I write in response to your Freedom of Information Act 2000 (or ‘FoIA 2000’) request dated

20/09/2018 in which you requested all College of Policing transactions over £25,000 for the

period of 25 months up to August 2018.

Decision

When a request for information is made under the FoIA 2000 a public authority must inform

you, when permitted, whether the information requested is held. It must then communicate

that information to you. If a public authority decides that it cannot comply with all or part of a

request, it must cite the appropriate section or exemption of the Act and provide you with an

explanation.

After conducting careful searches for information relevant to your request I can confirm that

there is information held. This has been disclosed to you in the accompanying document. Part

of the information has been withheld under section 40(2) FoIA 2000 because it constitutes

personal information. A detailed explanation of our decision can be found in Appendix A.

The College of Policing can neither confirm nor deny whether the disclosed information

represents all of the information held that would meet the terms of your request. This is

because the duty to comply with section 1(1)(a) of the FoIA 2000 does not apply by virtue of

section 23(5). Under s23(5) the duty to confirm or deny does not arise if, or to the extent

that, compliance with section 1(1)(a) would involve the disclosure of any information (whether

or not already recorded) which was directly or indirectly supplied to the public authority by, or

relates to, any of the bodies specified in section 23(3). This is an absolute exemption and a

public interest test is not required

Appendix A

Refusal Notice

Section 40(2) FOIA 2000 – Personal Information

Under section 40(2) by virtue of section 40(3A)(a), personal data of a third party can be withheld

if it would breach any of the data protection principles to disclose it. Personal data is defined in

section 3(2) of the Data Protection Act 2018 (DPA 2018) as ‘any information relating to an

identified or identifiable living individual’.

In this case the College of Policing has considered whether disclosure of the redacted personal

data would breach the first data protection principle, which states that ‘personal data shall be

processed fairly and lawfully.’ As the redacted information, alongside the information to be

disclosed, relates to salary information of identifiable individuals we consider that to disclose

the information in full would be unfair and therefore in breach of the first data protection

principle.

In order to provide the personal data of a third party we would have to seek their consent and

subsequently determine whether it was necessary to process their personal information.

Exception is given of course to those who hold senior positions within the College of Policing,

the UK police service, and the Police and Crime Commissioner, where there is an expectation

that such information would be disclosed with or without consent. We do not have, nor do we

consider it reasonable to seek the consent of the individuals concerned.

Section 40(2) in these circumstances is an absolute exemption and there is no requirement for

me to consider the public interest test. The College is committed to openness and transparency

and we consider that this commitment can sufficiently be met in disclosing the information with

the redactions applied.

Rights

If you are dissatisfied with the handling procedures or our decision made under the Freedom of

Information Act 2000 (the Act) regarding access to information you have a right to request an

internal review by the College of Policing.

Internal review requests should be made in writing, within forty (40) working days from the

date of the refusal notice and should be addressed to: FOI team, Central House, Beckwith

Knowle, Otley Road, Harrogate, North Yorkshire, HG3 1UF or via email:

The College of Policing will aim to respond to your request for internal review within 20 working

days.

The Information Commissioner

If, after lodging a review request you are still dissatisfied with the decision you may make an

application to the Information Commissioner’s Office (ICO) for a decision on whether the request

for information has been dealt with in accordance with the requirements of the Act.
