How does it work? These itineraries are exactly thesame as the regular year round itineraries on each tour,right up until the day they depart Las Vegas. Then theyskip the visit to Yosemite, take 1 night less in SanFrancisco and instead, pack 3 fun-filled days of snowaction at Lake Tahoe instead.

Contiki has been running tours foryoung people since 1962 and is amember of the Australian Federation ofTravel Agents (AFTA). The membersinclude all the major tour operators whoare financially bonded for your securityand who maintain the higheststandards. With the guarantees of theseorganisations, you know your holiday &money are secure with Contiki.

You must take out comprehensiveinsurance cover for cancellation, medicalexpenses, personal accident, personalbaggage, money and public liabilitybefore you travel. You may not beaccepted on a Contiki holiday unless youhave arranged satisfactory insurance.You also agree to indemnify us againstall third-party claims, actions, damagesand remedies against us arising fromyour participation in the holiday.

Coverage for Cancellation & ReturnFlight Security: Most tour operatorsare interested in their passengers onlyafter they reach their destination. WithContiki, however, you get a great dealeven before you leave home.Pre-paid Cancellation Option A$89per person: By paying an A$89 perperson Cancellation Option Fee withyour deposit, the full amount of yourdeposit and/or payment to ContikiHolidays will be refunded should youcancel your tour for any reason prior todeparture from Australia. Thiscancellation option covers the landarrangements made by ContikiHolidays only.

On Your Tour: Should you, or yourtravel companion, leave at any timeduring the tour for personal sicknessreasons or be required to return toAustralia due to injury, sickness ordeath, you and your companion will berefunded A$40 per person per day forthe unused portion of the tour. (Pleasenote that in some cases hotels requirea one night cancellation fee). ADoctor’s certificate is required.

The Cancellation Option Fee is notrefundable for any reason. See below for Return Flight Security.Return Flight Security: If you or amember of your direct family inAustralia should fall sick* while you areon your Contiki tour, we will take careof the additional cost of tickets for yourearlier or later return home in the sameclass of air travel on the first availableflight, provided you hold round-tripairline tickets on Contiki’srecommended airline(s) bookedthrough Contiki Holidays (Australia) PtyLtd from Australia. *Medical certificates as proof of allillness claims must be supplied.

Booking ConditionsOnce Contiki accepts your booking by confirmation thereof a contract is made between Contiki and you upon the terms and conditions set out below.

OUR RESPONSIBILITIES1. YOUR HOLIDAY RESERVATIONOn receipt of your deposit, subject to availability and atour discretion, Contiki will reserve your place on yourselected holiday. A contract is only made between youand us upon your booking being confirmed andaccepted by us and our confirmation thereof to eitheryou or your travel agent. 2. PRICE GUARANTEEPrices in this brochure are based on costs andexchange rates as at 25th March, 2009. Should thesecosts change, it may be necessary to make a surchargeon the price of your holiday. Should the total tour priceincrease by more than 10% you will have the right tocancel within 7 days of notification without penalty. Nosurcharge in respect of cost or currency fluctuationswill be made once payment of the deposit for your landtour has been received. This guarantee excludes fuelsurcharges and does not apply to any taxes, charges orlevies imposed by any government or their agencies. Inexchange for these guarantees, no refund will be madeif costs are reduced.3. IF WE CANCEL OR CHANGE YOUR HOLIDAY3.1 Contiki reserves the right to change or cancel yourbooking in accordance with operating requirements orcircumstances beyond its control.3.2 Should change or cancellation prove necessary wewill give you reasonable notice thereof, in thecircumstances, and where available, offer you acomparable alternative.3.3 If an alternative is not available or acceptable youwill be entitled to either a full refund of monies paid byyou to us or transfer to another Contiki holiday withoutpayment of any transfer fee.3.4 If the change or cancellation is due to force majeure(i.e. circumstances like political unrest, war or threat ofwar, riots, civil strife, closure of airports or ports,industrial disputes, terrorist activity, natural and nucleardisasters, fire, epidemic or health risk, Acts of God,adverse weather conditions or other similar eventsbeyond Contiki’s control) we will give a full refund ofany monies paid to us less reasonable expensesincurred by us in respect of your booking.3.5 Contiki is not responsible for the costs of any othertravel arrangements affected due to our cancellations orrescheduling of any tour departure.4. HOLIDAY DETAILS & CONDITIONS4.1 The information in our brochure is correct to thebest of our knowledge at the time of going to print (April 2009) but we cannot guarantee that any item oramenity mentioned will be available especially where wehave no direct control over it.4.2 Contiki will do their best, at their discretion, toselect accommodation, sightseeing tours andtransportation to give you good value for money.4.3 Contiki constantly strives to improve tour itinerariesand features. If such improvements can be made, orunforeseen circumstances beyond our control makechanges necessary, we reserve the right to varyitineraries and to substitute hotels. Contiki is notresponsible for any other travel arrangements affecteddue to our cancellations.5. LIABILITY5.1 Your travel agent shall, on the receipt of anymonies, hold such monies for you until the booking isconfirmed at which time those monies shall be remittedpromptly by your travel agent to us. All such moniesreceived by us will be deposited as required by law. 5.2 We will be entitled to keep for our account anyinterest earned on such monies.5.3 All monies paid by you to us through your travelagent or otherwise, whether in respect of the deposit orfull payment, may be disbursed by us as and when wesee fit, in respect of the services to be provided and/orfees payable under the tour program. The payment of a deposit or any other monies in respect of your tourshall be deemed to be an authorisation fordisbursement thereof as aforesaid.YOUR RESPONSIBILITIES1. BOOKING YOUR HOLIDAY1.1 In order to reserve your holiday, a deposit ofA$200, per person per tour or resort stay, or the fullamount payable if booking is made within 45 days ofdeparture, must be submitted to Contiki by you inrespect of that holiday. This payment is in addition toany deposit required by your travel agent. The depositis accepted as a first installment of the holiday price byContiki only once the booking has been confirmed inwriting by Contiki or your travel agent.1.2 Your land reservation will be confirmed on receipt ofa non refundable deposit of A$200 per person per touror resort stay which must be within 7 days of bookingor the reservation will automatically be cancelled.1.3 Any special meal requirements will be made on a

