Establishment and headquarters of the Commission

• A Commission shall be established under the Act, 2009 and to be known as the “ Human Rights National Commission”• The headquarters of the Commission shall be in the National Capital ; and may establish branches in the states of the Sudan.

Composition and membership

• The Commission shall be composed of fifteen members, selected by the President of the Republic after consultation in the Presidency provided that representation of women and civil society organizations shall be given due regard in their selection.

Term- Composition and membership

• The term of the member shall be five years, subject to renewal for another term only• The President of the Republic shall appoint a chairperson and a deputy chairperson; provided that one of them shall be a woman• The chairperson and his deputy shall work on full time basis.

Immunity of the members

Other than in cases of red-handedness no arrest or any proceedings shall be taken against the members of the Commission for any work relating to the discharge of duties assigned thereto under the provisions of this Act, save after obtaining a written permission from the Presidency.

• Prepare research and educational programmes on Human Rights.• Study any subjects with respect to any national matter in the field of Human Rights and submit recommendations.• Tender advice to the Government in any subject concerning Human Rights• Take the initiative through the competent bodies to submit bills, legislations and decisions relating to Human Rights and prepare reports , and submit recommendations concerning the same to the competent bodies.• Submit recommendations and proposals with respect to any matter relating to Human Rights in the term of legislative provisions or administrative decisions to be consistent with fundamental principles of Human Rights

Receive complains from individuals and other bodies, investigate and take the necessary measure in accordance with the provisions of this Act or any other law, and recommend to the bodies having relation to proceed necessary treatment Address the competent authorities in the term of violations which occur in the field of Human Rights and request them to cease such violations.

Encourage the Government to accede to the International Treaties pertaining to Human Rights Strive to effect compatibility of national legislations and practices of Human Rights Prepare annual reports on Human Rights in Sudan Disseminate awareness of Human Rights among the various sectors of Sudanese People. Co-operation with the United National Organizate and its Specialized Agencies and all similar institutions working in the field of Human Rights.

The Commission shall have the following powers:- Consider complains submitted thereto and investigate the same where there is violations of Human Rights and take such measures as may be necessary. Form ad hoc or standing committees or work teams to assist it in the performance of the tasks thereof. Research in full liberty all such matters having relation to Human Rights.

Address the public opinion directly or through available mass media to publish its opinion and recommendations to all society sectors. Make internal regulations to organize its business and procedures. ( The Commission shall not consider any complaint that is submitted before any competent court.)

Functions of the chairperson

• The Chairperson of the Commission shall be the chief responsible person of the Commission; and shall supervise all administrative and financial matters, required by the work at the Commission. Without prejudice to the generality of the foregoing, the Chairperson shall have the following functions, to:-

1. Preside meetings of the Commission.2. Represent the Commission, before others.3. Follow-up the execution of decisions of the Commission.4. Submit the reports which are approved by the Commission to the Presidency and the National Assembly on the matters relating to Human Rights and violations. 04/12/20

The Commission shall establish a general secretariat, presided by a Secretary General; and includes a number of employees according to the approved charts.

The General Secretariat shall have competence to proceed the routine executive and administrative business of the Commission and it shall have competence on the following functions to :- 1. Execute the decision and directives of

business3.Prepare the annual budget and submit it

to the Commission for approval and submitting it to the Presidency for validation

4. Prepare organizational chart for the Commission and terms of the employmees service

Budget accounts, subsidy and audit

1. The Commission shall have an independent budget, 2. The Commission shall establish an account unit thereof working in accordance with sound accountancy bases. 3-The Commission may obtain national and foreign subsidy as to such safeguards as the Presidency may specify. 4- The National audit Chambers, shall audit the accounts of the Commission at the end of every financial year .
