TOTAL NUMBER OF VACANT POSTS IN THE MINISTRY OF EMPLOYMENT, LABOUR PRODUCTIVITY AND SKILLS DEVELOPMENT

MR M. REATILE (SPECIALLY ELECTED): asked the Minister of Employment, Labour Productivity and Skills Development to state:-

i) the total number of vacant posts in his Ministry and to provide the break down by Departments and Districts;

ii) the total number of temporary employees engaged to acquire experience; and

iii) the challenges that cause delay in filling in these vacant posts.

ACTING MINISTER OF EMPLOYMENT, LABOUR PRODUCTIVITY AND SKILLS DEVELOPMENT (MR MOLEFHI): The total number of vacant posts in my Ministry is 163 and the breakdown by Departments and locations at the Districts is as follows:

ii) My Ministry has engaged a total of 95 temporary employees to address the manpower needs and acquire experience.

iii) Mr Speaker, the challenges faced in filling the vacant posts in my Ministry are as follows:

a) A total of 116 out of 163 vacancies were inherited from former Ministry of Education and Skills Development when the ministries were re-organised in October 2016. These vacancies can only be transferred to my Ministry in the next financial year (2017/2018). Pending the transfer of vacancies by the Directorate of Public Service Management (DPSM), my Ministry remains unable to fill the vacancies;

b) For the remaining 47 out of the 163 vacancies, 13 have been advertised, and three (3) have been offered for occupation. This leaves a total number of 31 vacancies, which my Ministry is currently unable to advertise due to budget constraints. The advertisements will resume in April 2017; and

c) In some instances, it takes too long to fill some vacancies as some candidates turn down offers of appointment to posts tenable outside their preferred locations. I thank you Mr Speaker.

MR BOKO: Supplementary. Minister, the information that you have just shared, is it not public knowledge? Is it not part of some public document called an Establishment Register or you have stopped keeping that?

MR MOLEFHI: It is possible Mr Speaker that this information could be part of the information available in the public domain. The vacancies in ministries are not disaggregated in a manner that I have just tabulated. It just provides a global picture of where the vacancies exist. But like I said, part of the problem is that these vacancies are those that come from former Ministry of Education and Skills Development and have not become part of the integrated human resource profiling of our Ministry. Therefore, in the new dispensation as the new financial year begins, we shall incorporate these in our manpower registers and that would become part of what is available. Thank you Sir.

PROGRESS MADE ON FOOD RATIONING TO STUDENTS AS A SECOND MEAL AT KHWEE

PRIMARY SCHOOL

MR S. LELATISITSWE (BOTETI EAST): asked the Minister of Local Government and Rural Development:-

i) to state progress made on food rationing to students as a second meal during the day at Khwee Primary School;

ii) what caused the sudden stoppage of this practice which was beneficial to the Rural Area Development Programme students who are not housed in the school hostel;

iii) whether it is true that this sudden stoppage affected the performance of the said school; if so,

iv) when he will consider resuscitating this practice as a remedial programme to the situation as is now; and

v) what duties have been assigned to the council employee who was preparing the second meal at this school.

ASSISTANT MINISTER OF LOCAL GOVERNMENT AND RURAL DEVELOPMENT (MR VAN DER WESTHUIZEN): Mr Speaker,

(i) My Ministry has resumed provision of second meal to Khwee Primary School pupils effective 8th February 2017 following temporary suspense. Currently all 25 primary schools in the Boteti Sub-district including Khwee Primary School have been supplied with additional food commodities to facilitate provision of second meal which will last up to the end of June 2017.

(ii) Provision of second meal was briefly suspended following the passing on of the temporary employee who was engaged to prepare their second meals. However, arrangements have since

been made to use available kitchen staff to prepare first and second meals.

(iii) There are many factors that could affect students’ academic performance. We therefore cannot ascertain that the unavailability of second meal affected their performance, as ours is supplementary feeding.

(iv) As I have already indicated, provision of second meal has been restored effective 8th February 2017 and will be continued until the end of June 2017. To ensure that the supplementary feeding programme is carried out more efficiently, my Ministry will further decentralise procurement of staple food items of samp, sorghum and beans to the Local Authorities effective 1st April 2017.

(v) As I already explained As already explained, the employee who was engaged temporarily for additional kitchen work is late. Thank you.

SHORTAGE OF WATER AT KHUDUMELAPYE VILLAGE

MR N. M. NGAKA (TAKATOKWANE): asked the Minister of Land Management, Water and Sanitation Services:-

i) if he is aware that the people of Khudumelapye village drink and cook using;

a) water from the pond in the middle of the village;

b) the borehole which is contaminated by nitrates and was long rejected by the Department of Water Affairs; and

ii) when the two (2) boreholes were identified to rescue water shortage.

MINISTER OF LAND MANAGEMENT, WATER AND SANITATION SERVICES (MR MAELE): Mr Speaker,

(i) I am not aware that people of Khudumelapye village drink and cook using water from the pond or from any contaminated borehole. Notwithstanding, I am aware that there is supply deficit of 80 cubic per day in the village due to the decline in the yield of boreholes in 2015. Currently, bowsing can only avail 40 cubic a day. In the meanwhile, a borehole has been identified that needs to be equipped. We are in consultation with the owner of the identified borehole to sign a Memorandum of Agreement of Lease.

(ii) The two (2) boreholes identified are part of the Malwelwe-Botlhapatlou wellfield which its

development was completed in 2008. In total, there are twelve (12) boreholes in the wellfield. This wellfield was developed to augment supply to Molepolole, Thamaga and Thebephatshwa. Only six (6) boreholes were connected to supply the target areas in 2014.

At the time, the Khudumelapye borehole yield was continually declining. In 2015 a decision was made to use 2 of the remaining 6 boreholes in Malwelwe-Botlhapatlou wellfield to supply Khudumelapye.

(iii) Plans are underway to equip the 2 identified boreholes in Malwelwe-Botlhapatlou wellfields. Projects design phase to equip the boreholes is budgeted for under 2017/18 financial year and construction phase will be budgeted to start after completion of the project design. Thank you Mr Speaker.

WATER LEAKAGES AT PHILLIP MOSHOTLE PRIMARY SCHOOL

MR H. G. NKAIGWA (GABORONE NORTH): asked the Minister of Local Government and Rural Development:-

i) what is being done to address water leakages at Phillip Moshotle Primary School for the past five (5) years;

ii) how much has been spent in water bills for this primary school since 2012; and

iii) if he is aware that teachers are also experiencing the same water leakages; if so, who is expected to pay for such water leakages at teachers’ quarters.

ASSISTANT MINISTER OF LOCAL GOVERNMENT AND RURAL DEVELOPMENT (MR VAN DER WESTHUIZEN): Mr Speaker,

(i) my Ministry has been using in-house crew and handymen through the Gaborone City Council to address water leakages at Phillip Moshotle Primary School for the past 5 years. To date, there has never been a major leakage in the school’s sub water system to warrant major maintenance. My Ministry continues to prioritise measures to cut on the water loss due to leakages as part of its maintenance response through both outsourced and in-house maintenance crew; and in some institutions through the handymen programme as and when faults are reported by the users and/or tenants.

(ii) Mr Speaker, the total amount paid to Water Utilities Corporation (WUC) for Phillip Moshotle Primary School from 2012 to 2016 is P2 724 579.98.

(iii) I am alive to the fact that where there is plumbing, there is bound to be leakages. School teachers as tenants and the sole occupants of Council houses allocated to them, teachers have a responsibility to routinely inspect and note any unusual variations of the meter readings and report the same to Water Utilities Corporation or Gaborone City Council for assessment and corrective action. It is therefore the responsibility of tenants to pay for bills due from any unreported water loss, and of course being the only person who has full access to all fittings within and outside the rented premises at all times to note such leakages and faults. Thank you.

DR P. BUTALE: Supplementary. Thank you Mr Speaker. Minister, are you aware of the full extent of this problem because primary schools in Gaborone, many of them in my constituency, experience these water leakages that are reported, and the response is just appalling. They never respond on time and the teachers are then left with this burden. Are you happy with the response turnaround time from the various authorities that you have just mentioned?

