Sub: Alienation of landed properties, misuse of funds, maladministration in the Management of Sri Sosale
Vyasaraja Mutt - Enquiry Report of the Committee; taking over Management and affairs of the Mutt
by the Government – appointment of an Administrator.

Preamble: Sri Sosale Vyasaraja Mutt is a renowned institution of the Madhwa Vaishnava faith. It achieved
prominence during the pontiffship of Shri Vyasaraja who was Rajaguru of the Vijayanagar Samsthanam during the
reign of Shri Krishnadevaraya. The Mutt has been richly endowed in terms of moveables and immoveable properties
by the Vijayanagar kings and subsequent contributions of the public.
2. For the past several years, the affairs of the Mutt have caused consternation in the minds of the devotees.
There have been several allegations of reckless squandering of the Mutt’s resources including sale of both moveable
and immovable properties by the peethadhipathi of Vyasaraja Mutt and its GPA holders. This has drawn adverse
attention in the media on various actions, including the present peethadhipathi (pontiff) being arrested by the Andhra
Pradesh police in a cheque bouncing matter and the very recent incident of selling valuable articles belonging to the
Mutt to a pawn broker in Mysore.
3. Shri B.R.G.K. Achar had filed a Writ Petition No. 7264/1991 before the Hon’ble High Court praying for
direction to enquire into the alienation of landed properties by the Mathadipathi of Sri Sosale Vyasaraja Mutt. The
Hon’ble High Court by its order dated 19.07.1996, allowed the said Writ Petition and directed the State Government
to look into the matter. Accordingly, the Government constituted an Enquiry Committee consisting of 4 members
headed by the Deputy Commissioner, Mysore District to enquire into the allegations. The Enquiry Committee pleaded
its inability to conduct an enquiry into the alienation of Mutt properties as these were located in neighbouring States
such as Andhra Pradesh and Tamil Nadu. Thereafter, the Government constituted a new Enquiry Committee
consisting of 6 members presided by the Commissioner of Religious and Charitable Endowments. At the time of the
enquiry, the petitioner Shri Achar was reported to be dead.

4. In the meanwhile, Shri Vyasaraja Seva Samithi (R), No.1236, 3rd Main, 7th Block, Banashankari, Bangalore,
submitted a representation to the Committee requesting to implead the Samithi in the Enquiry proceedings and
proceed with the Enquiry in the interest of the Mutt and its properties. After considering the said representation,
Government issued directions on 29.06.2007 as under:
“There is no need to make him a member of the Committee, he may be called by the Commissioner and his
views recorded”
5. Owing to non-cooperation by the members of the Enquiry Committee and lack of progress, the State
Government reconstituted the Committee on 13.10.2006 to be headed by the Endowment Commissioner and
consisting of 4 other members.
6. The Karnataka Hindu Religious Institutions and Charitable Endowments Act, 1977 came to be enacted with
effect from 1.05.2003. It repealed the Mysore Religious & Charitable Institutions Act, 1927. In the new enactment
there is no express provision for the takeover of the management of the Mutts. However, a proviso under Section 78(2)
of the said Act stipulates that Section 6 of the Karnataka General Clauses Act 1899 shall be applicable in respect of the
repealed enactment. The order of the High Court dated 19.7.1996 and subsequent enquiry and order may well attract
the saving clause 6 of the General Clauses Act.
7. The Enquiry Committee submitted its report to the Government on 3.9.2011. Following 11 allegations were
leveled against the Peetadhipathi of Shri Sosale Vyasaraja Mutt complaining about maladministration and squandering
of resources.
1. After handing over possession of the Old Choultry, belonging to the Mutt, the TTD authorities sanctioned
a site for construction of the new Choultry and the Peethadhipathi of the Mutt collected huge funds from
the devotees and constructed a building at a cost of Rs.1.85 Crores and leased out the 1st and 2nd floors
of the building to Shri N.C. Hari by collecting an advance of Rs.1.27 Crores and thereby the poor devotees
of the Mutt are deprived of the benefit of this Choultry.
2. Though there is an injunction by the Civil Court, the ;house situated in No. 4/220 Survey No. 2043 at
Govindarajapattanam of Tirupathi has been leased out for Rs.15.00 lakhs.
3. Though there is a written direction by the former peethadhipathi that no property be alienated, the house
situated in G.K. Temple street, Bangalore measuring 15 x 30 sq.ft has been mortgaged for a period of 5
years for Rs.75,000/- on 15.12.2006 by entering into an agreement.
4. The GPA entered in August 2010 for the sale of land measuring 559.29 acres situated in Survey No.1/1
in Pattemvenlapalli of Chittur district of Andhrapradesh in favour of Sri Papurajareddy has been
cancelled and the new GPA has been executed in favour of Shri Balaji.
5. Violation of the Government directions and the violation of Civil Court injunction by donating 1 acre of
land of the Mutt as found in the publication made in the Mysore Mithra news paper dated 1.09.2010.
6. Leasing of 3 properties in survey Number 1520/3,520/2A door No.205, T.S.No.1050/1, 2-B1 and
property No.60 situated in Annamandapam Road, Srirangam, Tamilnadu for a period of 29 years for less
rent than the Market rate without obtaining permission under Section 34 of the Madras Hindu Religious
and Charitable Endowments Act, 1957.
7. Sale of land measuring 79,000 Sq.ft. in survey No. 1208/22/2 situated in Madurai in Tamilnadu in
favour of K.Ramalingam and Sri P. Pandy for Rs.79 lakhs.
8. The flat No.2 measuring 5,959 sq.ft at Kolaigunta, Tirumala was earlier leased out for 30 years in favour
of N.C. Hari and brothers. Subsequently, the same property was again leased out in favour of

