Greetings

Dear Colleagues!

The Law Faculty of the University of Innsbruck has always been eager to not only provide the regular courses in line with the study of law but to also offer possibility to gain extra qualifications in order to prepare students for their professional lives.

In doing so, the Faculty has luckily been able to rely on the support of many a cooperation partner, such as the Bar Association (Rechtsanwaltskammer), the Chamber of Notaries (Notariatskammer), the Chamber of Accountants

and Tax Advisers (Kammer der Wirtschaftstreuhänder), the Innsbruck Appeal Court (OLG Innsbruck) and the European Law Students’ Association (ELSA).

Thanks to the support of ELSA, this year, we have the possibility to offer an international summer school in Innsbruck for the second time, namely the “Summer ELSA Law School on Medical and Health Law”. The programme offers lectures held by renowned (international) experts as well as workshops and excursions. The participants are both from national and international backgrounds, which encourages the possibility to establish international contacts.

I would like to express my gratitude to all the people involved in organising thissummer school. It could not have been realised without their ideas, contributions and commitment. I am confident that those attending the Summer School will have a stimulating and rewarding time.

I hope you will leave this event with numerous new contacts and new inspiration.

Dear participants!

On behalf of the Organisation Committee we could like to welcome every one of you very warmly to Innsbruck. We are delighted to have so many people from various parts of the globe in our city to participate in the 2nd edition of the Summer ELSA Law School on Medical & Health Law. The topic Medical & Health Law is not chosen randomly, but related to our University city of Innsbruck, often called “Heart of the Alps”. Innsbruck is an alpine-urban, sporty, and dynamic yet charming city, and the medical centre of western Austria, which delights us with cultural treasures

as well as natural wonders. As a part of the international ELSA network the European Law Students‘ Association Innsbruck in not only focusing on the organisation of variousextra-curricular events, but also in enhancing the juridical education of the Universityof Innsbruck with projects such as law schools.

Over the past few years ELSA Innsbruck has gained lots of experience when it comes to planning this event. All these achievements cannot be reached alone. In fact, it is the hard work of many people that made all this possible. That is why we would like to wholeheartedly thank our steady cooperation partner, the Faculty of Law at the University of Innsbruck, which offers us not only their facility but also their academic resources. We are honoured to have top class speakers from all over Europe in our academic programme with us this week. All of them are esteemed experts in Medical Law and/or related areas and we highly appreciate their effort of sharing their knowledge with us and giving us an insight view of their expertise. Thank you very much! We would also like to express our gratitude to our fellow members of ELSA Innsbruck, who joined the Organisation Committee of this year’s Summer Law School. Andreas Wimmer is Associate Professor at the Department of Public Law, State and Administrative Theory at the Leopold-Franzens-University of Innsbruck and Visiting Professor at the Johannes Kepler University of Linz. His main research areas concern Constitutional Law, Administrative Law, Theory of Law and Medical and Health Law. He studied law and history at the Paris-Lodron-University of Salzburg. Afterwards he worked in the Federal Ministry of the Interior. In 2010 Andreas Wimmer joined the University of Innsbruck. From 2017 until today he is deputy director of the Research Center on Medical and Health Law. In 2018 he habilitated for Constitutional Law and Administrative Law. The title of his habilitation thesis is „Legal relationships in Public Law – changing perspectives“.

Monday, July 1“The Greater Good - Legal remedies against vaccine hesitancy“

Teresa Weber is Assistant Professor at the Department for Public Law, European Law and International Law of the University of Salzburg. She studied Law at the University of Vienna (Mag.iur., 2006-2010) and continued her studies at the Vienna University of Business and Economics (Dr.iur., 2010-2014). At the Vienna University of Business and Economics, she worked as a Teaching and Research Associate at the Institute for Austrian and European Public Law (2010-2013). In the past, Teresa Weber spent time as Visiting Scholar at the German Research Institute for Public Administration in Speyer, the Max Planck Institute for Comparative Public Law and International Law in Heidelberg, as well as at the Université de Liège, Service de droit public et constitutionnel et des Droits de l‘homme and the Katholieke Universiteit Leuven, Leuven Centre for Public Law. Her current research focus includes the interplay between International, European and National Law as well as national constitutional boundaries to European Integration.

Monday, July 1“Sex&Drugs in the Millian liberal State“

Marie-Luisa Frick works at the Department of Philosophy at the University of Innsbruck. Her main research fields are ethics, philosophy of law, political philosophy and philosophy of religion. She is a former visiting fellow at Harvard Law School‘s Human Rights Program and author of numerous publications including her recent book „Human Rights and Relative Universalism“ (Palgrave 2019).

