Chapter 1. Introduction

1.1 BACKGROUND

The Odisha Works Department (OWD) has a medium to long-term comprehensive programme to rehabilitate, upgrade and expand the road network throughout the state to improve accessibility, con-nectivity and enhance the overall development. It is the pre-eminent state level road authority in Od-isha which deals with issues relating to Feasibility Study and preparation of Detailed Project Report including the Route Selection, even for relatively low volume roads.

The Government of Odisha has secured a loan from International Bank for Reconstruction and Development (The World Bank) towards the cost of Widening and Strengthening of existing Jagat-pur- Duhuria Road Project (106 km).

Jagatpur-Chandbali Road Project is part of 825 km of roads under Phase-I which aims at promoting trade and regional integration between districts by improving transport communication. The project road Jagatpur-Chandbali is a part of the Phase-I road development, which was built several years ago with two lane configuration and currently serves moderate level of traffic. The project involves widening of the existing road which has an average carriageway width of 5.5 m to 6.8 m and 1.5m. Earthen shoulder on both sides, to a 7.0 m carriageway and 2.5m shoulders on both sides in flat and rolling sections. The expected outcome of the project include reduced transportation time of goods and better connectivity between districts along with improved safety standards; reduced transit time for import and export goods via port.

1.2 THE PROJECT

The Jagatpur - Duhuria (MDR) section km 0/00 to km 49/00 which is a part of Jagatpur - Kendrapada – Chandbali - Bhadrak 152 km project corridor. The road section Jagatpur - Duhuria starts from at Chainage 28/00 km of NH-5 and ends at Duhuria. Jagatpur is industrial area in Cuttack district, Kendrapada is a district headquarters of Kendrapara district. There are in total 4 numbers of minor bridges in Jagatpur -Duhuria section. Along the project road there are in total 145 existing culverts be-tween Jagatpur -Duhuria section. About 46% of the road length passes through built up area.

The total length of the project road is 49.000 Km. the road passes completely through plain terrain. Major stretch of the road is located in the District of Cuttack and Kendrapara. This stretch passes through major human settlements at Jagatpur, Salipur and Kendrapara.

Terrain

The road passes predominantly through flat terrain from Jagatpur to Duhuria except few rolling sec-tions. This road has mostly flat gradient with good geometry. Geometric on the road are generally mild; nevertheless requires some improvement of the congested area.

Climate

The Project Road corridor Jagatpur to Duhuria is characterized by warm climate (200C to 450C) tem-perature. Rainfall along the project corridor is relatively high ranging from 801 to 1600 mm. per annum. Bulk of the rainfall occurs during the month of June to October during the monsoon period. The terrain and topography do not allow the water to recede very quickly and major part of the area remains under the spate of flood each year.

Brief Scope of Improvement Works

The road is to be upgraded to 7.0 m carriageway with Asphalt Concrete/Pavement Quality Concrete with 1.5 m width paved shoulders at selected locations on either side. The works include earthwork,

1.4 CONTRACT PACKAGE P04A: SCOPE OF WORK

Contract P04A involves widening and strengthening of existing carriageway to 2-lane from Jagatpur to Duhuria near Kendrapara from Km. 0.000 (near NH-05) to Km. 49.000. The road is to be upgraded to 7.0 m carriageway with Asphalt Concrete/Pavement Quality Concrete with 1.5 m width paved shoul-ders at selected locations on either side. The works include earthwork, rehabilitation and construction of pavement with bituminous surface/PQC, construction of drainage structures, and other allied works.

The civil works for the above corridors consists of new construction and/or widening and strengthening of existing single or intermediate lane width to double lane with paved/hard shoulder for about 49 Km from Jagatpur to Duhuria of MDR in the state of Odisha, India.

The work shall include:

Improvement of road geometry mostly on existing Chainage. Raising and widening of embankment considering drainage and geometry. Construction of Flexible Pavements with sub base, base and bituminous courses for about 2/3rd of

the total project length. Construction of Rigid Pavement in discrete stretches for about 1/3rd of the total length of the pro-

ject in the Built-Up areas and Toll Plaza. Providing road signs and road markings and traffic safety features.

