AN ACT TO EXCHANGE UNDEVELOPABLE LOTS WITIDN THE PIGUA SUBDIVISION "LAND FOR THE LANDLESS PROJECT", DESIGNATED IN PUBLIC LAW 25-181, WITH OTHER LOTS IN DEDEDO.

1 BE IT ENACTED BY THE PEOPLE OF GUAM:

2 Section 1. Legislative Findings and Intent. I Liheslaturan Guahan finds

3 that certain lots already awarded to thirty-one (31) families in the Pigua

4 Subdivision, Municipality of Merizo, known as the "Land for the Landless

5 Project", are undevelopable and were to be exchanged with thirty-one (31) lots

1 administered by the Chamorro Land Trust Commission. I Liheslaturan Guahan

2 further finds that Public Law 25-181, enacted on January 8, 2001, enumerating the

3 thirty-one (31) lots, and authorizing the Chamorro Land Trust Commission and I

4 Maga 'lahen Guahan to exchange said undevelopable lots within the Pigua

5 Subdivision was not implemented because the Chamorro Land Trust Commission

6 did not have the funds to conduct the required survey to effectuate the exchange. I

7 Liheslatura intends to have suitable lots situated under Tract 1113, Municipality of

8 Dededo, reserved under the Department of Land Management for the purpose of

9 land exchanges, be exchanged so the aforementioned awardees can proceed in

10 building much needed homes for their families.

11 Section 2. Lots in Tract 1113, Government of Guam, Land for the

12 Landless Subdivision. Notwithstanding any other provision of law, the

13 Department of Land Management and I Maga 'lahen Guahan are authorized to

14 exchange Block No.7, Lot No.1, Tract No. 3821, Pigua Subdivision, Municipality

15 of Merizo, owned by Dolores T. Hernandez, also known as Dolores T. Hernandez

16 Pangelinan, with a lot within Tract 1113, Block 13, Lot 4, Municipality of Dededo,

17 owned by the government of Guam. The Department of Land Management shall

18 administer the exchange of lands, within ninety (90) days upon enactment of this

19 Act.

20 Section 3. Other Undevelopable Lots within the Pigua Subdivision.

21 Owners of the remaining thirty (30) lots enumerated in Public Law 25-181 shall

22 have the option to request for land exchange within Tract 1113, Municipality of

23 Dededo, owned by the government of Guam, or wait until the Chamorro Land

24 Trust Commission can survey the property identified under Public Law 25-181.

25 Should the landowners identified in Public Law 25-181 desire to exchange their

26 lots in Tract 3821, Merizo, with lots in Tract 1113, Dededo, the Department of

27 Land Management and I Maga 'lahen Guahan are authorized to exchange their lots

1 in Tract 3821, Municipality of Merizo with lots within Tract 1113, Municipality of

2 Dededo, owned by the government of Guam. The Department of Land

3 Management shall administer the exchange of lands within ninety (90) days upon

4 enactment of this Act. Notice of said exchange shall be reported to the Speaker of

5 I Liheslaturan Guahan and I Maga 'lahen Guahan.

6 Section 4. Waiver of Appraisal Requirements. The requirement for

7 independent appraisal is waived since this is property being exchanged from one

8 ( 1) government subdivision to another.

9 Section 5. Notwithstanding any other provision of law, Block 10 Lot

10 Number 7, Block 10 Lot Number 8, Block 10 Lot Number 9, and Block 10 Lot

11 Number 10, of Tract 3821, Pigua Subdivision, Municipality of Merizo as described

12 in Section 3 of Public Law 25-181, shall be reserved for community use by the

13 residents of Merizo.

I. OVERVIEW

The Committee on Appropriations, Taxation, Banking, Insurance, Retirement, and Land convened a public hearing December 16, 2010, at I Liheslatura 's Public Hearing Room.

Public Notice Requirements Notices were disseminated via hand-delivery and email to all senators an all main media broadcasting outlets on December 9 (5 day notice), and again on December 14 ( 48 hour notice).

Senator pangelinan: The next item on the agenda is Bill481-30 (COR) We have signed up, Mrs. Pangelinan. Please come forward.

Bill481-30 (COR) was introduced by Senator Calvo and co-sponsored by Senator Tony Ada and I would like to give the opportunity to Senator Tony Ada. Please give us a brief synopsis on the bill.

Senator Tony Ada: Thank you Mr. Chairman. Mr. Chairman and panel this bill is an act to exchange undevelopable lots within the Pigua subdivision under the "Land for the Landless Project" designated in Public Law 25-181. What Mrs. Pangelinan would like to do is to get a lot in Dededo which is has been identified by the Dept. of Land Management and we all have a copy ofthe map on TRACT 1113 to exchange the lot for that and this bill intends to authorize that exchange from Pigua to Dededo. Thank you Mr. Chairman.

