C. 20210Dear Mr. Robertson:Reference is made to your Memorandum #79, dated December 17, 1968,inviting comments from Federal agencies on a proposed Form for semi-annual enforcement labor standards report.It is noted that the instructions for completing the Form requestsinformation on non-construction contracts subject to the Contract WorkHours standards Act. This will be a new reporting requirement if theLabor Department determines a need for this information. WithinDepartment of Defense the contracting offices for non-construction andconstruction work are generally separate and appropriate new imple-menting instructions would have to be issued. It is assumed that theclass of non-construction contracts to be reported would be those contractssubject to the McNamara-O'Hara Service Contract Act which your agencynow investigates for compliance. Some contract information on MOSCAis already being obtained by your Bureau of Labor Standards as well asyour own office through the receipt of the Notice of Intention to Make aService Contract.DoD can arrange to furnish the proposed information with respect toconstruction contracts although we have no objection to the continuationof the report in the Form now provided your Department.