request basis only. Contiki cannot guarantee special mealrequests nor will it assume any responsibility or liability ifclients’ special meal requirements are not fulfilled.2. PAYING THE BALANCE2.1 The balance of the holiday must be paid no laterthan 45 days before the scheduled departure date whichshall be by the due date stated on the confirmationissued to you by Contiki.2.2 If payment isn’t made by the due date, Contiki mayassume that you have cancelled and cancellationcharges in accordance with clause 3 below will belevied by Contiki.2.3 Tickets and other documents won't be forwardeduntil full payment has been received by us. Thedocumentation will be sent approximately 21 days priorto your departure from Australia.2.4 In the case of Late Bookings made within 45 daysof your tour departure, the full cost of the holiday willbe payable immediately on booking and we reserve theright to provide all travel documents at the holidaydeparture point. 2.5 Contiki reserves the right to cancel the booking andapply cancellation charges should payments not bereceived within the above specified periods.3. IF YOU CANCEL3.1 Notice of cancellation must be made in writing to Contiki.3.2 If you cancel more than 45 days before departure,your A$200 deposit will not be refunded, nor can it becredited to any other booking.3.3 Upon cancellation you will be liable to pay a fee tocover the estimate of cost and expenses incurred by usin the terms of the schedule set out hereunder. This isexpressed as a percentage of the holiday price and iscalculated as follows:PERIOD OF NOTICE CANCELLATION FEEOver 45 days notice: Deposit is forfeited45-22 days: 27.5% of tour fare21-8 days: 33% of tour fare7-1 days: 55% of tour fareDay of departure: 100% of tour fareWhere the percentage cancellation fee is less than thetour deposit, the cancellation fee will equal loss ofdeposit. If the reason for cancellation falls within theterms of any holiday insurance policy which you hold,then any such charges may, subject to the terms ofyour insurance policy, be refunded to you by theinsurance company.3.4 Any cancellation of additional services booked priorto and after your tour or resort booking, such as preand post accommodation and transfers, that arecancelled within 14 days of the tour departure incur a100% cancellation fee.3.5 These cancellation fees are in addition to anycancellation fees that may be levied by your Travel Agent.4. IF YOU CHANGE YOUR BOOKING4.1 If after your booking has been confirmed and morethan 45 days prior to departure, you wish to change toan alternate departure date or you wish to change to adifferent Contiki holiday, you may do so subject toavailability and provided the new holiday date is also inthis brochure.4.2 A fee of A$35 per person will be charged for anyrevision or alteration made to a reservation after thebooking is confirmed unless the change increases thevalue of the booking. A change of tour date, touritinerary or resort booking within 45 days of departurewill be treated as a cancellation, and normalcancellation fees will apply except when the change isto an earlier departure date of equivalent or greatervalue in which case a A$35 per person amendment feewill be charged.5. HOLIDAY DETAILS AND CONDITIONS5.1 Please read the brochure carefully for those itemsincluded in the price. No allowance or refund can bemade for meals, accommodation, excursions, etc. thatyou elect not to take, or when museums, shops, etc.are closed. Hotel facilities may vary from place toplace. Meals may vary in style.5.2 Recent legislation in various states in Australia hashighlighted the issue of Age Discrimination. In terms ofstyle and content, all of Contiki’s worldwide holidays arespecifically designed for a particular age group. Thisfact should be recognised when you book one of ourholidays.5.3 Contiki must be advised of any medical conditionsor physical disability requiring special attention beforeyou book your holiday. If you do not advise us at thisstage, we may refuse to accept your booking. We mayalso refuse you if we feel that the holiday chosen is notsuitable without a suitably qualified companion. Contikiwill try to help you with your requirements but cannotguarantee to do so, either on our own or our suppliers’(such as hotels, restaurants and excursions) behalf.

