dLaimed l)y the daimants i.e. KSh. 93,146.65 which is workedout at a modest fkure of 5 'per cen,t as a service oharge.The tourt must examlne tihe contents of clause 19 which lhas

been quoted hereinabove closely. This clause clearly states 'stheemployer will operate a service charge an'd the money 'collectedthrough the service charge shall kbe distrilbuted.'' lt is establishedthat t'he respondeats did not operate a servi'ce charge so tlleywere clearly in breach of dause 19 of the colleotive agreement.Naturally w'hen they did not collect a servico tharge there wasnothing to distribute. ilit is al'l very well for the respondentsto say that they ha'd noth'ing to distribute fbut they convenientlyoverlook' 'the fact that they wero required to olperate a serviceo'harge but did not. The reason they put forward for t'his wastha't t'hey had ito oll'er competitive rates in order to get businesj.The respondents slzould have taken the claimants into thmrconfidence in this matter an'd should have sought their agree-ment when they were formulatin'g m'tes to attraçt packapetours and should ltave made it clear to the claimants that lnorder to get business tihey did not propose to o'perate a servicecharge. They faileld to got the daimants' agreement to varyclause 19 and unilaterally proceedod to vary it to 't'he dis-a'dvantage of the workers. Operating a oollecting tbox at t'he'hotel is not .the same thing as 'charging a fi' xed servlce chargeon the bills !

The coumt is inolined to agree with the lindings' olf the M inistryof Laibour and linds t'hat the respondents were at fault in notincludin'g service charge in their rates on the 'package toursand for not obtainin'g the claimants' approval or agreementon this variation to clause 19 which requires them to operatea service charae. Thoy should Aave consulted the claimants onthis matter as tt is wrong for one patty to t'he collectike agrze-mont to doviate from it without ithe express agreement of thoother. 'rhe court, however, cannot overlobk tlzat the workersmust 'have receivTd some seaice charge either directly f romthe guests or throagh the collection box and the court according-ly has come to tho conclusion that it woul'd be f air under thecircumstances o'f this 'dispute that :0th parties should makeas sacrzce for the business that the resopndents attmcted at themateria'l time. The court awards t'hat the respondents yhouldpay their employee.s half of KSh. 93,146.65 by way of servicecharge which 'they should have collected but failed to do.This amount should be 'pai'd to t'he workers who were inemployment at the material time with the assistance of thelatbyur oëcer in 'charge of that area in collaboration wit'h theclaunana' ropresentatives. .

The claimants' demand against the respondents is based onthis figure which they maintained is 'the amount for servicecharge due to 'their menîbers who worked for 'the respondentsat the material 'time.The res'pondents maintained 'that no servlce clharge was madeon the bills in question and accordingly none is 'there for dis-tribuition. They stated that they llad operated a collection'box for tphe guests on package toturs from w'hich y11 servicecharge was distrilbuted. With esect from 1977 servlce ohargehad kbeen charged and distributed.The matter was discussed at the coas't area negotiating com-

mittee and then at the Joint Industrîal tcouncil but the rulingat 1b0th t'hese places was that as money was n'ot collected byway of service chargo there was nothin'g that could fbo dis-trilbuted.The claimants 'were not satiled with dtthis aàd. reported a
