1. SUBJECT: STRENGTHENING PUNISHMENT FOR HUMAN TRAFFICKING AND THE COMMERCIAL SEXUAL EXPLOITATION OF CHILDREN (DISTRICTS: ALL)

OVERVIEW:At the November 9, 2010 Board of Supervisors meeting this board unanimously supported a change in state law to strengthen penalties for crimes related to human trafficking and the commercial sexual exploitation of children.  There was also an informative presentation given by law enforcement and the District Attorney’s office that highlighted the increasing gang connection to pimping, pandering, and human trafficking.

Pimping, pandering, and human trafficking is increasing at an alarming rate across the country as well as right here in the San Diego region.  Criminal street gangs have embraced pimping as “the new crack”, rivaling narcotic sales as a major source of funding for many gangs.  This heinous crime targets our most vulnerable youth, who are often recruited within the walls of the schools they attend. Today’s action specifies two legislative efforts aimed at enhancing penalties for street gangs that engage in pimping and pandering, as well as for those who engage in pimping and human trafficking activity within or around a school.FISCAL IMPACT:There is no fiscal impact associated with this action.BUSINESS IMPACT STATEMENT:N/A

RECOMMENDATION:SUPERVISOR JACOB, SHERIFF GORE, AND DISTRICT ATTORNEY DUMANIS1. Sponsor State legislation that adds pimping, pandering, and human trafficking to

the list of primary activities outlined in the penal code required to define a criminal street gang.

2. Sponsor State legislation that would enhance penalties for those convicted of a crime associated with pimping, pandering, and human trafficking on school grounds or within 1000 feet of a school

2. SUBJECT: SHERIFF – REPORT OF INMATE WELFARE FUND EXPENDITURES FOR FISCAL YEAR 2009-10 (DISTRICTS: ALL)

OVERVIEW:This is an itemized report of expenditures from the Inmate Welfare Fund, as required under Penal Code section 4025. These expenditures are primarily for the benefit, education, and welfare of the inmates confined within the San Diego County adult detention facilities. The funding sources for the Inmate Welfare Fund are inmate telephone revenues and excess revenues from the sale of commissary items to the inmates.

FISCAL IMPACT:There is no fiscal impact as a result of this action. There will be no change in net General Fund cost and no additional staff years.BUSINESS IMPACT STATEMENT:N/ARECOMMENDATION:SHERIFFNote and file the Fiscal Year 2009-10 Report of Inmate Welfare Fund Expenditures.

3. SUBJECT: PROBATION DEPARTMENT – CALIFORNIA VICTIM COMPENSATION AND GOVERNMENT CLAIMS BOARD CDCR RELEASE OF ALL CLAIMS (DISTRICTS: ALL)

OVERVIEW:This is a request to seek authorization to execute a release of claims from the California Victim Compensation and Government Claims Board (VCGCB). The Probation Department filed a claim, number G594001, with the VCGCB for non-payment of Fiscal Year 2009-10 Senate Bill 618 Prisoner Reentry (SB618) program expenses. The VCGCB has approved Probation’s claim, subject to this release.

Funds for this request were included in the Fiscal Year 2009-10 Operational Plan in the Probation Department. This request resulted in costs and revenue of $3,042,142.86 in Fiscal Year 2009-10. The funding source is the State of California Victim Compensation and Government Claims Board. If approved, this request will allow the Probation Department to receive payment in Fiscal Year 2010-11 for expenses that were incurred in the prior fiscal year. There will be no change in net General Fund cost and no additional staff years.

BUSINESS IMPACT STATEMENT:N/A

RECOMMENDATION:CHIEF ADMINISTRATIVE OFFICERAuthorize the Chief Probation Officer, or his designee, to execute the CDCR RELEASE OF ALL CLAIMS for the Victim Compensation and Government Claims Board claim number G594001.

4. SUBJECT: IMPROVING MEAL OPTIONS FOR SENIORS, DISABLED AND HOMELESS UNDER THE SUPPLEMENTAL NUTRITION ASSISTANCE PROGRAM – SNAP (DISTRICTS: ALL)

OVERVIEW:The Supplemental Nutrition Assistance Program (SNAP), administered in San Diego County by the Health And Human Services Agency, is a federal benefit program with the purpose of providing improved levels of nutrition to low-income households while also strengthening the local economy.