Many of our holidays involve getting on and offcoaches, walking tours and other physical activities.Some holidays may not be suitable for you if you relyon a wheelchair or have certain other disabilities.Should your disability require you to have specialassistance, it is a condition of Contiki accepting yourbooking that you provide evidence satisfactory to usthat an able-bodied person will accompany you and isable to provide any special needs or services that youmay require. Contiki will not be responsible for thefailure of this person to provide these services.5.4 You are responsible for all travel arrangements andcosts to/from the point of commencement/conclusionof the holiday.5.5 There may be times when the Contiki Representativehas to make a decision in your best interests or the bestinterests of their group. You agree to comply with theauthority and decisions of the appointed ContikiRepresentative and the laws of the country in which youare travelling. If you do not so comply or if, in the ContikiRepresentative’s opinion, you are not compatible with thegeneral enjoyment and well being of other members on theholiday or smooth operation of the holiday itself, wereserve the right to refuse to let you continue with theholiday. Furthermore, you agree that your fellowtravellers and any Contiki Representative has the rightto travel/work in a safe environment. Any threats totheir safety, well being or inappropriate behaviour byyou, whether verbal or physical, will be taken extremelyseriously and may result in the immediate terminationof your holiday. In either event, you will be responsible foryour own repatriation and related costs and have noclaims against us.5.5.1 You are responsible for any costs incurred as aresult of damage or excess cleaning fees related to youraccommodation. You are advised to immediately reportany pre-existing damage in your room to hotel/ContikiVillage staff and/or a Contiki Tour Manager as soon as itis discovered.5.6 Where the passenger occupies a motorcoach seatfitted with a safety belt, neither the operator or serviceproviders, agents or co-operating organisations shall beliable for any illness, injury or death or any loss ordamages or claims whatsoever arising from anyaccident or incident, if the safety belt is not being wornat the time of the accident or incident.5.7 It is your responsibility to have a valid passport andall visas, permits and certificates required for yourselected holiday as well as any necessary vaccinationsand to comply with all applicable laws.5.8 You agree that our Contiki Tour Managers orRepresentatives may take photographs and films of youwhile you are on holiday and that these may be used inour Group brochures and/or advertising or publicitymaterial without obtaining any further consent orpayment in respect of such photographs and/or films.5.9 Should you have a complaint in respect of theholiday, you should inform the Contiki Tour Manager orRepresentative during the course of the holiday and ifthe matter cannot be resolved after the representative’sbest endeavours to do so during the holiday, yourcomplaint should be made in writing to Contiki as soonas is reasonably possible after the holiday but within 42days thereof so that your complaint can be investigated.Any claims made after the 42 day period will not beconsidered by Contiki. If you choose to write to Contikivia the Internet, please provide your home address sothat we are able to reply to you in writing.5.10.1 The contract and all matters arising in respecthereof shall be subject to Australian Law, unless weagree otherwise in writing.5.10.2 If any provision of this contract is held invalid orunenforceable by any court of competent jurisdiction,that provision shall be deemed to be re-written to giveeffect to the same purpose within the permitted limitsof the law. The validity and enforceability of the otherprovisions shall not be affected.5.10.3 If you are unsuccessful in any legal actioninstituted against us, you agree to pay all our costs,including but not limited to, attorney/client costs.6. INSURANCEContiki very strongly recommend that you take outcomprehensive insurance cover for cancellation,medical expenses, personal accident, personal baggage,money and public liability before embarking on aContiki holiday. Please check that the insurance coversall of the activities that you are going to be participatingin. Some policies exclude certain adventure activities.This should be arranged at the time of payment of thedeposit and will, in certain circumstances, cover youagainst loss of deposit or cancellation fees from thedate of confirmation of your booking, as shown in theinsurance policy. You also agree to indemnify usagainst all third-party claims, actions, damages andremedies which may be brought against us in

