Speak to us, Lord, this day Your disturbing, unwanted,off-balance,necessaryWord to each timid, safe,and sorry soul.Afflict the complacent.Discomfort those who are unwilling toget their handssoiled or their faith ruffled or their lives lived:those who would rather withdraw passing than fail, who bynever failing neversucceed.Make themcold or hot, not tepid.

We thank You for the passionthat allows us to havestrongviews, but in our excitementto shareour views with others, weoften forget our civility. Help us to respectone another’sviews,thoughthey be different from ours,and not attackthem for theirbeliefs.

PassionateGod, how wonderful it is that in the midst of allthe gray and banal and sad stuff of life, we havemet a personreally caring about truth, that we have seen something sobeautiful it took our boredom away - quiet couragein a timidperson,a man who could laugh at himself, a genuinelyhumbleperson who did not realize they were humble, and realindignationthat wasbetterthanself-righteousness.

Section501. NursingHomeConsumerInformationReport.In addition to the information required by the Department of

Health on a form providedby the Departmentof Healthpursuantto theprovisions of the act of July I 9, 1979 FL. 130, No.48. known as theHealth Care Facilities Act, and regulations promulgated pursuantthereto, each nursing homeshall provide to the Departmentof Healthno laterthan 90 daysafter thecloseof eachcalendaryear thefollowinginformation on the above-referencedform:

I Nursing hours worked per patient per day andnursing hours requiredby the Departmentof Health per patientperday. Actual hoursworkedper patientper day are for the mostrecentlyconcludedfiscal or calendaryear.

I The Departmentof Aging shall produce,in a timelymanner,a nursing home information site on the Internet. It shallinclude:

i The itemslisted in section501.ii Information obtained from the annual

Long-Term Care Facilities Questionnairessubmitted tothe Departmentof Health.

iii Informationobtainedfrom the Health CareFinancingAdministrationOwnershipDisclosureForm.

iv A comparative list of nursing homesdevelopedin the mannerprovidedin subsectionb.

v The Nursing Home Consumer InquiryTelephone Hotline telephone number required undersubsectionc.2 If errors are found in the Consumer Information

InternetGuide,all facilities shall be sent a correctionsheetwithin30 days of the Departmentof Aging’s receipt of notification ofthe error. For the purposesof this section, an error shall bedefined as information incorrectly transcribedfrom the formsprovidedto the Departmentof Health to the consumerguide.

3 The Department of Aging will send final proofs tothe nursing home of its dataprofile that will be publishedin theconsumerguide prior to publication.The nursing home will havefive days to notify the Departmentof Aging of any errors to becorrected.If the Departmentof Aging receivesno notification oferrors, the data profile will be consideredaccurate and will bepublished.b Comparativelist-The comparative list of nursing homes

shall be developedand included in the ConsumerInformation InternetGuide by the Department of Aging. It shall include the followinginformation:

I Name of facility.2 Facility addressand telephonenumber.3 Bed capacity.4 Owner of facility and managing company, if

applicable.5 Type of sponsorship,including, but not limited to.

governmental,nonprofit and for-profit or religious affiliation, ifapplicable.

6 Paymentsourcesaccepted,including, but not limitedto, Medicare. Medicaid, Veterans’ Administration, long-termcareinsuranceandprivatepay.

7 Current license, deficiencyand certification statusasdeterminedby the Departmentof Health; whether, within thepreviousfive years, the facility has beensubject to a provisionallicense, a ban on admissions,penalties imposed in connectionwith the licensureor certification process,a licenserevocationorappointmentof a temporary managerto operate the facility orMedicare or Medicaid decertification and the correspondingdates.

29 Information on communityresourcesthat can assistin the selection of a long-term care facility, such as tradeassociationsor consumeradvocacygroups.c Nursing Home Consumer Inquiry TelephoneHotline.-The

Departmentof Aging shall establish a Statewidetelephonenumber toserveas the Nursing HomeConsumerInquiry TelephoneHotline. Thisnumber shall be a toll-free number. The purpose of this telephonenumberis to respondto calls regardingthe currentlicensure,deficiencyand certification statusof nursing homes. All data provided by thehotline shall be updatedeachweek using information provided by theDepartmentof Health in a timely fashion.This telephonenumbershallbe prominently displayedin the annualConsumerInformationInternetGuide.

d Disclosure-TheState Long-Term Care Ombudsmanin theDepartmentof Aging shall mail at least the addressof the ConsumerInformation InternetGuide to the local long-term care ombudsmanofeach area agency on aging, to each nursing home and to thePennsylvaniaCouncil on Aging annually.

