It was moved by Mr. Isemoto, seconded by Mr. Konishi, and carried by majority vote (Mr. Matsuzaki recused himself) to defer reconsideration of the withdrawal of Mr. Hore’s conditional license in the C-40 Refrigeration and C-52 Ventilating and air conditioning classifications pending the submittal of a $233,000.00 surety bond and the repayment plan that has been confirmed by the bankruptcy court, including a list of all creditors.

It was moved by Mr. Leong, seconded by Mr. Kagawa, and unanimously carried to add the C-56 Welding and C-68RH classifications to Mr. Norris’ application; to approve his application for licensure in the C-68RH Refinery and resource recovery equipment classification; defer his application for licensure in the C-56 Welding classification pending the submittal of a project list verifying four years of on-site supervisory work experience; and deny his application for licensure in the “A” General engineering classification because he did not meet the experience requirement.

It was moved by Mr. Leong, seconded by Mr. Isemoto, and unanimously carried to defer Mr. Shi’s application for licensure in the “B” General building classification pending the submittal of additional projects verifying “ground-up” supervisory work experience.
Chapter 91, HRS, Adjudicatory Matters: Chairperson Polischeck called for a recess from the Board’s meeting at
11:28 a.m. to discuss and deliberate on the following adjudicatory matters pursuant to HRS chapter 91.

1. Settlement Agreements
a. In the Matter of the Contractor’s License of Richard E. Mead, Jr.; CLB 2015-292-L; CLB 2017-191-L
Richard E. Mead (“Respondent”) allegedly failed to disclose State and Federal tax liens on his 2014 and 2016 license renewals as required by Hawaii Revised Statutes (“HRS”) and Hawaii Administrative Rules (“HAR”). Respondent allegedly failed to notify the Board of his change of address within ten days of the change as required by HRS and HAR. Respondent allegedly operated under the tradename of Mead’s Masonry without registering it with the DCCA or the Board as required by HRS and HAR. If proven at an administrative hearing, the allegations would constitute violations of HRS §§ 444-11 and 444-17 and HAR § 16-77-55 (requiring disclosure of tax liens and proof of financial integrity); HRS 444-4 and 444-9 and HAR 16-77-88 (failure to update Board of a change of address); HRS 444-4 and 444-9 and HAR 16-77-8 (requiring any trade name used by a contracting entity be registered with the DCCA and the Board); and general non-disclosure to the Board under HRS 444-17 and HAR 16-77-6 and 16-77-8. Respondent agrees to pay an administrative fine in the amount of $2,500.00. After discussion, it was moved by Mr. Isemoto, seconded by Mr. Konishi, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.
b. In the Matter of the Contractor’s License of Cano Electric, Inc.; CLB 2014-
170-L and CLB 2014-259-L In 2011, Cano Electric, Inc. (“Respondent”) allegedly failed to make required disclosures in a contract with a homeowner, received payment from the homeowner to install a wind turbine system but failed to complete the work, and failed to reimburse monies to the homeowner. In 2014, Respondent allegedly failed to pay amounts due to a materials supplier for materials used by Respondent on a job even though he customer paid Respondent for these materials. On or about November 7, 2014, John G. Cano filed for bankruptcy relief in the U.S. Bankruptcy Court for the District of Hawaii.

The complainant in RICO Case No. CLB 2014-170-L was listed as a creditor in the bankruptcy action. On or about August 10, 2015, John G. Cano was granted a discharge in the bankruptcy action. If proven at an administrative hearing, the allegations would constitute violations of HRS §§ 436B-19(8) (failure to maintain a record or history of financial integrity); 444-17(13) (Wilful failure or refusal to prosecute a project or operation to completion with reasonable diligence); 444-17(14) (Wilful failure to pay when due a debt incurred for services or materials rendered or purchased in connection with the licensee’s operations as a contractor when the licensee has the ability to pay or when the licensee has received sufficient funds therefor as payment for the particular operation for which the services or materials were rendered or purchased); 444-25.5(b)(1) (written disclosure of information regarding bonding and liens); HAR §§ 16-77-79(a)(1) (disclosure of lien rights); 16-77-79(a)(4) (disclosure of bonding information); 16-77-80(a)(3) (disclosure of the date work is to commence and the number of days for completion); and 16-77-80(a)(7) (explanation of lien rights). Respondent agrees to the voluntary revocation of Respondent’s contractor’s license. Respondent agrees not to renew or restore its Hawaii contractor’s license or to seek a new contractor’s license in the State of Hawaii in the future. After discussion, it was moved by Mr. Isemoto, seconded by Mr. Konishi, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.
c. In the Matter of the Contractors License of Andre D. Hasselmann, doing
business as Kona Fabricators and A/C; CLB 2018-30-L On or about August 8, 2016, Andre D. Hasselmann dba Kona Fabricators and A/c (“Respondent”) electronically renewed his contractor’s license and answered “no” in response to the question: “In the past 2 years have you been convicted of a crime in which has not been annulled or expunged?” On or about May 23, 2016, Respondent was convicted of a petty misdemeanor office of Operating a Vehicle Under the Influence of an Intoxicant in the District Court of the Third Circuit, State of Hawaii. If proven at an administrative hearing, the allegations would constitute violation of HRS § 444-17(10) (misrepresentation of a material fact by an applicant in obtaining a license). Respondent agrees to pay an administrative fine in the amount of $500.00.

After discussion, it was moved by Mr. Isemoto, seconded by Mr. Konishi, and unanimously carried to approve the Settlement Agreement Prior to Filing of Petition for Disciplinary Action and Board’s Final Order in the above case.
2. Board’s Final Order None. Following the Board’s review, deliberation and decisions in these matters,
pursuant to HRS chapter 91, Chairperson Polischeck announced that the Board was reconvening to its open meeting at 10:39 a.m.

3. Rules Committee: Leonard Leong, Chairperson Status on Proposed Amendments to HAR Chapter 16-77
Executive Officer Ito informed the Board that the proposed rule amendments are being prepared in its final form by the Department’s Office of Administrative Services.

a. Blake D. Reid C-68 Classified specialist C-52 Ventilating and air conditioning
It was moved by Mr. Isemoto, seconded by Mr. Konishi, and unanimously carried to deny Mr. Reid’s request to create a C-68 classification for “Home Performance” because currently, the following classifications include the work he will be performing: C-1 Acoustical and insulation for attic insulation; C-2 Mechanical insulation for insulating pipes, C-15 Electronic systems or C-13 Electrical for control wiring; C-52 Ventilating and air conditioning for the installation of dehumidifiers; and deferred his application for licensure in the C-52 Ventilating and air conditioning classification pending the submittal of verification of four years of on-site supervision of his own crews in the broad scope of the C-52 Ventilating and air conditioning classification, including but not limited to, installation of cooling systems, noting the size and capacity of the units. The Board also determined that a contractor’s license is not required to perform “air-sealing” testing to detect air leakage in a building, however a contractor’s license may be required make repairs to the building to seal the air leaks detected depending on the type of repair that is needed.
