I spoke to Grant Moen of AnsiProducts who supplies our blood kits, and sure enough the Microject tubes have only 25 mg NaF compared to 100 mg in the BD Vacutainer tubes. He told me that the Microject tubes were added to the kits in error, and basically admitted it was their mistake. He also told me that according to their records, approximately 50 kits were affected since February 2010. I am trying to identify the affected bloods. Upon reading the affidavit you can tell that this is really a CDPHE compliance issue, so I was wondering if someone at your end might be in a position to respond with a counter-report stating that while the Microject tubes are not compliant, they don't affect the BAC result. Colorado Springs Police Department Metro Crime Laboratory Corrective Action Report

Initiator: Ian Fitch Incident or discovery date: May 25, 2010 Laboratory case number(s) affected (if applicable): Multiple CAR initiation date: May 27, 2010 CAR close-out date:________________ Description of non-conformance (to include how problem was discovered, effect on results or conclusions reported, other impact(s), etc.): 5/25/10 Dr. Fitch spoke with DUI Officer Christine Somersalmi about an affidavit from Rocky Mountain Labs stating our blood tubes did not comply with CDPHE guidelines. Apparently, BD Vacutainer tubes were replaced with Monoject tubes in some of our blood kits supplied by Ansci Products. RML measured the Sodium Fluoride (NaF ) concentration of a blood tube which came out to be 0.3% instead of >0.9%. Ian spoke with Grant Moen from Ansci Products who said that he remembers using the alternative tubes when BD were not available, and said he would email Dr. Fitch the specs on those tubes. Ian spoke to Cmdr. Pillard, CDPHE’s Howard Wells and Jeff Groff about this issue. The NaF is present to prevent bacterial growth. Dr. Fitch asked DNA analyst Sarah Brown to perform a literature search to determine the effects of lower NaF concentrations. 5/26/10 Grant Moen emailed Ian the specs on the Monoject tubes which shows that the Monoject have only 25 mg Sodium Fluoride compared to 100 mg in the BD Vacutainer tubes. He admitted the Monoject tubes should not have been placed in the kits, and offered to replace those kits. Ian responded, requesting more information so that we can define the scope of the issue. Moen stated that according to their records less than 50 kits contained the Monoject tubes in kits sent to our lab in February 2010. 5/27/10 Dr. Fitch went through all recent blood tubes in the BA fridge, and identified a total of 121 cases where blood was drawn into Monoject tubes. 5/28/10 Ian spoke with CDPHE’s Cynthia Burbach who stated that the NaF difference is a non-issue, and she’d be happy to testify to that effect, and has literature to support her opinion. Apparently, unless the subject was sick and had a high fever, the blood sample is unlikely to become infected such that fermentation occurs to produce endogenous ethanol. The NaF is added as a precaution, and while the CDPHE guideline states that blood samples should contain >0.9% NaF, it is not mandated. Cindy said that she and others in her lab have testified to this (non-)issue previously. 6/1/10

