1 INTRODUCTION

1.1 CONTEXT

This Construction Heritage Management Plan (CHMP) forms part of the Construction Environmental Management Plan (CEMP) for Bodangora Wind Farm (the Project).

This CHMP has been prepared to address the requirements of:

• New South Wales (NSW) Department of Planning and Environment (DPE) consolidated Conditions of Approval (CoA) Modification 2 (December 2016)

• all applicable legislation, during construction of the Project • mitigation and management measures listed in the Statement of Commitments (SoC) in the

Bodangora Wind Farm Environmental Assessment (EA)

CoA E21 states: As part of the Construction Environmental Management Plan for the Project required under condition E20 the Proponent shall prepare and implement:

(e) a Construction Heritage Management Plan to detail how construction impacts on Aboriginal and Historic heritage will be minimised and managed. The Plan shall be developed in consultation with the OEH and registered Aboriginal stakeholders (for Aboriginal heritage), and include, but not necessarily be limited to:

I. in relation to Aboriginal Heritage:

details of further investigation and identification of Aboriginal cultural heritage sites within the Project area;

details of management measures to be carried out in relation to Aboriginal heritage, including a detailed methodology and strategies for protection, monitoring, and conservation, of sites and items associated with the Project;

procedures for dealing with previously unidentified Aboriginal objects (excluding human remains) including cessation of works in the vicinity, assessment of the significance of the item(s) and determination of appropriate mitigation measures including when works can re-commence by a suitably qualified archaeologist in consultation with the Department, OEH and registered Aboriginal stakeholders, and assessment of the consistency of any new Aboriginal heritage impacts against the approved impacts of the Project, and registering of the new site in the OEH’s Aboriginal Heritage Information Management System (AHIMS) register;

procedures for dealing with human remains, including cessation of works in the vicinity and notification of the Department, NSW Police Force, OEH and registered Aboriginal stakeholders and not recommencing any works in the area unless authorised by the Department and / or the NSW Police Force;

heritage training and induction processes for construction personnel (including procedures for keeping records of inductions) and obligations under the conditions of this Approval and National Parks and Wildlife Act 1974 (where relevant) including site identification, protection and conservation of Aboriginal cultural heritage;

procedures for ongoing Aboriginal consultation and involvement for the duration of the Project, and ensure that the Wellington Local Aboriginal Land Council (administrator) is kept informed of the process; and

mechanisms for the monitoring, review and amendment of this plan.

II. in relation to Historic Heritage:

identification of heritage items directly and indirectly affected by the Project; details of management measures to be implemented to prevent and minimise impacts on heritage items (including further heritage investigations, archival

recordings and / or measures to protect unaffected sites during construction works in the vicinity);

procedures for dealing with previously unidentified heritage objects, (including cessation of works in the vicinity, assessment of the significance of the item(s) and determination of appropriate mitigation measures including when works can recommence by a suitably qualified and experienced archaeologist in consultation with the Heritage Branch of OEH and the Department, and assessment of the consistency of any new heritage impacts against the approved impacts of the Project;

heritage training and induction processes for construction personnel (including procedures for keeping records of inductions and obligations under the Heritage Act 1977 and these conditions including site identification, protection and conservation of non-Aboriginal cultural heritage; and

mechanisms for the monitoring, review and amendment of this plan.

1.2 BACKGROUND

Bodangora Wind Farm Pty Ltd (BWFPL), a subsidiary of Infigen Energy Development Pty Ltd, received planning approval for the construction and operation of a wind farm and ancillary infrastructure at Bodangora, in central west NSW. This Project is a State Significant Development project and environmental initiative that represents an important contribution to renewable energy generation in NSW.

The Environmental Assessment (EA) summarised the key findings of the assessment of the impacts of the construction and operation of the Project on Aboriginal and non-Aboriginal heritage, included in the EA. This assessment included consultation with relevant government authorities and Aboriginal groups, searches of heritage databases including the NSW Office of Environment and Heritage (OEH) Aboriginal Heritage Management Information System, State Government Section 170 registers, the Local Environmental Plan, and State Heritage Register, as well as a comprehensive field survey.