Tuesday, July 2“Dynamic Consent - from participant to partner“

Dr. iur. Julian Mausbach works as a senior-researcher and Fellow of the Digital Society Initiative at the University of Zurich. His main research areas concern the law on human research, precision medicine, data protection, transplantation, reproductive medicine as well as the federal act on electronic patient records and penal law in general.

He studied law at the Goethe University of Frankfurt (Germany) and is trained as a lawyer. In 2006 he joined the law school of the University of Zurich and received his doctorate (summa cum laude) for his thesis on medical confidentiality and regulation of disclosure. From 2010 to 2015 he managed the centre for excellence of medicine, ethics and law at the University of Zurich.

In addition he is member of the cantonal ethics committee and the ethics committee of the ETH Zurich and works as an attorney at law, specialised in medical law.

Gabriela Staber joined CMS in Vienna in 2003 after completing her legal studies at the University of Vienna and King’s College London. She acquired extensive international experience through her work for renowned law firms in Boston from 2009 to 2012 and her studies in the U.S., where she obtained a Master’s degree in Intellectual Property and Information Technology Law. Gabriela Staber is fluent in German and English and is admitted to the bar in Austria, New York, and Massachusetts. She frequently publishes in the fields of lifesciences and intellectual property law.

Felix Kesselring is a Swiss attorney-at-law at CMS von Erlach Poncet Ltd in Zurich. His practice focuses on public and administrative law. He specialises in advising companies in regulated markets such as healthcare, pharma, life sciences and foodstuffs.

Felix Kesselring received his law degree from the University of Zurich and the University of Strasbourg. He holds a postgraduate degree (LL.M. in Public Law) from the London School of Economics and Political Science (LSE) and received his PhD (Dr. iur.) from the University of Basel. He regularly publishes on healthcare, pharma, life sciences and foodstuffs issues. Felix Kesselring also worked as a seconded legal counsel for a Swiss-based multinational pharmaceutical company.

Thursday, July 4“Informed Consent: medical law vs. clinical practice“

Hubert Niedermayr works as an attorney-at-law since 2006 in Steyr (Upper Austria). He received his doctorate degree of law at the Johannes Kepler University Linz. He completed his studies of cultural sciences and philosophy at the FernUniversität in Hagen where he is studying history, as well. In addition he holds an MBA (General Management).

His main interests concern medical liability and fundamental human rights. Currently he is pursuing his doctorate studies at the Leopold Franzens University Innsbruck (thesis: medical assisted suicide), where he joined the PhD programme „Medical law and health service“ in 2018.

Thursday, July 4“To donate or not to donate your gametes - is that a question of law in reproductive medicine?“

Magdalena Flatscher-Thöni is Assistant Professor at the Department of Public Health and Health Technology Assessment at UMIT - University for Health Sciences, Medical Informatics and Technology in Hall in Tyrol, Austria, where she is department member since 2011. She is coordinator of the Program on Health Policy, Administration, Economics and Law. Magdalena completed her Ph.D. in law at the Leopold-Franzens-University Innsbruck, as well as undergraduate studies in law and economics. Postdoctoral research stays have led her to the Rotterdam Institute for Law and Economics, School of Law, Erasmus University Rotterdam, Netherlands and to the Department of Agricultural and Resource Economics, University of Maryland, USA.

Her research interests lie in the area of medical and public health law with a special focus on the evaluation of human life and reproductive medicine, using empirical approaches. She has collaborated actively with researchers of several other disciplines e.g. psychology, medicine and economics in different research projects.

Magdalena has published numerous papers in international journals (e.g. Journal of Empirical Legal Studies, Journal of Public Health or International Review of Law and Economics), and is teaching courses in medical and public health law, as well as in empirical legal studies.

Friday, July 5“Hazards in alpine environments – risk and responsibility“

Stephanie Jicha is University Assistant at the Department of Public Law, State and Administrative Theory at the University of Innsbruck since May 2016. She is teaching administrative sciences and administrative law as well as theory of states, theory of constitutions and constitutional law.

In addition to her job at the University of Innsbruck she is the vice president of the Tyroliean Parliament. There she is faced with the hazards in alpine environments frequently and also faced with the tension between the risk on the one hand and the need of regulation on the other hand.

Friday, July 5“(Re-)Legalize it! Smoking and the Law in Austria and Europe“

Bernhard Rudisch has been appointed extraordinary professor at the Institute for Civil Law of the University of Innsbruck in 2004. He engages in teaching and research in contractual and non-contractual obligations under national Austrian Law, Private International Law, Comparative Law and selected foreign legal orders. In the Innsbruck legal education, among courses on civil law in general he supplies specialised lectures and courses on e.g. Private Insurance Law, e-Commerce, Private Law in Public Administration, Medical Law, and Consumer Protection Law.