Sampathkumar Jain and Jaganlal for a period of 25 years for Rs.2.60 Crores and accepted an advance of
Rs.35.00 lakhs hiding the earlier lease transaction. As the earlier lessee did not handover possession of
the property, the 2nd advance received was returned with a penalty of Rs.35.00 lakhs to the 2nd lesses and
the said cheque of Rs.70.00 lakhs come to be bounced resulting in prosecution of the peethadipathi and
misappropriation of the fund of the Mutt.
9. A loan of Rs.25.00 lakhs is received by mortgaging the Vidya Payonidhi Mandir at Mysore in favour of
B.M. Soumya w/o Manjunath and Smt.M.P. Sandhya Rani and the said amount was credited to the
personal account of the Peetadhipathi leading to misappropriation.
10. Though there is a direction by the Government in order No. Kum.E.49 Muabi 1999, dated 28.3.2002 that
the prior permission of the Government should be obtained for the sale of the property of the Mutt, the
Peethadhipathi has sold the property of the Mutt by violating the Government Order.
11. Misappropriation of loan amount of Rs.97,000/- from Agasthya Credit Co-operative Society, Mysore by
pledging silver articles of the Mutt without crediting the loan amount to the Mutt account.
8. The Enquiry Committee, on detailed enquiry and after providing sufficient opportunities to the Mutt
authorities, arrived at a finding that the allegations of Sl.No.1,2,3,4,6,7,8,9,& 11 were proved and allegations at Sl.No.
5 and 10 were not proved.
9. The State Government has continued to receive several representations about illegalities committed by the
present pontiff, including sale of moveables, immoveables and misappropriation of funds. The documents at hand and
the Enquiry Report submitted by the Commissioner for Religious and Charitable Endowments prima-facie establish a
reckless alienation of properties, squandering and misappropriation of funds which amounts to criminal breach of
trust on the part of the Mutt authorities.
10. Further examination by the State Government indicates several instances of the Mathadipathi not honouring
the orders of the Courts. One instance relates to executing a GPA in favour of K. Ramalingam, for ostensibly gifting
the property of the Mutt at Madurai. The Mathadipathi obtained a collateral agreement from K.Ramalingam that he
would pay the rate of Rs.100 per sq.ft for 79,000 sq.ft of land at Madurai. This was virtually a sale in disguise in
violation of the powers of the matadhipathi to effect sales in that State. On knowing about this transaction, a notice
was given to the parties not to deal with the property of the Mutt at Madurai. According to the devotees, the
Mathadipathi suppressed an injunction order passed in OS No. 25765/2007 and obtained ex-parte order of injunction.
Thereafter, he executed 14 gift deeds disposing the property of the Mutt and received a sum of Rs.30.00 lakhs from K.
Ramalingam and others. This sum was deposited in Ing-Vysya Bank, Devaraj Urs Road, Mysore and has since been
withdrawn. These and other allegations are hereby looked into by courts, including the Supreme Court, examining the
issue of the contempt of court by the Matadhipathi.
11. The Government is concerned to note that a non-bailable warrant was issued against the present
peethadhipathi by a court in Andhra Pradesh which resulted in the release of the peethadhipathi on bail. This has
shocked the conscience of the devotees. There is an apprehension that the peethadhipathi is not discharging the
function befitting the position of a pontiff.
12. It is further observed that, various efforts made by the devotees to either stop or control undesirable state of
affairs have not been successful. Efforts were also made to give a quietus through a compromise formula proposed in
OS No. 2898/2005 before the City Civil Judge at Bangalore. As per the terms of compromise, the present pontiff would
relinquish the office of the Peetadhipathi of the Mutt and request the court to appoint a suitable person as the
Administrator. Accordingly, he swore to an affidavit dated 29.12.2011 which reads thus “I submit that as the
Peetadhipathi of the 1st defendant Mutt, in the past, I may have authorized and empowered J. Shukachar, Sosale
Prakash and certain other power of attorney holders to administer the affairs of the 1st defendant Mutt, I am not aware