On April 21, 2009, this Board of Supervisors, at the recommendation of Supervisors Ron Roberts and Bill Horn, unanimously approved the Nutrition Security Plan with a goal of increasing SNAP participation by 50,000 kids and seniors by June 2012. As of November 30, 2010, 42,851 kids and seniors have been added, bringing us nearly 86 percent of the way to that goal. Indeed, participation in SNAP, once called Food Stamps but now known as CalFresh, has increased greatly in recent years. As of November 2010, SNAP participation exceeded 210,000 recipients and was up 79 percent compared to November 2008. A report approved by this Board on December 7, 2010, set in motion changes to further bring this benefit to those who are eligible.

Unfortunately, a segment of our eligible SNAP population struggles daily to use the

benefit to acquire hot or prepared food. They may be without a residence, lack a proper cooking appliance or deal with a handicap that limits their ability to prepare certain foods.

It is our recommendation that the Board of Supervisors direct staff to report back in 90 days with the design of a program that would allow the County of San Diego to develop a feasible implementation plan allowing seniors, disabled and homeless to use their SNAP benefits at qualified restaurants while ensuring low-cost healthy options are available.FISCAL IMPACT:There is no immediate fiscal impact to the County General Fund for the requested actions. Staff will return to the Board with an implementation plan that outlines the costs and sources of funding for this program.

RECOMMENDATION:CHAIRMAN HORN AND VICE CHAIRMAN ROBERTSDirect the Chief Administrative Officer to report back to the Board of Supervisors within 90 days with an analysis of the feasibility, timeline, costs and resources required to implement a program that allows the senior, disabled and homeless populations to use their SNAP benefits at qualified restaurants while ensuring low-cost healthy options are available.

OVERVIEW:On December 7, 2010 (25), the Board of Supervisors introduced Ordinance for further consideration and adoption on January 11, 2011.

On June 22, 2004, the Board of Supervisors adopted ordinance number 9655 which added Section 364.4 to the San Diego County Administrative Code, establishing the fee ordinance for the Office of the Treasurer-Tax Collector. There have been no modifications to the fee ordinance since that time.

This is a request to adopt an Ordinance amending Section 364.4 of the Administrative Code relating to the fees charged by the Office of the Treasurer-Tax Collector. The proposed amendment would introduce 12 new fees, adjust 9 existing fees, and include and/or adjust 5 statutory fees. These changes are necessary to ensure costs are recovered to the fullest extent legally possible and to provide a more comprehensive list of the fees a taxpayer may incur by requesting discretionary services or by failing to pay tax obligations in a timely manner.

The fees included in the proposed ordinance are imposed only upon those individuals who fail to pay their property tax obligations prior to the statutory deadlines and those individuals that request discretionary services. It is these preventable and discretionary services that ultimately increase the operational costs required to fund the tax collection program.

FISCAL IMPACT:If approved, this request will ensure full cost recovery for services provided. The proposed fee package will generate total revenue estimated at $565,000 in Fiscal 2011-12. Revenue for this request is not included in the Fiscal Year 2010-2011 in the Operational Plan for the Office of the Treasurer-Tax Collector. This request will

OVERVIEW:On December 7, 2010 (26), the Board of Supervisors introduced Ordinance for further consideration and adoption on January 11, 2011.

The proposed amendments to the San Diego County Compensation Ordinance are part of the ongoing effort to manage and maintain a skilled and competent workforce dedicated to sustaining operational excellence and serving the public. These amendments include: establishing one new job code/classification; adjusting the salary ranges for one job code/classification in the classified service and two job codes/classifications in the unclassified service; re-titling three job codes/classifications to reflect organizational changes; deleting three obsolete job codes/classifications; amending sections of the Compensation Ordinance related to re-titles and deletion of obsolete classifications; and amending the section pertaining to the duration of the Military Anti-Terrorist Campaign Leave Provisions. In addition, the section relating to the Sheriff’s Department Hard to Recruit Referral Program has expired and is being repealed.

FISCAL IMPACT:If approved, the proposed amendments would result in an increase of approximately

In accordance with Board of Supervisors Policy A-76, Sunset Review Process, the Finance and General Government Group periodically reviews certain Board policies and provisions of the County Administrative Code to ensure that obsolete policies and Administrative Code provisions are deleted and remaining policies reflect current Board standards and practices. The actions requested in Recommendations 5, 6, 7 and 8 require two steps, approval of the first reading of the Ordinances on December 7, 2010 and adoption of the Ordinances on January 11, 2011.