MR VAN DER WESTHUIZEN: Mr Speaker, when I got the response from GCC, I then made a follow up to check on the response, and they assured me that the response is adequate. If there are any further problems with the response time, then I can still make a follow up on that.

i) the total number of vacant posts in his Ministry and provide the breakdown by departments and districts;

ii) the total number of temporary employees engaged to acquire experience; and

iii) the challenges that cause delay in filling in these vacant posts.

(i) The Ministry has 45 vacancies out of a total establishment of 522 posts. These vacancies are broken down as follows:

Headquarters; that is here in Gaborone - 23

Department of Mines in Gaborone – 14

Department of Mines in Francistown – 1

Geological Survey which has transitioned, but at the time of transitioning which is in Lobatse – 2

Department of Energy in Gaborone – 5

(ii) Presently there are no temporary employees engaged by the Ministry for purposes of acquiring experience.

(iii) The general trend where experienced personnel especially in the mining and engineering fields tend to prefer to work for the private sector hence making the filling of vacant posts very, very slow. I thank you Mr Speaker.

MR MOLALE: Thank you Mr Speaker. The general trend has been that across Government, there is slow uptake of this; and I am answering this wearing another hat. What we have agreed is that we are now going to cause ministries to take up more of these interns. Currently, there is work led by Honourable Kgathi and Honourable Olopeng to also see ways of how to improve that uptake and how to strengthen policy in that regard. We do hope that this will improve in the ultimate. Thank you.

PROGRESS MADE ON THE SELF HELP HOUSING AGENCY (SHHA) 2004/2006 BENEFICIARIES IN LETLHAKANE

MR S. LELATISITSWE (BOTETI EAST): asked the Minister of Local Government and Rural Development to state the:-

i) progress made on the Self Help Housing Agency (SHHA) 2004/2006 programme beneficiaries who are paying for loans without houses being built in Letlhakane;

ii) number of people affected; and

iii) when they will be attended to and how.

ASSISTANT MINISTER OF LOCAL GOVERNMENT AND RURAL DEVELOPMENT (MR VAN DER WESTHUIZEN): Mr Speaker,

(i) following the misappropriation of Self Help Housing Agency (SHHA) funds at Boteti Sub-District Council, there has been some delays in resolving the matter due to protected criminal investigations by the relevant authorities. The Council has since taken the decisions to consult the concerned beneficiaries with a view to either stop the loan requirements and/or subsequently refund them or enrol them into the programme.

(ii) There are 68 beneficiaries affected by the above.

(iii) The Council will conclude the matter by the 30th April 2017. Thank you.

ISSUANCE OF PRACTISING CERTIFICATES BY THE REGISTRAR OF THE HIGH COURT

MAJ. GEN. P. MOKGWARE (GABANE-MMANKGODI): asked the Minister of Defence, Justice and Security:-

i) if he is aware that attorneys who have been enrolled to practice take months to be issued with their practising certificates by the Registrar of the High Court; and

ii) what should be the turnaround time for issuance of the same soon after an attorney has been admitted to the Bar by the High Court.

MINISTER OF DEFENCE, JUSTICE AND SECURITY (MR KGATHI): My apologies for coming late.

i) Mr Speaker, Section 30 (1) of the Legal Practitioners Act (Cap 61:01), puts an obligation on the Registrar to issue a practising certificate to a legal practitioner within seven(7) days, provided the attorney applying for the certificate meets the set requirements as set out in the Act. However, I am aware that there are instances where it takes longer to issue practising certificates, where the attorney has not paid his/her annual subscription fee or in cases of first time applicants who fail to produce a certificate of pupillage.

ii) Mr Speaker, the turnaround time for the issuance of a practising certificate once an attorney has been admitted is seven days as stipulated in Section 30 (1) of the Legal Practitioners Act. Therefore any deviation from the set requirements amounts to non-compliance to service standards. I thank you Mr Speaker.

MAJ. GEN. MOKGWARE: Supplementary. Honourable Minister, are you saying that there are no delays in cases where the attorney has fully complied with the requirements? Is that what you are saying?

MR KGATHI: No, that is not what I am saying. Unless you have a particular case that you can bring forward to me. As I said when concluding, our service standards are set out gore you should do it within seven days. So anything that has gone beyond that, amounts to non-compliance with our service standards. So please come out, tell me of any particular case so that we can solve them.

MAJ. GEN. MOKGWARE: Supplementary. Honourable Minister, are you saying it is the first time for the Registrar to hear that there are people who are complaining about non-compliance with that particular turnaround time which you have just said, of seven days?

VACANT POSITION OF SOCIAL AND COMMUNITY DEVELOPMENT OFFICER IN

KHUDUMELAPYE

MR N. M. NGAKA (TAKATOKWANE): asked the Minister of Local Government and Rural Development if he is aware that there is no Social and Community Development officer in Khudumelapye; if so, how does this affect service delivery to the people.

ASSISTANT MINISTER OF LOCAL GOVERNMENT AND RURAL DEVELOPMENT (MR VAN DER WESTHUIZEN): Mr Speaker, I am

aware that Social and Community Development Officer position became vacant in September 2016 when the officer was transferred somewhere else. Since that time the village has been serviced by an officer from Letlhakeng who visits the village on Wednesdays and Thursdays every week.

An officer was recently transferred from Maboane to Khudumelapye in February 2017 and was introduced to the community on the 17th March 2017. The absence of an officer has not adversely affected service delivery as there was an officer giving service two days a week in the village, an arrangement that will continue for smooth handover. Thank you.

a. Their non-existence in the new structure due to optimization of resources through the organisational and methods review exercise.

b. Management decision to outsource some functions, making those posts redundant

c. Management deciding to hold out on some recruitment due to the impending restructuring exercise that I alluded to above.

b. MDCB i. Some vacancies were only to be recruited for after the directors for those functions were appointed.

ii. Candidates turned down our job offers due to non-competitive remuneration packages, and uncertainty surrounding the company.

iii. The company wanted to have some of the positions analysed and evaluated. The MDCB strategic plan will be reviewed once the company strategy and operational structure has been agreed to by the MDCB Board and approved by the shareholder. This process will most likely see the number of vacancies being reduced or restructured.

iv. The company took deliberate decisions not to fill some of the positions and rather use consultants on a needs basis, for a number of years, before filling the vacancies.

That is why the current CEO is working hard to make sure that all these negative consequences as a result are being dealt with. I thank you Mr Speaker.

STATUS OF A RURAL AREA DEVELOPMENT PROGRAMME HOSTEL CONSTRUCTED IN MMATSHUMO

MR S. LELATISITSWE (BOTETI EAST): asked the Minister of Local Government and Rural Development:-

(i) to apprise this Honourable House on the status of a Rural Area Development Programme hostel constructed around the year 2000 in Mmatshumo village;

(ii) how much was spent to construct the building;

(iii) who authorised construction of the hostels;

(iv) which company carried out the works;

(v) why the building was never occupied for intended use after handing over;

(vi) when the handover was done;

(vii) if it is appropriate that the building is currently used by a certain church and not serving the purpose for which it was built; and

(viii) how much is paid as rent and to who.

PLANS TO HAND OVER THE ADMINISTRATION OF THE INDUSTRIAL COURT TO THE ADMINISTRATION OF JUSTICE

MAJ. GEN. P. MOKGWARE (GABANE-MMANKGODI): asked the Minister of Employment, Labour Productivity and Skills Development:-

(i) if he has any plan to hand over the administration of the Industrial Court to the Administration of Justice and thus the Ministry of Defence, Justice and Security which has the mandate to administer other courts; and

(ii) whether this will not ensure that the appointment of Judges is done by an independent panel like the Judicial Service Commission and avoid the current secretive selection and appointment of these Judges.