of the documents that may be been executed by such persons as my agent and power of attorney holders. I was misled
by them stating that I was required to execute powers of attorney for managing the affairs of the Mutt”. However,
though, sworn to, the said affidavit was not filed by the present swamiji before the Court.
13. Since all reasonable efforts to bring in an amicable solution to the vexatious problem of Sosale Mutt have
failed, the devotees prayed that the State Government should intervene in the matter and appoint an Administrator to
ensure that the properties and valuables of the Mutt are fully protected.
14. The earlier Mysore Religious & Charitable Endowments Act, 1927 and Rules provided for the Government to
appoint an Administrator in religious institutions. Its successor Act which came into force from 1.5.2003 does not
contain such provision. The Government is, however, of the view that adequate materials on record exist to
corroborate the charges of blatant misappropriation, alienation of properties and squandering of funds at the behest of
the present Mathadipathi and his cohorts. Such actions on their part have been taken up in disregard of convention,
propriety and orders of courts.
15. Subsequent to detailed examination of the issue at various official levels by the Government, the opinion of
the Law Department was sought. The Law Department has opined:
“a) For the management of the secular functions of Sri Sosale Vyasaraja Mutt, namely the management of the
property of funds, an Administrator may be appointed for a period of two years or until further orders whichever is
earlier in order to secure proper management of the property of the Mutt.
b) The Administrator shall function under the directions of the Government which may be issued from time to
time, and the Administrator shall take documents of all the assets to prepare an inventory and ensure upto date
accounts.
c) The Administrator to take steps to identify all the properties alienated since 2004 and take action to recover
the same in accordance with law.
d) The religious functions of the Mutt including the daily pooja and rituals to the deities shall continue to be
conducted by the present Peethadhipathi.
e) The Administrator may be guided by the Committee consisting of three qualified individuals among the
followers of the Mutt appointed by the Government.”
16. Whenever misuse of resources and ransacking of properties have taken place in a religious institution, the
State Government in exercise of its sovereign powers has appointed individuals to administer the affairs of these
institutions. In the case of Vidyavarithi V/s Baluswamy (AIR 1902 PC 123), the Government of the Maharaja of
Mysore took over Management of the properties of Vyasaraj Mutt and appointed individuals to administer the same on
grounds of maladministration. This action of the Government was upheld by the Privy Council and it was stated that
Mathadipathi was a trustee and liable to account for the assets received and failure to do so renderd him liable for
criminal breach of trust under Section 409 IPC. The said decision is quoted with approval by the Supreme Court in
the case of Krishnasingh v/s Mathura Alvir (AIR 1980).
17. The State Government has examined the matter in the light of its inherent duties and obligations to protect
public resources handled by the religious institutions, despite there being no provision in the Karnataka Hindu
Religious Institution & Charitable Endowments Act, 1997 to take over management of the Mutts. In this context, the
decision of the Hon’ble Supreme Court in Rai Sahib Ram Jawaya Kapur and others Vs. The State of Punjab (AIR 1955
SC 549) is extremely relevant. The Supreme Court dwelt on the powers of the executive in the absence of legislation.
It cited an order of The Allahabad High Court in Motilal Vs. The Government of the State of Uttar Pradesh: “in the
opinion of these learned Judges an Act would be within the executive power of the State if it is not an Act which has
been assigned by the Constitution of India to other authorities or bodies and is not contrary to the provisions of any
law and does not encroach upon the legal rights of any member of the public.” The Supreme Court then observed

