South Lakeland Local Development Framework Land Allocations Development Plan Document – Further Consultation Gerald Eve LLP is instructed to submit further representations to the Council’s Land Allocations document, in relation to land at The Ghyll and Highlands, Brigsteer Road, Kendal. These representations follow initial representations submitted by Knight Frank (letter dated 8 April 2011) (ref: 135/HS/MC/RN) on behalf of our client and provides further details on these proposals. The representations make comments on the following sites:

• Site RN254 and RN279 (The Ghyll and Highlands) situated to the north of Brigsteer Road;

• Site R143 (Proposed extension to RN129M), to the north west of the Ghyll and south of Underbarrow Road.

In addition, we attach a site analysis and indicative layout proposal for this site, which shows how a well designed, small scale, low density residential proposal could come forward on the site and the benefits it could offer to the local community. This information has been discussed informally with the local member of Kendal Town Council who saw no major problems with the proposal. My client has also offered local residents the opportunity to inspect their plans and ask questions. Brief commentary is also provided in relation to an initial objection proposed to this allocation (by Mr Robert Boyd, dated 2 September 2011, 15.05pm) to clarify a couple of misunderstandings in relation to this proposed allocation. Site Analysis and Indicative Proposals (Prepared by JDA Architects) The conclusion of the initial site analysis is that the site could comfortably achieve 5 new detached dwellings (with a new access from Brigsteer Road), in the south western portion of the site and 3 new detached dwellings (accessed from Underbarrow Road), to the north east of the site (north of Highlands). Full details of the site analysis undertaken, and the key constraints to development of this site, is set out in the attached brochure. In brief summary, a list of the site constraints, commentary on how these matters may be improved and a summary of the wider benefits (in addition to assisting the Council in meeting its housing targets) of this proposal is set out below:

• Drainage / flooding – poor drainage through the south western portion of the site (fronting Brigsteer Road) has historically caused problems with flooding along Brigsteer Road close to the junction with Underwood, due to an inadequate culvert passing under Brigsteer Road and draining away to the east. These proposals offer the opportunity to significantly improve this situation. New residential development and the introduction of a new access roundabout offers the ideal opportunity to resolve this issue by introducing the appropriate drainage to ensure the site drains away to the east under Brigseteer Road.

• Highways safety – there have been a number of road traffic accidents along Brigsteer Road notably close to the access of the Ghyll/Highlands and along Brigsteer Road, close to the junction with Underwood. Initial highways advice suggests the most appropriate way to access the site is with the introduction of a new mini roundabout (as shown in the attached brochure) which would provide a safe access to this site while also acting as a natural safety mechanism, by slowing down traffic travelling away from Kendal along Brigsteer Road.

• Amenity open space – the site is currently privately owned with no access to the public. There is however an opportunity with this proposal to not only provide publically accessible amenity space on the site, but to provide public access through the site linking the existing amenity space to the east (on the opposite side of Brigsteer Road) and the proposed leisure allocation directly to the west.

Proposed Site Allocation RN254 & RN279 The attached brochure (and the brief explanation above) is hoped will assist the Council with its consideration of the appropriateness of this site for residential development. The site analysis and constraints plan demonstrate that the site is not appropriate for high density development, but does offer the opportunity for carefully designed low density development which would sit comfortably within the site context and offer an entirely appropriate ‘entrance’ to the town of Kendal. Proposed Site Allocation R143 Objections were previously raised to the western part of proposed allocation R129M (the fields directly to the west and north west of The Ghyll) due to the relationship with the National Park (to the west) and the impact this element could have of views into and out of the National Park. Those objections are considered to be even more relevant to proposal R143 as that site would be closer and more visible from the National Park. Our client therefore raises further objection to

proposed extension R143 on the basis of the relationship with the National Park and the significant impact new housing development would have on the important views into and out of the National Park. Responses to Land Allocations – Further Consultation In review of the comments made in relation to the Council’s further consultation have identified opposition to our clients proposed allocation from Mr Robert Boyd (dated 2 September 2011, 15.05pm). The key concerns of My Boyd relate to potential flooding problems if our clients’ site is developed and a potential rat run being created from Brigsteer Road to Underbarrow Road as a result of these proposals. To clarify, we reiterate the comments made earlier in this letter that a key benefit of the proposed residential development on our clients site (R129) is the potential to resolve existing flooding problems on that site and Brigsteer Road, with the introduction of an appropriate drainage system. With regard to a rat run being created from Brigsteer Road to Underbarrow Road, comments were raised previously that the site could assist with developing the residential development to the north with a secondary access to Brigsteer Road, but following further site analysis this does not appear to be practical and therefore the current proposals do not involve the creation of a through route from Brigsteer Road to Undebarrow Road. The proposal would not therefore create a rat run.