A. For improvement to drainage in the area the work comprises new constructions and rehabilitation and replacement of a number of cross drainage structures on the road including major and minor bridges and road side drains. Widening, repair and rehabilitation of old bridges. Construction of new minor bridges and culverts. Widening of existing structurally safe and functional culverts.

Besides the cross drainage structures there will be earth retaining structures, drains and ap-purtenances.

B. Traffic management during the construction activities shall be undertaken. The works shall include but not limited to the following items Traffic diversion and management during the construction. Routine maintenance of project corridor during the construction period. Construction and maintenance of the diversion road. Environment management during the construction activities shall be under taken. The works

shall include Construction of transverse structure in the road to be used for animals. Construction of structures for mitigation of environmental issues. Management of environmental protection measures. Ensuring due observation for social and environmental safe guards/policies/clauses/ guidelines

provided in the civil works contract.

The Civil Works Contract is awarded to M/S. Valecha Engineering Ltd. The salient features of the pro-ject are given here as under:-

Road Work:

(i) Clearing & Grubbing-

There was no Clearing & Grubbing work during this quarterandas on datetotal progress has reached to12.56Kms (Half CW width).The details are listed in Table 5-2.

(ii) Earth Work-

The embankment work has been taken up in additional length of2.75Kms(LHS/RHS) during this quar-ter. With this, as on date total length ofembankment in progress has reached to 11.15 Kms (Half car-riageway width).The details are available in Table 5-3

The various layers executed in this quarter and the as-on-date status of the work is annexed in Chap-ter 5.

Structural Work:

The total 16nos. of Hume pipe culverts are in progress as on date.

The status at the end of this quarter is annexed in Chapter 5.

Road Maintenance Work:

After the handing over of the site and declaration of the Commencement date for execution of Civil Works as 24thDec. 2013.Contractor had to take up the maintenance work as per Sub-Clause 4.1 of specific provisions Part-B of Conditions of Contract Vol.-II.

Pot hole repair from Km 11+000 to Km 16+000, Km 28+400 to 32+500 and Km 33+100 to 33+700 in Mile stone-I has been done. Pot hole filling in Milestone-II has not been taken up. Letter is issued to the Contractor to take up the maintenance immediately or else, the work shall be carried out by other agency vide letter no LASA/RE-1/73466/2015/210 dated 17th March 2015.

Reasons for slow progress during this quarter:

The Contractor has abandoned the site since February 2015. However,the overall reasons for delay are listed below:

Non mobilization of required Plant &Machinery.

Delay in erection and commissioning of Plants.

Delay in obtaining statutory approvals for establishing plants and borrow areas.

Non setting up of Camp & fully functional & equipped field laboratory.

Inadequate technical staff and other manpower in accordance with therequirement at site and as per Contract.

Delay in construction of base camp.

Delays in operational sing of Quarries, Borrow Areas(soil& sand) and identifying and getting approval of sources of other materials.

Slow rate of testing of material due to non-availability of technical personnel and laboratory equipments as per the requirement of the work.

Non-committal attitude in survey work, non-establishment of reference pillars and TBM pil-lars,etc.

Poor site management. Insufficient shuttering material. Non-procurement of construction mate-rials in time.

2.2 OBSTRUCTIONS:

The Employer had handed over encumbrance free length of 11.850 Km stretch for construction as mentioned in the milestone I to the Contractor on 27.11.2013 as per the mile stones details (1stmile stone) given under Clause 4.6 of Conditions of Contract Vol.-ll, which was duly accepted by the Con-tractor.

As per the Contract schedule the land for MS-II had to be handed over to the Contractor by April’14, but it could be handed over only in August 2014 which was duly signed by the Contractor.

Chapter 4. Contractor’s Mobilization 4.1 SITE ESTABLISHMENT

M/s. Valecha Engineering has established their Base Camp & Plants at Km. 22+500 (Ken-dupatna village)and submitted revised layout of it on 22.08.2014. The layout is approved vide letter no. LASA/73466/RE-1/08/07/118.