“..........The executive Government, however, can never go against the provisions of the Constitution or of any law. This
is clear from the provisions of Article 154 of the Constitution but, as we have already stated, it does not follow from this
that in order to enable the executive to function there must be a law already in existence and that the powers of the
executive are limited merely to the carrying out of these laws......”
18. To examine the veracity of the charges against Sri Vyasaraja Mutt, Government had constituted an Enquiry
Committee headed by the Endowment Commissioner. The report established the veracity of 9 from the 11 charges.
Speaking about the role and responsibilities of the head of a religious institution in AIR 1960 SC 889, Hon’ble
Supreme Court held that “failure to account, account of the properties entrusted to him or over which he has
dominion, even when a duty to account is imposed upon him, but where he is unable to account or renders an
explanation for failure to account which is untrue, an inference of misappropriation with dishonest intention may
readily be made”. The State Government is satisfied that a grave situation exists in the Vyasaraja Mutt, calling for
urgent intervention to protect the institution from further despoliation. It is now incumbent on the part of Government
of Karnataka to take appropriate action to protect the moveable and immoveable properties of the religious & charitable
institution which has more than 600 years of standing. The moveable articles are of tremendous heritage and antique
value and require to be protected to honour the sentiments of the devotees. Hon’ble Supreme Court in A.A.
Gopalakrishnan vs.Cochin Devaswom Board (2007) 7 SCC dealing with fraudulent transactions relating to temples and
religious and charitable institutions observed as follows:
“The properties of deities, temples and Devaswom Board requires to be protected and safeguarded by their
Trustees/Archaks/Shebiats/employees. Instances are many where persons entrusted with the duty of managing and
safeguarding the properties of temples, deities and devaswom boards, have usurped and misappropriated such
properties by setting up false claims of ownership or tenancy or adverse possession. This is possible only with the
passive or active collusion of the concerned authorities. Such acts of ‘fences eating the crops’ should be dealt with
sternly. The Government, members or trustees of Boards/Trusts, and devotees should be vigilant to prevent any such
usurpation or encouragement. It is also the duty of courts to protect and safeguard the properties of religious and
charitable institutions from wrongful claims or misappropriation”.
19. The State Government has examined the position of law and precedent which may be applied in the facts of
this case. In the light of the various judicial pronouncements, the State Government cannot remain a passive spectator
in the wake of wanton misuse of public property, abrogation of trust and wanton misconduct on the part of the present
Peethadhipathi of Sri Vyasaraja Mutt. It has a duty and obligation to resort to necessary reserve powers to intervene in
the situation and take appropriate action. After due consideration, and the State Government is of the opinion that
appointment of an Administrator is absolutely necessary to preserve, and safeguard the interests of the Mutt and
devotees.
20. Now, therefore, after considering the report of the Enquiry Committee, the opinion of the Law Department,
other related documents and circumstances surrounding the palpable bad state of affairs in the Sri Sosale Vyasaraja
Mutt, the Government is satisfied that a situation has arisen to exercise the powers vested with it under Article
31A read with Article 162, and to make the following order with regard to take over the management of Sri Sosale
Vyasaraja Mutt, and to appoint an Administrator to administer the affairs of the mutt.

After careful examination of records and in view of the circumstances explained in the preceding paras, the
State Government in public interest hereby order the take over of the Management and properties with all the assets,
both moveable and immovable, records, accounts, funds of Sri Sosale Vyasaraja Mutt, and all its attendant branches
and properties located in various parts of the country with immediate effect for an initial period of two years by an
Administrator appointed by the Government for the purpose.

2. The powers and functions of the Administrator are in the Annexure-I to this order.
3. The terms and conditions of the Administrator are in the Annexure-II to this order.

