In this instance the applicant would be eligible for reimbursement in the maximum amount of $25,000. If this grant is awarded, the available Business Incentive Grant budgeted money will be approximately $50,000 for any future projects to be awarded by the Village Board in the remainder of this fiscal year

RESOLUTION APPROVING A BUSINESS INCENTIVE GRANT APPLICATION FOR THE PROPERTY AT 605-625 NORTH MIDLOTHIAN ROAD, MUNDELEIN, ILLINOIS

UNDER THE MUNDELEIN ECONOMIC DEVELOPMENT INCENTIVE PROGRAM

WHEREAS, James Toscas of AMPA Management, Project Manager and Agent for Property

Owner, Mychal Angelos, has applied for a Village of Mundelein Grant for interior improvements

under the Business Incentive Grant Program (BIG) for the property at 605-625 North Midlothian

Road, Mundelein, Illinois (the "Grant Application") and has submitted cost proposals for the following

improvements:

(a) Demolition & General Conditions $22,800.00

(b) Structural Framing $43,200.00

(c) Exterior Surfaces $37,140.00

(d) Windows and Doors $54,000.00

(e) Roof Deck $30,000.00

Total $187,140.00

Village Participation $25,000.00

WHEREAS, James Toscas of AMPA Management, applicant, acting as Agent and Project

Manager for Mychal Angelos, property owner, of the subject property at 605-625 North Midlothian

Road, Mundelein, Illinois, have signed the Grant Application; and

WHEREAS, the Village's Community Development Department has made a recommendation

to the Village Board of Trustees that the Grant Application be approved for a 50% matching grant

under the Village of Mundelein Business Incentive Grant Program, not to exceed the amount of

$25,000.00 for the interior improvements; and

WHEREAS, Ordinance No. 15-04-17, amended by Ordinance No. 16-01-04, allows the Village

Board of Trustees to review each request on a case-by-case basis. Approved projects would be

awarded no more than 50% of the project cost up to a maximum of $5,000.00 for sign improvements,

$25,000 for interior improvements, and $25,000.00 for exterior site improvements, which may be

increased at the discretion of the Village Board of Trustees.

WHEREAS, the Village Board of Trustees has determined it would be in the best interests of

the Village to award the Grant Application for sign replacement as provided herein.

NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE

VILLAGE OF MUNDELEIN, COUNTY OF LAKE, STATE OF ILLINOIS as follows:

SECTION I: The Grant Application for a 50% matching grant in an amount not to exceed

$25,000.00 for interior improvements, shown on the application and plans attached hereto and made

a part hereof as Exhibit A, is hereby approved as provided herein.

SECTION II: This approval is subject to the Applicant's compliance with all terms and

conditions in the Village of Mundelein Business Incentive Grant Program.

Workmanship: All work shall be in strict accordance with manufacturer’s technical data specifications for type of

materials. No material will be used without reading and complying with manufacturer’s recommendations. All work shall

be by skilled workmen having not less than three years’ experience. All materials shall conform to FS standards.

Contractor shall supply all necessary barricades and covering as above stated work progresses.

Safety: All workers required to attend “Safety Services” safety meetings which include reviews of safety rules and

policies. We take a proactive stance in regards to safety by developing a safety plan as an integral part of each project.

All projects will be reviewed by management to identify possible hazards and make recommendations to abate.

We also take part in Quarterly in house safety training. Our Lead Safe Services manual is available for inspection.

Supervision: All projects applicable will be staffed with an on-site Supervisor to establish schedules and report on job

progress. It will be his/her responsibility (along with Management) to regulate and monitor project safety standards and

Quality Control. All Supervisors are trained and comply with definition of “competent person” which designates such

supervisors as responsible for his/her project and capable of identifying existing and predictable hazards in the

surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees and has authorization to

take prompt corrective measures to eliminate them. Code of Federal Regulations Part 1926.32 (F) We are Lead Safe &

Safety Services Certified.

Insurance: The contractor shall pay workmen’s compensation, public liability; carry vehicle insurance and an umbrella.

We will provide the certificate of insurance.

Cleaning Up Premises: Premises shall be left clean and orderly, and consistent to that which existed prior to initiation of

restoration project. All debris will be removed from job site as a result of restoration project.

Permit Fee’s TBD Miscellanies: This contract contains the entire understanding and agreement between the parties and no verbal agreements or changes

are to be recognized. Use of a change order is accepted for all modifications and add on work. Buyer(s) represents he/she is agent for

the property on which work is to be furnished. Seller shall not be liable for delays caused by strikes, weather conditions, delay in

obtaining goods or other causes beyond its control. Contractor is not responsible for conditions or circumstance beyond its control

including moisture/condensation resulting from or due to pre-existing conditions. Payment is due in full upon completion of

installation as described. Late fees may begin to accrue if payment in full is not received within 15 days of completion date. All sums

remaining unpaid thirty days after date of completion shall bear interest at the rate of 5% per month, or fraction thereof. Should the

buyer fail to pay in full as provided herein upon completion, and there are no manufacture or installation defects, they will be

responsible for all court costs, costs of litigation, and reasonable attorney’s fees incurred in the collection of any past due amounts.

made by Seller and Buyer for the Work. The costs of all permits for the Work and Extra Work are in addition to the price of the Work and Extra Work, and shall be paid for Buyer.

5. Unless otherwise stated on the face hereof, no bonds shall be required of Seller. Seller shall only be required to furnish evidence of worker’s compensation insurance in statutory amounts, and general commercial liability insurance insuring Seller against liabilities with combined limits of $1,000,000.00 per occurrence and shall only be required to name Buyer as an additional insured. Buyer shall maintain and pay for Builder’s insurance for the benefit of Buyer, Seller and its subcontractors in an amount not less than the total price of the Work.

6. All Extra Work shall be authorized by a change order signed by Buyer and Seller itemizing the Extra Work and its price, except if there is no agreed price, the price shall be Seller’s costs for labor, materials, and insurance plus 15% of such costs for overhead and profit.

7. Seller warrants the Work and Extra Work will be performed in a workmanlike manner in accordance with industry standards, that all material will be of good quality, and that all Work and Extra Work will be free from defects for one year after completion of the Work and Extra Work. SELLER DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE AND HABITABILITY. Seller shall not be liable for incidental or consequential damages or for liquidated damages. To the extent permitted by law, Seller shall indemnify Buyer against all claims arising out of Seller’s performance of the Work except to the extent that such claims arise out of acts or omissions of persons other than Seller or its subcontractors.

8. Except if there is a default, the contract may be terminated only by written consent of Buyer and Seller. If the Buyer suspends work for more than 60 days, such suspension shall be a breach of the contract. If Buyer shall breach any of the provisions of the contract, Seller may give 10 days notice to Buyer and if Buyer shall fail to cure such breach, Seller may terminate the contract and recover from Buyer Seller’s costs, and 15% of the total price of the Work and Extra Work as Seller’s profits and overhead. This contract shall be construed in accordance with and shall be governed by the laws of the State of Illinois applicable to contracts to be fully performed in such State and enforced only in the courts of such State.