The EA identified limited potential for minor impacts on heritage values in the proposal area. While some low density Aboriginal heritage artefacts and a section of a historic heritage railway are present in the proposal area, it was concluded that direct impacts of the Proposal are of low significance, discreet in nature, and will occupy a relatively small footprint. The EA proposed the implementation of mitigation and management measures to minimise these impacts.

A Consortium has been awarded the contract to construct the Project. The Consortium comprises an EPC Contract Partnership between CATCON and GE, where both parties are signatories to the EPC Contract, with CATCON being the lead contractor. GE are responsible for supply of towers and turbines, while CATCON are responsible for the remainder of works including civil, electrical, substation, and installation of towers and turbines. The switchyards and overhead powerlines will be constructed by TransGrid. All TransGrid staff and contractors will be inducted into and operate under this CEMP.

This CHMP describes the environmental management measures CATCON will implement during the construction work.

1.3 ENVIRONMENTAL MANAGEMENT SYSTEMS OVERVIEW

The overall Environmental Management System (EMS) for construction of the Project is described in the CEMP. This CHMP is part of the environmental management framework for the Project. Mitigation and management measures identified in this CHMP will be incorporated into site or activity specific Environmental Work Method Statements (EWMS).

Used together, the CEMP, CHMP, strategies, procedures and EWMS form management guides that clearly identify required environmental management actions for reference by CATCON personnel and contractors.

The review and document control processes for this plan are described in the CEMP.

2 PURPOSE AND OBJECTIVES

2.1 PURPOSE

The purpose of this plan is to describe how impacts on heritage will be minimised and managed during construction of the Project.

2.2 OBJECTIVES

The key objective of the CHMP is to ensure that impacts to Aboriginal and non-Aboriginal heritage are minimised and within the scope permitted by the planning approval. To achieve this objective, the following will be undertaken:

• Ensure appropriate controls and procedures are implemented during construction activities to avoid or minimise potential adverse impacts to Aboriginal and non-Aboriginal heritage in the project footprint

• Ensure appropriate measures are implemented to address the mitigation measures detailed in the EA and CoA

• Ensure appropriate measures are implemented to comply with all relevant legislation and other requirements as described in Section 3.1 of this plan

• Facilitate engagement with the local Aboriginal community in partnership to appropriately manage the Aboriginal cultural heritage values associated with the Project

2.3 TARGETS

The following targets have been established for the management of Aboriginal cultural heritage and non-Aboriginal heritage impacts during construction of the Project:

• Full compliance with the relevant legislative requirements • Full compliance with relevant requirements of the EA and CoAs • Impacts on known Aboriginal and non-Aboriginal heritage sites minimised or avoided • Correct procedures followed, including notification of any previously unidentified Aboriginal

heritage objects/places uncovered during construction • Aboriginal and non-Aboriginal Cultural Heritage Awareness Training provided to all

personnel in the form of inductions before they begin work on site

3 ENVIRONMENTAL REQUIREMENTS

3.1 RELEVANT LEGISLATION AND GUIDELINES

3.1.1 Legislation

Legislation relevant to air quality management includes:

• Environmental Planning and Assessment Act 1979 (EP&A Act) • National Parks and Wildlife Act 1974 (NPW Act) • National Parks and Wildlife Amendment Regulation 2009 • Heritage Act 1977 (Heritage Act) • Aboriginal and Torres Strait Islander Heritage Protection Act 1984 (Commonwealth)

Relevant provisions of the above legislation are explained in the register of legal and other requirements included in section 3 of the CEMP.

3.1.2 Guidelines and standards

The main guidelines, specifications and policy documents relevant to this plan include:

• Aboriginal cultural heritage consultation requirements for proponents (DECCW 2010) (ref.) • Interim Guidelines for Aboriginal Community Consultation, Requirements for Applicants (Dec

2005) • Draft Guidelines for Aboriginal Cultural Heritage Impact Assessment and Community

Consultation (NSW DEC 2005) • Altering Heritage Assets (Heritage Office and DUAP 1996) • Assessing Heritage Significance (NSW Heritage Office 2001) • Archaeological Assessment Guidelines (NSW Heritage Office and NSW Department of Urban

Affairs and Planning 1996) • Aboriginal Participation in Construction Guidelines (NSW Government 2007)

3.1.3 Conditions of approval

CoA E2 States: In undertaking the Project, impacts to heritage, shall to the greatest extent practicable, be avoided and minimised. In particular:

(a) clearly identify and avoid the stone procurement artefact area (SU18/L1), and the Kaiser Mine, and include methods for restricting access to these sites as part of the Construction Heritage Management Plan required by condition E21(e); and

(b) where impacts as assessed in the EA are unavoidable, works shall be undertaken in accordance with the strategy outlined in the Construction Heritage Management Plan required by condition E21(e).

