Determination of Rentals and Charges Under Sub-sectlon 11(2^

I, Leo Anthony Tyrrell, the National General Manager, Network and Consumer Services, of the Australian Telecommunications Corporation, being a person to whom the Corporation had, pursuant to Section 33 of the Telecommunications Act 1975 ("the Act") as in force on 31 December 1988, given a delegation of its powers under sub-section 11(2) of the Act which delegation was in force on that date and which is continued in force by sub-section 29(2) of the Telecommunications Amendment Act 1988, hereby, in pursuance of sub-section 11(2) of the Act, make the following determination:

1. The determination of rentals and charges made by the Corporation on the 21 August 1975*, as varied to date 0, is further varied by -

(A) Omitting from Item 6 of Schedule 2 subparagraphs (k)(iii) and (k)(iv).

(B) Omitting Item 6A of Schedule 2 and substituting the following -

"ITEM 6A CHARGES FOR STD/ITEMISED CALL RECORDS SERVICES

The charges payable by a subscriber in respect of a STD/Itemised Call Records Service shall be -

NOTICE OF DETERMINATION OF OBJECTIONS

Dear (Objector)

I refer to the objections lodged with me on (date) to certain electors' names being retained on the electoral roll. I have investigated each objection. In a number of cases electors had re-enrolled for another address or were known to still be living at their enrolled address. A form "Notice of Intention to Remove Name From Electoral Roll" was issued to the remaining electors on (date). The period for reply to these notices expired on (date). Each objection has now been determined, and the electors advised of my decision. Names have been removed from the electoral roll where necessary. The attached schedule indicates the action taken in each case and whether the deposit of $2.00 is to be reftmded or forfeited. The Commonwealth Electoral Act 1918 provides that the $2.00 deposit will be forfeited where the Divisional Returning Officer concerned holds that the objection was made without a reasonable belief that grounds for the objection existed. A cheque for the amount of the refunded deposits will be sent to you shortly.

AUSTRALIAN CAPITAL TERRITORY Public Health Ordinance 1928 PUBLIC HEALTH (SALE OF FOOD AND DRUGS) REGULATIONS Noticc made in pursuance of the power conferred on the Minister of State for the Arts and Territories under regulation 13 of the Public Health (Sale of Food and Drugs) Regulations, and delegated under section 12C of the Seat of Government (Administration) Act 1910 to the General Manager of the Australian Capital Territory Community and Health Service. 1. The advertising or sale of:

(a) Solanum sodomaeum, including all extracts or de-rivatives thereof in preparations for therapeutic use;

(b) Solanum dulcamara, including all extracts or deriv-atives thereof in preparations for therapeutic use;

(c) Solasodine for therapeutic use; and (d) Curaderm Cream

is prohibited. 2. This notice shall remain in force until varied or revoked

by a subsequent notice. 3. Any person who contravenes the provisions of this notice

COMMONWEALTH OF AUSTRALIA Health Insurance Act 1973 STATEMENT UNDER SECTION 106AA On the twentieth day of July 1988, 1, Neal Blewett, Minister of State for Community Services and Health, made a deter-mination under section 106 of the Health Insurance Act 1973 (the Act), in respect of Dr Anthony Alfred Lyall of 70 Alexandra Road, Ulverstone, Tasmania 7315. Particulars of Determination A copy of the determination is at Attachment A. Reasons for Determination

The determination was made by me on the basis of a report made under section 104 of the Act by the Medical Services Committee of Inquiry for the State of Tasmania, after its inquiry into the practice of Dr Lyall.

The Committee was of the opinion that in respect of the patients under reference, certain of the services were exces-sive, in that they were not reasonably necessary for the adequate medical care of the patients concerned. The Com-mittee arrived at this opinion by referring to the informa-tion before it and bringing to bear the knowledge and experience of its members. Commeats The Government is seriously concerned by the practice of doctors like Dr Lyall who provide services which are not reasonably necessary for the adequate medical care of the patients concerned. Excessive services are a drain on public funds and every effort is being made to reduce the magni-tude of the problem. Dated this 13th day of April 1989.