respect of your participation in the holiday.7. ILLNESS OR ABSENTEEISMIn the event of your withdrawal from a holiday after the commencement as a result of illness, you must obtain a medical certificate in support of any insurance claim. No refunds will be made for any absence from the tour.8. WHAT’S NOT INCLUDED IN THE HOLIDAY PRICEAirfares to and from your holiday destination, airporttaxes, passport and visa fees, insurance, laundry, phonecalls, beverages, meals not detailed in the itinerary, tipsto tour managers, representatives, drivers and localguides, items of a personal nature, excess baggage,optional excursions.9. WEATHER CONDITIONSUnder no circumstances can we be held responsible forsnow or weather conditions, nor can any holiday becancelled or amended by you at any time on the basisof snow or weather conditions.

GENERAL1. CONTRACTING PARTIES1.1 The Booking Conditions detailed herein contain theentire contract between you and Contiki. Norepresentation, term, warranty or condition can beexpressed or implied by reference to any other writing,advertisement or conversation. This contract may onlybe varied in writing by a duly authorised officer ordirector of Contiki.

1.2 Your contract is with us as the tour operatingcompany. At any time and at our complete discretionwe may nominate to you in writing any other companyor person to have the benefit of some or all of thoseprovisions of this contract, which we may then specify,as if you had agreed the provisions concerned directlywith that company or person in the first place as well asagreeing them with us. We may at our completediscretion assign all or any rights and liabilities arisingunder or by virtue of this or any other contractwith you.

1.3 Transportation companies, airlines etc. are not to beheld responsible for any act, omission or event duringthe time passengers are not on board planes,transportation or conveyances. We rely on internationalconvention which may apply to the services provided byus, our suppliers or agents with respect to any claim ofany nature brought by you against us as a result of theprovision of those services. International conventionswhich apply may include: Warsaw Convention 1929, (asamended by Hague Protocol and Montreal Protocol) inrelation to air travel, or Montreal Convention; the BerneConvention for rail travel; Athens Convention 1974 forcarriage by sea; the Geneva Convention for carriage byroad and the Paris Convention 1962 for Hotels. We are tobe regarded as having all benefit of these conventions onlimiting our liability in relation to any claim for death,injury, loss, damage and delay to passengers andluggage. Enrollment in and payment for a tour shallconstitute agreement and acceptance by the passengerof the terms and conditions set forth in this brochurewhich cannot be varied except in writing by an officer ofthe Company.1.4 Contiki is not a carrier or hotelier nor does it ownaircraft, hotels or coaches. All bookings with carriers,hoteliers and other service providers are subject to theterms and conditions and limitations of liability imposedby those carriers, hoteliers, and other service providers.Please note that some of these limit or exclude liability inrespect of death, personal injury, delay and loss ordamage to baggage. Whilst we cannot accept anyresponsibility for any loss as a result of such actions oras a result of any act or omission of any such third-parties, we will give every reasonable assistance inhelping to resolve any reasonable dispute. Please alsonote that Contiki cannot be held responsible for thefailure of any of these parties to provide facilities orservices for disabled clients (see also 5.3 under HolidayDetails & Conditions).1.5 Please note that no airline or carrier depicted orrecommended in this brochure by virtue of theirendorsement of this brochure represent themselveseither as contracting with any purchaser of a holidayfrom Contiki or as having any other legal relationshipwith any such purchaser.1.6 Every effort is made to ensure brochure accuracy atthe time of going to print, however Contiki cannot beheld responsible for printing or typographical errors, orerrors arising from unforeseen circumstances.

How to Book1. Your travel agent will confirm by phone with the local Contiki office that there's space on the tour you've chosen.

At the same time, your travel agent can book your hotel accommodation before and/or after your Contiki tour(see page 49).

2. At the time of booking, you must pay to your travel agent a non-refundable deposit of A$200 per person per tour which must be sent to Contiki within 7 days. This payment is in addition to any deposit required by yourtravel agent.

3. Once your deposit has been received, Contiki will send your travel agent confirmation of the details of thebooking.

4. You must pay the balance of your holiday fare to Contiki through your travel agent no less than 45 days beforethe departure date, or at the time of booking if less than 45 days before departure.

5. We will then send to your travel agent your travel vouchers and detailed information about your holiday. Thedocumentation will be sent approximately 21 days prior to your departure from Australia.

IMPORTANT: By paying the A$200 deposit per person per tour to your travel agent, you acknowledge that you have readand understood the Booking Conditions as set out on page 51, which make up the contract between you and Contiki.
