THE CLEAN NEIGHBOURHOODS AND ENVIRONMENT ACT 2005 THE DOG CONTROL ORDERS (PRESCRIBED OFFENCES AND PENALTIES, etc.) REGULATIONS 2006 (S.I 2006/1059) THE DOGS ON LEADS (PRESTON CITY COUNCIL) ORDER 2012  The Pres t on City Council (in this Or der called “ t he Council”) hereby ma k e s t he following Order: 1. This Order comes into force on [ at least 14 days after the date on which the order is made] 2011. 2. This Order applies to the land specified in the Schedule below. Offence 3. (1) A person in charge of a dog shall be guilty of an offence if, at any time, on any land to which this Order applies he does not keep the dog on a lead of not more than 6 feet in length, unless:- a) he has a r easonable excuse for failing t o do so; or b) the ow ner, occupier or other person or aut hority having control of the land has consented (generally or specifically) to his failing to do so. (2) For the purposes of this article a person who habitually has a dog in his possession shall be taken to be in charge of the dog at any time unless at that time some other person is in charge of the dog. Penalty 4. A person who is guilty of an offence under article 3 shall be liable on summary conviction to a fine not exceeding level 3 on the standard scale.

THE DOG CONTROL ORDERS (PRESCRIBED OFFENCES ANDPENALTIES, etc.) REGULATIONS 2006 (S.I 2006/1059)

THE DOGS ON LEADS (PRESTON CITY COUNCIL) ORDER 2012

 The Preston City Council (in this Order called “the Council”) hereby makes thefollowing Order:

1. This Order comes into force on [at least 14 days after the date on which theorder is made] 2011.

2. This Order applies to the land specified in the Schedule below.

Offence

3. (1) A person in charge of a dog shall be guilty of an offence if, at any time,on any land to which this Order applies he does not keep the dog on alead of not more than 6 feet in length, unless:-

a) he has a reasonable excuse for failing to do so; orb) the owner, occupier or other person or authority having control of the

land has consented (generally or specifically) to his failing to do so.

(2) For the purposes of this article a person who habitually has a dog in hispossession shall be taken to be in charge of the dog at any time unlessat that time some other person is in charge of the dog.

Penalty

4. A person who is guilty of an offence under article 3 shall be liable onsummary conviction to a fine not exceeding level 3 on the standard scale.

SCHEDULE(Description of land to which the Order applies)

 This Order applies to all land within the administrative area of the Council andwhich is:-

(i) All recorded vehicular highways (which will include footways,carriageways, cycle tracks and verges within the highwaywidth); or

(ii) Miller Park; or(iii) The footpaths adjacent to and leading from Avenham Park

Pavilion; or(iv) J apanese Garden in Avenham Park; or(v) Winckley Square Park; or(vi) A playground or playing field of a school; or(vii) The grounds of Leisure Centres including sports pitches; or

(viii) A Council owned cemetery or crematorium grounds; or(ix) The Peace Garden at the junction of Friargate and Ringway;

or(x) The Flag Market, Market Place, Preston; or(xi) The two Covered Markets; or(xii) A designated area within one of the Local Nature Reserves

listed below and more particularly defined on the mapsattached to this Order: Haslam Park, Grange Valley, PopeLane, Hills and Hollows, Fishwick Bottoms, Boilton Wood

 The “footpaths adjacent to and leading from Avenham Park Pavilion” beingthe areas which are shown shaded yellow on the map attached to this Order.

 The “Flag Market” being the area flanked by the Harris Museum/Library, MillerArcade, Crystal House, Cheapside, The Old Post Office, Preston Crown Court(Sessions House).

 The “Covered Markets” being two large roofed structures situated on eitherside of Earl Street and demarcated by Lancaster Road and Birley Street to theEast and Market Street to the West.

“A designated area within a Local Nature Reserve” being an area which isshown shaded yellow on the maps attached to this Order.

The proposed Order and map can be viewed at the Town Hall,Lancaster Road, Preston, PR1 2RL during normal office hours or alternatively, it can be found on the Preston City Council websitewww.preston.gov.uk under Dog Welfare.

 Anyone who wishes to do so may submit representations to theEnvironmental Health Department about this proposed Order by

submit ting those representations to the above address or by e-mailto [email protected] Such representations must be in writingand must be made no later than Date: 31