WMM and Concrete Batching plants have been mobilised. Batching plant is in operation while WMM plant is partly erected. The approval for ‘Consent to Establish’ has been obtained. The contractor is yet to apply for ‘Consent to Operate’.

Only, the non-bituminous testing equipments has been brought at site but the equipments for bituminous testing work is yet to be brought.

Required nos. of Chairs and Table are not available for the technicians and Engineers. Fans and AC have not been installed in the laboratory.

The construction of the Camp has not been started yet.

Communication system e.g. Telephone, Fax and Internet facilities are to be provided in Con-tractor’s proposed Camp Office.

Stores, workshops, dwelling units for labourers shall have to be established in the base Camp with necessary facilities.

The Contractor has abandoned the site since February 2015 and the Base camp is guarded by Security personnel.

4.2 MANPOWER STATUS

The Contractor has not mobilized its manpower till date in accordance with the mobilization schedule of Contract Agreement Vol. I (P-46). While the commencement date of the civil works of the project has been given as 24th Dec. 2013 vide Consultant’s letter no. LASA/RE-1/73466/2013/11 dated 24th Dec. 2013.

The Contractor of P04A has yet to mobilize their Plant and Machinery as scheduled in Contract Agreement Volume-1 (P- 46, 51 and 75) and need to submit the detailed mobilization program as per their own inference to fulfil their contractual obligations.

3. Maintenance of Existing Road:

Pot hole repair from Km 11+000 to Km 16+000, Km 28+400 to 32+500 and Km 33+100 to 33+700 in Mile stone-I has been done. Pot hole filling in Milestone-II has not been taken up. Km 33+100 to 33+700 has been done during this quarter.

Notice was issue to Contractor for maintenance of handed over stretch, else, it will be carried out by other agency vide CSC’s letter no LASA/RE-1/73466/2015/210 dated 17th March 2015.

4.6 STRUCTURE

Chapter 5. S-Curve & Bar Chart 5.1 WORK PROGRAMME

Contractor had submitted their work programme to the Engineer on 25.02.2014 under Clause 8.3 of Conditions of Contract, but the work programme had not been developed in the MS Project/ Prima-vera, with this it was also not the resource based programme.

After CSC’s reminders, the revised programme was submitted on 08.04.2014, which also lacked de-tails and was not in conformance with the Clause 8.3 of General Conditions of Contract (Vol.-II). The work programme was vague and sketchy, it was neither resource neither based nor supported with the monthly execution of the quantities, monthly deployment of the equipment, monthly cash flow, monthly requirement of material and S-curve. The Supervision Consultant had issued letters in this regard to the Contractor.

After much persuasion the Contractor has submitted the ‘abstract of work plan’ on 19-08-2014 through e-mail. Revised work programme is submitted on 22-8-2014 vide their letter no. VEL/OSRP/Site/NSN/2014-15/043, as assured in the review meeting held on 14.08.2014 at OWD, Bhubaneswar. The programme still lacks many details e.g. S- curve etc and it has also not been pre-pared in MS Project.

A letter asking to submit the revised work programme was issued to contractor vide letter no. LASA/73466/RE-1/03/03/150 dated 01.11.2014.

The Contractor submitted a revised programme on 04.12.2014 vide letter no. VEL/LASA/P04A/Site/2014-15/80. This programme also lacks many details. Mobilisation plan of re-sources vis-à-vis requirement, the back-up of quantities and S- curve etc are not available and it has also not been prepared in MS Project. The completion is extended up to November 2016 against the scheduled date of completion of March 2016.

5.2 S-CURVE

Revised work programme submitted by Contractor on 22-8-2014 does not contain S-curve. As per this programme, the work starts only in October 2014.

As such, the S-curve is developed by CSC based on programme included in Contract Agreement. The projections as per the programme submitted on 22-08-2014 are superimposed.

The S-Curve has been appended as Appendix-A-8.

