This CONTRACT is made and entered into, by and between:

WITNESSETH:

W1SREAS, the FIRST PARTY, after the conduct of a public bidding by its Bids and

Awards Committee, awarded the Contract to the SECOND PARTY after finding out that its

proposal is the lowest calculated and most responsive bid.

NOW TI{EREFORE, for and in consideration of the foregoing premises and mutual

covenants and stipulations hereinafter set forth, the parties have agreed, as they rnutually agree to

the followrng:

t. That the SECOND PARTY shall provide ONE (1) JANfTORIAL STAFF to work for the

FIRST PARTY eight (8) hours a day, from 8:00 A.M. to 5:00 P.M. Monday to Friday

- with t hour break. And 8:00 AM to 12:00 P.M. every Saturday.

2. That the personnel to be assigned to the FIRST PARTY should possess the appropriate

experience, technical skills and competencies required for the job; he should also be

mentally, emotionally and physically fit, of good moral character and reputation, honest,

hardworking, cooperative and with positive disposition. The FIRST PARTY may ask for

replacement of the assigned janitor should he fail to meet the requirements for the job.

3. That the SECOND PARTY shall provide the FIRST PARTY copy of the most recent

NBI, Police and Court Clearances and Medical Certificate of the janitor to be assigned to

the FIRST PARTY.

4. That the janitor to be assigned by the SECOND PARTY to the FIRST PARTY is an

exclusive employee of the SECOND PARTY and that there is no employee-employer

relationship between the janitor and the FIRST PARTY. In view of such employment

relations, itre SECOND PARTY hereby agrees to comply with the labor Code of the

Philippines and such

related laws bearing on emplopnent, including minimum wage, workmen's

compensation, employer's liability, SSS, Philhealth coverage, PAG-IBIG Fund, income

tax payment, permit fees and other requirements necessary for the execution of work.

5. That the SECOND PARTY shall regularly supervise, monitor and discipline its janitor,

taking into consideration the rules, policies and regulations of the FIRST PARTY. The

FIRST PARTY shall also exercise direct supervision and c,orrtrol of the janitor assigned

to the FIRST PARTY insofar as work implementation and adherence to the office rules,

policies and regulations are concemed.

That the SECOND PARTY shall not hold the FIRST PARTY responsible for any

liability, suit, action, demand or cost of fees on account of death, and/or injuries arising

from the performance of the duties and responsibilities of the janitor assigned to the

latter.

That the SECOND PARTY shall assume responsibility for any and all acts or omissions

committed or allowed to be committed by the assigned janitor, resulting in the loss or

damage to any of the property of the FIRST PARTY and its employees.

That the FIRST PARTY shall determine the number of janitors to be assigned to its

offica, and upon written notice, may increase or decrease its personnel, or may request

for relief or replacement, anytime and for whatever reason.

That the SECOND PARTY, upon request of the FIRST PARTY, shall provide additional

janitors to the latter to be assigned to its Regional Office/s outside of Davao City.9.

That the scope of work contemplated in this Contract shall include daily maintenance and

cleaning of the entire area occupied by the FIRST PARTY, viz:

DAILY ROUTINE OPERATIONS

Sweeping, mopping, spot scrubbing and polishing of floors, stairways and alleys

Cleaning, disinfecting, sanitizing and deodorizing of all the washrooms including

toilet bowls, urinals and lavatories

Dusting and cleaning of all glass tops, inside windows, window ledges, pieces offurniture, fixture, equipment and partitions

5. Dusting and cleaning of horizontal and vertical surfaces, ceiling and walls

6. Disposal of trash from the confines of the building to receptacles provided for this

purpose, and other related duties

13. That in accordance with the schedule of the operations, the general cleaning of the FIRST

PARTY's premises shall be performed once a month, on a Saturday. It shall cover the

following:

a. Removing of stubborn dirt and stainb. Polishing of floorc. Wiping of walls, partitions and glass windows

d. Wax stripping and waxing of floorse. Shampooing of carpets

f. Cleaning and disinfecting comfort roomsg. Planting and replanting of ornamental plants

h. Vacuum cleaningi. Floor polishing

The general cleaning shall be supervised directly by the Supervisor of the SECOND

PARTY.

For and in consideration of the above stated conditions and services, the FIRST PARTY

shall pay the SECOND PARTY at the rate of NINE THOUSAND ONE HUNDRED

THIRTY EIGHT & 8lll00 ONLY (Php 9,138.87) per month or NINETY ONE

THOUSAND THREE HUNDRED EIGHTY EIGHT & 871100 ONLY ( Php 91,388'87-)

minimum or additional benefits to the basic wage during the term of this contract.

SECOND PARTY agroes to post a Performance Bond issued by the Government Service

by the Insrtrance Commission to answer for any damage that may be incurred by the

SbCONO pARTY and/or by reason of its failure to comply with its obligation/s.

WHEREAS, this Contract takes effect on 1 March 2012 to 31 December 2012

and shall continue in force and effect until terminated by either party by giving notice to

the other party at least thirty (30) days before the effective date of termination.
