    maintaining a post abroad or, in the absence of another government officer, any citizenof the Philippines qualified to vote under R.A. No. 9189.Sec. 2 . Quali$cations of members of the SBOC. - No person shall be appointedas a member of the SBOC, unless he :

    1a) Is of good moral character and irreproachable reputation; andb) Is able to speak and write English or Pilipino.Sec. 3. Disquali~cations. The following are disqualified from serving asmembers of the SBOC:a) Those who are related within the fourth civil degree of consanguinity oraffinity to:

    t I I1) Any member of the same SBOC;2) Any of the candidates for Senator; or3) Any of the nominees for the party-list system of representation.

    b) Those140 ave been convicted of any election offense or of any other crimepunishable by more than six ( 6 )months of imprisonment; or,C)Those why have a pending case filed against them for any election offense.See. 4 . Powers and functions of tlze Board. - The Board shall have fullauthority to keep qrder within the canvassing room or hall including its premises andenforce obedience to its la~yful rders. If any person refuses to obey any lawful order ofthe Board or conducts himself in such disorderly manner as to disturb o r interrupt itsproceedings, the Board may, by a majority vote, order in writing any peace officer/guardof the embassy or eonsulate to take such person into custody until adjournment of themeeting. In the absence of any peace officer/guard, any other competent and ableperson deputized by the Board in writing, shall execute such order. Such fact shall benoted in the Minutes of the proceedings.Further, the;Board shall:a) Canvass/~onsolidatehe electronic results;1b) Generate and print the COC and SOV;c) Load the Pesults; andd) Perform such other functions as may be directed by the Commission.

    ARTICLE I1COMMON PROV ISIONS

    S ec . 5. Consolidation and Canvassing System (CCS) Operator. - TheSBOC shall be assisted by an information technology-capable person authorized tooperate the CCS, to be known as CCS operator. The CCS operator shall be deputized bythe Comnlission, from among the personnel of the Post or other agencies andinstrumentalities of the government, including government-owned and controlledcorporations maintaining offices abroad.'d

    The CCS operators shall be designated by the head of Post and shall beconsidered as member of the SBOC bu t he cann ot participate in the deliberation of th ethree (3) mem bers of the SBOC except on technical ma tters .The mem bers CCS Operator shall not be related to each @ her or to any m emberof the Board or to any candid ate whose votes will be canvassed by t he Board, within th efourth civil degree of consanguinity or affinity.Sec. 6. Reception and Custody Group. The Board may constitute aReception and Custody Group (RCG) for the reception and safekeeping of the mainmemory card an d of the hardcopies of ERs.The RCG shall be composed of not more than tw7o (2) members who aregovernmen t appointive officials. They shall be designa ted by the concerned ch airman ofthe Board and shall receive honoraria computed as that of the m em bers of th e Board.

    The members of the RCG shall not be related to each other or to a ny mem ber ofthe Board or to any can didate whose votes will be canvassed by the Board, within th efourth civil degree of consanguinity or affinity.Sec. 7. Duties and Responsibilities of the Reception and CustodyGroup. The RCG shall:a) Receive from The SBEI, th e envelope containing th e m ain m em ory card ofPCOS anh the envelopes containing the prin ted copies of the ERs intended the

    I) Date and tim e of receipt;2) Condition and the serial number of corresponding paper seal of theenvelope;'3) The precinct num ber of the envelope containing the m em ory card;

    c) Mark In hhe project of precincts the corresponding precincts ~ ~ h i c hnvelopecontaining the main memory card;d) Place th e envelopes containing the ERs/COCs inside th e ballot box, close thesam e with security seal; andf ) Fom7ard:to the Board, the ballot boxes containing the ERs/ COCs and onecopy of.the ist of precincts as marked.Sec. 8. Notice of disqualification - Any member of the Board who isdisqualified for any of the above reasons shall, upon appointment, noti@ the Head ofthe Post, in writing, who shall, in turn submit a replacement to the Commission,through the COV Chairman, for appointm ent.For this purpose, the COV shall fi~rnishhe Post, through the DFA-OVS, the listof senatorial candidates and t he n ame s of nominees of party list gro ups participa ting inthe party-list system of representations for the May 13, 2013 National, and LocalElections so that the members of the Board will be able to know whether they arequalified or not to accept their app ointm entsSet. g. superviiion nd cont~-01.     supenfision and control over the Board an d m ay m o t ~roprio relieve, at any tim e for acause, any member thereof and designate the corresponding substitute/repla cem ent.Sec. lo.Replacement of Chairman and Members of the Board. - Incase of non-availability, absence, disqualification du e to r el at io ~s hi p, r incapacity forany cause of the Chairman , th e replacement shall come from a mo ng any oth er rankingofficial from 'th e Post or from any of the government agencies m aintainin g a p ostabroad, of good standing, n ot othenvise disqualified unde r th e law.With respect to the o ther m embers of the Board, the replacement shall be fromthe qualified foreign service corps personnel or from members of the Filipinocommunity at the Posts.

