We hope that each and every one of you is doing well and taking steps to remain safe.

The COVID-19 pandemic has impacted our lives in ways that were unforeseen just a few months ago. However, along with the incon-veniences and special precautions that have become ordinary, we have also seen some unexpected benefits. Many families are spending more time together and bonding in new ways. It seems as if walkers, joggers, and cyclists are circling the Deer Creek “loop” at an all-time high. ful and attentive when out for a walk, jog, or ride.

This is also a good opportunity to embrace the importance of courtesy and caution as more of us are outside enjoying the great outdoors. If riding a bicycle and approaching pedestrians, please slow down to ensure safety. If approaching walkers from behind, please alert them to your presence rather than zooming by unannounced. These are words of advice to share with our younger riders too.

Another key project was the demolition of an eyesore house that although it was not on Deer Creek property, was nevertheless a nuisance to our community. We owe tremendous gratitude to Montgomery City Councilman Glenn Pruitt, whose guidance and support allowed this project to meet with success. The Board moved purposefully and methodically to ensure each step of the demolition was executed legally and properly. We thank our Marston neighbors for their patience.

The record cold temperatures of Mother’s Day weekend provided a refreshing extension of the spring… but the heat and humidity of the summer lie ahead. We are closely monitoring guidelines from Governor Kay Ivey and the City of Montgomery to determine what is permissible. We hope the pandemic has only a minimal impact on the swimming pool season. We are also optimistic that the exercise room and playground will be back to normal (if they have not already reopened while this newsletter is going to print).

Finally, a huge “thank you” goes out to the professionals who staff the Deer Creek office. Abby, Tammy, and Cierra maintained office hours throughout the pandemic to tend to Deer Creek affairs and resident concerns. Our thanks also go to everyone in the community for their patience and understanding during these unusual times. Annual Dues will be billed semi-annually for January – June 2020 and for July – December 2020.

January invoices will be mailed in early January and are delinquent if payment is not

Exterior paint. Paint is a quick and easy way to keep your property looking fresh, new and clean. It will also protect against corrosion, weathering and insects.

Landscaping. Landscaping is extremely important to our com-munity’s curb appeal. Please remove dead plants and branches. Keep shrubs properly pruned and flowers well-tended. Keep yards free of leaves and remove grass clippings.

Roofs. Please insure your roofs are properly maintained and cleaned.

Driveways and sidewalks. Please repair cracks, pitted or flak-ing surfaces and other concrete problems. Remove weeds from sidewalk joints and debris from driveways and sidewalks. Do not use driveways for storage or auto repairs.

AssociationArchitectural Review

Although the Association may seem like Big Brother when you want to build a storage building, patio cover, new roof, or put up a fence, the Deer Creek Architectural Review Committee (ARC) program is actually a benefit – not a burden. The ARC Guide-lines are based on maintaining harmony throughout the overall

community, providing consideration for neighbors, and promoting high-quality construction practices.

The ARC Guidelines exists to maintain, protect, and enhance the value of your property, and it strives for a balance between

individual rights and the good of the entire community.

While Association Members have the biggest stake in property values, others are also very interested in seeing this community well maintained and looking its best. Builders’ reputations and

lenders’ financial support are closely connected to the community. Also, public officials have an interest in maintaining and enhanc-

ing the community since tax revenues depend on property values.

The office staff gives all new Members (new homeowner and ten-ant) the information about the ARC Guidelines during registration. If you cannot locate your copy or would like another copy, please

contact the Information Center or go to the Deer Creek Home-owners Association website at www.deercreekhomeowners.net.

brings in material on a Double Axle Trailer, there will be a charge for disposal. In addition, there will be a disposal charge for any commercial

COMMUNITY CONCERNSThe Deer Creek Homeowners’ Association receives many calls and emails regarding pets. Below is a list of the most common

concerns. Dogs off Leash - The City of Montgomery requires all dogs to be leashed. Leashes must be used in the areas around the lakes, on

the roadways and walking trails and in any open spaces. There have been reports of loose dogs frightening children and scaring

and injuring the wildlife. Barking Dogs - Dogs that bark or howl constantly disrupt the quiet

and make it very unpleasant for neighbors. If you have a howling dog, please make an effort to keep it from disturbing neighbors.

Scoop the Poop - Please be courteous and take a pooper scoo-per and bag with you when you walk your pets. No one likes to

find a surprise left by a pet when they are walking on the grass or sidewalk. There are pet waste bags located throughout Deer Creek

for your convenience. Catting Around – Cats are not required to be leashed but are

trespassing when they enter another person’s property. Please be courteous to your neighbors and keep the cat at home.

In accordance with an agreement made between the City of Montgomery and the Montgomery Humane

Society, the Humane Society will now provide Animal Control and Humane Officer Division services to both the City and County as a whole. The schedule of op-

erations is as follows:

Hours of Operation: 7 days a week 24/7.

There is a live dispatcher from 8am to 6pm, excluding federal holidays, at the Montgomery Humane Society

& Shelter, 334-409-0622 Ext. 213.