e Availability-Each nursing home shall post next to itsDepartmentof Health licensean exactcopy of its listing as found in theConsumerInformationInternetGuide. A nursing homeshall provide toeach prospective resident and family member of such prospectiveresidentwho visits the facility, or any member of the public uponrequest, during normal businessor visiting hours. Sunday throughSaturday. an exact copy of its listing as set forth in theConsumerInformation InternetGuide.

f Inspections-TheDepartment of Health shall verify theavailability of the listing during annual licensing surveys. TheDepartmentof Health shall monitor compliancewith the requirements

of this act for regular filing of the Long-Term Care FacilitiesQuestionnairewith the Departmentof Health.

g Update-TheDepartmentof Healthshall issue modificationsto the Long-Term Care Facilities Questionnaireresulting from changesin the reimbursementsystem for nursing homes. Such modificationsshall providethe sameinformation in an updatedformat.

h Regulations-TheDepartmentof Aging shall promulgateregulationssetting forth proposedadditions, changes,or both, if thedepartmentdoesany of the following:

I Expandsthe scopeof the consumerguide beyondthosetopicsexpresslysetforth in subsectiona.

2 Expandsthe scopeof the comparative list beyondthosetopicsexpresslyset forth in subsectionb.

Section 503. Complaints.Complaintsof noncompliancewith this act shall be filed with the

Departmentof Aging. A complainantshall include a local ombudsman,a nursing home employee, a nursing home resident, a prospectivenursing home resident, or any personrepresentingthe interestsof anursinghomeresidentor prospectivenursing homeresident.Section504. Additional consumerinformation.

Each nursing home shall provide to each prospectiveresidentorrepresentativethereof at the time of initial inquiry, a companionconsumerguide which describeshow to selecta nursing home. Thisinformation can be eithera publication of the Departmentof Aging, acamera-readycopy of a publication provided by the DepartmentofAging or a comparablepublication that will inform the consumeronhow to choosea nursinghome.Section505. Penalties.

The Departmentof Aging shall have the authority to assessa$1,000 civil penalty for each violation of this chapter. Any personaggrievedby an adjudicationby the Departmentof Aging shall havethe right to appeal under42 Pa.C.S. relating to judiciary and judicialprocedure.

CHAPTER 7MISCELLANEOUS PROVISIONS

Section 701. Repeals.All acts and parts of acts are repealed insofar as they are

requires the department to establish certain nursing homeconsumerinformation on the Internet.

Mr. Speaker,growing older is a fact of life for every one ofus. Here in Pennsylvania.by the year 2020. it is estimatedthatalmost 25 percent of our population will be over 60. Thisnumber is staggering, and it also means that most of ourfamilies will be faced with making a very important decisionabout putting one of their loved ones into a nursing home,andthey needall the informationthat they canget.

Now, every oneof us has senior citizens in our district, andevery one of us should want to help thesefamilies know thatwhen they make thesedecisions,they are well informed aboutthe information pertaining to this difficult decision. CurrentlyPennsylvaniahasprovided very little information to help themmake an informed decision aboutone of the mostdifficult yet

important decisionsthey may face: choosing the right nursinghome for those whom they love.

You know, we work hard to ensure that proper care andtreatmentis provided inside our nursing homes,and as we aredoing with this bill, however, we are doing very little to helpthosewho are in the processof placing a family memberin oneof these homes. Those citizens have so many questions, somanyconcerns, and that is what this amendmentis designedtodo, is to help easethose fearsand anxietiesfor our constituentswho mustmakethat life-changingdecision.

Many of those decisions must be made immediately, andwith very little time for writing letters, requestingbooklets,visiting many different facilities, and comparingmany varietiesof reports that can be overwhelming to a stressedfamilymember.

My amendment is simple. It says, in the informationhighway that we are on today, that we need to place thisinformation in a useful, easy-to-readformat on the Internet. Theamendment calls for useful, practical information- informationfamilies want andneed- accurateand up-to-dateinformation tobe placedat their fingertips.

Technologyis moving at the speedof light, and the Internetis becoming a natural, commonplacelocation to turn forinformation. My amendment would ensure that ourCommonwealthmakes the best use of today’s technologyandenhancesthe printed information alreadyavailable.

Now, Mr. Speaker,we all have our State Websiteaddressonour license plates. All we are asking today is, let us use thistechnologyto help our families gain the knowledgethey needtoincreasetheir comfort and decreasesome of the stress thataccompaniesthis decision.