ACTING MINISTER OF EMPLOYMENT, LABOUR PRODUCTIVITY AND SKILLS DEVELOPMENT (MR MOLEFHI): Mr Speaker,

i) Relocation of departments and agencies of Government are dependent on restructuring and rationalization of Government functions. There are currently no plans to restructure my Ministry, hence no plans to hand over the Industrial Court to the Administration of Justice.

MR N. M. NGAKA (TAKATOKWANE): asked the Minister of Local Government and Rural Development to update this Honourable House on incorporating the Kgare/Sebotswane settlement to Ditshegwane Village.

ASSISTANT MINISTER OF LOCAL GOVERNMENT AND RURAL DEVELOPMENT (MR VAN DER WESTHUIZEN): Mr Speaker, Kweneng District Council held a Kgotla meeting with the community of Kgare and Sebotswane settlement on the 24th October 2016 to consult the community on the prospect of incorporation. I will further call him to respond to the debate at 15:20 hours today and I will put the question at 15:30 hours. Honourable Minister, you have fifteen (15) minutes.

ACTING MINISTER OF EMPLOYMENT, LABOUR PRODUCTIVITY AND SKILLS DEVELOPMENT (MR MOLEFHI): Mr Chairperson ke a leboga, before I delve into the detail presentation, I want to bring the attention of colleagues to the correction of Page 2 and in particular Paragraph 2 of my presentation. You have been provided with single paper Page 2 for purposes of the corrected version. Mr Chairperson, allow me to present for consideration to this Honourable Committee the Industrial Court budget as proposed for the financial year 2017/2018. Allow me to further briefly outline some of the activities which relate to the core business and mandate of the Industrial Court that were carried out in the financial year 2016/2017. Mr Chairperson as at 31st December 2016 a total of 5, 239 cases were pending before courts out of which 1, 957 were registered in 2016…

MR MOLEFHI: Mr Chairperson, I am sympathetic but I do not think I have to summarise further the summary that is before this Honourable House.

Mr Chairperson, as at 31st December 2016, a total of 5 239 cases were pending before the courts, out of which 1 957 were registered in 2016 alone and 3 279 brought forward from previous years. Out of those that were brought forward 346 are considered backlog as they were more than 24 months old. Out of the 346 cases 12 are pending from 2004 to 2009 (2004-1, 2005-1, 2006-1, 2007-4, 2008-1, 2009-4). One hundred and thirty-two (132) cases were pending judgements as at 17th January 2017, whereas 209 cases are at different stages of case management.

Mr Chairperson, in an effort to reduce or eliminate delays in conclusion of cases by the Courts, several initiatives have been introduced. These include Case Management Reforms, and review of the Rules of Court which were completed in 2016/17. The Court Rules were provided in Braille as I trust this will go a long way in reducing

the margin of inconvenience often experienced by the category of our clients with compromised sight.

More initiatives are planned for financial year 2017/18 to enhance and improve systems for timely delivery of justice and more especially to address critical issues for case disposal. These are in the areas of Execution of Court Orders and Case Records Management Systems (CRMS). The use of manual systems of case management has resulted in the Court operating in an archaic and less productive environment. CRMS will be expected to positively impact on management and disposal of case records.

Mr Chairperson, regarding access to Justice, it is worthy to note that as at the year 2012 to date, the Court operates 2 Divisions in Gaborone and Francistown, with a total complement of nine (9) Judges; seven (7) in Gaborone and two (2) in Francistown.

The Court also operates Circuit Courts in other areas of Maun, Palapye, Selebi Phikwe, Kanye, Ghanzi, Letlhakane and Kasane to enhance its visibility and services. The Court has plans to expand to Maun and Selebi Phikwe. In 2016/17 the Court successfully procured premises in Selebi Phikwe and Kanye. These premises are old buildings which were previously used by other Government institutions. The Selebi Phikwe structures will be refurbished in 2017/18 financial year. In Maun, the Court rents premises, and full occupation is expected to be completed in 2017/18 financial year.

Mr Chairperson, the Trade Disputes Act 2016 has amongst other things, empowered the Office of the Registrar to directly manage and dispose some cases coming before the Court. These changes are expected to improve the turnaround time for cases referred to the Industrial Court.

The Industrial Court plans to find innovative ways to enhance access to justice through the use of electronic systems. A project on production of judgments in electronic form is at an advanced stage, and expected to commence in May 2017. Furthermore, in June 2017 the Court will commence the use of Short Message System (SMS) to communicate with clients. This initiative will assist to keep clients informed on the business of the Court, including notification of the outstanding documents to be filed, dates of hearings, judgment dates, and dates for collection of payments.

RECURRENT AND DEVELOPMENT BUDGET 2016/17

Mr Chairperson, I wish to give progress on the previous financial year’s expenditure, that is, the 2016/17 financial year.

The expenditure on the Recurrent Budget stood at Thirty-One Million, Seven Hundred and Ninety-Eight Thousand and Four Hundred and Thirty-Six Pula (P31,798,436) against a budget allocation of Forty-Two Million, Five Hundred and Six Thousand and One Hundred and Ten Pula (P42,506,110), representing an expenditure rate of 75 per cent.

Expenditure on the Development Budget stood at Five Hundred and Three Thousand and Four Hundred and Five Pula (P503, 405), against a budget allocation of Five Million, Nine Hundred and Eighty-Five Thousand Pula (P5, 985,000), giving an expenditure rate of 8 per cent. It is regrettable that the Court could not utilise the funds according to the plan. The budgeted project of Local Area Network (LAN) overhaul could not be implemented as it was withdrawn at the instruction of the Department of Information Technology (DIT) Technical Team. The cabling of the Maun Division of the Court could not commence due to delays in the partitioning of the building, which was coordinated by the then Ministry of Lands and Housing.

RECURRENT BUDGET 2017/18

Mr Chairperson, I propose a Recurrent Budget allocation of Forty-Three Million, Forty Thousand and Five Hundred Pula (P43, 040,500).

DEVELOPMENT BUDGET 2017/18

Mr Chairperson, I submit a proposal for a Development Budget allocation of Eight Million, Four Hundred and Sixty Thousand Pula (P8 460,000).

CONCLUSION

In conclusion, Mr Chairperson, I now move that the sum of Forty-Three Million, Forty Thousand and Five Hundred Pula (P43, 040,500) under the Recurrent Budget for Organisation 2100, be approved and stand part of the Schedule of Appropriation (2017/18) Bill 2017, and that the sum of Eight Million, Four Hundred and Sixty Thousand Pula (P8 460,000) for Organisation 2100 under the Development Budget be approved and stand part of those estimates for the 2017/18 financial year. I move accordingly. Thank you Mr Chairperson.

Mr Chairperson, about the Industrial Court, the first point I want to make is that the reason why we have backlog at the Industrial Court is because of the ineffectiveness of the Department of Labour. What we need Honourable Minister, is to set up a Commission for Conciliation, Mediation and Arbitration with a quasi-judicial function to deal with labour matters. The reason why I am proposing this independent body, it is because; (i) the Government sometimes has disputes as the employer, and you would need an independent body to deal with such matters.

(ii) The other thing is that, when you have an independent body equipped in terms of the enabling law, resources, expertise, you could have cases which end up at the Industrial Court being reduced in number because the Commission for Conciliation, Mediation and Arbitration (CCMA) with quasi-judicial function would have dealt with these cases. It is something that we really need to consider. I know that in the Revised Act, you tried to empower the Commissioner of Labour, but in our view, that is inadequate. We need an independent body to deal with such cases.

The other point I want to make Mr Chairperson is that, in terms of the Trade Disputes Act which establishes the Industrial Court, the Industrial Court is a court of law and equity. When you look at; I do not know if it is still Section 19, Section 15 establishes the court and Section 19 provides that this court would not be bound by rules of evidence or procedure and may disregard technical irregularity which may result in miscarriage of justice. This is equity. It is a court of law and equity.

Now, having made that point Mr Chairperson, there is a need to have a Labour Court of Appeal. The reason why I say we need to have a Labour Court of Appeal is that, because Industrial Court is a court of law and equity, that equity aspect is lost when cases are referred to the Court of Appeal on appeal, because there the Court of Appeal is bound by the rules of evidence and procedure, and cannot disregard technical irregularities which may result in miscarriage of justice. This can only be done or it is applicable in the Industrial Court.