From 6pm to 8am, there is an assigned ON CALL Hu-mane Officer every day of the week. You may contact them through MPD at 334-241-2651 for calls in the city limits and through MCSO at 334-832-4980 Ext. 1 for out

of city limit calls.

PEDESTRIAN SAFETYBeautiful scenery surrounds the 2-mile walking trail in Deer Creek and we know it is hard to resist taking ad-

vantage of this amenity. However, it’s very important to use caution when walking. Follow these tips to insure

you have a safe and fun walk!

1. Always walk on the sidewalk. If there is no sidewalk and you have to walk in the road, ALWAYS walk

facing traffic so that you can see any car that might become out of control.

2. Dress to be seen. Brightly colored clothing makes it easier for drivers to see you during the daytime. At

night, you should wear special reflective material on your clothing so that you are easily seen by traffic.

3. Tips for Crossing the Street

• Cross only at corners or marked crosswalks.• Stop at the curb or the edge of the road. Look thor-

oughly to the left and right for traffic before you step into the street.

• Remember when crossing – walk, don’t run!

Deer Creek Homeowners Association (HOA) Yard of the Month (YOTM) program begins May 2020 to highlight residents that have taken pride in the curb appeal of their property. First award for each POD will be the 3rd week of May. See criteria below.Judging criteria for YotM awards

Yard of the Month properties are judged solely on the exterior appearance of their property as viewed from the street. Yards will be judged on neatness, landscaping, and color. Overall appearance and factors include, but are not limited to:a. Tidiness and neatness of the front and side yardsb. Pruned and trimmed trees and shrubs edged and

defined lawns, borders and flower beds, and a visually appealing façade.

c. Lawn will have healthy grass with no bare spots or excessive weeds. Grass shall be mowed and edged, and grass around foundations and fences shall be trimmed.

d. Landscape and Flower Beds are weeded, mulched and edged. Trees and shrubs pruned. Efforts are made to improve upon builder landscaping, including the addition of color and through the use of flowers, trees, and shrubs.

e. Walkways and Driveways: Walkways and driveways shall be clean. Walkways, driveways and curbs shall be edged and free of debris and dirt. Use of accent and safety lighting for an improved evening appearance is permitted.

f. Aesthetics: The use of originality and creativity ( in accordance to the HOA Covenant) to create an inviting front entryway and a positive overall look to the landscaping and curb appeal with the use of color and textures, garden art, hanging

baskets and pots is encouraged.MISCELLANEOUS:

The yard selected from each pod will get a letter of recognition and a picture in the Deer Creek News-letter. At the end of the year, all yards from May to October will be reviewed and an overall winner will be selected and win a $100 gift card.

Fishing Season is here!Please observe the following rules when using the ponds:

• Fishing is for Deer Creek Homeowners’ Associa-tion members only. Members may have no more than 3 guests at any one time. Guests may fish only when accompanied by a mem-ber.

• Members may fish in lakes directly adjacent to their lot. Other members may fish in the Club-house Lake and the lake at Deer Creek Cross-ing on common area property only. Please remember, lake areas located adjacent to lots can only be fished by the owners of the adja-cent lots.

• Boating is NOT permitted in lakes.• The chemical balance, structure or drainage of

the lakes should NOT be tampered with.• Swimming in lakes is prohibited.• Ducks, swans, etc. may not be introduced into

the lakes without prior written consent of the General Manager.

Remember, the lakes are for Deer Creek Resi-dents only. Visitors are welcome, but only if accompanied by a resident while fishing. Please help by having your Deer Creek access keycard with you. Homeowners can also obtain a Deer Creek access keycard at the Information Center. Officers from the Alabama Wildlife Freshwater Fisheries periodically patrol Deer Creek lakes and residents may be asked to show proof of resi-dency. The State of Alabama does have 12” limit for bass and all members of the Association must abide by this limit. After fishing, please leave only your footprints behind and take any trash with you for proper disposal.

For the People, By the HomeownersCommunity associations like ours have a lot in common with municipal governments. As members of a governing body, our board

members meet regularly to discuss and vote on important community issues, like paying

the association’s bills, funding our reserves and contracting with vendors to keep our commu-nity amenities in good repair. The board makes

decisions about these and other important topics using a democratic process.

Also like a government, our association board has the legal authority to enforce rules and

regulations—somewhat like laws—and to col-lect assessments, like a government collects

taxes, to pay to maintain shared amenities like parking lots, general landscaping and street

lights, and to pay the association’s bills.

Our association also has the authority to take legal action, if necessary, if a homeowner

fails to meet his or her obligations that we all agreed to when we purchased in this commu-nity. These obligations include paying regular assessments on time, abiding by architectural or design policies, and observing community

rules.