Let me also say that this amendmentwas also a bill that wasreportedin the last sessionout of committee. It was reportedJune 15 of 1999 overwhelminglyout of committee.The timehas come for this type of legislation, and I ask you for yourconsideration and your vote on this type of legislation.Thank you, Mr. Speaker.

bad idea, and a year ago this informationwas notavailable.TheDepartmentof Health recentlypostedon their Websitea surveyof all the nursing homes in Pennsylvania.You can see thedeficienciesand the plusesof eachnursing home,and you cansee what each nursing home has done to correct it. Also, Iwould be happy to provide anybodywith a MedicareWebsitethat comparesnursinghomesside by side in eachcountyso thatyou can comparethem and know which is the best home foryour loved one.

At one time in my career,I was a chargenurse in a nursinghome, so I truly care a great deal about the care that thesepatients get. The information is now available. AsRepresentativeDeLuca, the prior speaker, said, it was notavailable a year ago. It is now available.But the best way todeterminethe bestsite for your loved one is a personalvisit.

But again I ask for a "no" vote, only becauseit wouldreplicatewhat is alreadythere.Thankyou, Mr. Speaker.

time, and I would like to just follow up on what the previousspeakersuggestedabout the information that is containedinyour amendmentthat would be offered to the people ofPennsylvaniaandthe argumentthat it is not necessary,that theinformation alreadyexists. Could you addressthat, becauseit ismy understandingthat that is not thecase.

Mr. DeLUCA. Thankyou, Mr. Speaker.Mr. Speaker,althoughthe departmenthasmade stridesto put

some of this information onto the information highway, whichis voluntary- let me saythis, it is not in statute; it is voluntaryright now - a lot of this information, after researchingit andhaving my staff peoplepull up some of the nursing homes inAllegheny County and talking to the Departmentof Aging inAllegheny County, we find out that a lot o this information isnot available.

Let me just allude to what we are askingto be put on thisinformationalhighway which peopledo not haveaccessto.

We are asking for the name and telephonenumber of thelocal ombudsmanpersonthere. We are asking for the cost perday, month, andyear.We are askingfor visiting hours. If thereare any telephonenumbersavailable for private conversations.Is there a registered dietitian on board? Is there a writtenemergencyevacuationplan? What is the nearesthospital? Ifthereare isolation areasand roomsfor patientswith contagiousdiseases. Is there an Alzheimer’s or a Parkinson diseaseprogram? Whether there are qualified physical therapists onboard. Whether there is a written description of the patient’srights andresponsibilities.Whetherthere is a written policy on"do not resuscitate"orders, physical restraints, and chemicalsedation.What medical servicesare available onsite, includingdentists,podiatrists,pharmacists,ophthalmologists.

This is some of the information we are asking. Althoughsomeof that information is on a voluntary basis - it is not instatute- this is what we are asking for, to put in statute.

Now, I have contacted my Department of Aging inAllegheny County, and I hadmy staffpersonwho is very wellfamiliar with the Internet process, it took her a half hour to gothrough the different sites, and we got very little informationpertainingto one of our nursinghomes,which is a big nursinghome, Beverly Nursing Home in Allegheny County, which isthroughoutthe Commonwealth.We talked to thepeopleof theDepartmentof Aging. They could not accessit themselves.They put us on to the ombudsman,who said there is certaininformation they couldnot give us.

But this is commonsenselegislation, commonsenseissues,requirementsthat somebodywho is placing their loved one inthis facility should know, to make an intelligent decision. Weare in a busy world today. This is one of the toughestdecisionsa personhas to make, and they should have this information.We are wiring up our schools, our libraries. Everybody isgetting the Internet. The Governoris specifying that we do thaton our licenseplates. Any one of you. turn on our Website on

our license plate and see what you can get as far as thisinformation pertainingto your district.

That is what we are asking for, Mr. Speaker.Mr. ROONEY. Mr. Speaker, I have concluded my

amendment, the Democratic chairman of the InsuranceCommittee. What this amendmentwould do would be toprovide people with much-neededinformation. He referencedthe fact that oftentimes choosing a nursing home for one’sparentor loved one is the most difficult decision a family canface. I know that firsthand. And let me say that, you know,oftentimes family membersdo not all live in the samecommunityas their parent.They may havemoved after havinggone to school- Whateverthe case may be. they are not there.And for a child of a parentwho is about to be placed into anursing home, they care as deeply abouthow their parentwillbe treated as the people, their siblings, who live in thatcommunity, who have accessto go to the facility, to be able tounderstandall the programsthat are in placeand how well theirparentwill be treated.But if you live in California and yourmotheris being put in a nursinghome in Bethlehem,that canbevery difficult to accomplish.What the chairman,Mr. DeLuca,has offered through this amendmentis some very simple andbasicinformation that I think is not in any way, shape,or formunreasonableto ask be postedon a Websiteso that people canhave accessto this very basic information. I do not think it isexcessive.I do not think it is intrusive. I think it is somethingthat needsto occur.