This equity aspect, when cases are referred to the appeals court, they are subjected to the rules of honour, rules of procedure, rules of evidence and other technicalities, and the equity is lost. There is a need for a Labour Court of Appeal which will also not be bound by the rules of evidence and procedure, and may disregard irregularities which may result in miscarriage of justice.

The backlog of cases; Minister, why do you not employ Acting Judges to deal with the backlog? I think it is worth exploring. The High Court sometimes employs

Acting Judges for purposes of trying cases. This can also be explored at the Industrial Court for a specific purpose of dealing with the backlog of cases. I plead with you Minister that consider employing Acting Judges.

Honourable Minister, through you Mr Chairperson, I am reminded of a case in 2006 in which BCL machinemen were dismissed; I think they were about 200, after embarking on what the employer thought was an unprotected industrial action in a form of a strike. That case has not yet been resolved by the Industrial Court; from 2006. These people have been coming to the offices of Members of Parliament in Selebi Phikwe to say they are unable to get employment, even by companies which were sub-contracted by BCL because they are saying their case has not been resolved at the Industrial Court. If it can take more than ten (10) years for a case to be resolved, I think it is miscarriage of justice. Justice delayed is justice denied. Some people have died still waiting for the outcome of that case. I think it is important to employ Acting Judges to dispose of these cases.

The other argument which I have made before is that of the Industrial Court; the Government has reduced this court to some sort of a customary court. The reason why that it is the case is because, Honourable Minister, this court is not a creation of the Constitution but a creation of the Trade Disputes Act. This court must be a creation of the Constitution, with all the powers derived from the Constitution. Its Judges should be appointed in accordance with the advice of the Judicial Service Commission, not just a Judicial Service Commission but an improved Judicial Service Commission. The same argument we have made about the nomenclature of the Judicial Service Commission where you have the Judge President, who has been appointed by the President to his position as Judge President. The Chief Justice who has also been so appointed by the President to his position, the Attorney General, the Chairperson of the Public Service Commission, and another person preferred by the President, and then another member appointed by the Law Society. So, we have five (5) members of the Judicial Service Commission (JSC) loyal to the President, serving the interests of the Executive recommending for the appointment of Justices.

It is our considered view that we need to have an improved Judicial Service Commission recommending not just Justices of the High Court and Justices of the Court of Appeal, but also Justices of the Industrial Court. The manner in which Justices of the Industrial Court are appointed leaves a lot to be desired. Our suspicion has always been that Judges who are appointed in a manner that suggests that the Executive controls the appointment, these Judges sometimes, the

way in which they adjudicate cases, it is suspicious. We suspect that sometimes they serve the interests of the appointing authority; in this case, the President and/or the Executive. Let us have these Judges employed on recommendation of an improved JSC.

Lastly Honourable Minister, foreigners who serve in the Industrial Court are eligible for re-appointment. You see, His Lordship Abednego Tafa dealt with this point in his latest judgement on the Court of Appeal, that the appointment of a Judge on renewable contract is bad in the sense that it diminishes the independent mundaneness of a Judge. It is important that these Judges who are foreigners are appointed on a fixed term contract because security of tenure is very important for a serving Judge.

Having said that, I thank you Mr Chairperson.

ORGANISATION 2200 – MINISTRY OF YOUTH EMPOWERMENT, SPORT AND

CULTURE DEVELOPMENT

MR CHAIRPERSON: Honourable Members, 2 hours 25 minutes has been allocated to this organisation and I shall upon the Honourable Minister to reply to the debate at 17:25 hours today and the question will be put at 17:55 hours. Honourable Minister, you have 20 minutes, please present your budget proposal.

MINISTER OF YOUTH EMPOWERMENT, SPORT AND CULTURE DEVELOPMENT (MR OLOPENG): Thank you very much Mr Chairperson. Mr Chairperson, I handed over the presentation to Members sometime last week and I take it that they have gone through the presentation. Therefore I am going to summarise as much as I can, so that it can give them more time to debate this presentation.

Mr Chairperson, Honourable Members, I have the privilege to present my Ministry’s budget proposals for consideration and approval by this Honourable Committee for the financial year 2017/2018, under Organisation 2200. Allow me first to highlight progress on key programmes in the strategic areas of Youth Empowerment, Sport and Culture Development.

YOUTH EMPOWERMENT

Mr Chairperson, the majority of our population are young people under the age of 35. Young people therefore present a human capital opportunity for our country if they are seen as an important resource and not a problem. These statistics mean Botswana’s population pyramid is heavy at the bottom, and if we do not make significant investments on this population segment today, we run the risk of having an elderly population that is unable to support itself owing to missed opportunities at a stage when they were still youth. It is therefore imperative that all efforts are made to tap into the energy and creativity of our youth and also to develop our youth into model citizens for the development of our country in this globally competitive world. In this connection, my Ministry runs various programmes aimed at entrepreneurship development, youth advocacy and behavioural change, and job readiness skills for the youth. Ultimately, these will help the country harness this youth demographic dividend.

• Entrepreneurship Development

In the year under review, my Ministry received a total of two thousand, seven hundred and one (2,701) Youth Development Fund (YDF) applications. As at February 2017, 847 have been funded at a tune of P101 154 046.30, creating two thousand and seventy-four

(2,074) employment opportunities for young people. Adjudications and appraisals continue to be undertaken and it is expected that the entire budget allocation of P112 567 150 will be disbursed by the end of the current financial year.

Mr Chairperson, despite these good efforts, youth enterprises face challenges such as lack of operational space, high rentals, limited market access and lack of business management skills. To mitigate these, the Ministry is identifying and refurbishing old buildings, and is working on compilation of land banks for access to the youth. Furthermore, Government continues to introduce affirmative action initiatives in favour of the youth. This year exemptions on Public Procurement and Asset Disposal Board (PPADB) registration, procurement of tender documentation at fifty (50) per cent and reservation of selected services for youth were introduced. Significant progress was noted across ministries on implementation of the twenty (20) per cent quota reservation for youth, resulting in nine hundred and two (902) youth companies awarded tenders to the value of P106 201 689 across Government. Youth are also trained in business management to improve their skills and enhance sustainability of their businesses. As at February 2017, 1,481 youth had been trained on business management.

The Ministry will continue to evaluate and reform the Youth Development Fund to make it more effective and contributing to the country’s priorities. To improve market access for funded and other youth businesses, the Ministry now hosts an annual Youth Business Expo. The Expo brings together young business people and potential procuring entities.

• Behavioural Change

Mr Chairperson, our interventions on building the character of our youth continue as we seek to foster socially acceptable behaviour and discourage bad habits such as criminal activity, drug abuse, lack of respect for fellow citizens and institutions. In this regard the Ministry continues to collaborate with various youth serving organisations to provide psycho-social and character building interventions.

My Ministry is finalising a strategy on youth character building which will introduce a more effective approach to coordinating, monitoring and evaluating character building initiatives in the country for greater impact. A number of initiatives have been put in place financed through the Alcohol Levy Fund which includes consultative forums with the youth to solicit their input on the reduction of alcohol and drug abuse strategies, intensifying public education using different media

platforms as well as the refurbishment of 5 recreational centres with counselling services. The Ministry is working with stakeholders to select the 5 centres to be refurbished.

My Ministry intensifies the Human Immunodeficiency Virus/Acquired Immune Deficiency Syndrome (HIV/AIDS) campaign targeting the youth during the Month of Youth Against AIDS (which happens in March) each year. This is a targeted intervention aimed at high incidence areas across the country. This year, the Botswana National Youth Council (BNYC) is collaborating with different stakeholders to deliver messages on HIV/AIDS to young people across the country. This year, the Ministry once more leads the commemoration of the Month of Youth Against AIDS with the main event at Palapye and several district commemorations across the country.

