Stolen Property; Hearsay; Preliminary HearingAttorney(s): Constance Nelson, Esquire for Prosecution Kevin S. Santos, Esquire for DefendantDate of Order: March 18, 2010Judge: Leonard N. Zito, J.Description of Decision:

The Court denied the Defendant’s Petition for Habeas Corpus, finding that the combination of DNA evidence, eyewitness testimony and video surveillance footage was sufficient to establish a prima facie case against the Defendant for burglary, receiv-ing stolen property, theft by unlawful taking, and criminal conspiracy. In addition, the Commonwealth did not rely exclusively on DNA evidence to establish its prima facie case, and therefore the Magisterial District Judge did not err in permitting the Com-monwealth to introduce limited hearsay testimony during the proceeding.Caption: LTD Acquisitions, LLC v. Zito, J.Description of Decision:

The Petitioner requested court approval for the transfer of her right to a settlement offer. The Petitioner intends to use the funds to pay her daughter’s college tuition and expenses. Settlement Funding LLC proposes to purchase Petitioner’s rights in which Petitioner would pay an effective interest rate of 19.31% per year. The Court rejected this interest rate as an outlandish amount. The Court did not find that any exigent circumstances existed that would justify the possibility of entertaining such a miserly offer. The Court rejected the Petition as contrary to the Petitioner’s best interest.

Description of Decision:Defendants filed Preliminary Objections to the Plaintiff’s Complaint. The Defen-

dant objected to due to Plaintiff ’s failure to state the location of its business and the improper verification. The complaint was filed after a seventeen month period in which Plaintiff ’s attorney could have obtained verification by a representative of the Plaintiff, but the Plaintiff ’s attorney verified the complaint on behalf of the Plaintiff. The Court sustained the Defendants’ objection to the verification and granted Plaintiff leave to file an amended verification.

The Defendants objected to the Plaintiff ’s failure to attach a copy of the alleged agreement to the complaint. Pa. R.C.P. requires that when a claim is based upon a writing the pleader shall attach a copy of the writing. The Court found that the complaint was insufficiently specific to meet the requirements of the Pa. R.C.P. Description of Decision:The Court overruled preliminary objections filed by the Defendant to the Plaintiff’s

Amended Complaint. The Defendant objected to the factual sufficiency of the amended complaint. The court found this objection meritless because the amended complaint set forth the substance of the alleged oral changes. The Court believed that these allega-tions were sufficient to permit the Defendant to prepare a response to the arguments.