COMMONWEALTH OF AUSTRALIA Health Insurance Act 1973 DETERMINATION UNDER SECTION 106 WHEREAS (a) The Medical Services Committee of Inquiry for the

State of Tasmania, established under sub-section 80 (1) of the Health Insurance Act 1973, has inquired into the matter of the rendering of professional services by Anthony Alfred Lyall, a legally qualified medical prac-titioner of 70 Alexander Road, Ulverstone, in that State, referred to the Committee under section 82 of the Act;

(b) the said Committee, after having conducted a hearing into the abovementioned matter pursuant to section 94 of the Act, has reported to the Minister, under section 104 of the Act, and has expressed the opinion that the services identified in its report and which were ren-dered by the said Anthony Alfred Lyall were excessive services within the meaning of paragraph 79 (IB) (a) of the Act;

(c) Medicare benefits within the meaning of sub-section 3 ( 1 ) of the Act in respect of the abovementioned services have been paid or are payable to the said Anthony Alfred Lyall;

(d) the services included in the reference to the Committee were rendered on or after 1 February 1984;

(e) the said Committee has made recommendations pur-suant to paragraphs 105 (2) (c), 105 (2) (ca), 105 (2) (f) of the Act, and

( 0 sub-section 106 (1) of the Act provides that the Min-ister may make a Determination in writing in accord-ance with the said Committee's recommendations.

NOW T H E R E F O R E 1, Neal Blewett, Minister of State for Community Services and Health, hereby determine that, in accordance with the said Committee's recommendations:

(i) under paragraph 105 (2) (c) of the Act, the said An-thony Alfred Lyall be reprimanded and I do so repri-mand him;

(ii) under paragraph 105 (2) (ca) of the Act, the said Anthony Alfred Lyall be counselled; and

(iii) under paragraph 105 (2) ( 0 of the Act, the amount of Medicare benefits referred to in paragraph (c) herein be payable by the said Anthony Alfred Lyall to the Commonwealth of Australia, being as specified hereunder:

B. Without in any way limiting or being limited by the pro-visions of sub-rule A, the Union is open to: (i) Telegraphists, Phonogram Operators (VDU) and

Message Bureau Operators (who immediately prior to selection for training as Message Bureau Operators were designated Telegraphist) employed in the Aus-tralian Telecommunications Commission.

(ii) All Postal Clerks, Senior Postal Clerks, Officer-in-Charge Grade 1, Officer-in-Charge 2, Officer-in-Charge Grade 3, employed in the Australian Postal Commission.

(iii) All Postmasters who are not qualified to be promoted to, or transferred to, positions classified as being within the Third Division of the Public Service.

(iv) All instructors, Postal Training Schools, employed in the Australian Postal Commission.

(v) All Trainee Telegraphists employed in the Australian Telecommunications Commission.

(vi) All Trainee Postal Clerks and all Assistant Postal Officers selected for training as Postal Clerk employ-ed in the Australian Postal Commission.

(vii) All persons employed as paid Officials of the Union.

(viii) Trainee Postal Services Officers, Postal Services Officers, Postal Service Controllers and Postal Managers employed in the Australian Postal Commission.

6. PROPOSED CHANGE TO DESCRIPTION OF INDUSTR Y It is proposed that, upon the proposed amalgamation becoming effective, the description of industry or in con-nection with which the APTU is registered be changed from: 'The industry in connexion with which this union is regis-tered is the postal and telecommunications industry of Australia."

'The industry in connection with which this Union is regis-tered is the postal and telecommunications industry in Australia and postal and telecommunications services."


7. PROPOSED ARRANGEMEKTSRELATINGTO PROPERTY AND LIABILITIES It is proposed that upon the proposed amalgamation taking effect and upon the cancellation of the registration of the UPT: (a) all the funds, property and liabilities of the UPT shall

be transferred to the amalgamated organization and shall become the funds, property and liabilities of the amalgamated organization which shall satisfy all the then liabilities, debts and obligations of the UPT; and

(b) the financial and other books and records of the UPT shall be transferred to and become the property of the amalgamated organization which shall accept, treat and recognise them in the same way any other books and records of the amalgamated organization.

8. PROPOSED SPECIAL ARRANGEMENTS (a) Upon the proposed amalgamation becoming effective

the Rules set out in Attachment A to the Joint Submis-sion and Application for approval of Amalgamation shall come into force and be the Rules of the amal-gamated organization.

AUSTRALIAN BROADCASTING TRIBUNAL Submissions invited NOTICE OF INQUIRY INTO THE RENEWAL OF THE LICENCE FOR PUBLIC RADIO SERVICE 4CRB GOLD COAST (QLD) The Australian Broadcasting Tribunal has commenced an inquiry into the renewal of the licence for the above service, which is due to expire on 28 August 1989.