Chapter 6. Environmental Monitoring Status

Compliance status of environment and safety aspects is given in this report. Although, contractor has stopped the work from 12th January 2015 and completely abandoned the site since 31st January 2015. Chapter 7. Financial Progress, Advances & Securities

7.1 FINANCIAL PROGRESS:

The Contractor has raised the bill for Mobilisation Advance (IPC 1 & 2). IPC 3 has been passed for the work done up to 31.08.2014 for a gross amount Rs 53,30,220/-.IPC 4 has been passed for a gross amount Rs. 32,82,656/-for the period from Sep ’14 to Nov ’14.Interim Payment Certificate de-tails are enclosed as Appendix C-1.

7.2 ADVANCES:

The Contractor has been paid the mobilization advance of INR 7,56,52,928/- being 5% of Contract amount, in two parts as detailed below:

7.3 FINANCIAL SECURITIES:

The Contractor has submitted Bank Guarantees against Performance Security for Rs. 7,56,53,000/- being 5% of accepted contract amount valid up to 6th September 2014 and additional security of Rs.11,00,00,000/- for unbalanced bids valid up to 18th September 2014. The validity of the Perform-ance Security shall be in force until the Contractor has executed and completed the works and reme-died any defects. The Contractor has extended the validity of BGs up to 31.03.2017.

The Contractor has submitted Bank Guarantees for the Mobilisation advance payment.

The details of bank, validity of guarantee, etc. have been enclosed as Appendix C-2.

7.4 INSURANCES:

The Contractor has submitted a copy of cover note of Contractor’s All Risk policy. The period insured is 31.03.2014 to 30.03.2016 whereas contractual requirement is to start from 24.12.2013. “All risks” is not specifically mentioned, not in joint names and reinstatement guarantee are not given.

The Contractor has submitted the Workmen’s Compensation Policy on 10.06.2014, which is also not conforming to contractual requirements.

Chapter 8. Variation

Variations have been found in some items during design review and the details have been submitted in the Final Design Review report after review of the Employer. Variation order will be generated pro-gressively with the increase in the quantities.

Chapter 10. Issues, Reasoning & Corrective Action

10.1 KEY ISSUES & CORRECTIVE ACTIONS PERTAINING TO THE CONTRACTOR:

The contractor has stopped all the activities at site since 12th January 2015 and completely aban-doned the site from 1st February 2015.

Key issues pertaining to Contractor’s general obligations under Sub-clause 4.1 of general conditions of contracts are described below:

The Contractor has yet to establish the camp as per EMP as specified in the Contract. Re-vised layout plan of base camp has been approved by CSC on 22.08.2014. Approvalfor ‘Con-sent to Establish’ of the plants obtained from OSPCB. The Contractor is yet to apply for ‘Con-sent To Operate’

The Contractor has to furnish all survey and setting stake out data as has been done at site and as specified in the Contract.

The Contractor has to identify sources of the materials proposed to be used in the execution of the Civil Work and has to take approval for source from Consultant. The sources of sand, cement, aggregate, steel, Hume Pipes and admixtures approved. The source of morrumiden-tifiedatKamamga village and satisfies the specifications, but, statutory approval is pending.

The Contractor has to ensure safety of all site operations, methods of constructions, Tempo-rary works, and design of each item of plant and materials as is required for the item to be in accordance with the Contract.

The Contractor has to take up the maintenance work of the handed over stretches under sub cl. 4.1 of specific provisions Part-B of Conditions of Contract Vol.-II. Pot hole repair from Km 11+000 to Km 16+000, Km 28+400 to 32+500and 33+100 to 33+700 in Mile stone-I has been done. Pot hole filling in Milestone-II has not been taken up.

Notice was issue to Contractor for maintenance of handed over stretch, else, it will be carried out by other agency vide CSC’s letter no LASA/RE-1/73466/2015/210 dated 17th March 2015.

In Survey and setting out work the Survey pillars are still to be erected in the entire project corridor. Correctness of the survey data as per field condition has to be verified. New pillars have to be erected in case of additional requirement as well as in place of the disturbed pillars as the DPR was done 6 years ago in the year 2007. Disturbed TBM pillar construction and verifying Bench Marks Completed in 1st Milestone.