CoA E3 States: Clearly identify the level of construction vehicles required to use the Sandy Hollow to Maryvale Railway line, and the ability of the existing road to accommodate heavy vehicles. Should widening or other enhancements be required to safely accommodate heavy vehicles, a Statement of Heritage Impact is required in accordance with relevant Heritage Council guidelines, in consultation with the Heritage Branch of the OEH, and to the satisfaction of the Secretary.

CoA E21 requires the CEMP to have a Construction Heritage Management Plan to detail how construction impacts on heritage will be minimised and managed. CoA 21 subsection E are addressed in this plan below.

4 CONSULTATION The process for consultation included written notification to the following requesting persons who may have an interest in the Project:

• OEH ECP Dubbo Office • Wellington Local Aboriginal Land Council (letter returned to sender) • Office of the Registrar, Aboriginal Land Rights Act 1983 • The National Native Title Tribunal, requesting a list of registered native title claimants,

native title holders, and registered Indigenous Land Use Agreements • Native Title Services Corporation (NTSCORP) Limited • Wellington Council • Central West Catchment Management Authority, requesting contact details for any

established Aboriginal reference group (and four letters to individuals and on behalf of reference groups sent accordingly)

Three groups registered an interest in the Project, whose details were forwarded to OEH. A copy of the Project details was forwarded to the three parties, but no responses were received pertaining to cultural information relating to the project area. A copy of the draft report by New South Wales Archaeology was provided to the registered parties for a period of 28 days for review.

At the time of writing of the EA, no responses had been returned following the review of the draft report by the consulted parties. There have been no late registrations of interest, but had there been, they would have been accommodated during the process of consultation. In particular, attempts were made to consult with the Wellington Local Aboriginal Land Council; however, at the time the study was conducted, the organisation was not functioning.

Heritage areas, objects, or places identified as a result of the Project approval process and Aboriginal community consultation undertaken for this Project will be conserved as required by the CoAs.

The CHMP was forwarded to OEH for comment. The OEH recommendations are reproduced and addressed in Appendix C of the CHMP.

The CHMP was forwarded to aboriginal stake holders for consultation. One response was received from Bradley R. Bliss J.P. WVWAC Chairman and Contact Officer (Appendix C).

A copy of the original ACHAR has been provided to WVWAC.

The request from WVWAC to conduct the Aboriginal Cultural Heritage Inductions will be considered further. WVWAC will be invited to provide a scope of work and quote for the Aboriginal Cultural Heritage Awareness training. The Aboriginal Cultural Heritage Awareness training will be delivered to senior project staff prior to the commencement of construction. The scope of works and quote will be assessed on a commercial basis.

In regard to the WVWAC request to be present during work close to the site, it is considered that this would not be necessary.

4.1 ON-GOING ABORIGINAL CONSULTATION

CATCO are committed to the continuing Aboriginal involvement in the Bodangora Wind farm Project. Ongoing consultation with the Aboriginal community is a requirement of CoA21(e). Ongoing consultation with the Aboriginal community and registered stake holders for the project will occur during the construction of the project. The triggers for consultation with the community during construction include:

• The need to keep Wellington LALC informed (CoA E21(e)) • Any additional heritage assessments for changes in project scope • The Unexpected Finds Procedure (Appendix A) • Aboriginal participation in the project construction • Aboriginal cultural heritage inductions for senior project staff

5 EXISTING ENVIRONMENT The following sections summarise what is known about Aboriginal and non-Aboriginal heritage within and adjacent to the project area. Heritage sites are shown in Figure 5-1. Closeup maps are presented in Appendix B.