POOL/SPLASH PARK RULES1. Access to the pool area is by use of a keycard.2. Swim at your own risk.3. Children ages 13 and up, who can swim the length of

the pool, may swim unaccompanied by an adult. These children may be asked by the lifeguard, at any time, to demonstrate the ability to swim the length of the pool. An adult 18 or older must accompany Members and guests of Members the age of 12 and under using the swimming pool. Children ages 8 -12 years old, who can swim the length of the pool, may swim unaccompanied as long as a parent or guardian is on the pool deck at all times. Children age 7 and under must be accompanied in the water by a parent or guardian at all times.

4. Users of the wading pool must be accompanied and supervised by an adult at all times.

5. The pool is open when lifeguards are on duty. Instructions given by lifeguards must be obeyed at all times. Members cannot be on the pool/splash park deck or inside the pool if a lifeguard is not on duty.

6. Diving is not allowed.7. Please shower before entering pool.8. Pool hours will be posted and/or are available at the

Information Center. Loitering at the pool for any reason other than sunbathing and swimming will not be permitted.

9. Profane language and shouting are prohibited. Public intoxication and/or disorderly conduct will not be tolerated. Running, shoving or rough play will not be allowed. No objects may be thrown in the pool or on the deck area.

10. Glass containers and bottles are not allowed in the pool area. Please help keep the pool deck clean and dispose of all trash.

11. Please use the bathhouse restrooms for changing. Proper swimwear, as determined by Management, must be worn to enter the pool. Unhemmed cut-offs are not allowed. Bathing suits are not allowed inside the Amenity Center.

12. Children’s disposable diapers are not allowed in the pool. Appropriate swimming diapers and plastic pants must be worn at all times.

13. Radios, televisions, etc. may be used as long as they do not cause a disturbance to others.

14. The only flotation devices allowed in the pool area are as follows: water wings, swim vests, noodles, small blow-up balls and baby swim rings. Floats and boogie boards are not allowed.

15. Emergency equipment is to be used by lifeguards only. Do not play on or around the lifeguard stand.

16. Return all pool furniture in a neat and orderly arrangement. Semi – permanent pool furniture (i.e. picnic tables) should not be moved.

17. If the pool/splash park deck or restrooms need attention, Members should notify the lifeguards.

18. Please be considerate of your neighbors.19. The bather load is 263 persons for the main pool and 57

persons for the wading pool.20. Adult Swim – this time is for adult swimming only (for ages

18 and up). Adult Swim will be called by lifeguards.21. Lifeguards are on duty for the protection of Members and

their guests. Do not distract them in any way unless there is an emergency. If a member or guest needs to talk with one of the lifeguards, that member or guest should wait until the lifeguard is no longer guarding and is on break.

22. There is a strict no smoking policy for the pool area. Other tobacco uses are also prohibited.

DO YOU WANT TO SPENDYOUR SUMMER AS A CRAWFISH?

Deer Creek residents can join the team by completing an application and paying a small fee to the YMCA. The Crawfish Team will accept swimmers throughout the summer. All levels / ages of swimmers can partici-pate. If you can swim one lap of the pool, you may become a member.

The Crawfish Swim Team is a good source of exercise and a great way to learn and master swimming tech-niques, but most of all - IT’S FUN!

23. Animals are not allowed on the pool deck unless use is for aid in disability.

24. Management reserves the right to adjust or add any rules as needed. Additional pool rules may be posted at the pool area or may be implemented without notice.

25. Management reserves the right to refuse anyone the use of the pool and its facilities.

26. Failure to adhere to these rules may cause the loss of pool privileges. The Pool guest policy may be revoked or changed at any time by Association Management.

POOL / SPLASH PARK WEATHER CLOSURES1. The pool/splash park may be closed at times due to

inclement weather.2. The pool/splash park must be cleared immediately at the

direction of the lifeguards at the first sound of thunder or sight of lightning. Members and their guests will be told to keep a safe distance from the pool and from all objects that would endanger them. Members, or their guests, are not permitted to go near water, take showers, sit on picnic tables or use the telephone (except in the case of an emergency) until conditions permit.

3. Closure will be until thunder has not been heard and/or lightning has not been seen for at least 30 minutes.

4. Any condition that causes the lifeguard’s vision of the bottom of the pool to be distorted is reason to close the pool. This includes raining (without lightning or thunder), increase in algae growth or chemical imbalance. Once the condition is cleared, re-entry will be allowed.

SPLASH PARK RULES1. Food or drinks are not allowed on the splash pad surface.2. Pool furniture should not be placed on the splash pad

surface.3. Members and/or guests should not climb on, or swing on,

splash park equipment.4. Toys and/or sports balls should not be used on the splash

pad surface. 5. Manual manipulation of drop buckets is prohibited.6. All pool rules apply to the splash park area.

POOL / SPLASH PARK GUEST RULES1. Each Family may have three (3) guests at any one time.

All guests must be accompanied by a Member. Members are responsible for the actions of their guests. Guests are defined as anyone other than a Member of the Deer Creek Homeowners’ Association, Inc. Guests must follow the pool rules. Violation of this rule can result in the loss of pool/splash park privileges.
