the District Court of Cheyenne County, Nebraska, in an action pending in said Court wherein Rita A. Sutton and Kai Carlson are plaintiffs and Helen Killham, et al are defendants, and 3RP Operating, Inc. is Intervenor, directing me as Referee to sell the following described prop-erty, to-wit:

The working interest in two oil wells on the following described real estate:

Township 15 North, Range 52, West of the 6th P.M., Cheyenne County, Nebraska

Section 1: SW1/4consisting of the leasehold

interest granted to Lessee by “OIL AND GAS LEASE” dated the 14th day of January, 1981, wherein Helen S. Policky, Personal Representative of the Estate of Christina Carlson is named as “Lessor” and C & S Production Company of Sidney, Nebraska, a joint venture which includes Jack L. Scoville and Fred L. Carlson is named as “Lessee”; and also consisting of various items of personal property generally described as two pumping units, two storage tanks and related miscellaneous equipment. (A more complete equipment list will be supplied by the referee upon request.) The property will be sold as one unit.

I will sell said property at public auction on the 18th day of December, 2015, at 9:00 a.m. at the east door of the Courthouse in Sidney, Nebraska, said sale to remain open for thirty minutes and as long thereafter as active bidding continues.

Terms of sale are twenty-five percent (25%) cash down on day of sale and the entire bal-

ance on confirmation of sale by the Court.

Buyer will receive posses-sion of the property on confir-mation of sale by the Court, payment of the balance of the purchase price and delivery of the Referee’s sale transfer doc-ument.

The property will be sold “as is” with no warranty, express or implied, as to either the condi-tion of the equipment or as to the current validity of the lease-hold interest.
