Cundall bail conditions eased STAFF REPORTERS – THE MERCURY November 24, 2009 09:42am GARDENING guru Peter Cundall will be free to wander the waterfront this Christmas after bail conditions were altered. Mr Cundall was arrested along with 56 other protesters in Hobart last Friday during an anti pulp mill protest on Parliament House steps. Mr Cundall was charged with failing to comply with the directions of a police officer and bailed to appear in court in February. The bail conditions imposed on the protesters prevented them from areas of Hobart's waterfront - conditions roundly criticised by supporters. They say the waterfront restrictions are designed to restrict the movements of people charged with violence or anti-social behaviour - not 80-year-old protesters. Today police decided to change the bail conditions after a review by Southern District Commander Peter Edwards. "I believe it is appropriate that the conditions be varied so that the only requirement is for those charged to attend at the court at the time and on the date specified on their notice," Commander Edwards said. He has pleaded not guilty and is to appear in the Supreme Court later this month. The man appeared in the Hobart Magistrates Court yesterday for allegedly breaching his bail conditions by being arrested at the girl's home on Thursday

GARDENING guru Peter Cundall will be free to wander the waterfront this Christmas after bail conditions were altered.

Mr Cundall was arrested along with 56 other protesters in Hobart last Friday during an anti pulp mill protest on Parliament House steps. Mr Cundall was charged with failing to comply with the directions of a police officer and bailed to appear in court in February.

The bail conditions imposed on the protesters prevented them from areas of Hobart's waterfront - conditions roundly criticised by supporters. They say the waterfront restrictions are designed to restrict the movements of people charged with violence or anti-social behaviour - not 80-year-old protesters.

Today police decided to change the bail conditions after a review by Southern District Commander Peter Edwards.

"I believe it is appropriate that the conditions be varied so that the only requirement is for those charged to attend at the court at the time and on the date specified on their notice," Commander Edwards said.

"The conditions that restricted those charged from going to the Hobart waterfront are to be removed.

"I will be writing to each of the individuals concerned to inform them of this fact." he said.

She was granted conditional bail to reappear on February 15.

A FRAIL 82-year-old man extradited from Tasmania to Western Australia to face charges over a 1992 murder has withdrawn his bid for bail over concerns about who will care for him if he is released.Ronald Leslie Pennington was extradited from Tasmania, where he had been living in a New Town flat, earlier this year and charged with the murder of Perth woman Cariad Anderson-Slater nearly two decades ago.Mr Pennington was scheduled to make a bail application in the West Australian Supreme Court yesterday but his lawyer Linda Black said he had withdrawn his bid."The difficulty for Mr Pennington is he was extradited from Tasmania and has not lived in WA for some 20 years," Ms Black told the court."The difficulty he finds himself in is he has no family or friends or place to live in WA. He is deeply concerned about how he will find accommodation, who will care for him and who will feed him."During the brief court appearance, Mr Pennington relied on a walking stick to make his way into the dock.He will next appear in the Supreme Court on July 11. Ms Black said she had arranged for a psychiatrist to assess Mr Pennington to ensure he was fit to instruct his lawyers.

FOREST activists arrested in the Florentine Valley earlier this month will contest their bail conditions in court this afternoon.Environmental groups and the Tasmanian Greens are outraged at the bail conditions imposed by police, which prevent the protesters from entering Forestry Tasmania-operated land and from going within 5km of the Florentine Valley.Activist Bridget Gatenby was arrested on May 8 after allegedly chaining herself to a log truck.Police granted her bail on the condition that she stay at her family home at Mountain River from 7am to 3pm each day.The 21-year-old and 17 out of the 22 protesters arrested on May 10 have made an application to vary their bail conditions.The matter is due to be heard in the Hobart Magistrates Court this afternoon, but the media will be unable to report on the proceedings. The Justice Act prevents the media from reporting on bail application proceedings.

AN 18-year-old man was refused bail when he appeared in court today in relation to a home invasion on Sunday.Joshua Stephen Olding, of no fixed address, appeared on a count of trespass and two counts of common assault in relation to an incident in Pitt Ave, Trevallyn, at 1.45pm on Sunday.He was also charged with assault and trespass in relation to a second incident five hours later at the same address.One other male has been bailed to appear at a later date on a charge of assault.Police are still looking for two other males they believe were involved in the incident.