ANNEXURE-I TO GOVT. ORDER NO. RD 67 MUDAPRA 2002, DATED:
POWERS AND FUNCTIONS OF THE ADMINISTRATOR
1. The Administrator shall take possession of all the assets, both movable and immovable, accounts, records,
funds of the Mutt, prepare an inventory, ensure upto date accounts, and ensure orderly administration and
Management of activities in the Mutt .
2. The Administrator shall take steps to identify and recover all properties alienated since 1991 and report to the
Government the action taken to recover the same, in accordance with law.
3. The religious functions of the Mutt including the daily pooja and rituals to the deities shall continue to be
performed by the present Peethadhipathi of the Mutt and all its expenses shall be paid by the Administrator.
4. All financial transactions related to the Mutt shall vest with the Administrator who is authorized to recover
dues outstanding, incur expenditure in both secular and religious affairs of the Mutt.
5. The expenditure towards maintenance of Peethadhipathi, including his personal expenditure, if any, shall be
paid by the Administrator from the funds accruing to the Mutt.
6. The Administrator shall have complete control over the employees of the Mutt, including authority to take
action against them for their lapses in their duties and responsibilities.
7. The Administrator will have powers to appoint individuals for the superintendence of the Mutt to bring it to
order, especially in administration, legal management and finances, on such terms and conditions as he
deems fit.
8. The Administrator shall be the authority to sue or to be sued on behalf of Mutt in any Court of Law under the
direction of the Government.
9. The annual budget of the Mutt shall be approved by the Administrator and intimated to the Government for
the period till the Mutt is under the Administrator.
10. The Administrator will have the power to get the accounts of the Mutt audited by a qualified Chartered
Accountant.
11. The Administrator may be guided in the management of the affairs of the Mutt by a Committee consisting of
three or more qualified individuals, to be appointed by him with due intimation to Government.

ANNEXURE-II TO GOVT. ORDER NO. RD 67 MUDAPRA 2002, DATED:
TERMS AND CONDITIONS OF APPOINTMENT OF SRI K. JAIRAJ, IAS, ADMINISTRATOR,
SRI SOSALE VYASARAJA MUTT
1. The State Government will provide a vehicle for the use of the Administrator. Consumables for the said
vehicle, including repairs, will be met from the funds of Sri Vyasaraja Mutt.
2. The Services of a Driver will be made available from the State Government or any other public body on
deputation basis to the Vyasaraja Mutt for the use of the Administrator.
3. The Vyasaraja Mutt will meet the salary and allowances of the Driver.
4. The Administrator will be eligible to draw reasonable TA and DA in connection with the mutt affairs while on
tour.
5. The services of PS and PA will be made available by the Government for the use of the Administrator, and the
Mutt will meet the salary and allowances of these individuals.

Whereas the draft of the following rules further to amend the Karnataka Prosecutions and Government
Litigation (Recruitment) Rules, 2012, which was published as required by sub-section (2) of Section 3 of the Karnataka
State Civil Services Act, 1978 (Karnataka Act 14 of 1990) in Notificatin No. HD 122 PPE 2012, dated 09.05.2012 in Part
IV-A of the Karnataka Gazette (Extraordinary) dated 9th May 2012 inviting objections or suggestions from all the
persons likely to be affected thereby within fifteen days from the date of its publication in the official Gazette.
And whereas, the said Gazette was made available to the public on 9th May 2012.
Objections and suggestions have not been received.
Now therefore, in exercise of the powers conferred by sub-section (1) of Section – 3 read with Section 8 of the
Karnataka State Civil Services Act 1978 (Karnataka Act – 14 of 1990), the Government of Karnataka hereby make the
following rules namely:-
RULES
1. Title and commencement:- (1) These rules may be called the Karnataka Prosecutions and Government
Litigations (Recruitment)(Amendment) Rules, 2012.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Amendment of Schedule:- In the Karnataka Prosecutions and Government Litigations (Recruitment) Rules
2012, in the Schedule, in the entries relating to the category of the posts of "Public Prosecutors / Law Officer (Senior)"
at serial No. 3 in the column No.(8), the following shall be inserted at the end, namely:-
"Provided that if a person who has put in a service of not less than five years is not available for promotion, a
person who has put in a service of not less than three years may be considered for promotion."
