PRINCIPAL FEATURE OF THE WORK
1. GENERAL:-
The work under tender pertains to Construction of Power Supply to 05 KW Commercial
Purpose Load at Satlama Market Yard under RMC, Bargarh.
2. ACCESS TO SITE: -
The worksite is located at Satlama MY.
3. MEDICAL AID: -
The nearest Hospital / Public health center are available at Satlama.

TERMS & CONDITIONS
ELIGIBILITY CRITERIA FOR QUALIFYING BID
1. (a) Cost of tender Paper + 5% VAT in shape of Bank Draft ion favour of the
Secretary R.M.C., Bargarh
b) 1% EMD in shape of Bank Draft in favour of the Secretary R.M.C., Bargarh
payable at any Nationalized Bank, Bargarh
c) Attested copy of Uptodate VAT – 612 Clearance Certificate.
d) Attested copy of PAN CARD.
e) Attested copy of Valid Electrical H.V. Registration License from E.L.B.O.,
Govt. of Odisha.
f) Attested copy of Similar nature of Works Experience Certificate &
completion certificate from appropriate authority.
2. EARNEST MONEY DEPOSIT AND INITIAL SECURITY DEPOSIT
The tenders whose tender is selected for acceptance shall within a period of seven
days upon written intimation being given to him of acceptance of his tender make an
initial security deposit of 1% (one percent) of the tendered amount so that the earnest
money and initial security deposit will be 2% of the tendered amount and sign the
agreement in the Office of the Secretary R.M.C., Bargarh failing which, the tender will
be rejected with forfeiture of E.M.D.
This security deposit, together with the earnest money and the amount withheld if
any shall be retained as security deposit for the due fulfillment of this contract. Failure to
enter into the required agreement and to make the security deposit, as above shall entail
forfeiture of the Earnest Money. No tender shall be finally accepted until the required
amount of security deposit (money) is deposited. The written agreement to be entered

into between the contractor and the Secretary R.M.C., Bargarh shall be the foundation of
the right of both the parties and the contract shall deem to be incomplete until the
agreement has first been signed by the contractor and then by the Secretary R.M.C.,
Bargarh.
3. The Bidder should have successfully completed any electrical substation including HT &
LT line work totaling of value not less than 50% of the value of work put to tender in a
single contract during any of the last three financial years in govt. / semi–govt. / other
organization. He is required to furnish necessary certificates in support of the aforesaid
work experience from the competent authority of concerned department / organization.
4. The bidder should have annual average financial turnover (Total of 3 years /3) not less
than 50% of the value of work put to tender in electrical substation including HT & LT
line work during last three financial years and the turn over need to be certified by a
registered Chartered Accountant alongwith audited balance sheet.
5. Tenderers have to furnish an affidavit in support of no rescission of any contract due to
abandonment / negligence of any work by the agency / firm in last 5 years.
6. Tenders have to furnish an affidavit stating that the information furnished are correct. In
case at any stage if any information are found wrong his tender will be liable for
rejection alongwith taking up of legal action against him as deemed proper.
7. Bids from joint ventures are not acceptable.
8. The envelope containing the bid document must be superscribed with “Construction of
POWER SUPPLY TO 05 KW COMMERCIAL PURPOSE LOAD AT SATLAMA
MARKET YARD UNDER RMC, BARGARH”
9. TIME OF COMPLETION:- The work is to be completed within 30 (Thirty) days
commencing from the date of issue of order to proceed with the work.

10. VALIDITY OF TENDER:- The Bid will be valid for a period of 90 (ninety) days from
the date of receipt of tender.
11. AWARD OF CONTRACT:- The bidder whose tender is selected for acceptance is to
sign the agreement in the P.W.D. form P-1 for fulfillment of the contract in the office of
the Secretary R.M.C., Bargarh. The Bidder is required to deposit 2% of the accepted
tender before entering into agreement as the Initial Security Deposit. The earnest money
deposited with the tender will form a part of the initial security deposit.
12. This security deposit will carry no interest. Failure to enter into the required agreement
and to pay the security deposit as above within the specified period shall entail forfeiture
of the earnest money. No tender shall be finally accepted until the required amount of
security money is deposited. The written agreement to be entered into between the
Contractor and the Secretary R.M.C., Bargarh shall be the foundation of the rights of
both the parties and the contract shall be deemed to be incomplete until the agreement has
first been signed by the Contractor and then by the Secretary R.M.C., Bargarh.
13. TAXES- Income tax, Sales tax and workers welfare cess will be deducted as per
prevailing Govt. orders from time to time.
(a) INCOME TAX- As per new section 104 in the Income Tax Act, 1961 introduced
by Finance Department Act, 1982 as communicated in Govt. of Orissa Finance
Department No.(M.E.-62-111-32) dtd. 19.01.1972) when individual contract
exceeds by Rs.50001 deduction as applicable % will be recovered and credit
thereof will be passed onto the Income Tax Authority by cheque under the head of
account “Taxes of Income”.
(b) VAT:- Deduction @5% from billed amount will be made from every bill of the
contractor towards ODISHA VAT.
(c) CESS:- Deduction @ 1% from billed amount will be made from every bill

14. INTEREST:- Under no circumstances interest is payable for dues of the Contractor if
any laying unpaid or payable for the work .
15. FAIR WAGE CLAUSE:- The Contractor should abode the fair wage clause introduced
by the Govt. and shall not pay less than the fair wages fixed by the Govt. to the labourer
engaged by him in the work.
16. The transformer should be tested by the Contractor at works by one officer of E& MR
Division / Store Division and one officer of BED Bargarh Division positively.
17. The Sub-station shall be installed at a suitable place outside the premises for easy
maintenance by WESCO as per approved drawing through authorized H.T. licensed
contractor, as per I.E. Rule & I.S.S.
18. The materials utilized in the lines & substation work should be of good quality and
specification of WESCO. The original cash memos in support of procurement of
materials are produced before the Supply Engineer of WESCO to ascertain the sources of
receipt of materials.
19. Any dispute arising out of any reason due to location of substation and construction of
11KV line and L.T. line shall be settled up / compromised at the cost of the party.
20. The substation will be energized only after getting clearance from the Electrical
Inspector, Govt. of Odisha. The inspection work will be arranged by the party at his cost.
21. The power supply shall be effected at 11 KV with suitable metering at LT individual with
R.F. metering provision.
22. L.T. bushings of the transformer shall be protected by provision of cable and termination
box having sealing arrangement, which shall be sealed by Supply Engineer of WESCO at
the time of energisation.

