Charter school projects and the expansion of existing schools are providing opportunity for beleaguered con- struction and development businesses.  For construction companies, charter schools offer profitable work that is largely immune from broad- er economic trends. One firm,  Aventura- based ESJ Capital Partners, got started in charter school construction in 2008 and has completed sev- eral South Florida projects since, with more in the pipeline. Even construction industry giants like Turner Construction are getting involved in the sector. The fast-growing Chartwell Law Offices, which expanded from four attorneys to 66 since forming in Pennsylvania in 2002, started the new year by opening a Miami office. It brings in Jerome A. Pivnik and Caroline Nitsche Carlson, who have practiced together for more than 20 years in the litiga- tion boutique Pivnik & Nitsche and previously with Katten Muchin Zavis. The new partners specialize in property insurance defense work as well as commercial and em- ployment litigation. The Miami base is considered a jumping-off point for work along the Gulf Coast and in Latin America. Chartwell chief executive of- ficer Clifford A. Goldstein sees room for growth in the Miami of- fice and expansion beyond its 10 offices. Rick Scott has an early chance to fill a vacan- cy on the 4th District Court of Appeal. But he is stuck with a list of four finalists forwarded to his predeces- sor because the Judicial Nominating Commission is refusing to submit a new and expanded list. Scott’s general counsel asked the commission for the maximum six nomi- nees instead of the four sent to then-Gov. Charlie Crist. The JNC met behind closed doors and came out with the status quo. In a similar case decided by the Florida Supreme Court in 2009, the gov- ernor was told he had no authority to reject a JNC’s list or manipulate its pro- cedures.