5.1 ABORIGINAL CULTURAL HERITAGE

5.1.1 Background search results

The project area was traditionally occupied by the Wiradjuri peoples, who inhabited a widespread area extending from the Great Dividing Range west to the Macquarie, Lachlan, and Murrumbidgee Rivers.

The project area is located on landforms and terrain which is highly amorphous and generally undifferentiated in character. Biodiversity values was assessed to be relatively low, and water sources are ephemeral. Accordingly, Aboriginal use of this landscape is predicted to have been sparse, of low intensity, and restricted to a limited range of activities such as movement through the country, hunting and gathering forays, etc. These types of activities would have resulted in artefact discard which is patchy and low density in distribution.

A search of the NSW OEH AHIMS identified 10 recorded heritage places, all situated outside the project area.

Three heritage places are located outside of but in proximity to the project area.

The distribution of these sites is related at least in part to variance in topography and ground surface geology. Stone artefact scatter sites, scarred or carved trees, and grinding grooves (found in rock surfaces and resulting from the manufacture and maintenance of ground edge tools) are the most common site types found in the region.

Larger and more complex sites are likely to occur in association with permanent watercourses, while sparse artefact scatters and evidence of intermittent and infrequent occupation will be located on landforms which are removed from permanent water sources, such as ridge tops or lower order ephemeral creeks.

5.1.2 Field survey results

Two Aboriginal objects were found within the project area during the field survey:

• SU3/L1: artefact locale (696852, 6411952) – a scatter of stone artefacts found along five metres of farm track, including a chert flaked piece and retouched artefact, and quartz items including a core. There is no potential for the site to contain subsurface archaeological deposit, however it is likely that the items were likely to have been larger given that the locale is highly disturbed from road grading and traffic. This item is located along a proposed access track. Unmitigated impacts* on this locale are considered to be appropriate. *Unmitigated impact means the site can be directly impacted.

• SU18/L1: possible stone procurement area (692880, 6411849) - a quartz outcrop which possesses evidence of having been struck by means of hard hammer percussion. While the exact nature of the use of this quartz outcrop for this purpose is uncertain, archaeological excavation would be required for determination. This item is located along a proposed access track. Impacts to this area will be avoided by micro-siting the proposed access track around the area.

The dearth of Aboriginal objects most likely reflects low effective survey coverage, given the thick grasses within the survey area. Any unrecorded items present are likely to be present in low or very low density and a patchy distribution.

During the field study, no landforms or areas in landforms were identified that are likely to have been environmental focus points that Aboriginal people would have habitually occupied, and would hence have resulted in high density concentrations of artefacts.

5.1.3 Further archaeological survey

Additional archaeological survey is planned for the electricity transmission line. The additional survey will include the path of the transmission line between the substation adjacent turbine 27 and the 132kv TransGrid transmission Line at Cunnegalderie Road. The additional survey will occur in the coming months and be completed prior to August 2017.

5.2 NON-ABORIGINAL HERITAGE

5.2.1 Background search results

Heritage values at Bodangora and in the wider region relate to pastoral and agricultural activities, mining, and transport.

Pastoralists first arrived in the Wellington Valley as early as 1819. Several townships were established, and agriculture increased in the region following the introduction of the Main Western Railway system to Sydney in 1880.

Other settlements were established following the discovery of gold including the township of Bodangora following the establishment of the Kaiser gold mine (located near proposed wind turbine generator 44). The mine ceased production in 1881.

Pastoralism was introduced into the Wellington Valley as early as 1817, the year that Oxley had observed the presence of recent cattle tracks as he was exploring the region. Thereafter, pastoralists moved into the district in increasing numbers as they sought ever more pastures for their herds. The first wheat crop was planted in the area in 1823. However, while pastoralism flourished from its introduction, agriculture in earnest was slow to become established, principally because the great distance to the main market in Sydney made such farming unprofitable.

The area which comprises the township of Bodangora and its surrounds was formerly part of the ‘Nanima’ estate, and was originally used primarily for sheep grazing.

Proposals for an additional railway were advanced that would link the Main Western Railway line to the Northern Railway Line, being the Sandy Hollow to Maryvale line. The railway was constructed to 95% completion, although the track was never laid for various political and funding issues. A section of this railway is within the project area.

