2 CHAIRPERSON’S REPORT The Chairperson reported on duties he had carried out since the last meeting, including the ADBT economic briefing, Sister City Committee meeting, ANZ presentation, art gallery visit, discussions with managers, Regulatory Services induction workshop, Citizenship presentation, and a meeting with Lieutenant Commander Grant Finlayson of the RNZN and the Mayor.

The Committee considered a report from the Parks and Recreation Manager on submissions to the Draft Caroline Bay Management Plan, advising there are also some changes to the Plan relating to regulatory requirements.

Mr Fraser Ross spoke to his submission, commending Council on the Draft Management Plan and also council staff for their work and commitment to Caroline Bay. Mr Ross expressed concern for the little blue penguin colony and the proximity of one of the proposed areas for a café. Clr Earnshaw suggested a compromise by moving a proposed area away from the beach front by the volleyball courts and more inland along Marine Parade, noting that the development of areas adjacent to a colony at Oamaru has enhanced the public’s awareness of the wildlife there. Mr Ross is generally opposed to any building development on the Bay, but would like to see more development of the penguin habitats first. The Chairman thanked Mr Ross for his submission and presentation. The Committee considered the two submissions received and resolved the following: 1.5 Status A submission was received requesting consideration be given to placing Caroline Bay under Section 17 of the Reserves Act 1977, or another appropriate classification. The Committee discussed various classifications and their limitations. It was noted that retaining the area in fee simple ownership gives a wider scope for the Council’s decision making for the area.

5 SPORT CANTERBURY UPDATE

The Committee considered a report from the Parks and Recreation Manager on Sport Canterbury. Verna Parker, South Canterbury Regional Manager and Chris Hutchison, Sport Canterbury General Manager, spoke to the report with a powerpoint presentation, outlining the function of Sport Canterbury in the Timaru District, including working with the Council on the Community Sport and Recreation Strategy, delivering Kiwisport Projects, Sports Club Partnerships, and various events Sport Canterbury has delivered including Sports Forums, Jump Jam, Holiday Programmes, Sea to Sea Challenge, and Active for Life. Clr Stevens thanked Sport Canterbury on behalf of the Geraldine Community noting significant changes over the last few years. The Chairman thanked Sport Canterbury for their contribution to the Timaru District, and their very comprehensive presentation.

6 DRAFT CAROLINE BAY MANAGEMENT PLAN SUMISSIONS (CONTINUED) Management Policies 3.4 Cafes Discussion took place on the potential locations of a café on Caroline Bay in the sand dune area, and the possible impact on the native wildlife. It was noted that potential café locations had been discussed extensively by Council.

Applications may only be made for a defined area. The hours of the licence will be determined by the District Licencing Committee. (third paragraph) A liquor ban shall apply on New Year’s Eve to the whole of the Bay from 7.00pm on 31 December to 7.00am on 1 January and may be applied for in designated areas from time to time for events………”

3.24 Information Signs A submission was received requesting additional signs along Marine Parade advising dog owners when dogs are not permitted on the Bay. The Committee noted the amount of signage already on the Bay. Instead of increasing signage, it was generally agreed that more patrols of the area by Animal Control Officers is required, and that this be referred to the Regulatory Services Group.

3.3 Aviary A submission was received requesting native birds not be enclosed in the aviary. The Parks and Recreation Manager advised native birds have not been housed at the Caroline Bay aviary for some years, although the Timaru Botanic Gardens aviary has housed the native parakeet Kakariki. The proposal to exclude native birds from the Caroline Bay aviary was not supported.

7 MINOR NATURE MATTER Naval Reunion The Chairman advised the Committee of the Royal New Zealand Navy’s 75th anniversary in May 2015. Celebrations are happening in Devonport, Auckland. The Chairman and the Mayor met with Lieutenant Commander Grant Finlayson and discussed inviting part of the navy to the Timaru area as part of the anniversary celebrations, with various events including a street parade etc.

Parks Liaison Officer Tenure Forestry Block RS29160

_______________________________ Purpose of Report This report is prepared to investigate options for a requested sale of Council fee simple land currently used for forestry purposes on SH79 Rangitata (RS29160) to an adjacent dairy operation (see attached aerial photograph). Background Council’s forestry operation comprises 239 ha located at 58 reserve areas over the district. While small (by comparison to many local authority forestry operations) this operation pays its own way and requires no rates or other funding inputs from Council. Income from forestry sales is used to replant and sustain the operation, and is also used for the revegetation of certain reserves when forestry is no longer considered an appropriate use for the land. This occurs most commonly with forest reserves located adjacent to residential areas or where other reserve management plans adopted by Council require it. Recent examples include Cemetery Hill at Pleasant Point, Waitohi Bush Reserve northwest of Pleasant Point (ongoing), and will involve Barkers Street/Riddells Reserve/Peka Peka Gully forestry blocks on the Geraldine Downs over a number of years. Loss of any productive plantation areas has an impact on long term financial viability and to date this has been overcome by utilising other Council owned land or vested reserves that are suitable to supplement planted areas. Options for this however are very limited. The Land RS 29160 is a Council owned (Fee Simple) parcel of land situated on the Rangitata-Geraldine Highway SH79 at Rangitata. It comprises 20 ha of land and is the second largest single reserve area utilised in the forestry operation. The land is of good quality for forestry production, and is flat in contour with good drainage characteristics making it accessible for maintenance and harvesting requirements on a year round basis. It is relatively close to the Port of Timaru and has a frontage onto to SH79. It is the combination of these factors that make it the ideal forestry block.

Currently the land contains 2 separate tree crops – 10 ha of Pinus radiata aged 20 years and 10 ha of Douglas Fir aged 35 years.

The Pinus radiata portion sustained severe windthrow in last September’s wind events and this crop has been sold but is yet to be harvested. This should occur by the end of May this year.

The Douglas Fir crop was undamaged by the wind events and is being grown on a 45 year rotation.

Both of these crops are registered in the Emissions Trading Scheme.

Council was approached in 2008 by Rangitata Dairies which owns land adjoining this reserve regarding a possible sale or land swap of part of the reserve area to better enable them to effectively utilise irrigation assets on their property. A report to Council was made at that time recommending a swap of land adjacent to the reserve. This did not proceed given uncertainties over obligations under the Emissions Trading Scheme and concerns that land offered was not as suitable given the proximity of high voltage power lines in the immediate vicinity.

Further approaches regarding possible purchase of the reserve have been made since then by Rangitata Dairies, the most recent in 2013 following the September wind events.

This report is in response to these recent requests. Options There are several options that exist when considering this request:

1. Do nothing and retain current land ownership and use as it is. Given current Council ownership of the reserve in a fee simple state and the suitability of the site for plantation purposes this would appear to be the most advantageous position to Council.

If change is sought then the following options exist:

2. Exchange a portion or all of the reserve with Rangitata Dairies for an equivalent or larger area of their property provided that any land offered is of at least equal quality to the land being sought by them, is located with a frontage to a legal formed road to facilitate access and future harvest, is fenced, and is not encumbered with any services (overhead or underground), water schemes or the like. All costs – subdivision, legal, Emissions Trading Scheme obligations etc to be met by Rangitata Dairies.

3. Sell the reserve to Rangitata Dairies at a price agreeable to Council with all costs (legal etc) and including any settlement requirements under the Emissions Trading Scheme being met by Rangitata Dairies. Any revenues gained from the sale to be used to purchase another appropriate piece of land for Council forestry use. The land could be sold with the current Douglas Fir crop as part of the deal or Council could sell the Douglas Fir independent of and prior to any sale process.

4. A final option would be to enter into a lease of the land to Rangitata Dairies at an agreed rate that would compensate for tree crop revenues that could be generated on the site.

This option provides for ongoing income to the Forestry account to replace lost revenues and retains ownership of the reserve with Council.

Identification of Relevant Legislation, Council Policy and Plans As stated any sale of the reserve or other arrangement entered into that would not see tree crops continue to be grown on the site will incur obligations under the Emissions Trading Scheme. In the event of a sale and any new owner not replanting in forestry but clearing for other purposes such as dairying then the new owner would be responsible for any obligations under the Emissions Trading Scheme. A period of 4 years between harvest and replanting is permitted under the current rules of the scheme. Assessment of Significance This matter is not deemed significant under the Council’s Significance Policy. Consultation In matters of land valuation Council has engaged the services of Carter Valuation Ltd of Timaru. In the matter of tree crop valuations and Emissions Trading Scheme obligations we engaged Laurie Forestry Services of Waimate. Other Considerations As a fee simple block of land RS29160 has been in Council ownership since 1880, and apart from the current request from Rangitata Dairies to purchase the land no other use other than plantation has been sought for the site. It is difficult however to see what the future holds and what possible community uses may be found for the land at some future time. Given its location adjacent to the busy SH79 it has the potential to be well placed for any future purposes. Funding Implications Sale of RS 29160 would require the purchase of an alternative block of land to maintain a sustainable land bank in the forestry operation. It may in fact be a challenge to find another 20 ha block of land offering the same advantages as that currently enjoyed with RS29160 (distance to port, access onto a formed road, flat topography, and suitability for year round access and felling) any one of which has the opportunity to increase costs and reduce actual returns to Council. It may well be that any potential new land available comes with additional drawbacks such as snow loading implications etc. This might perhaps be offset somewhat if in fact it is possible to buy a larger than 20 ha block with any revenues gained from sale of RS29160, but would also come with additional establishment costs. Entry into the Emissions Trading Scheme for any new block of land would not be mandatory, unless the land was already subject to these provisions. Conclusion For reasons stated earlier RS29160 is the ideal forestry reserve and any sale of this land would potentially open the forestry operation to uncertainty and preclude any potential future Council use for the land.

While it is appreciated that surrounding land use has changed significantly in the past 10 years, and that sale to the adjoining landowner - Rangitata Dairies would assist the effectiveness of their farming operation, any such land use changes being considered should be beneficial and at a minimum be cost neutral to Council. Given the uncertainties around a potential sale we should be gaining something from any change other than just being a good neighbour. Recommendations 1. That Council retains ownership of RS29160

2. That Council negotiates a lease of the reserve to Rangitata Diaries as

outlined in Option 4 of this report, after first selling the standing timber in the Douglas Fir compartment.