Safety during construction is of prime concern for Contractor. Proper road diversions, road signage, road markings etc. for guiding road users has to be ensured to reduce injury and elimination of loss of human lives. Moreover safety of construction workers also of the prime importance. Use of gum boots, gloves, safety helmets etc. will have to be ensured while con-struction. Black spots along the corridor to be identified. Engineers will review the safety pro-visions provided in the report and recommend improvement, if any.

Environmental aspects as stipulated in the Contract has to be taken care of by the Contractor while execution of the Project. Contractor has to ensure and maintain each and every aspect of mitigation measures and give especial attention on environmental clearances.

10.2 KEY ISSUES & CORRECTIVE ACTIONS PERTAINING TO THE CONSULTANT:

After carrying out the site visit and based on the initial study of the documents, the key issues and concerns noticed are as follows:

Geometric Improvement: Geometric design will be verified in comparison with the provisions of applicable Geometric design manual and accordingly improvements if required will be rec-ommended to OWD for approval. Geometric design improvement at the locations wherein ROW is restricted will also be modified/improved and the same will also be finalized after dis-cussion with OWD.

Fixing of Horizontal Alignment: During the kick off meeting with the Client, It was opined that no additional land would be acquired furthermore. Therefore, the proposed centre line of the project may have to be accommodated within the proposed/available RoWs keeping in view all the constraints of geometric design parameters.

Concentric/Eccentric Widening: In the entire length of Project Corridor, approximately 30% of the alignment falls in the eccentric widening category while 70% of the alignment falls in the concentric widening of the road. Therefore, the traffic diversion and its management as well as the safety aspects in such areas shall have to be taken care of during the construction pe-riod of the Project.

Bus bays / Bus shelters: 58 nos. (30 no’s on LHS and 28 no’s on RHS) of Bus Bays-cum-shelters for package P04A are proposed in the DPR design drawings at the small settlements. The same needs to be verified on the basis of importance of the junction/settlement and some locations may be shifted or additional requirements will be notified.

Survey/BMP Pillars: As the DPR was done 7 years back in the year 2006, all of the Survey pillars were missing and disturbed along the entire corridor. Correctness of the survey data as per field condition has been verified. New pillars are being erected in case of additional re-quirement as well as in place of the disturbed pillars. Disturbed TBM pillar construction and verifying Bench Marks Completed in 1st Milestone.

CD Structures: In site visit for design review work, providing adequate number of CD struc-tures as compared to the site condition and contract provisions has been verified and neces-sary changes has been suggested in design review report. Areas such as water stagnation, ponding and swampy areas has been identified and necessary methodology for construction (if required) has been recommended in design review report.

Canals and Irrigation structures: At many of the locations like at Km 8+500(LHS), irrigation canals are running just parallel to existing carriageway. The proposed roadway/carriageway and its embankment toes may fall in to the waterway of the canal and obstruct the flow. Op-tional studies like shifting of alignment or provision of toe/retaining wall may have to be con-sidered, which is being dealt in the design review work. Similarly an important Irrigation structure exists at Km 31+100(RHS) just adjacent to existing carriageway and at the same location the proposed DPR FRL is around 1.5 meter raised with respect to the existing road FRL which may badly affect the irrigation structure. OWD has told during the site visit that the height of the Irrigation structure would be raised, the matter has been pursued by OWD with the Irrigation Department. And the Irrigation Department has agreed to raise the level of Structure.

Issues of CBR: As per part II of contract specification, clause no. 305.2.1.5, soil/sand re-quired for embankment construction shall be of CBR not less than 10%. Contractor has been

able so far to locate Komonga village borrow area for soil for which statutory approval proce-dure is being processed.

Safety: Engineer has to ensure safety during construction. Use of gum boots, gloves, safety helmets etc. will have to be en-sured while construction. Black spots along the corridor to be identified. Engineer will review the safety provisions provided in the report and recommend improvement, if any.

Environmental Issues: Engineer would check each and every aspect of mitigation meas-ures and give especial attention on environmental clearances. The Engineer has a major challenge to review the available report and check the compliance of the requirement for the project.