Furthermore, the Ministry is focused on resuscitating youth character building organisations, particularly the Scouts and Girl Guides. To date, my Ministry has supported the Scout and Girl Guide movements both technically and financially to ensure they intensify on the mobilisation for youth enrolment. Currently in school Scouts troupes have one hundred and thirty-nine (139) clubs with four thousand, five hundred and eighty-six (4,586) members while those out of school stand at fifty-five (55) cubs with one thousand, seven hundred and six (1,706) members. Girl Guides has eighteen (18) clubs with five hundred and fourteen (514) members in schools and twelve (12) clubs with four hundred and twenty-five (425) membership for the out of school youth.

• On the Job Training and Attachments

Mr Chairperson, in the last sitting I talked about the challenges which face the youth, among which are poverty, unemployment and lack of work experience and skills mismatch with the job market, rendering them unemployable. Government continues to implement various schemes intended to provide the youth with opportunities for meaningful engagement and gaining employment readiness skills.

As at 31st January, 2017 enrolment in the National Internship Programme stood at three thousand, seven and fifty- six (3,756). Of these, two thousand, five hundred and sixty-seven (2,567) were enrolled in the public service; five hundred and twenty-five (525) with parastatals; whilst five hundred and twenty-eight (528) were with the private sector and one hundred and thirty-six (136) under the Non-Governmental Organisations. (NGOs). The transition of interns into employment has improved with 865 employed by different sectors during the period of April to January, 2017.

Botswana National Service Programme (BNSP) commonly known as Tirelo Sechaba, enrolment as at 31st January, 2017 was 15,290.

SPORT AND RECREATION

Mr Chairperson, It is evident that, participation in sport has a number of benefits such as socio-economic development, health and wellbeing and further enhances our national unity and pride. It is therefore necessary for Government to make resources available to promote sport excellence and encourage active lifestyles among our people. I am encouraged by the performance of our athletes over the last year especially those that represented the country well at the international competitions including Rio 2016 Olympics. I am hopeful, looking at the performance trends, that our athletes are motivated and will continue excelling at international stages and make our country proud. The number of medals accrued this financial year is 194. The total amount of incentives and appearance fees paid to national team players and coaches stand at P2 294 641.60.

National Fitness Programme

The National Fitness Programme (NFP) is an intervention designed to promote the engagement of all Batswana in physical fitness activity for wellness and recreation. My Ministry has set every second Friday of the month as Fitness Day. The programme continues to bear fruits as evidenced by participation at various outdoor gyms and participation levels captured on every second Friday of every month and the people jogging and deliberately walking for fitness along various walk ways. I would propose that you urge Members of this House to participate in this programme as leaders so that they lead by example Mr Chairperson. Participation levels captured on every second Friday of every month for the period under review has reached 10,017 participants exceeding the set target of 10,000. Currently three Outdoor Gyms are at tender stage. These will be constructed in Lobatse, Maun and Molepolole. My Ministry continues to explore ways of collaborating with stakeholders to construct more outdoor community gyms.

Sport for Development

Constituency Sport Tournament continues to attract a lot of out-of-school youths across the country to play sport. The participation levels for Cycle 3 of the 2016/17 financial year stand at 85,498. The tournament continues to have a positive impact on youth, with over 255 participants having joined mainstream league teams, while some volunteers who were officiating in the programme have since graduated and are officiating at the mainstream leagues. Mr Chairperson, given

the popularity of the programme and its benefits, my Ministry intends to include athletics in the Constituency Sport Tournament in the coming financial year...

DR P. BUTALE: On a point of clarification Mr Chairperson. Just a quick one, this 255, since when, is it since the inception of the programme or it is for a certain period of time? The 255 participants that have joined mainstream league teams.

MR OLOPENG: This is for the cycle not from inception, the current.

Sport Development

Mr Chairperson, as a way of building capacity in sport development, the Ministry continues to empower technical officials and coaches. Capacity building courses for coaches and mentors were conducted and a total of 754 coaches have been capacitated. The country participated at the 2016 African Union Sport Council Region 5 (AUSC Region 5) under 20 games in December in Angola and obtained 35 Medals (14 Gold; 14 Silver; 7 Bronze) and finished Position 2 out of the 10 countries. This is a commendable achievement given the fact that these athletes are being prepared for higher level games

The Ministry continues to implement programmes that assist excelling athletes in sport; these programmes are the Elite Scholarship and the Zebra Fund which are administered by the Botswana National Sport Commission. The Elite Scholarship Fund is designed to assist talented young sports performers to gain access to tertiary education at international institutions whilst attaining success at the highest levels within their chosen sport. For the year 2016/17, six (6) athletes were recommended for funding. Two (2) of these have already gone for further studies in the United States of America (USA).

The Minimum Governance Standards was introduced for National Sport Associations. This is to enable office bearers of National Sport Associations to uphold the highest levels of good corporate governance, and act in the best interests of the stakeholders that they represent amongst their clubs.

Anti-Doping

As a nation, we have done well over the years to retain compliance status with the World Anti-Doping Code. This past year nineteen (19) doping tests were conducted, for which all came out negative. Educational workshops

and awareness campaigns were conducted inclusive of those who participated in Rio 2016 Olympics.

Competitiveness in Sport

Botswana’s performance in sport is improving each year with Batswana athletes in various sport codes excelling at Regional, Continental and World level competitions. Twelve (12) Athletes, some of whom are beneficiaries of the Ministry’s programmes, competed at the Rio 2016 Olympics in August 2016. Some of these athletes made the country proud by reaching the final stages of the competitions.

Mr Chairperson, my Ministry continues to give incentives to national team players as per the Presidential Directive CAB. 7(B)/2012 with a view to motivate national team players with appearance fees, monthly allowances and performance incentives. This initiative continues to play a pivotal role in motivating national team players in their quest to achieve excellence in their chosen sport. In this financial year P2 294 641.60 has been paid to 294 national team players from different sporting codes as appearance fees, performance incentives and monthly allowances.

Hosting of Major Sporting Events

Sport in Botswana has grown to a level that it can now host major sporting events. This past financial year the country hosted the Africa Women in Sport Conference in which 205 delegates from 22 countries attended and P1 083 006.57 was spent for the event. The conference was the precursor to the upcoming International Working Group World Conference that the country will host on the 17th to 20th May 2018.

To prepare for readiness for the Netball World Youth Cup, the country hosted the Africa qualifiers for Netball World Youth Cup from the 24th -30th July 2016 where nine (9) countries took part. Therefore, Botswana will confidently be hosting the Netball World Youth Cup on the 8th –16th July 2017 where countries are expected to participate.

The country will also be hosting the World Softball Conference in October 2017, and the African Union Sport Council Region 5 (AUSC Region 5) youth games in December 2018. The AUSC Region 5 youth games are held on rotational basis every two years.

Sport Infrastructure

Mr Chairperson, improvements at the National Stadium were completed in preparation for the 2016 Independence Celebrations (BOT50). The improvements increased the seating capacity from 20,000 to 23,000. The Stadium is complete and functional at the present moment.

My Ministry continues to improve community sport fields, currently nine (9) community sport facilities are being improved with assistance from the Local Authorities. Improvements are being done at Charleshill, Letlhakeng, Rakops, Sefhare, Shakawe, Shoshong, Thamaga, Tlokweng and Tutume.

Sport Legislation and Governance

Mr Chairperson, Draft Regulations of the Botswana National Sport Commission (BNSC) Act are being developed to simplify implementation of the Act. The draft was presented to National Sport Associations in July 2016 and to the Board in November 2016, and are currently being considered by the Attorney General’s Chambers.

ARTS AND CULTURE

Mr Chairperson, preservation and promotion of the arts, culture and heritage of our nation are essential for social cohesion and national unity. The focus of the Ministry has been to consolidate the growth and appreciation of local arts and crafts while promoting economic gain from these activities. Opportunities continue to be provided through programmes such as cultural exchanges, President’s Day Celebrations and arts and culture grants among others.