As he indicated, the chairmanhad this bill reportedout ofcommitteeand voted on, as I recall, in the last sessionof theGeneralAssembly. The time to act on this important issue istoday. We have the vehicle to do that through amendmentA2I 11, and I would just ask my colleaguesto stand in supportof providing Pennsylvaniaconsumerswith information that theyneedto make informed, reasoned.intelligent decisionsabout thecare that their loved oneswill be receiving in their remainingdays.

So I ask my colleaguesfor an affirmative vote.The SPEAKER.The gentleman,Mr. Blaum.Mr. BLAIJM. Thank you, Mr. Speaker.Mr. Speaker,I rise in support of the DeLuca amendment,

and I havegot to tell you, it is a little difficult to sit here andlisten to the commentsof thoseon the otherside opposingthisamendmentwhen for years this departmentopposedthe effortsof RepresentativeVeon to amend legislation to get the verysameinformation out to thepeopleof Pennsylvania.

This information that is currently available is inadequate,andit is thereat the whim of the department.It can go away at anytime, and I daresay, Mr. Speaker, there is nothing on thatWeb pagethat the nursing home industrydoes not want on thatWebpage.

The peopleof Pennsylvaniaand the families of Pennsylvaniadeservethis information.They deserveit to be partof statute inPennsylvania,that this information is requiredto be put beforethe public via the Internet and other means that may beavailable to us so that Pennsylvaniafamilies are knowledgeableabout what information is contained in various reportssubmittedon various nursing homes.

We need only go back a few months, and we see theshortcomingsof more than one department,as documentedbythe Auditor Generalin the inspectionsof nursing homesacrossPennsylvania. This is basic information for Pennsylvaniafamilies. It should be in statute, and I ask the membersfor anaffirmative vote.

I have firsthand experience,and thatexperience,for 2 1/2 years my motherwas in a nursing home.Luckily, having had county backgroundand county experience,most of the information I was able to understandor know howto access.But I can tell you that many, many times thereweremembers from other families who approached me forinformation, and that should not have to happen. I think thisinformation is necessary.I think anyone who visits a nursinghome or would have any memberof their family in a nursinghomewould certainlyappreciatethis.

So I ask my colleaguesto pleasesupport this amendment.I think it is a good amendment, and if you ever have theopportunity to visit these places firsthand, I think you canunderstandthe intent.

I am concernedthat there is a potential for abuseherewhen wehave physiciansprescribingdrugs for membersof their ownfamilies that we shouldnot overlook. As the previousspeakerpointed out, this language,generousand thoughtful though itmay seem to be, actually violates the original intention of thevolunteerlicenses.Regretfully, we have to recognizethe factthat medicalprofessionalsthemselveshave higher ratesof drugaddictionand abusethan the generalpopulation. Looking at thepotential here for abusewithin the family, I do not think I cansupportthis bill.

The SPEAKER.Mrs. Vance.Mrs. VANCE. Thankyou, Mr. Speaker.I believeperhapsa clarificationmay be in order.Severalyearsagowe passedthe volunteerhealthlicensebill

for retired health-care practitioners. Retired physicians havealways beenable to prescribefor their family. That has neverchanged.That has alwaysbeenthe practice. So someof themstarted to work in volunteer clinics with a volunteer license,giving of their time. The Departmentof State said, well, thelegislation that we had passedearlier did not specifically givethem the right to continue to do that. So we needto do this inorder for them to keep volunteering in clinics. We hadphysicians who were already volunteering in clinics whodecided,well, if I cannotcontinueto prescribefor my family, asI had for generations and generations,I am not going tovolunteermy time.

The bottom line, by voting "no" on this, is that you areimpactingpeople that are gettingmuch-neededservicein clinicsbecausetheseretired health-careprofessionalsare volunteeringtheir time, and I urge you to vote "yes" in order to facilitatetheseclinics. Thankyou, Mr. Speaker.
