Different Applicants for Different Designated States(Rules 4.5(d), 18.3 and 19.2): It is possible to indicate different·applicants for the purposes of different designated States. Atleast one of all the applicants named must be a national orresident of a PCT Contracting State for which the receivingOffice acts, irrespective of the designated State(s) for thepurposes of which that applicant is named. Where the United

Precantionary Designation of States Subject toConfirmation (Rules 4.9(b) and (c) and 15.5): For theapplicant's safeguard, the lower part of Box No. V contains astatement indicating the applicant's wish tomake, in addition tothe specific designations made by marking the check-boxes inthe upper part ofBox No. V (at least one such designation mustbe made), a precautionary designation of all other PCTContracting States which are not specifically designated.

If the applicant does not wish to avail himself of thissafeguard and does not want to make any such precautionarydesignations, the statement must be crossed out.

If the applicant wishes to expressly exclude a certain Statefrom .such precautionary designation so that the internationalapplication does not have any effect in that State, the name ortwo-letter country code ofthat State should be indicated in thespace provided. In no other case is it necessary to make use ofthis possibility,

If, after filing the international application, the applicantnotices that there are any omissions andlor mistakes among thespecific designations made, it will be possible to rectify thesituation by confirming the precautionary designationsconcerned. The confirmation ofany precautionary designationis possible before the expiration of15 months from the (earliest)priority date indicated in Box No. VI or, where no priority isclaimed, the international filing date. To effect suchconfirmation, the applicant must file with the receiving Officea writtennotice specifyingthe name ofeach State the designationofwhich is confirmed (with, where applicable, an indication ofthe kind of treatment or protection desired) and pay to thereceiving Office, for each such designation, a designation fee(even where eleven designation fees have already been paid)together with a confirmation fee corresponding to 50% of thedesignation fee.

The receiving Office will not send to the applicant anyreminder or invitation to confirm precautionary designations.

Ifno precautionary designation is to be confirmed, no actionis required by the applicant, and the precautionary designationswill then be automaticallyregarded as withdrawnby the applicantat the expiration of 15 months from the priority date.

Priority Claim (Rule 4.10): If the priority of an earlierapplication is claimed, the declaration containing the priorityclaim must be made in the request.

The request must indicate the country in which the earlierapplication from which priority is claimed was filed (or, wherethe earlierapplication is aregional or an international application,at leastone country for which it was filed), the date on which itwas filed and the number it was assigned. IReduction of the International Fee for Applicants from

Certain States: An applicant who is a natural person and whois a national ofand resides in a State whose per capita nationalincome is below 3,000 US dollars (according to the average percapita national income figures used by the United Nations fordetermining its scale ofassessments forthe contributions payablefor the yeats 1995, 1996 and 1997) is entitled, in accordancewith the Schedule ofFees, to areduction of75% ofcertain PCTfees includingthe internationalfee. If there are several applicants,each must satisfy the above-mentioned criteria. The reductionofthe international fee (basic fee and designation fees) will beautomatically available to any applicant (or applicants) who is(or are) sol entitled on the basis of the indications of name,nationality andresidence given in Boxes II and III ofthe request.

Calculation of the International Fee (Basic Fee andDesignation Fees) in Case of Fee Rednction: Where theapplicant is (or all applicants are) entitled to a reduction oftheinternational fee, the total to be entered at box I is 25%ofthe sumofthe amounts entered at boxes B and D (see below).

Box B: Basic Fee. The amount ofthe basic fee depends onthe total number of sheets of the international application,which appears under "Total" in Box No. VIII (CHECK LIST)of the request. The basic fee must be paid within one monthfrom the date of receipt ofthe international application by thereceiving Office.

Box D: Designation Fees. The number ofdesignation feesdue corresponds to the number of check-boxes marked inBox No. V ofthe request.

The number of designation fees which are due is the sameas the number ofnational patents and regional patents in respectof which specific designations under Rule 4.9(a) are made.Only one designation fee is due for the designation "AP", thedesignation "EA", the designation "EP" or the designation"OA", irrespective ofthe number ofStates for which an ARIPOpatent, a Eurasian patent, a European patent or an OAPI patent,respectively, is sought.

Where any States are designated twice (once forthe purposesofan ARIPO patent, a Eurasian patent or a European patent andonce for the purposes ofnational protection), the applicant mustpay one designation fee in respect of the ARIPO patent, theEurasian patent or the European patent and a further designationfee in respect ofeach national patent or other title ofprotectionsought (Rule 15.I(ii) and Section 210).

Any designation, in excess of eleven designations forwhich the fee is due, is free ofcharge. Therefore, themaximumamount to be indicated in box D is eleven times the amount ofthe designation fee. IMPORTANT GENERAL INFORMATIONI

Who ~ay File a Demand? (Article 31(2)(a) and Rule 54):A demand '(for international preliminary examination) may onlybe filed by an applicant who is anational or resident of a PCTContracting State which is bound by Chapter 11 of the PCT;furthermore, the international application,must'have been,filedwith a receiving Office of, or acting for, a State bound byChapter IIi Where there are two or more applicants (for the sameor different elected States) at least oneof them must qualify.