Commercialisation of the Arts and Crafts

Government has, through Presidential Directive CAB. 1 (B)/2015, introduced a programme to Support Local Art and Crafts by providing an annual allocation of P7 670 485 which is administered by my Ministry. The funds have been spent on procurement of Performance Services and Arts and Crafts, and the proceeds went directly to the artists. Furthermore, all local radios stations played 100 per cent local music as part of the BOT50 Celebrations, and this contributed to increased royalties for artists.

Arts Talent Identification

Mr Chairperson, President’s Day celebrations are held across the country to unearth artistic talent and promote the culture of the different regions of our country. For this reporting period, 18,971 individuals participated in the programme compared to 14,739 in 2014. The total prize money increased from P2 864 500 in 2015 to P3 964 525 in 2016, a 38.4 per cent increase due to introduction of new categories.

Library and Information

Libraries remain the primary vehicle of choice in provision of information for communities to support information needs for leisure, communication, research,

and education in order to improve their lives. To this end, Libraries have diverse programmes which have registered an average of 3,988 participants and 24,900 visits per month. Currently, 71 public libraries are connected to the internet and Basic Information and Communications Technology (ICT) training for members of the public has registered 69,355 users compared to 66,911 users in the last financial year. Public awareness and response to the Legal Deposit Law is also gaining momentum and has had an increase in the National Heritage Collection to 9, 484 compared to the 8, 765 during this same time in the last financial year.

National Archives and Records Services

Mr Chairperson, the Botswana National Archives and Records Services (BNARS) is charged with preserving and documenting government and historical records, and ensuring public access to those documents, which comprise the National Archives.

In pursuit of this mandate, the Ministry has intensified inspections on records keeping practices in ministries and departments to provide guidance and ensure compliance with security of information, service delivery standard and preservation of records. In 2015/16 compliance level was 70 per cent and has since decreased slightly to 65 per cent in 2016/17. The inadequate management of semi current records at ministries was noted and will be addressed through engagement with the relevant ministries.

Most records at BNARS are in the public domain, enabling access to both local and international users. The level of usage of the archives has averaged 3.7 per cent since 2015/16. Diversity in the national documentary heritage achieved through the increase in the size of the collection increased from 26.3 per cent in 2015/16 to 58.7 per cent in 2016/17. The Department has introduced social media platform (Facebook) to improve accessibility, achieving 513,921 hits to date.

RECURRENT BUDGET

Mr Chairperson, allow me now to present the budget proposals under my Ministry for the financial year 2017/2018, starting with the Recurrent Budget.

I wish to propose the 2017/2018 Budget for the Ministry of Youth Empowerment, Sport and Culture Development in the sum of Eight Hundred and Forty-Three Million, Eight Hundred and Forty-Six Thousand, Six Hundred and Ten Pula (P843 846 610) representing a decrease of 6 per cent as compared to the 2016/2017 Budget. It should be noted that the 2016/17 Budget was more by P93 551 170 to cater for BOT50 activities which have since been concluded.

Headquarters

I submit a request for Five Hundred and Seventy-Four Million, Eight Hundred and Twenty-Five Thousand, and Two Hundred and Forty Pula (P574 825 240) for Ministry Headquarters. The provision shows a decrease of (13 per cent) Eighty-Four Million, Four Hundred and Forty-Five Thousand, Three Hundred Pula (P84 445 300) as compared to the 2016/2017 Budget.

Botswana National Archives and Records Services

I request an allocation of Twenty-Two Million, Five Hundred and Ninety-Eight Thousand, Eight Hundred and Eighty Pula (P22 598 880) for this Department. The provision shows an increase of (1 per cent) Two Hundred and Fifty-Eight Thousand, One Hundred and Eighty Pula (P258 180) as compared to the 2016/2017 Budget.

Department of National Service and Internship

I submit a request for Two Hundred and Forty-Six Million, and Four Hundred and Twenty-Two Thousand, Four Hundred and Ninety Pula (P246 422 490) for the Department of National Service and Internship. The largest share of this budget which is Two Hundred and Thirty-Four Million Four, Hundred and Sixty-Six Thousand, Three Hundred and Forty Pula (P234 466 340) or 95 per cent goes to Interns and National Service Allowances.

DEVELOPMENT BUDGET

Mr Chairperson, the total Development Budget for my Ministry for the 2017/2018 financial year is Thirty Four-Million, Six Hundred and Eighty-Six Thousand Pula (P34 686 000). This is a reduction of Eighteen Million, One Hundred and Ninety-Eight Thousand Pula (P18 198 000) from last year’s budget allocation of Fifty-Two Million, Eight Hundred and Eighty-Four Thousand Pula (P52 884 000) which represents about 34 per cent decrease.

Strengthening MYSC Operations

Mr Chairperson, a total of Six Million, Eight Hundred and Sixty-Two Thousand Pula (P6 862 000) is requested under this programme to undertake the following projects;

a) MYSC Computerisation at Three Million, Nine Hundred and Forty-Eight Thousand Pula (P 3 948 000) to develop the Ministry’s IT Infrastructure Project in regional and district offices to improve service delivery.

b) MYSC Fleet Expansion at Two Million, Five Hundred and Thirty-Eight Thousand Pula (P2 538

c) MYSC Information Systems Consultancy at Three Hundred and Seventy-Six Thousand Pula (P376 000) to engage consultants for the Ministry Information Management System, which is aimed at improving programmes management and monitoring.

MYSC Infrastructure

Mr Chairperson, a total of Twenty-Three Million, Five Hundred Thousand Pula (P23 500 000) is required to construct a roof on the Very Important Persons (VIP) Stand at the Francistown Sport Complex facility. The sport complex design has a roof on top of the VIP (Western) stand, which was deferred in previous years due to financial constraints. This will complete the scope of the Francistown Sports Complex.

Development of Cultural Infrastructure and Programmes

Mr Chairperson, I request a total budget of Four Million, Three Hundred and Twenty-Four Thousand Pula (P4 324 000) under this programme as Government contribution towards our partnership with the Sara and Robert Rothschild Family Foundation which has pledged to construct twenty (20) community libraries for Batswana. Government contribution is by way of providing equipment and furniture as well as constructing performance stages and ablution blocks at every community library constructed by the Foundation.

CONCLUSION

Mr Chairperson, this concludes my presentation of the 2017/2018 Recurrent and Development Budgets for my Ministry. I therefore move that the sum of Eight Hundred and Forty-Three Million, Eight Hundred and Forty-Six Thousand, Six Hundred and Ten Pula (P843 846 610) under Recurrent Budget for Organisation 2200 be approved and stand part of the Schedule of the Appropriation (2017/2018) Bill, and that the sum of Thirty-Four Million, Six Hundred and Eighty-Six Thousand Pula (P34 686 000) for Organisation 2200 under the Development Budget be approved and stand part of those Estimates for the financial year 2017/2018.

I also stand to support the Honourable Minister of Youth Empowerment, Sport and Culture Development, but to start with, to thank you Honourable Minister on a personal note that you received a call from a football team in my constituency where they requested for some sports equipment and I want to thank you that you decided to bring the donation through my office. They have requested me to thank you profoundly for the help and I wish you would continue to support and have the energy to ensure that young people are being assisted.

Just two points Honourable Minister; we have good programmes on the ground and we want to continue to thank you. We have seen the energy and the challenge that we are facing is implementation; the turnaround time. That is where we are having a big problem.

I still want to repeat what I have said in the past, we need to have a clear coordination between Government departments. You will find that for example; on your side, the Youth Development Fund (YDF) officials would have funded a group of young people, but they will struggle to get land. We still have problems such as that Honourable Minister. Please engage the Minister of Land Management, Water and Sanitation Services and ensure that these complaints Mr Minister, are put to rest.

We have a number of young people who have been funded and complaining that they have a problem of accessing land. If you look at the first page Honourable Minister of your presentation on entrepreneurship development, where 2 701 applications were received for the YDF and only 847 were successful, to me, that uptake is very, very low. It means that 1 854 applications were not successful. We need to know why, so that we are able to respond to why the uptake is very, very low. We are busy encouraging young people to ensure that they take advantage of these programmes, but then it becomes worrisome when the uptake is very, very low.