Office Specialist Jerry Gibson sent Dr. Fitch a worksheet that Dr. Fitch initiated with the 121 cases. Jerry, with volunteer Liza Romero’s help, added subject’s name, etc. Dr. Fitch asked Liza to double-check the cases by going through the boxes of stored blood samples. Liza identified one additional case, bringing the total to 122 (Note: in three cases, including #122, the Metro Crime Lab tested blood from a BD Vacutainer, but the second tube is a Monoject. In one case, the Metro Crime Lab tested from a Monoject, and the second tube is BD). 6/15/10 Dr. Fitch received a report from the CDPHE ( ), he suspected because the blood was drawn into a Monoject tube. The tube lot # on the Chain of Possession tube was 922607. Upon checking other Monoject tube cases, he confirmed this is the lot # of the Monoject tubes (Note: the tubes also have the number 352788 which may be written on the Chain of Possession instead). This represents case #123. Dr. Fitch emailed the DA’s office. Date/Initials: Dates above/ITF Root cause(s) (to include a description of any troubleshooting performed, and the investigative steps taken to identify the cause(s) of the problem): 5/27/10 The Metro Crime Laboratory has been using Ansci Products in Greeley, CO, to generate blood alcohol kits for a number of years. To our knowledge, they have always supplied the kits with BD Vacutainer tubes which contain 100 mg NaF and 20 mg Potassium Oxalate. These are the tubes specified in the lab’s Blood Manual. After speaking with Grant Moen, it is apparent that the company at some time in early 2010 had trouble getting the BD tubes and replaced them with Monoject tubes instead. These tubes have 25 mg NaF and 20 mg Potassium Oxalate. Both are grey-topped tubes. The company either failed to realize these tubes were not equivalent, or did not feel the lower NaF concentration was an issue. Grant Moen now understands that using Monoject tubes is unacceptable. The blood alcohol kits come in cardboard boxes containing plastic bags containing Styrofoam mailers containing two tubes. The kits also contain alcohol swabs and needle fixtures. The Metro Crime Lab has had no reason in the past to check these kits before taking them to the hospitals. Therefore, lab personnel were not aware that some kits contained Monoject tubes. The phlebotomists clearly just used the kits as usual. Dr. Fitch spoke with Senior Forensic Chemist Bobby Striebel 5/27/10 who has analyzed most of the 121 Monoject blood samples, and Bobby stated he had not noticed the change in tubes. Date/Initials: Dates above/ITF Description of Corrective Action Plan (to be completed following a discussion with the QAM, and TUL, if applicable): 5/27/10 The Metro Crime Lab needs to ensure that no more blood samples are drawn into Monoject tubes. Therefore, lab personnel will check each kit before it is taken to the hospitals. On 5/26/10, Dr. Fitch went to Memorial Central Hospital to ensure all kits at the hospital had BD tubes. None had the Monoject tubes. On 5/27/10, he did the same for the Memorial North Hospital. He identified seven kits with Monoject tubes and removed them. On 5/27/10, Dr. Fitch also emailed Lt. Buckley in charge of the CSPD DUI officers and told her to ensure that the phlebotomist(s) who deploys with the mobile blood alcohol vehicle ensure that they use kits with BD tubes.

According to lab records, 1000 blood alcohol kits were shipped to the lab in January or February 2010. Until all of these kits are depleted, lab personnel will check each kit for BD tubes before going to the hospital. 5/28/10 Cynthia Burbach sent Dr. Fitch the contact for the company the CPDHE use for their blood kits. As part of our corrective action plan, we will stop using Ansci Products once we have used up all of the kits we have, and switch to Therapak. 6/1/10 Dr. Fitch spoke with an officer from Teller County Sheriff’s Office and asked that he bring in all blood kits so that we can check them. He did so the following day. All 18 kits were fine. 6/3/10 Dr. Fitch emailed Lt. Buckley to ask that all kits in patrol vehicles, or elsewhere, be checked to ensure they contain BD Vacutainer tubes. Based on some literature Cynthia Burbach sent him, Dr. Fitch wrote an affidavit explaining why in his opinion the use on Monoject tubes should have no effect on the blood alcohol results. Dr. Fitch sent it to Officer Somersalmi for her DOR hearing. He also sent it to the DA’s office, who will forward it to all 122 subjects. Dr. Fitch also asked Ms. Burbach to write an affidavit. She agreed. 6/24/10 Cynthia Burbach emailed Dr. Fitch her affidavit addressing the sodium fluoride issue. Dr. Fitch forwarded it to the DA’s office and DUI Officer Christine Somersalmi. 9/21/10 Office Specialist Jerry Gibson started picking up Therapak kits from the CDPHE sometime in August. These will be used instead of Ansci Products’ kits from now on. CDPHE requests for the various agencies in El Paso County were sent to us by the CDPHE (as .pdfs), and binders containing these requests were placed in both Memorial Hospitals so that they can be filled out whenever blood is drawn for blood-alcohol analysis into the Therapak kits.