Where Must the Demand Be Filed? (Article 31(6)(a»:The demand', must be filed with a competent InternationalPreliminary Examining Authority (IPEA). The receiving Officewith which the international application was filed will, uponrequest, give: information about the competent Il'Ea (or seeAnoex C ofvolume I ofthePCT Applicant's Guide). IfseveralIPEAs ,,' are competent, the applicant has the choice and thedemand must be filed with (and the fees must be paid to) the!PEA chosen by the applicant. The IPEA chosen by theapplicant may be identified, preferably by an indication of thename or two-letter code of the IPEA, at the top of the first sheetof the 'demand in the space provided for that purpose.

iwhen-Must the Demand Be Filed? (Article 39(1»: The

demand must be filed before, the expiration of 19 months fromthe priority date in order to extend the time Iimit for entering thenational.phase of the PCT procedure from 20 to 30 months fromthe priority-date. Warning: if the demandis filed later, thenational phase will not be delayed in respect ofthe elected Statesand the applicant must enter the. national phase before theexpirationlof'the time limit applicable under Article 22 (whichis usually 120 months from the priority date).,

In Whie;h Language Must the Demand Be Filed?(Rule 55.1): The demand must be filed in the language of theinternatio*al'iapplication if that language is Chinese, English,French, G¢rman, Japanese or Russian;' .otherwise, the demand'must be filed,in English.

IIn WpiCh Language Must Amendments Be Filed?

(Rule 66.~): ,Amendments and letters relating thereto must bein the language of publication.

Whatjls the Language of Correspondence? (Rule 92.2and Section 104): Any letter from the applicant to the IPEAmust be in the same language as the international application towhich it relates. However, the IPEA may authorize the use ofanother language for letters which do not contain' or' relate toamendments .of the international application. ,Any letter fromthe applicant-to the International Bureau must be in English orFrench, at.the choice of theapplicant. However, ifthe, languageof the international application is English, the letter must be inEnglish; if the language of the international application isFrench, tI1e letter must be in French.

iWhich Fees Must Be Paid and When? (Rules 57 and 58):

At the time the demand is submitted, the applicant must pay thepreliminary examination fee and the handling fee. The Fee

Identification ofthe InternationalApplication (Rule 53.6):The international application number must be indicated in BoxNo. I. Where the demand is filed at a time when the internationalapplication number has not yet been notified by the receivingOffice, the name ofthat Office must be indicated instead of theinternational application number.

International Filing Date and (Earliest), Priority nate(Section 110): Dates must be indicated by the Arabic numberof the day, the.name ofthe month and the Arabic number of theyear-in that order; after, below or above such indication,thedate should be repeated in parentheses, using two-digit Arabicnumerals for each of the number of the day" the number of themonth andthe last two numbers of the year, in that order, andseparated by periods, slants or hyphens, e.g., "05 March 1992(05.03.92)", "05 March 1992 (05/03/92)" or "05 March 1992(05-03-92)". Where the international application claims thepriority of several earlier applications, the filing date of theearliest application whose priority is claimed must be indicatedas the priority date.

Applicant(s) (Rule 53:4): All the applicants for the electedStates must be indicated in the demand; an applicant named inthe request (Form PCT/RO/101) for a State which is not electedneed not be named in the demand. It should be noted that thepersons"named as "inventor only" in the 'request need, not benamed in thedemand.

Make in Box No. II of the demand the required indicationsas appearing in Boxes Nos. II and III ofthe request. The Notesto the request apply mutatis mutandis. Ifthere are two or moreapplicants for the States elected in the demand, give the requiredindications for each of them; if there are more than threeapplicants, make.the required indications on the "ContinuationSheet": .

Ifdifferent applicants are indicated in the request for differentdesignated States, indicate in Box No. II of the demand only theapplicants for the States elected in Box No. V (no indication ofthe States for which a person is applicant need be made, becausethose indications have been made in the request).

NOTES TO THE FEE CALCULATION SHEET(ANNEX TO FORM PCTlIPEAl401)

iThe purpose of the fee calculation sheetis to help the applicant to identify the prescribed fees and to calculate the amounts to

be paid. It is strongly recommendedthat the applicant complete, by entering the appropriate amounts in the boxes provided, andsubmit the f~e calculationsheet at the time of filing ofthe demand. This will help the InternationalPreliminaryExaminingAuthority(!PEA) to verify the calculations and to identify any error in tbem.

ICALCULATION OF PRESCRIBED FEES

Calculation ofthe Handling Fee in Case of FeeReduction:Where the applicant is (or all applicants are) entitled to areductionof the handling fee, the total tobe entered at Box H is25% of the bandling fee.

Total Box: The total of the amounts inserted in Boxes Pand H is the amount which must be paid to the IPEA.

MODE OF PAYMENT

In order to help the !PEA identify tbe mode of payment ofthe prescribed fees. it is recommended to mark the applicablecheck-box(es).

AUTHORIZATION TO CHARGEDEPOSIT ACCOUNT

The applicant should check whether the IPEA allows theuse of deposit accounts for payment of peT fees. In addition,it is recommendedthat the applicantcheckwhat are the specificconditions applicable to the use of deposit accounts with theIPEA since not all IPEAs provide for the same services.

Finally, if the IPEA is not the same national Office orintergovernmental organization as that with which theinternationalapplicationwas filed, the deposit account with thereceiving Office cannot be charged for the purpose of payingthe preliminaryexaminationandhandling fees due to the IPEA.

The IPEAwill not chargefeesto deposit accountsunless thedepositaccountauthorizationis signed and indicatesthe depositaccount number.