I want to support Honourable Batshu on youth officers more especially sent to rural areas. Let us ensure that we send very experienced people because they are required to support young people in rural areas who have been excluded from a number of things. Therefore, they need someone who is very experienced to ensure that they fill the gap found in those societies instead of sending newly qualified officers. They face challenges as Honourable Minister correctly said of impatience to try and support these kids.

The other point Honourable Minister, I humbly request you, we need an office ya Youth kwa Seronga. The terrain in my constituency is very, very difficult, you are aware of it. In my constituency, we are number two (2) in terms of poverty or being disadvantaged. Our kids are not doing very well in school. So, we need to be supported. We need an office in Seronga so that the catchment areas from Gudigwa, Beetsha, Gunitsoga, Ngarange le Sekondomboro can be assisted on the other side of the river instead of coming to Shakawe.

Currently Honourable Minister for your own information, the office in Shakawe is referred to as a satellite office. So, in most cases, young people are still referred to Gumare which was our complaint when we requested an office in Shakawe. Please assist us Honourable Minister with fully-fledged offices in Shakawe and Seronga.

Of course I want to support Honourable Minister Batshu; I want to agree with you, Tutume is a very big village. I think it is one of the centres in the northern side of the country. It is very unfortunate and sad that

they do not have a library. The same applies to Seronga; we want to thank you that at least we have a library in Shakawe. If I was requested to support Honourable Batshu, I will support him looking at the size of Tutume and the catchment areas in Tutume. I would support him for the call of a library in that area because I have seen the number of people in that area, it is very big.

Of course I do not want to be repetitive; my point Honourable Minister is on implementation. Otherwise you are trying your level best, you are doing a good job, but let us ensure that the affirmative action programmes as we have announced them to the young people, are put to practice and are adhered to by all departments. With those few remarks, I thank you.

Every time when we speak or purport to be quoting any statistic, we are often asked to provide sources; but the Member on the floor is suggesting that 70 per cent of police is made up of the youth and yet he is not helping us to understand where he gets those figures from. We are saying these are successes that will go a long way in terms of a legacy.

DR P. BUTALE (GABORONE CENTRAL): Thank you Madam Chairperson. I want to begin by cautioning the Minister responsible for the Youth that as a country, we are sitting on a time bomb and I want the Minister to register this, that our young people are increasingly losing hope. We have indeed condemned our young people to soul-sapping inactivity. As much as we are spending so much money as the Minister has been pointing out, there is very little to show Honourable Minister when you look at the lives of our young people. I have looked and listened to Honourable Member speaking here and I concur that something drastic has to be done to address the challenges facing our young people.

I agree with Honourable Molao when he was speaking about the change in terms of the way we approach these issues. I speak every time in Parliament about the need for us to stop reporting at the output level. He spoke in Setswana, and he said, “re se ka ra taboga ka dipalo gore re file banana ba le kae, bokae, re lebelele gore kwa bofelong jwa letsatsi, what change has that occasioned?” When I speak about outputs versus outcome, this is what I am talking about. We do not want to hear about

the activities of your ministry. We do not want to hear about the amount of money that you have squandered, we want to hear about the difference in the lives of these young people.

I also fully agree with Honourable Belle when he says that there is indeed a need…

MADAM CHAIRPERSON: It is Billy.

DR P. BUTALE: Oh! Yes I agree Madam Chairperson, it is Belle.

MADAM CHAIRPERSON: Hey! Not Belle, Billy.

DR P. BUTALE: I agree with Honourable Billy my brother, that there is need for evaluation. Honourable Minister, I always say this to you, that there is too much trial and error in your Ministry. You are throwing money left, right and centre. You are on some spending spree at your ministry. I think when you look back, you are going to see a lot of disaster in terms of the money that has been spent. When I talk about trial and error, how many of these programmes; you talk about Target 20 000, Boot Camp, Tirelo Sechaba, GV something, Internship and you are spending lots of money. How are these programmes integrated? How do they add onto one another? Right now all of them are full. You are not taking any more young people into this because you have not thought-out, you have not conceptualised exactly what you want to get. If somebody graduates from the Internship, where do they go, because you are not creating jobs? Internship is now like a permanent job. People who are supposed to be hiring our young people are exploiting them.

That is why I think we need to rethink Honourable Minister. Take all this money, put it in some strategic meeting, come up with a proper strategy that will help our young people and take these resources to put them to good use. I think what we are doing now is just wasteful expenditure that is not helping our young people. We need a properly thought-out strategy.

If you listen to an idea that I want to bring, a Four Pronged Approach would help you. A Four Pronged Approach based on supporting or support as one anchor point. You support through capacity development of young people. Currently I do not know in terms of capacitation, what is your approach? I meet young people who tell me, “we may not have money, we may be poor materially, but we are not poor mentally. We have a lot of ideas.

The problem is that the ministry concerned comes to us with ideas of their own, which we do not subscribe to”. Young people have ideas, and they want you to capacitate them within these ideas. This is why I always

talk about Amartya Sen who says, “Development has to be about capacitation.” You need to move away from, like Honourable Molao was saying, Mathematical estimations and gradations. The first thing you give is figures, figures, but we are talking about lives. We are talking about people who want to improve their lives. So, you need to listen to young people, listen to their ideas, and come up with a strategy that will work for our young people.

One of those ways is also to engage young people. I see Minister that you do try in your advocacy issues, but what I want to see is mainstreaming of youth issues in all spheres of development planning.

Youth is not about your ministry, it is about every other ministry. I was shocked when Honourable Kgathi was speaking earlier on purporting to paint this Government as a Government that loves the youth, and talking about the forces, and giving example of the forces that he so much misrepresents. I come from a constituency where there are Botswana Defence Force (BDF) camps and Prisons Department. Hey! I came to this Parliament and spoke about young people who have put their lives on the line to defend this nation, but they were staying in tents in Maruapula Special Support Group (SSG) Camp. You tell me that that is something to celebrate; because of this lack of good ideas, because you guys do not plan things; you spend on the run, now you want to come here and you want us to join you in celebrating mediocrity. We will not. We want proper ideas Honourable Minister. We like your energy; I personally like your energy, and if energy is properly harnessed, I guess we can then be able to arrive at a very good point.

MINISTER OF DEFENCE, JUSTICE AND SECURITY (MR KGATHI): Clarification. Ke a leboga Honourable Member. I want us as Parliament to be engaged at the idea level. When the Honourable Member speaks about the need to promote the arts, I brought a motion to this Parliament, about a creative economy policy. That is the kind of thinking that I want to encourage Members of Parliament to be engaged in. Creative policies that will ensure that we indeed help young people, our performers, and help our artist to ensure that we add value to this talent that they have. This is the kind of thinking; you cannot expect me to come here and support boot camp that you were trying it out. The moment you realised it was not working, you stopped it abruptly, with no evaluation. We do not even know why it did not work.

You come up with Tirelo Sechaba. I know at some point it would not work, and you will stop it. So, this trial and error, you are wasting our resources and you are condemning our young people to a life time of poverty.

If we look back as a country Honourable Minister, if you were to come here and tell us how much you are spending on this trial and error stock taking measures, and we look at whether there is value for money, I think all of us here would agree there is no value for money.

You make pronouncements that each constituency is eligible or can get access to P2 Million. How many constituencies here are getting the P2 Million; or Two Million worth? I can give any Honourable Member here who can stand up and say, every financial year my constituency or youth in my constituency are assisted with this P2 Million. It is just tokenism. You want people to think you are active. Honourable Minister, I said I love your energy, but the energy I think for me is also a problem. You are running away with our money. You are spending on the run, and there is very little to show for it. I think I am recommending here Honourable Minister, stop and evaluate the damage that you have done so far so that we can save money, and save the future of our young people. I thank you.

