September 10, 2013 TO: City of Keller, Texas City Council Members Planning and Zoning Commission RE: Proposed Corner Store #1563 Northeast Corner Hwy. 377 & Ridge Point Parkway Keller, Texas Dear Council and Commission Members, CST Brands, Inc. has entered into a Purchase Contract through its subsidiary Big Diamond, LLC, to acquire a 3.961 acre parcel located at the northeast corner of Hwy 377 and Ridge Point Parkway from Engler Acquisition Partners, Ltd. The site is part of the Shops At Marshall Ridge planned development within the City of Keller. CST requests approval of a Specific Use Permit to allow the property to be developed as a Corner Store branded neighborhood market with Valero branded motor fuel and a drive-through car wash. The facility to be constructed will include a 7,800 sq. ft. building housing a 5,650 sq. ft. Corner Store convenience store with food service, a beverage center and an interior ATM banking facility. An attached 2,150 sq. ft. Subway restaurant with interior and patio seating areas will be in the same building. A separate building will house a drive-through car wash providing several levels of service choices. The fuel facility will be Valero branded with 10 fuel dispensers (20 fueling positions) with multiple grades of gasoline, E-85 and auto diesel fuel. Access will be provided by one driveway from each street and an interior cross-access drive connecting the remainder of the Shops At Marshall Ridge development. CST Brands, Inc. recognizes the style of living the City of Keller has established; a place recognized by CNN Money Magazine as a top 100 “Best Places to Live.” Mindful of this distinction, CST is proposing its preeminent Corner Store to date (excluding its travel center facilities). The facility, car wash, and fuel canopy will incorporate a distinguished facade with stone, brick and stucco material as well as feature prairie-style elements including porticos over the entrances, deep awnings over the fenestrations, and a ribbon of accent brick to accentuate the horizontal lines of the building in conformance with the Highway 377 North Corridor Overlay District and Marshall Ridge community development standards. Corporation’s Retail Division. It is a fortune 220 company listed on the New York Stock exchange as “CST”. The company owns or leases 1,036 company operated convenience stores throughout seven southwestern states with 630 stores located in Texas. In addition, it also operates nearly 900 store and fuel outlets in northeastern Canada. CST plans for aggressive development of facilities within major growth areas of its marketing area. Growth communities such as Keller are part of the company’s strategic growth plan. Corner Stores are managed and operated by direct company employees from the local area. The proposed facility will be part of the retail, business and office mixed-use planned for the Marshall Ridge project and will be compatible with the overall planned development. CST and the developer will provide expanded utility service into the area at their own expense. The development cost of the Corner Store facility will be in excess of $4.5 million, providing additional tax base to the city and school district. CST Brands believes that its stores provide a desired shopping facility offering multiple services needed by residents and businesses in the neighborhood and area. Such food items as Fresh Choice bakery goods, grilled items, prepared sandwiches, fresh baked kolaches, fresh fruit and salads, F-real milkshakes, Icee, Iced Tea, Cibolo Mountain coffees and cappuccinos and Subway menu items will add to the fresh food offerings. Carrying on Valero’s tradition of providing a great place to work, CST is creating amazing stores and a fun, hard-working environment where team members are proud to call CST Brands their employer of choice. The proposed Keller Corner Store will employ approximately 40 team members. The store will be an important flagship fixture in the heart of North Keller. The new store couldn’t be better located to serve our customers - offering a welcome stopping point for highway travelers, work commuters, in addition to the residential and school communities. Those of us at Corner Stores in the U.S. and eastern Canada and at Depanneur du Coin in Quebec, are about making our customers’ lives easier. From the fuel islands that allow for easy access and from inside the store where speed matters, we want to make it easy for our customers to get back on the road while providing them with the quality, value and freshness of our products that can’t be beat. In order to provide convenient, high visibility parking options to customers, CST is seeking a variance to allow parking to encroach into the required landscape buffer along Ridge Point Parkway. There is a 25’ (twenty-five feet) lot separating the Ridge Point Parkway right-of-way (ROW) and the proposed site. CST believes the desired visual appearance from the street will remain intact due to the adjoining lot’s existing landscaping, and it creates a larger buffer from the proposed parking to the ROW than the landscape buffer requires. CST will install the required landscaping per the Unified Development Code (UDC) within the remaining landscape buffer. As part of Valero’s recognizable trade appearance, CST is requesting a variance to allow the Valero teal and yellow colors to be used on the aluminum composite material (ACM)

of the fuel canopy fascia. The canopy will have the required standing-seam metal pitched roof, masonry wrapped columns to match the Corner Store, and the fascia will not be backlit all of which will provide an elevated fuel canopy aesthetic. CST is also seeking a variance to use two exterior ice merchandisers and one exterior propane merchandiser to better serve the public’s needs. To alleviate the visual impact of the exterior merchandisers from the street-view, CST is proposing to vinyl-wrap the ice merchandisers to match the adjacent store materials. In addition, CST will provide a freestanding, three-sided masonry enclosure designed in the spirit of the prairie-style freestanding, low masonry walls that will house the propane merchandiser. This ensures the merchandiser will not be seen from the street. The fire lane requires a 14’ (fourteen feet) vertical clearance to be maintained at all times. It is recommended by the fire reviewer to use ornamental trees in lieu of canopy trees adjacent to the fire lane to maintain the required clearance while retaining the tree’s aesthetic appeal. Per the fire reviewer’s recommendation, a variance is requested to allow all required canopy trees adjacent to the fire lane to be replaced with ornamental trees.