A search of the Australian and State heritage databases has been undertaken, revealing the following heritage places which are protected by State and Commonwealth legislation:

• 42 items listed on the Register of the National Estate present within the Wellington Council, none of which are within the project area

• 59 items of the NSW heritage database are present within the Wellington Council, three of which are located within, or are in proximity to the Bodangora project area:

o Bodangora Gold Mine Former Remains – Chimney, Shaft and Engine Footings, Bodangora

o Sandy Hollow to Maryvale Railway, Sandy Hollow and Maryvale o St Paul’s Catholic Church, Bodangora

There is a probability that additional items of historical significance may be present within the project area, most likely related to the heritage themes of agriculture/pastoralism, mining, and transport/telecommunications, which are not specifically listed on State or Commonwealth heritage databases. Items may include standing structures or ephemeral sites and ruins.

5.2.2 Field survey results

The field survey identified one previously recorded heritage item, the Sandy Hollow to Maryvale Railway, which is within the study area and currently being used as a farm road within the Glen Oak property.

One unlisted item of historic significance was also recorded during the field survey, Kaiser Mine, which is comprised of a concrete ore treatment plant, mine shaft, mullock heap, and associated features and discarded items, and located outside the project area.

5.2.3 Constraints mapping

The location of environmental constraints including heritage are displayed on constraints Maps. An overview of the constraints maps is provided in Figure 5-1. Close ups of the constraints maps are provided in Appendix C. High resolution constraint maps are provided electronically as PDFs and shape files to design and construction teams.

6 ENVIRONMENTAL ASPECTS AND IMPACTS Key aspects of the Project that could result in adverse impacts to Aboriginal and non-Aboriginal heritage include:

• Excavations, earthworks, and associated soil disturbance for roads, laydowns, turbine footings, compound and substation construction

• Trenching for underground electrical and telecommunications cables and track and pole installation for overhead cables

• Clearing and grubbing of vegetation • Removal of topsoil • Construction of footings, tracks, stockpiles, and ancillary facilities • Installation of ERSED control measures

6.1 ABORIGINAL CULTURAL HERITAGE IMPACTS

New South Wales Archaeology concluded that the proposed impacts to the archaeological resource of the site can be considered of low impact and low significance. Impacts as a result of the physical infrastructure proposed within the project area will be discreet in nature and will occupy a relatively small footprint. While the stone procurement artefact area (SU18/L1) is an identified heritage place for conservation, impacts to this site will be avoided by micro-siting of the access track between WTG 35 and 37, allowing the diversion of the proposed access road around this site. The artefact scatter (SU3/L1) has been assessed to be of low archaeological significance, and given the nature of the site on an existing access track, unmitigated impacts are considered appropriate.

Further investigation of Aboriginal cultural heritage is planned for the transmission line. Where design changes require works outside areas previously assessed or unexpected finds warrant additional Aboriginal Cultural Heritage investigations will occur, including:

• The investigation area will be identified on a plan, • Access to the proposed investigation area will be restricted, • An archaeologist will make a preliminary determination of the need for and level of

investigation required, • An investigation plan will be compiled if further detailed investigation is required, • The registered stakeholders, OEH and DPE will be consulted on the plan, • The investigation would take place with registered stakeholders as required, • The outcomes of the investigation and management actions would be reported to

registered stakeholders, OEH and DPE.

6.2 CONSERVATION STRATEGY

Items exist on or near site and are to be conserved such as SU18/L1 and the Kaiser Mine complex. The location and extent of these items were identified in EA. In order to conserve items the design of tracks, turbines and other ancillary facilities will consider the location and extent of these items.

The design of facilities and work will be sited to avoid items to be conserved. In addition, a buffer of 25m surrounding the extent of the item to be conserved will be included. The extent of an item to be conserved and the buffer will be marked on the designs drawings as an exclusions zone.

Prior to construction commencing adjacent to items to be conserved an exclusion zones will be marked in the field by surveyors. Subsequently exclusion fencing and exclusion signage will be erected around the site. Exclusion fencing will be of star pickets and three plain wires. The top wire will be highlighted using orange flag tape or similar. Exclusion signage will be similar to the type shown below (Figure 6-1).