    IFor this purpose, all replacements shall be appointed by the Chairman of thecov.I ,

    Set. 11. Notice of meetings of the Board. - Not later than May 8, 2013,Philippine time, the Chairman of the Board shall give written notice (OVF No. 11-C) tothe other member4 of the Board, and, through the COV, give similar notice to eachcandidate, politicali part y or coalition of political part ies fielding can did ates for S ena torand political parties, organizations or coalitions thereof participating und er t he party-list system of representation. The notice shall include the date, time and place of thecanvassing, which shall be held in the Philippine Embassy/Consulate, unl ess otherw iseordered by the Comm ission.Similar notices shall also be given for subsequent meetings unless notice hasbeen given in open session. Proof of service of notice to each member, candidate,political party fielding candidates for senator, and political party, organization orcoalition thereof participating under the party-list system of repre sentation shall beattached t o and foum p art of the records of the proceedings. Fo r this purpo se, the COVshall send th e proof of service of notice to the Posts, throug h t he DFA-OVS, which inturn, shall ensu re that said proof of service of notice are with th e different Boards at thetime they convene. .

    IIf notice is given in ope n session, such fact shall be recorded in the Minutes of theproceedings.Notice of the canvassing shall also be posted in three (3) conspicuous places inthe building where the canvass shall be held as well as in the websites of the

    Commission, the DFA and of th e Post concerned.The COV whenever practicable, use other means of disseminating suchnotice which may include bu t n ot b e limited to th e tri-media.Sec. 12. B-eliminary to canvassing. - Not later than M a y 12, 2013,Philippine time, the m embers of th e Board shall mee t to:I) ~ c ~ u a i n t ' t h e m s e l v e sith each other;2) ~arni l ia r i~zehemselves w ith their respective dutie s and responsibilities duringthe canva'ssing;43) Ensure that all the required canvassing forms and supp lies are complete; and4) Discuss {perational and procedural ma tters to en sure that th ey are able tofulfill their duties and responsibilities in accordance with these generalinstructions and o ther guidelines set by the C ommission.

    Sec. 13. Convening of the Board. - The Board shall meet at 6:00 o'cloclc inthe evening of M a y 13, 2013, Philippine time, at the designated building/place inthe Philippine Embassy/Consulate or other foreign sewice establishments authorizedby the Commission, to receive the election returns and to immediately canvass thosethat have already been received. It shall meet continuously frpm day to day until thecanxrass s completed, an d may adjourn only for the purpose of awaiting ot her electionreturns. However, as the need arises, the B oard may declare a recess.The proceedings of the Board shall be open and public.

    Sec. 14.Minutes of the Board; distribution.- The M ember-Secretary shallprepare the Minutes of Canvassing (OVF No. 11-B)of the Board in three (3) copies byrecording therein th e proceedings and such other incidents or m atters relevant to th ecanvass. 1

    Copies of the Minutes of the proceedings shall be distributkd as follows:a. one copyifor th e Chairman of the Board;b. one copyifor th e Law Departm ent of the Com mission;c. one copy;for the Special Ballot Reception an d Custody Grou p (SBRCG) a t thePost whei-e th e canvassing was held.

    Sec. 15. Temporary Absence of a Regular Board Member. - In case aregular member of the Board is temporarily absent, the members present shall firstverify whether notice has been served on the ab sent member. In case no such notice wassent, one shall be immediately served on the absent m ember. If the la tter cannot belocated or his whereabouts a re unknown, h e shall be substituted in accordance with Sec.6 hereof. These facts shall be recorded in the Minutes of the Board. As soon as theabsent member appears, the substitute member shall relinquish his seat to the regularmember.

    Sec. 16.Prohibition against transfer, leaving omcia1 station. - Duringthe period beginning election day, May 13, 2013, until the COC shall have beenpersonally submitted to the Commission, no member or s~~bstitute ember of thedifferent Boards shall be transferred, assigned or detailed outside of his official stationnor shall he leave said station without prio r authority of the C hairman of the COV.
