Many people find cookies to be intrusive, so addressing them in your Privacy Policy shows good faith and keeps your users happy even if not legally required.

A cookie is a small data file that gets stored on a user’s computer or mobile device.

It holds data that’s used for different purposes including customizing a website, remembering log-in information, saving preferences, etc.

The EU Cookies Directive covers websites that are owned by EU businesses or are directed towards EU citizens.

It requires you to inform visitors/users of your website/mobile app that:

Cookies are in use, andHow cookies are used

You also must obtain consent from an individual before using cookies on his device.

Most companies provide a banner to notify users and require users to click to show active consent to cookies being used.

These banners can provide links to a separate Cookie Policy (mandatory in the EU) or a Privacy Policy with cookie clauses included within it.

You’ll also commonly find cookie clauses within Privacy Policies.

Aside from sometimes being mandatory and showing good faith to users, there are 2 main reasons why you should include these clauses:

1. Get Implied Consent for Cookies - Users accept your Privacy Policy when they sign up with you.

Having cookies clauses in your Privacy Policy lets you obtain implied consent that the user accepted your use of cookies when he accepted your Privacy Policy.

2. Limit Potential Liability - These clauses can limit your liability for things like a reduced user experience if a user disables cookies or clicks links from third parties with cookies.

Your cookies clause should be clearly labeled as such, under its own heading or sub-heading.

This keeps it easy to find within your Privacy Policy.

Let users know that:

You use cookies,What you use them for, andWhy you use them
