    Findings of Fact:

    The site is located on the east side of Roswell Road (SR 9) and the south side of Hammond

    Drive. The property is zoned C-1 (Community Business District) conditional under Z58-0011and is currently developed with a shopping center. The subject property is located withinthe Main Street District of the Sandy Springs Overlay District.

    Enforcement:

    On November 30, 2009 the site received a notice of violation for no permit for the retainingwall or patio structure or entryway structure, outside storage of the storage shed as well. thefile is on my desk. The site is currently under a notice of violation notice.

    Abutting Property Land Uses/Zoning:

    Request:

    The applicant is seeking approval for an existing vestibule and a modular wall. Theapplicant has constructed a six (6) foot eight (8) inch wide by ten (10) feet high vestibule inthe front of the store. The vestibule has an aluminum frame with Concord Sunbrella fabricwith clear marine vinyl inserts. The applicant has also constructed a concrete modular wallin the rear of the building. The wall is five (5) feet tall and seven (7) foot long. The wallscreens the view of linen bins and free-standing CO2 tanks.

    The Board is asked to comment on the appropriateness of the building permit to the intentof the ordinance relative to appearance and function. If the proposed building permit seemsappropriate with some modification, the Board should make a recommendation on changesthat might bring the relief proposed into harmony with the intent of the ordinance and withthe surrounding development if deemed appropriate.

    Analysis

    The requested building permit review involves a number of Main Street District Overlayrequirements. Relative to the building, staff requests the Board address each item under thefollowing sections of the Zoning Ordinance:

    12B.8.E. Building Heights the plan meets this standard. 12B.8.F. Building design guidelines the plan meets this standard. 12B.8.G. Color the plan meets this standard. 12B.8.I. Building materials the plan meets this standard. 12B.8.J.Architectural features required the plan meets this standard.

    The Board should also review and comment on the following streetscape and sitedevelopment standards:
