Master Sgt Joseph Beliveau of the Illinois State Police and currently assigned to the Working

Against Violent Elements (WAVE) detail Complainant now appears before the undersigned judge

of the Circuit COUli of said County and requests the issuance of a search warrant to search the

PREMISES OF CLUB ROLEX BEING A COMMERCIAL BUILDING WITH RED BRICK

AND WOODED DECK STEPS LEADING TO THE FRONT DOOR WHICH FACES EAST

commonly known as 3803 STATE STREET EAST ST LOUIS ST CLAIR COUNTY

ILLINOIS and seize the following instruments articles and things which have been used in the

commission of or which constitute evidence of the offense(s) of THE CONTROLLED

SUBSTANCE AND CANNABIS NUISANCE ACT MAINTAINING A PUBLIC NUISANCE

UNLAWFUL POSSESSION OF CANNABIS POSSESSION OR SALE OF DRUG

Records ledgers receipts and other papers relating to transporting purchasing

distributing or possessing Cannabis and Controlled Substances

United States Currency precious metals jewelry and financial instruments including

but not limited to stocks and bonds

Indicia of occupancy use andor ownership of the premises to be searched includig~Jmt

documents instrumentalities video recordings audio recordings or substances which constitute

evidence of the commission of or constitute fruits of or which property has been used as the mean

Complainant says that he has probable cause to believe based upon the following facts1taq~e

above listed things to be seized are now located upon the PREMISES OF CLUB ROLEX BEING A

COMMERCIAL BUILDING set forth above

Complainant Master Sgt Joseph Beliveau of the Illinois State Police has been a police

officer for years with the Illinois State Police and has been assigned to the Working Against

Violent Elements (WAVE) federal task force for months WAVE is a task force of federal

state and local law agencies Due to the high crime rate in East State Louis WAVE was created

to patrol and investigate in an attempt to curb violent crime During its existence information

and reports have shown violent crime can be traced to buildings with liquor licenses incl~q~ng~J

but not limited to convenience stores clubs and liquor stores within housing projects -At the

7 request of the US Attorneys OfficSrmd the States Attorneys Office WAVE has beensent to

investigate violent crimes within nightclubs

Club Rolex 3803 State Street East Saint Louis Illinois is a commercial establishment

with a liquor license Over the course of sixteen months from September 2010 to January 2012

there have been calls to the East Saint Louis lgtolice Department to this specific location and

surrounding this location The specific calls to Club Rolex are listed below

0111312011- Stolen Vehicle Report (ESL PD)

09272010- Agents arrested Grazino Baker for Aggravated UUW by a Felon Baker was

inside the club and fought with agents during the arrest

Based on these reports a walk through was conducted at this specific location Club

Rolex On January 26 2012 Reporting Agent (RIA) Chris Lutz Special Agent (SA) Todd

Goldasich and MSgt Beliveau conducted awalk through of Club Rolex as part of the WAVE

task force MSgt Beliveau states under oath to the best of his information and belief that the

following is true

At approximately 0055 hours agents entered Club Rolex and upon reaching the upstairs bar area

detected the overwhelming odor of burnt cannabis and observed the room to be filled with white

smoke While walking through MSgt Beliveau and SA Goldasich observed a black male subject

seated at a table with a bag of cannabis in front of him On further observation RIA observed

numerous tables with loose tobacco and empty cigarillo wrappers which are commonly use to roll

cannabis blunts The RIA located two small bags of cannabis and two cannabis blunts one of which

was partially burned on the floor near the tables MlSgt Beliveau informed one of the managers of Club

Rolex of the aforementioned observations after which the manager responded by saying Yeah it

really does smell like weed up here

Based on Complainants training and experience Complainant has probable cause to believe that weapons of any form Catalogues magazines brochures books manuals and evidence of ordering the same relating to equipment or materials used in the preparation to traffic Cannabis and Controlled Substances Paraphernalia equipment and tools for packaging cutting weighing distributing storing processing and using Cannabis and Controlled Substances including but not limited to the following scales baggies timers pipes cooking utensils Books records receipts checks check receipts passbooks bank statements and records documentation reflecting an account at a financial institution money drafts letters of credit money orders cashiers and bank checks loan records documents andor keys relating to safety deposit boxes credit card receipts and other items of evidencing the obtaining secreting transfer concealment andor expenditure of money and other real or personal property Digital paging devices cellular and digital phones and the electronic messages contained therein Maps itineraries papers tickets schedules calendars statements lodging receipts passports visas an other items relating to interstate andor foreign travel plans

Based on the above information and facts Complainant has probable cause to believe that

officer for 22 years with the Illinois State Police and has been assigned to the Working Against

Violent Elements (WAVE) federal task force MSgt Beliveau states under oath to the best of

his information and belief that the following is true

WAVE is a task force of federal state and local law agencies Due to the high crime

rate in East Saint Louis and the surrounding communities WAVE was created to patrol and

investigate in an attempt to curb violent crime During its existence information and reports

have shown violent crime can be traced to buildings with liquor licenses including but not

limited to convenience stores clubs and liquor stores within housing projects Further

WAVE gathered other intelligence reports which show that cannabis and other drugs are

used frequently by patrons in an open and obvious manner Based on these documented

intelligence reports the US Attorneys Office for the Southern District of Illinois and the States

Attorneys Office have requested that WAVE investigate violent crimes and other criminal

activity within the nightclubs in this area

Club Posh 657 East Broadway East Saint Louis Illinois is a commercial establishment

with a liquor license Over the course of seven months from June 2011 to January 2012 there

have been numerous calls to the East Saint Louis Police Department to this specific location and

surrounding this location The specific calls to Club Posh are listed below

Based on these reports a walk through was conducted at this specific location Club Posh

On January 28 2012 Reporting Agent (RIA) Scott Boothe Federal Bureau of Investigations

(FBI) Special Agent (SA) Bryan Yingling MlSgt Joseph Beliveau FBI SIA Nick Manns and

Special Agent (SA) Chris Lutz conducted a walk through of Club Posh as part of the WAVE

task force

At approximately 1205 am on January 282012 detail units converged on Club Posh during

an after hour party to search for illegal activity because these parties have resulted in large fights and

shootings in the past As agents arrived at the front door and approached the entrance the odor of burnt

cannabis could be smelled coming from the interior of the building foyer area As agents entered the

club club personnel were posted at the main door wearing t-shirts marked security Patrons were

sent through a metal detector checked with a metal detection wand and patted down for weapons and

contraband Several individuals were observed by WAVE personnel being checked for contraband

and weapons prior to being allowed entrance into the club as WAVE personnel were on the

premises

Agents entered the club common area and began looking for drugs and dmg use in plain view

The RJA checked closed doors and bathroom areas The RJA checked a small closet easily accessible

to anyone once inside the club and found a camouflaged jacket lying on an upper shelf and a build

bench like area against the north wall As the RJA looked around the unfinished closet he observed a

handgun between the wall studs lying on the floor of the closet hidden from view by the built in bench

The RJA advised other detail units of the firearm and Deputy Justin Biggs provided a camera to the

RJA who photographed the firearm in its original position The RJA then retrieved the firearm made

the weapon safe and found that the firearm contained one magazine of five live rounds but none had

been chambered The camouflaged jacket owner who has no criminal history was identified As

indicated by his Metro link card he had just arrived at Club Posh and claimed he had no knowledge of

the firearm The firearm was boxed and transported to District 11 Zone 6 Headquarters by the RJA

The firearm was packaged per ISP policy labeled exhibit and submitted to the Zone 6 Vault for

transport to the ISP Crime Lab for test firing and comparison to the open case files

Contact was made with an on duty manager of the club MSgt Joe Beliveau and FBI SA

Nick Mamls spoke with the manager and advised the manager of the found firearm and the strong odor

ofburnt cannabis coming from inside the club dance floor and foyer areas The manager was also put

on notice that if illegal activities continued inside the club the management and club ownership could

be potentially violating both state and federal statutes

Club 103103 Collinsville Avenue East Saint Louis Illinois is a commercial

establishment with a liquor license Over the course of sixteen months from November 2010 to

March 2012 there have been numerous calls to the East Saint Louis Police Department to this

specific location and surrounding areas The specific calls to Club 103 are listed below

031112012- Stephan Holmes (AKA Tanky) was murdered in the parking lot


0412412011- Disturbance (ESL PD)

11252010- Agents Received information that Darius Jenkins was working at Jesses

Place Jenkins was wanted in connection with the Dominique Brown murder in 2009

Based on these reports a walk through was conducted at this specific location Club 103

On April 27 2011 the Reporting Agent (RIA) and M1Sgt Joseph Beliveau conducted a walk

through of Club 103 as part of the WAVE task force

On April 27 2011 WAVE agents conduct a consensual walk through of the club Agents

readily detected a strong odor ofburnt cannabis in the basement of the club It was also obvious that

subjects were hollowing out their cigars and discarding the content in a trash can in the basement The

RIA knew this to be a common practice for marijuana users Two security guards were also carrying

concealed firearms One of those guards was a convicted felon The other guard advised agents that the

Mayor of East Saint Louis has mandated that they escort patrons to their vehicles when they leave the

club and that it was dangerous to do so Therefore he wore a bulletproof vest and carried a firearm

Based on Complainants training and experience Complainant has probable cause to believe that weapons of any form Catalogues magazines brochures books manuals and evidence of ordering the same relating to equipment or materials used in the preparation to traffic Cannabis and Controlled Substances Paraphernalia equipment and tools for packaging cutting weighing distributing storing processing and using Cannabis and Controlled Substances including but not
