a. In the Matter of the Contractors License of Eric W. Beresford-Wood, doing business as Lanikai Construction and Roofing; CLB 2010-346-L

RICO received a complaint alleging that Eric W. Beresford-Wood (“Respondent”) failed to pay his subcontractors and materialmen despite receiving payment to do so on a project requiring the replacement of a roof and construction of a second floor addition.

RICO also alleges that his contract was missing disclosures and

information required to be in the contract. The Board discussed the settlement agreement in which

Respondent, who does not admit to violating any law or rule, agrees to pay an administrative fine of $2,500.00.

After discussion, it was moved by Mr. Yamada, seconded by Mr. Dill, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.

Contractors License Board Minutes of the April 19, 2013 Meeting Mervyn W. Lee The Board previously discussed Mr. Lee’s inquiry at its March 22, 2013

meeting regarding whether the RME and “employees” of a contracting entity may have their wages paid by another (non-contracting) company owned by the RME. According to Mr. Lee’s March 15, 2013 letter, the RME/owner of an air conditioning company owns a separate distribution company and, for tax reasons, pays the air conditioning company employees through the payroll of the distribution company. The Board had discussed his inquiry and requested further clarification.

Mr. Lee provided the following information:

1. The RME receives a W-2 and wages from both companies; 2. More than 75% of the RME’s wages come from the air

conditioning company; 3. The distribution company issues the W-2 forms to the

workers; 4. Contracts for installation of the air conditioning systems are

signed by the air conditioning company, not the distribution company;

5. The distribution company does not hold itself out as an air conditioning company; and

6. The distribution company does not direct or supervise the workers, but acts solely as a payroll administrator.

After discussion, the Board concluded that the distribution company does

not appear to be holding itself out as a contractor and therefore, it was not required to hold a contractor’s license. It was then moved by Mr. Dill, seconded by Mr. Kagawa, with Mr. Lee opposed, and carried that the distribution company is not required to hold a contractor’s license as long as it does not hold itself out as a contracting entity.

Committee Reports: 6. Scope of Activity Committee: Gerald Yamada, Chairperson Derek Shimizu The Board discussed his inquiry at its February 22, 2013 meeting

regarding road maintenance work at Orchidland Estates. In response to his questions, the Board advised him that the road maintenance work had to be done by licensed contractors. Mr. Shimizu then provided a copy of a memo dated May 26, 1998 from the Board stating that a contractor’s license is required to perform the excavating and grading of new roads,


but that association road crews may perform road maintenance work, such as fixing pot holes and re-grading. Therefore, Mr. Shimizu is requesting further clarification on this issue.

Recommendation: The Board reaffirmed its February 28, 2013 determination that the performance of road maintenance work as described in his January 24, 2013 letter requires a contractor’s license. It was noted that previous determinations by the Board are informal and non-binding opinions, and that circumstances, such as the amount of public access or maintenance work necessary, may have changed in the 15 years since the previous determination. Ferguson Ferguson requests determination on whether a contractor’s license is required to do the following work:

1. Replacing appliances for residential customers; 2. Installing appliances (including built-ins) for new

installations, with all hard wire and plumbing connections performed by the appropriately licensed contractor; and

3. Requirements for single or multiple dwellings is the same, and the dollar value of the appliance installation activity is not relevant.

Recommendation: A contractor’s license is not required to replace or install appliances for residential customers, if all hard wire and plumbing connections are done by appropriately licensed contractors. This interpretation is the same for single or multiple dwellings, and is applicable regardless of the dollar value of the appliance installation activity. American Environmental Group American Environmental Group requests consideration of a C-68 license for the installation of geosynthetic containment system materials, including geomembranes, geotextiles, geocomposites, geonets, and geosynthetic clay liners. This work involves specialized equipment, tools and skilled technicians to protect the environment. The work is generally performed in industrial settings, such as landfills, commercial mining sites, and nuclear power plants requiring specialized health and safety training. They feel the work is unrelated to the C-55 Waterproofing classification, that they would have difficulty qualifying for the C-55 classification, and that a C-68 license would be more appropriate. Recommendation: The establishment of a new, separate C-68 classification for geosynthetic containment system materials is not warranted. The C-55 Waterproofing classification, and other license classifications may be relevant based on the specific purpose of the geosynthetic work. For example, if the geosynthetic system is for lining a


roadway, it could be performed under the C-3 Asphalt paving and surfacing classification. Therefore, rather than creating a classification specific to geosynthetic containment systems, the classification required should be determined by the type of project for which the system would be used.