The application for the renewal of the licence has been lodged by the licensee company. Gold Coast Christian and Community Broadcasting Association Limited. The issues to be considered The issues to be considered in the inquiry derive from the criteria for the renewal of a public licence, which are set out in section 86E of the Broadcasting Act 1942. The criteria are: 1. Whether the licensee has given an undertaking to pro-

vide an adequate and comprehensive service, to provide Australian programs and use and encourage the use of Australian creative resources;

2. Whether the renewal of the licence would be contrary to a provision of the Act;

3. Whether it is advisable in the public interest to refuse to renew the licence having regard only to the following matters or circumstances; (a) whether the licensee is no longer a fit and proper

person to hold the licence; (b) whether the licensee has the necessary financial,

technical and management capabilities to provide an adequate and comprehensive service pursuant to the licence;

(c) whether a condition of the licence has not been complied with;

(d) whether the service is commercially viable; (e) the undesirability of a person being in a position to

exercise control of more than one public radio licence;

( 0 the undesirability of the Commonwealth, a Stale or the Northern Territory or a statutory authority of the Commonwealth, a State or a Territory, or a political party, being in a position to exercise con-trol of the licence;

(g) the undesirability of the licence being held by a corporation whose operations pursuant to the lic-ence have been, or will be, conducted either wholly or substantially for the purpose of the acquisition by another person of profit or gain;

(h) the desirability of members of the community served being in a position to exercise control of the licence; and

(i) the need to encourage members of the community served to participate in the operations of the licen-see and the selection and provision of programs.


The licensee has satisfied the first criterion by giving the required undertaking. In this inquiry, the concept 'an adequate and comprehensive service' has regard to:

(i) the technical conditions of 4CRB's licence warrant; (ii) the requirements of the Act and the regulations;

(iii) the nature of the Gold Coast community; (iv) the diversity of the interests of that community; and (v) the nature of the broadcasting services (including

broadcasting services provided by the ABC or the SBS) having service areas that overlap the 4CRB service area.

The Tribunal specified three matters for review during 4CRB's current licence period when it last renewed the licence. These are:

(i) sponsorship announcements; (ii) access by the Gold Coast community to 4CRB's

operations; and (iii) assessment by Gold Coast Christian and Community

Broadcasting Association of the needs of its community.

i) the remains of ships described in the schedule, being wrecks situated in Australia waters or in waters above the continental shelf of Australia, may be of historic significance; and

ii) all articles that were associated with the remains of ships described in the schedule may be of historic significance,

I, ALLAN CLYDE HOLDING, Minister of State for the Arts and Territories, pursuant to section 7 of the Historic Shipwrecks Act 197 6, hereby declare that the area of sea specified in Schedule 1, being an area of sea within which the historic shipwreck specified in Schedule 2 is situated, to be a protected zone.

PRELIMINARY FINDING INTO THE ALLEGED DUMPING OF SPARK IGNITION PISTON RNGINED OUTDOARD MOTORS OF 0.93 KW (1.2 HP) TO 168 KW (225 HP) FROM BELGIUM AND CERTAIN EXPORTERS FROM JAPAN AND THE UNITED STATES OF AMERICA

CUSTOMS ACT 1901 - NOTICE UNDER SUB-SECTION 269TD(2)

Gazette Notice S23 of 19 January 1989 advised of the initiation of inquiries into the alleged dumping of spark ignition piston engined outboard motors of 0.93 kW (1.2 HP) to 168 kW (225 HP), from Belgium, the United States of America, and certain exporters from Japan. The Notice was published following an application for the imposition of dumping duties by Outboard Motor Australia Pty Ltd. The Australian Customs Service (ACS) has now completed its inqu i ries.

I, Peter William English, .delegate of the Comptroller-General of the Australian Customs Service, have made a preliminary finding under sub-section 269Tn(2) of the Customs Act 1901, there being reasonable grounds to conclude that:

(a) outhonrd motors have been exported to Auslrnlia from Belgium; from Japan und(jr the Mariner, Mercury, Suzuki, Toliatau and Yamaha brand names, and from the USA under t]je Mar-iner and Mer-cuty brand names, at dumped prices;

(b) material injury to the Australian industry has been or is being caused or is threatened by exports of the dumped ou I. board raot<.»rH;

(c)~ a causal link between the dumped exports and the material injury or threatened material injury to the Australian industry has been established.

The ACS will, within 7 days of the publication of this notice, refer to the Anti-Dumping Authority the question as to whether publication of a Dumping Duty Notice is justified.

The ACS will impose provisional anti-dumping measures on outboard motors as it considers that there would be material injury to the Australian industry pending finalisation of this matter. The provisional anti-dumping measures will be in the form of cash or documentary securities on future imports. Such securities will be taken pursuant to Section 42 of the Customs Act 1901.