23. The substation shall be provided with 5 nos. earthing, spreading of sand & metal
boundary wall with fixing of M.S. grill etc. having locking arrangement within the
premises of party.
24. An enclosure with roof, door and locking arrangement has to be constructed by party near
the metering unit installed for protection of energy meter and TP box etc. from rain /
storm.
25. The guarding must be provided against the existing 33 KV line / 11 KV line / LT line/
telephone line / road if any keeping allowable clearance.
26. Anti climbing device is to be provided in the substation.
27. Circuit breaker of suitable rating to be installed at the transformer secondary (LT) side
and H.T. isolator alongwith required protective system at the H.T. side must be provided
as per I.E. rule 1956.
28. Any dispute / legal complicacy arising out of damage / accident owing to lines & sub-
station has to be settled up at the responsibility and cost of the party.
29. The selected contractor may take delivery of supply of materials according to his need for
the work issued by the Engineer-in-charge of the work. The contractor shall make all
arrangements for proper storage of materials. But no cost for raising shed for the storage
of materials and pay of watchmen etc. will be borne by the Secretary R.M.C., Bargarh.
These are all to be borne by the Contractor. The Secretary R.M.C., Bargarh is not
responsible for considering the theft of materials at site. It is contractor’s risk Under any
such plea if the contractor stops the work he shall have to pay the penalty as per the
clauses of the contract.
30. For the purpose of jurisdiction in the event of dispute if any contract should be deemed to
have entered into within the State of Odisha and it is agreed that, neither party to the

contract nor the agreement will be competent to bring a suit in regard to the matters
covered by this contract at any place outside the State of Odisha.
31. After the work is finished , all surplus materials and debris are to be removed by the
contractor and preliminary works such as vats, mixing platforms, etc. are to be
dismantled and all the materials are to be removed from the site. No extra payment will
be made to the contractor on this account. The rate quoted should be inclusive of all these
items. The ground up to 15 meter shall be cleared and rough dressed.
32. The contractor shall not interfere within the execution of water supply or electrical
fittings arrangements and any other works entrusted to any other agency by the Secretary
R.M.C., Bargarh at any time during the progress of work.
33. The Contractor will have to arrange for water supply for all works and made sanitary
arrangements at his own cost for his labour camps. The contractor has to arrange
adequate lighting arrangements for night works whenever necessary at his own cost.
34. The tenderer shall have to abide by the C.P.W. Safety Code introduced by the Govt. of
India Ministry of Works, Housing and Supply in their standing orders No.44250
dt.25.11.57.
35. The contractor will have to submit to the Secretary R.M.C., Bargarh monthly return of
Labour both skilled & un-skilled employed by him on the work.
36. No contractor will be permitted to furnish their tender in their own manuscript papers.
37. The earnest money deposited by the unsuccessful bidders will be refunded as per relevant
rules in force not earlier than the finalization of tender case.
38. Quality control tests are to be carried out as per standard norms by the contractor through
a Govt. Laboratory or any authorized Govt. Laboratory. No extra payment will be made

for these tests. The department may conduct separate tests as when felt necessary, the
cost of which will be borne by the Department.
39. The contractor has to arrange adequate lighting arrangement for night works wherever
necessary at his own cost.
40. The quantity / volume of item may alter during construction as per field condition.
41. Wherever there is ambiguity or missing data, the work shall be done as per the direction
of the Engineering-in-charge.
42. The interested bidders may visit the site and should be acquainted themselves with the
field activities to be experienced during construction.
43. The delay if any due to other departments such as digging on road etc. shall be the
responsibility of the successful bidder.
44. The bidder shall possess electrical license from ELBO, Odisha.
45. Guarantee:- The contractor shall furnish a guarantee to the effect that all items of the
work constructed and supplied and tested by him shall be free from any defect both in
terms of materials and workmanship for a period of not less than 12 months from the date
of the final completion of the work and commissioning. During this period, the contractor
shall replace the defective materials if any or rectify the defects if any at his own cost as
pointed out by the Engineer, OSAM Board / Engineer-in-charge / authorized
representative to the satisfaction of the latter.
46. Statutory clearance from electrical inspector shall be the responsibility of the successful
bidder.
47. The bidder should be responsible for inspection of lines & sub-station before charging.

48. The estimated rates given are approximate. It is the responsibility of the successful bidder
to obtain detailed estimate along with supervision charges to be given to the electrical
authorities.
49. After completion of work inspection certificate for electrical inspector should be obtained
by the successful bidder before charging.
50. No conditional tender will be accepted.
51. The item rates in the tender should be written both in words and figures and in case of
any discrepancy, the item rates written in words will prevail.
52. The work shall be executed by the bidder as per the guide line of Competent Electricity
Authority.
53. Tenderers are required to submit the following documents along with the Bid.
(1) List of major works executed in the prescribed proforma enclosed herewith
(2) List of T & P, Machineries & vehicles available with bidder.