MS KENEWENDO: Clarification. Thank you Madam Chairperson and thank you Honourable Minister. Would you be willing to reconsider opening up the Internship Programme for the private sector, given that we are seeing that some of the interns in the private sector are actually working without even an allowance. They are suffering even more unlike before when they had a stipend from the Government. I will give you an example in the services sector where some of the waiters, waitresses and cleaners are put under an intern banner and are not being given anything and are just made to work for tips and are we looking at protecting those young people’s rights to ensure that at least they get a decent minimum wage? Thank you.

MR OLOPENG: Thank you Madam Chairperson. Thank you Honourable Member. Honourable Member, I think you are much aware that we used to post interns to private sector and then we had to stop that for the different reasons. The reason why we did that is because we have realised that some of the private companies, the moment they get interns into their companies they retrench permanent staff and labour ya bone depend upon the interns. We are really looking into that. If we happen to open to private sector again it will be with condition and the condition would be, if we give a private company interns, we would demand gore that company should top up ka 100 per cent of the allowance that young person is getting from Government. While you were discussing the issue of land and open spaces, can you please also quickly brief us on the status of those low hanging fruits that were said to help enable doing business environment for young people, in particular if we have managed to deal with the issue of trade licenses versus registration certificates that were given to young people operating at home? Thank you.

MR OLOPENG: Ke a leboga Honourable Member. I just want to know Honourable Minister whether your ministry is at all considering setting up a hub for arts because we have got very talented young people in this country which will position this country, as a regional hub for the arts and culture? Is this something that you are considering to set up, where all the artists, be it painting, tapestry and basket weaving where they can operate and actually position the country as an export for the arts in the region?

MR OLOPENG: Ke a leboga Madam Chairperson. Ke a leboga Honourable Member. There is this belief in this country ya gore for you to run a business, you have to be operating within a two hundred square metres. It is not like that, in other countries they operate within cubicles, di le well stocked. They think it is the responsibility of the Ministry of Youth Empowerment, Sport and Culture Development. It is wrong, as leaders we have to know, re rotloetse our Councillors at our ward level. Ke rotloetsa bongwanake to do this, ke batla thuso ya gago fa” and so on because we do not want to this thing just for the sake of funding young people. Re batla go bona maduo and so on.

I therefore, move that the sum of Eight Hundred and Forty-Three Million, Eight Hundred and Forty-Six Thousand, Six Hundred and Ten Pula (P843 846 610) under Recurrent Budget for Organisation 2200 be approved and stand part of the Schedule of Appropriation (2017/2018) Bill and Thirty-Four Million, Six Hundred and Eighty-Six Thousand Pula (P34 686 000) for Organisation 2200 under Development Budget be approved and stand part of these Estimates for the financial year 2017/2018. ORGANISATION 2300 - MINISTRY OF INFRASTRUCTURE AND HOUSING

DEVELOPMENT

MADAM CHAIRPERSON: Order! Honourable Members, let us move onto the Ministry of Infrastructure and Housing Development, and that is Organisation 2300. Please note that two (2) hours, five (5) minutes has been allocated to this organisation. I shall call upon the Honourable Minister to reply to the debate at 16:35 hours tomorrow and the question will be put at 17:05 hours. Honourable Minister, the floor is yours.

MINISTER OF INFRASTRUCTURE AND HOUSING DEVELOPMENT (MR MOLEFHI): Madam Chairperson, thank you very much.

INTRODUCTION

Madam Chairperson, Honourable Members, I am honoured to present my Ministry’s budget Estimates for the financial year 2017/18 under Organisation 2300 for consideration and approval by this Honourable Committee

The Ministry of Infrastructure and Housing Development (MIH) was established in October 2016 as a result of the re-organisation of the Government portfolio responsibilities. Infrastructure relates to construction and maintenance of Government buildings and Housing Development focuses on ensuring that citizens have access to affordable housing or shelter and promotes home ownership through affordable housing schemes.

The mandate of MIH primarily focuses on ensuring the development of sound and quality building infrastructure for use by Government. MIH also facilitates the development and growth of the construction industry through providing a conducive policy and legislative environment. Furthermore, the Ministry promotes dignified livelihood through provision of housing, as well as creating an enabling environment to facilitate other stakeholders to participate in housing delivery. As the custodian of National Housing Policy, the Ministry sets housing regulations and facilitates its implementation in partnership with stakeholders.

Notwithstanding that this Ministry was only established in October 2016, I will nevertheless apprise this Honourable House on some of the achievements realised by the Ministry as well as challenges encountered during the 2016/17 financial year.

PUBLIC BUILDING INFRASTRUCTURE

Madam Chairperson, as I indicated previously, this Ministry has established three (3) Registration Boards, being, the Engineers Registration Board, Architects Registration Council and the Quantity Surveyors Registration Council. These Boards are now making significant progress towards enforcing their relevant Acts.

Since coming into operation, the Engineers Registration Board, has received over 3, 600 applications of which 1, 050 were received during the year 2016 alone. So far 2, 651 engineers or 48 per cent of all applications received have already been registered, out of which 461 or 17 per cent are engineers employed by Government.

On the same note, the Architects Registration Council received 274 applications (architects / architectural technologists/architectural draftsperson) of which 169 architectural professionals have been registered.

The number of candidates issued with certificate of registration and practising certificate increased shortly following the examinations that were conducted in November 2016.

With regards to the Quantity Surveyors Registration Council, the founding Registrar was officially appointed in February 2016. The Council has since made commendable progress with regard to the establishment of its office whose function is among others to oversee the day to day administration activities of the Council including registration of Quantity Surveyors. The Council is expected to commence the registration of Quantity Surveyors as soon as the Quantity Surveyors Registration Regulations and the Code of Ethics are completed. Consultations on the completion of these documents are currently ongoing and expected to be finalised in due course. It is worth noting that the stated instruments are pivotal in guiding Professional Conduct Standards for Quantity Surveyors in Botswana and will thus play a critical role in facilitating the envisaged registration process.

The review of the Building Control Act has commenced and the Draft Inception Report was submitted by the consultant in December 2016. The reference group has already considered and approved the inception report and instructed the consultant to proceed to the next phase of the project. The approval of the inception report has paved way for the development and submission of the 1st Draft Revised Building Control Act as the next key milestone and is expected to be achieved by April/May 2017.

Madam Chairperson, as previously indicated during presentations to this Honourable House, my Ministry continues to create a self-regulatory environment in which the construction sector can develop and grow so as to meaningfully contribute to the growth of the country’s economy. In this regard the Construction Industry Authority Draft Bill was received from Attorney General’s Chambers on the 19th December 2016 for our perusal and comments. The target is to submit the Draft Bill to Cabinet for consideration during the first quarter of 2017/18 culmination in its submission to Parliament for consideration during the July Meeting.

Madam Chairperson, I would like to take this opportunity to update this Honourable Committee on the progress on some of the building infrastructure projects under my Ministry.

The Ministry continues to deploy the services of its Audit Teams to ensure that all new construction projects and procurement of offices and staff houses from the private sector service providers are fit for purpose at

completion stage or rental/purchase stage. From April 2016 to date, the Ministry has conducted sixty-one (61) inspections, twenty-four (24) of these inspections sought to establish whether the projects were ready for practical completion or handover. The remaining thirty-seven (37) inspections were ad-hoc and were aimed at helping ministries to decide on whether to purchase or rent the identified facilities.

The construction of Shakawe Primary Hospital has just been awarded at a contract amount of BWP 309,898,812.00. Currently the contractor is mobilizing on site; the project is expected to start in March 2017 and be completed by September 2019. The Ministry undertakes to complete the project within time, cost and quality/specifications.

The construction of the Forensic Science Laboratory for the Botswana Police Services in Gaborone was awarded in November 2016. The project, which is valued at BWP 267,627,547.00; started on the 9th January 2017 and is scheduled to be completed in April 2019. The Ministry is monitoring this project closely to ensure that it is finished within time, the agreed contract amount, and quality/specifications.

In addition, the construction of Mmathubudukwane Police Station and staff housing started on 9th January 2017 and will be completed in January 2019. The project was awarded at BWP161, 637, 159.00…