Exclusion zone fencing will be inspected on a regular basis by construction staff. The results will be recorded in the weekly inspection reports. Any damaged exclusion zone fencing and signage will be repaired as soon as practicable. At the completion of construction exclusion zone fencing will be removed.

6.3 NON-ABORIGINAL HERITAGE IMPACTS

The two items located outside the project area (Bodangora Gold Mine Former Remains and St Paul’s Catholic Church) are not expected to be impacted as a result of the Project, as they are located away from any proposed physical development.

Sections of the Sandy Hollow to Maryvale Railway are currently being used as a farm road within the project area. The railway is proposed to be utilised for wind farm access during construction and operation. New South Wales Archaeology concluded that the proposed impact to the railway/road would be negligible, as it is not expected that there will be any additional impacts beyond those to which the railway line already sustains as a road.

Any widening of the rail road formation will protect the existing structure and integrity. As such changes to the cross-section would be minor and reversible. Enlarging cuttings and deep excavation of the rail road formation will not be permitted. Strengthening and/or Enlarging the formation rail road formation to provide heavy vehicle access and a sufficient level of safety will occur at select locations. Where strengthening/enlargement occurs, the following process will be followed:

1. An SOHI will be prepared 2. Archival recording of the sections of Sandy Hollow to Maryvale Railway impacted by access

upgrades will be prepared 3. A clear boundary between the historic and new formation using geotextile fabric will be created 4. Areas of restricted access (exclusion zones) will be clearly signposted or flagged 5. Road building materials will be placed and compacted 6. Only the newly placed road building materials will be trimmed and shaped

Kaiser Mine is located near to but outside of proposed development within the project area. Direct impacts are not expected on the Kaiser Mine. Any potential associated impacts can be appropriately mitigated.

Specific measures and requirements to address impacts on heritage values are outlined in Table 7-1 (blue text = CoA, green text = SoC). The measures listed cover broad activities, some repetition of mitigation measures may occur.

The CATCON Project Team’s organisational structure and overall roles and responsibilities are outlined in the CEMP. Specific responsibilities for the implementation of environmental controls are detailed in Section 4.2 of the CEMP.

8.2 TRAINING

All construction employees, contractors and utility staff working on site will undergo site induction training. This training will address obligations under the Project CoAs, National Parks and Wildlife Act 1974, Heritage Act 1977 and project specific site identification, heritage conservation and management measures. Targeted training in the form of toolbox talks or site specific training will be provided to personnel with a key role in heritage management. Further details regarding staff induction and training are outlined in the CEMP.

8.3 MONITORING AND INSPECTION

Inspections of sensitive areas and activities with the potential to impact Aboriginal and non-Aboriginal heritage will occur for the duration of construction.

8.4 AUDITING

Audits (both internal and external) will be undertaken to assess the effectiveness of environmental controls, compliance with this sub-plan and other relevant approvals, licenses and guidelines.

Audit requirements are detailed in Section 8 of the CEMP.

8.5 REPORTING

Reporting requirements and responsibilities are documented in Section 8 of the CEMP.

9 REVIEW AND IMPROVEMENT

9.1 CONTINUOUS IMPROVEMENT

Continuous improvement of this plan will be achieved by the ongoing evaluation of heritage management performance against heritage policies, objectives and targets to identify opportunities for improvement, as detailed in Section 9.1 of the CEMP.

9.2 CHMP UPDATE AND AMENDMENT

This CHMP will need to be revised whenever the construction program, scope of work, or work methods change, whenever the work methods and control structures are found to be ineffective, or if so directed by the Principal. This will occur as needed and in accordance with the process outlined in Section 9.2 of the CEMP.

APPENDIX A UNEXPECTED FINDS PROTOCOL

A.1 PURPOSE

This unexpected finds protocol has been developed to provide a method for managing unexpected non-Aboriginal and Aboriginal heritage items identified during the construction and maintenance of the Project. The unexpected finds protocol has been developed to ensure the successful delivery of the Project while adhering to the NSW National Parks and Wildlife Act 1974 (NPW Act) and the Heritage Act 1977 (Heritage Act).

Despite undertaking appropriate heritage assessment prior to the commencement of the Project, unexpected heritage items may still be identified during construction, operation and maintenance works. If this happens the following unexpected finds protocol plan should be implemented.