1. Dolores Pangelinan, resident

Dolores Pangelinan: Thank you Senators I just need your help. My name is Dolores Pangelinan and I have been landless for the longest time. The place is on an undeveloped area. I pay my share for the landless since I identified property in Dededo. If you give me the opportunity I can build me a place for me and my kids.

So I don't have to be renting for the longest time and not throw away my money on rent. I am already a great grandmother and I have nothing to share with my kids. Since there is a property identified. I am just asking for your help.

Panel Comments and Questions

Senator pangelinan: Thank you very much Mrs. Pangelinan. The property that you were given was under the land for the landless and then when we found out that when the property was not developable they exchange the property with Chamorro Land Trust property and allowed you to give up your land for the landless and take the Chamorro Land Trust property that was supposed to be developable and the Chamorro Land Trust has not acted on that at all?

Dolores Pangelinan: Yes.

Senator pangelinan: Ok so that's why we are here. There may have been other lots in the Chamorro Land Trust properties that are also not developable so we have to find another site. This would allow you to exchange for property in Dededo that have been set aside for the purpose of land exchanges. You are satisfied with that site?

Dolores Pangelinan: Yes.

Senator pangelinan: Alright. Any other questions or comments? We hear your plea and we'll what we can to bring this issue to a close so you could full fill your dream. You have paid up the property?

Dolores Pangelinan: Yes it has been paid up for almost 10 years.

AN ACT TO EXCHANGE UNDEVELOPABLE LOTS WITHIN THE PIGUA SUBDIVISION 11LAND FOR THE LANDLESS PROJECT" DESIGNATED IN PUBLIC LAW 25-181 WITH OTHER LOTS IN DEDEDO

1 BE IT ENACTED BY THE PEOPLE OF GUAM:

2 Section 1. Legislative Findings and Intent. I Liheslaturan Guahan

3 finds that certain lots finds already awarded to twenty-seven (27) families

4 in the Pigua Subdivision, Municipality of Merizo, known as the "Land for

5 the Landless Project are undevelopable and were to be exchanged with

6 twenty-seven lots administered by Chamorro Land Trust. I Liheslaturan

7 Guahan further finds Public Law 25-181 enacted on January 8, 2001

8 enumerating the twenty-seven (27) lots, authorizing the Chamorro Land

9 Trust and I Maga'lahen Guahan to exchange said undevelopable lots within

10 the Pigua Subdivision was not implemented because Chamorro Land Trust

11 did not have the funds to conduct the required survey to effectuate the

12 exchange. I Liheslatura intends to have suitable lots situated under Tract

1 1113, Municipality of Dededo reserved under the Department of Land

2 Management for the purpose of land exchanges be exchanged so the

3 aforementioned awardees can proceed in building much needed homes for

4 their families.

5 Section 2.Lots in Tract 1113, Government of Guam, Land for the

6 Landless Subdivision. I Mag a 'lahen Guahan is hereby authorized to

7 exchange a lot within Tract 1113, Municipality of Dededo, owned by the

8 government of Guam with Block 7, Lot 1, Tract 3821 located at the Pigua

9 Subdivision in the Municipality of Merizo. The Department of Land

1 o Management shall administer the exchange of lands, within ninety (90)

11 days upon enactment of this Act.


13 Owners of the remaining twenty-six (26) lots enumerated in Public Law 25-

14 181 shall have the option to request for land exchange within Tract 1113,

15 Municipality of Dededo, owned by the government of Guam or wait until

16 Chamorro Land Trust can survey the property identified under Public Law

17 25-181. Should the landowners identified in Public Law 25-181 desire to

18 exchange their lots in Tract 3821, Merizo with lots in Tract 1113, Dededo,

19 the Department of Land Management and I Maga'lahen Guahan are

20 authorized to exchange their lots in Tract 3821, Municipality of Merizo

21 with lots within Tract 1113, Municipality of Dededo, owned by the

22 ovemment of Guam. The Department of Land Management shall

1 administer the exchange of lands within ninety (90) days upon enactment

2 of this Act. Notice of said exchange shall be report to the Speaker, IMina'

3 Trenta Na Liheslaturan Guahan and I Maga'lahen Guahan.


5 independent appraisal is waived since this is property being exchanged

6 from one (1) government subdivision to another.

7 Section 5. Notwithstanding any other provision of law, the

8 Department of Land Management and I Maga'lahen Guahan are authorized

9 to exchange Block No. 7, Lot No.1, Tract No. 3821, Pigua Subdivision,

1 o Municipality of Merizo, owned by Dolores T. Hernandez also known as

11 Dolores T. Hernandez Pangelinan, with a lot within Tract 1113, Block 13,

12 Lot 4, Municipality of Dededo, owned by the government of Guam.

13 Section 6. Notwistanding any other provision of law, the following

14 Block 10 Lot Number 7; Block 10 Lot Number 8; Block 10 Lot Number 9;

15 and Block 10 Lot Number 10, Tract 3821 contained in Public Law 25-181,

16 Section 3 shall be reserved for community use by the residents of Merizo.
