piece of equipment critical to the completion of the project becomes inoperable and it is determined that it will take up to six months for a replacement to be fabricated.

For both the Three-Month and Six-Month No-Cost Extension: •The request must be provide justification for the extension and be received at least 30 days prior to the original deadline from which the extension is requested. •Extensions are not granted merely because the Principal Investigator has unexpended funds.•Decisions regarding request will be communicated in writing to the PI and Institutional Official within 14 business days of the receipt of the written request.

Nonprofit Agencies and Institutions/Organizations

Grant funds provided by the CHRB to state agencies and institutions must be audited by the Auditor of Public Accounts [APA].

Grant funds provided by the CHRB to nonprofit agencies and institutions must be audited as part of the recipient organization’s annual audit by a qualified external auditor or external certified public accountant. •The Grantee Institution or Organization must provide written confirmation that the

institution or organization has been audited in accordance with the terms and conditions of the grant requirements and provide a copy of the most recent audit or notification that a copy of the most recent audit is available on the Auditor of Public Accounts [APA] website, must be provided to the CHRB Administrator once completed.•All audit and reporting costs are the sole responsibility of the grant recipient. CHRB grant funds nor matching funds may be used to pay for audit and/or reporting costs.•The CHRB may require the Grantee Institution or Organization to repay any inappropriately expended funds to the CHRB if the audit report indicates that funds were inappropriately expended, or any time when evidence is presented that grant funds are being, or were, expended inappropriately.

InventionsThe Grantee Institution or Organization must:• Obtain, at its own expense, any and all patent, copyright, trade

secret, proprietary information, or other intellectual property licenses necessary to use any invention, patent, article, applicant, process, or technique of whatever kind required to fully carry out the CHRB project.

• Pay all royalties and license fees.• Reimburse the CHRB for the full amount received from the CHRB

to execute the proposal when specific thresholds are reached.• Agree to be solely responsible, where found liable, to the extent

covered by insurance or specified by statute, whichever is less, for the payment of all claims for loss, personal injury, death, property damages, or otherwise arising out of any act or omission of its employees or agents, including without limitation, the infringement or other unauthorized use of any patent, copyright, license, or other form of intellectual property.

Requirements

As part of the CHRB’s ongoing evaluation efforts, each Principal Investigator [PI] and Grantee Institution or Organization is required to complete a CHRB Annual Evaluation Report for a period of five years after the conclusion of the Grant due by December 31st of each year.

This provision also requires:

• Two reprints of any publication resulting from the funded research sent to the CHRB as soon as they are available.

• Notification of future grant awards received as a result of research funded with grant funds from the CHRB.

• All licenses, copyrights, patents, inventions, or income-producing processes, discovered or arising from research funded, at least in part, by the CHRB, which begin to produce income.

Acknowledgement of Support

The CHRB requires all published journal articles, monographs, or other special reports based on grant-supported projects to carry a standard footnote of acknowledgement as follows: “This research was supported by grant funding from Virginia’s Commonwealth Health Research Board.”

Pursuant to Va. Code §2.2-3705.6 (17) of the Virginia Freedom of Information Act, Records submitted as a grant application, or accompanying a grant application, to the Commonwealth Health Research Board pursuant to Chapter 22 (Section 23-277 et seq.) of Title 23 to the extent such records contain proprietary business or research-related information produced or collected by the applicant in the conduct of or as a result of study or research on medical, rehabilitative, scientific, technical or scholarly issues, when such information has not been publicly released, published, copyrighted or patented “may be withheld from public disclosure,” if the disclosure of such information would be harmful to the competitive position of the applicant.

Copies of grant proposals funded by the CHRB are provided to the public upon request, in accordance with the Virginia Freedom of Information Act, §2.2-3700 et seq., of the Code of Virginia (1950), as amended. However, the Principal Investigator (PI) is contacted by the CHRB Administrator prior to the release of any funded CHRB grant proposals to afford the PI and the Grantee Institution or Organization an opportunity to identify any information it deems proprietary. The decision regarding what, if any, information is to be withheld from disclosure pursuant to the foregoing exemption to the Virginia Freedom of Information Act rests within the sole discretion of the CHRB’s Chair.

Copies of Concept Papers and Full Proposals that do not result in a Grant Award are not released to the public.