A.2 WHAT IS A HERITAGE UNEXPECTED FIND?

An unexpected heritage find is defined as any possible Aboriginal or non-Aboriginal heritage object or place that was not identified or predicted by the project’s heritage assessment and is not covered by appropriate permits or development consent conditions. Such finds have potential to be culturally significant and may need to be assessed prior to development impact.

Unexpected heritage finds may include:

• Aboriginal stone artefacts, shell middens, modified trees, hearths and rock art; • Human skeletal remains; and • Remains of historic infrastructure and relics.

A.3 ABORIGINAL HERITAGE PLACES OR OBJECTS

All Aboriginal objects are protected under the NSW National Parks and Wildlife Act 1974 (NPW Act).

An Aboriginal object is defined as:

Any deposit, object or material evidence (not being a handicraft made for sale) relating to the Aboriginal habitation of the area that comprises New South Wales, being habitation before or concurrent with the occupation of that area by persons on non-Aboriginal extraction and includes Aboriginal remains.

All Aboriginal objects are protected and it is an offence to harm or desecrate an Aboriginal object or place.

A.4 HISTORIC HERITAGE

The Heritage Act 1977 protects relics which are defined as:

Any deposit, artefact, object or material evidence that relates to the settlement of the area that comprises NSW, not being Aboriginal settlement; and is of State or local heritage significance.

A.5 UNEXPECTED FINDS MANAGEMENT PROCEDURE

All staff working on site will receive an induction prior to commencing work on site. The induction will include examples of Aboriginal objects that may occur in the area. Staff will be advised of this procedure in the induction. Staff will be instructed to contact their supervisor immediately if they see an object that may be Aboriginal in origin or may be human remains. Staff will be instructed to stop work immediately if they see an object that may be Aboriginal in origin or may be human remains. All staff are responsible for being aware of and looking for aboriginal objects.

In the event that any unexpected Aboriginal heritage places or objects or any substantial intact historic archaeological relics of State or local significance are unexpectedly discovered during the Project, the following management protocols will be implemented:

1. Works at that identified heritage location will cease with an appropriate buffer zone of at least 20 metres to allow for the assessment and management of the find. All site personal will be informed about the buffer zone with no further works to occur within the buffer zone.

2. Heritage specialist will be engaged to assess the Aboriginal place or object encountered, Representative from the registered the Aboriginal Stakeholders for the Project may also be engaged to assess the cultural significance of the place or object;

3. The Project approvals will be reviewed to assess consistency with the approvals to impact Aboriginal heritage within the Project area

4. The discovery of an Aboriginal place or object will be reported to the local office of the Office of Environment and Heritage (OEH);

5. If the Aboriginal heritage places or objects are found to be covered under the existing approvals to impact Aboriginal heritage within the Project area, works may continue to be conducted in accordance with mitigation measures and approval requirements.

6. If the Aboriginal heritage places or objects are found to not be covered under the existing approvals to impact Aboriginal heritage within the Project area, works will not recommence at the heritage place or object until advised to do so by OEH.

7. If the heritage place or object can be managed in situ, works at the heritage location will not recommence until appropriate heritage management controls have been implemented, such as protective fencing.

8. For historic relics, work must cease in the affected area and the Heritage Council must be notified in writing. This is in accordance with section 146 of the Heritage Act 1977.

9. Depending on the nature of the discovery, additional assessment may be required prior to the recommencement of work in the area. At a minimum, any find should be recorded by an archaeologist.

A.6 HUMAN SKELETAL REMAINS

Where human skeletal remains are unexpectedly found during works for the Project the following protocol would be adopted:

1. Works at that location will cease, and an appropriate buffer zone of at least 50 metres will be established;

2. The human remains will not be moved;

3. The NSW police will be notified, and if the human remains are deemed a crime scene, the place will be managed by the police;

4. Should the human remains be deemed Aboriginal or historical by the police, DPE, OEH must be notified immediately to assess the remains; and

5. Should the human remains be deemed Aboriginal in origin all registered Aboriginal parties for the Project are to be notified in writing.

The above process functions only to appropriately identify the human remains and secure the site, from which time the management of the remains is to be determined through liaison with the NSW police, OEH and the relevant Aboriginal stakeholders.
