PENALTY FOR INFRINGEMENT
Infringer pays the dollar amount of damages & profits.
Law provides a range from $200 to $150,000 per work infringed.
Infringer pays all attorney’s fees & court costs.
Court can issue an injunction to stop the infringing acts.
Court can impound the illegal works.
Infringer can go to jail.
FAIR USE…
Having the ability to use another's creation for
your own purpose without getting the permission or
paying a royalty.
Promotes free speech, learning, scholarly research,
and open discussion.
CONDITIONS FOR DECIDING FAIR USE…
Can not be sold,
Copied to make a profit, or
Claimed as your own.

The purpose of the use.
The nature of the work.
The amount of the work used.
The market effect of use.
MULTIMEDIA IN THE CLASSROOM
Students may use portions of lawfully acquired copyrighted works in their
academic multimedia projects, with proper credits and citations.
Students and teachers must include on the opening screen of their programs
and on any printed materials that their presentations has been prepared under
fair use exemption of the U.S. Copyright Law and are restricted from further use.
Up to 10% of a copyrighted work or 3 minutes, whichever is less. Clip cannot be
altered in any way.
No more than 5 images of an artist’s or photographer’s work.
Up to 10% of a copyrighted musical composition, but no more than 30 seconds.
No more than 2 copies of the original production may be made.
HOW TO USE OTHER’S WORDS
Provide proper citation for works that are used.
MUSICAL SCORE…
Can be used in the classroom- if use is relevant to
the instructional activities of the class & the
audience is the classroom.
Language learning center-language textbook
tapes.
Library reserves- library should own the work
being copied.
Must be shown as part of the
instructional program.
Shown only by students,
instructors, or guest lectures and
only shown to students &
educators.
Must be a legitimate copy with
the copyright notice included.
Films or videos may not be used
for entertainment or recreation.
FILMS IN THE CLASSROOM…

The broadcast must be relevant to the instructional
activities of the class & the audience is the
classroom.
Can only be view to a single class & within 10 days
of the broadcast date.

ITEMS ON A WEBSITE
Whenever an author posts anything on the
internet, he or she reasonably expect that it will be
read, downloaded, printed out, forwarded, and even
used as the basis for other works to some degree.
Fair use ends when the multimedia creator loses
control of his product’s use, such as when it is
accessed by others over the internet.
BAD USES OF FAIR USE…
Nature of work is imaginative.
More that a small amount of work is used.
Takes away sales from the original product created
(royalties).
GOOD USES OF FAIR USE…
Nature of work is factual and published.
Small about of work is used.
No money is deducted from the original product
created.
